1 Minutes COUNCIL MEETING City Hall Bel Aire, Kansas April 5, :00 P.M. I. CALL TO ORDER - Mayor David Austin called the City of Bel Aire Council meeting to order, April 5, 2016 at 7:02 pm. II. ROLL CALL Council Members present Dr. Ramona Becker, Guy MacDonald, Betty Martine, Peggy O Donnell, and Diane Wynn. Also present City Attorney Alison McKenney-Brown, City Manager Ty Lasher, and City Clerk/Utility Clerk Jamie Hayes. III. IV. MOMENT OF SILENT PRAYER - A moment of silent prayer was led by Mayor David Austin PLEDGE OF ALLEGIANCE TO THE AMERICAN FLAG The Pledge of Allegiance to the American Flag was led by Mayor David Austin V. DETERMINE AGENDA ADDITIONS: Mayor Austin stated that the Community Development Committee is currently full and would therefore like to withdraw all pending nominations for that committee and remove Item D from the agenda. VI. CONSENT AGENDA A. Minutes of the March 15, 2016 City Council Meeting. MOTION: Mrs. O Donnell made a motion to approve the consent agenda as listed and authorize the Mayor to sign. Seconded by Ms. Wynn. Motion carried 5-0. VII. DISCUSSION AND APPROVAL OF APPROPRIATIONS ORDINANCE A. Appropriations Ordinance in the amount of $1,471, MOTION: Mrs. O Donnell made a motion to approve appropriations Ordinance Seconded by Mr. MacDonald. Motion carried

2 VIII. CITY REQUESTED APPEARANCES: None IX. PROCLAMATION Fair Housing Month April 2016 Child Abuse and Prevention Month April 2016 X. CITIZEN CONCERNS: Oral communication from the audience (Please move to the podium and state your name & address so that you can be clearly heard by the viewing public as well as the Governing Body. Comments are limited to three (3) minutes unless additional time is granted by the Mayor). XI. REPORTS: A. Mayor s Report Mayor Austin had no formal report. He was very pleased with the turn out for the Spring Festival and thanked all of the volunteers that helped out and made it possible. It was a great event. Mayor noted that the next big celebration as individuals will be July 4 th and hoped the wind will die down in time for that. Mayor Austin apologized he was unable to attend the tour of the CCUA facilities with Park City, he was glad that some of the members were able to do that. Mayor is excited for April and Opening Day of baseball and that his Phillies do well this year. B. Council Member Reports Dr. Becker enjoyed the long vacation we had this time due to how the calendar fell. Dr. Becker was at the Spring Festival as well and was very impressed with the amount of people who came out on that cold and windy day. She said it was a lot of fun and everyone seemed to enjoy themselves. Dr. Becker also appreciates the Bel Aire Breeze and the great write up they did on it. Dr. Becker attended the REAP Legislative luncheon on March 24 th, she said it was a real nice meeting with good discussion and good people in attendance. She also attended the CCUA plant tour with Ms. Wynn and Mrs. O Donnell on March 31 st. Mr. MacDonald had a couple of comments for the City to further investigate. Mr. MacDonald talked about the considerable amount of traffic on Rock Road and Woodlawn and the toll that those roads take due to the heavy traffic and the larger semi-trucks that drive on it. Mr. MacDonald talked about the fees that truckers pay to the Federal Government each year that help pay to maintain the roads as well as how the City of Wichita puts reinforced concrete in certain places such as bus stops to help alleviate certain damages caused by the heavier vehicles. Mr. MacDonald suggested that the City Engineer look into the possibility of rerouting heavier trucks around Bel Aire and not allow them to drive down Rock or Woodlawn and possibly divert those vehicles to Webb. Mr. MacDonald said it s a common thing for smaller towns to not allow larger trucks in their cities. Mr. MacDonald would like to know if this is a 2

3 possibility and what costs are involved with it. Next issue Mr. MacDonald had was involving FDI, Foreign Direct Investment, and was intrigued to find out that REAP, along with other organizations are involved in helping Wichita and the surrounding areas out in economic development. Mr. MacDonald stated that Wichita has applied for federal assistance and those in charge of the program have agreed to come to the Wichita area and talk to Wichita and surrounding areas to find out what would be most beneficial to improve economic development. Mr. MacDonald thinks this would be very worthwhile and would like to see us participate in it. Mrs. O Donnell thanked staff, especially Mr. Lasher for working up the agenda, Jamie for the certificates, and the Chief and Lt. Foxx and everyone else for their help with the Sunrise mock City Council meeting on March 30 th. Mrs. O Donnell said they had a wonderful mock council and keep saying how much they enjoyed it and that they are very privileged to be able to come and do that. Mrs. O Donnell had a wonderful time at the CCUA plan tour and had not been since 2007 so it was nice to see the different improvements. Mrs. O Donnell mentioned that they have been talking about doing a well tour at some point with Park City as well. Mrs. O Donnell thanked Mayor Austin for the Child Abuse Prevention Month proclamation, she is in her 4 th year of participating in the Big Brothers Big Sisters program. Lastly Mrs. O Donnell gave a shout out to the basketball players in the tournament and how it was one of the best tournaments in March Madness history and how neat it was to see former students playing, especially Buddy Hield who has put Bel Aire on the map again. Mrs. O Donnell will be at the workshop on the 12 th but will be unable to attend the meeting on the 19 th. Ms. Wynn attended the REAP Legislative meeting along with Dr. Becker. Ms. Wynn said there will be another REAP meeting tomorrow and the focus will be on the tax lid, she won t be able to attend the full meeting but will phone in and listen. Ms. Wynn said they will be contacting the legislators and bring up talking points and other items regarding the tax lid proposal. Ms. Wynn attended the Senior Center dinner last night where Chief Atteberry was the guest speaker. She said it was a very animated meeting about current staff and how he perceives community policing. She said it was a very fun and vocal meeting. Ms. Wynn announced that the speaker for the Chamber meeting tomorrow will be Carolyn McGinn. Ms. Martine wanted to comment on Mr. MacDonald s proposal of the trucks on Woodlawn and offered her yard to be used to conduct the surveys in. She said that all hours of the day and night she can hear the big trucks coming by her house. Ms. Martine said that 45 th and Woodlawn is getting worse. She would like to attend the CCUA well tour as long as there is notice well in advance of it instead of a day like this time. C. City Manager Report Mr. Lasher announced that Lindsie Nygaard is the Employee of the Quarter for the 1 st quarter of Lindsie started last year in the administrative office and an opening came up over in the court/police department and she moved over to it. Chief 3

4 Atteberry along with other staff have commented on the excellent job she is doing over there and the changes that she has made to help the department run more smoothly. The brush pile will be open this Saturday from 9:00am to 1:00pm and will be located on 53 rd street between Rock and Webb. Mr. Lasher noted that the Beautify Bel Aire contest is underway again. The monthly winner gets a $50.00 gift certificate and must submit before and after pictures of the improvements made to beautiful their home exterior. Mr. Lasher congratulated Michelle and Tristin for their work on the budget and receiving the Distinguished Budget award for the 3 rd year in a row. Mr. Lasher really appreciates their hard work on it. There were over 1,500 applicants, 16 were cities in Kansas and only 4 were cities of the 2 nd class. D. Committees/Boards/Commissions Reports XII. ORDINANCES, RESOLUTIONS AND FINAL ACTIONS: A. Consideration of a Sign Code Waiver for the Next Level Hoops building in the Sunflower Commerce Park. MOTION: Mr. MacDonald made a motion to approve the Sign Code Waiver for Next Level Hoops and authorize the City Manager to sign. Seconded by Ms. Martine. Motion carried 5-0. B. Consideration of confirming Mayor Austin s recommendation to reappoint Warris Jaffery to the Utility Advisory Committee. MOTION: Mrs. O Donnell made a motion to confirm the reappointment of Warris Jaffery to the Utility Advisory Committee. Seconded by Dr. Becker. Motion carried 5-0. C. Consideration of confirming Mayor Austin s recommendation to reappoint Ellie Skokan to the Utility Advisory Committee. MOTION: Dr. Becker made a motion to confirm the reappointment of Ellie Skokan to the Utility Advisory Committee. Seconded by Mr. MacDonald. Motion carried 5-0. D. Consideration of confirming Mayor Austin s recommendation of Jeanette Clement to the Community Development Committtee. Mayor Austin has removed Item D from the agenda. E. Consideration of approving the Final Plat for the Englert Addition to the City of Bel Aire. MOTION: Dr. Becker made a motion to approve the Final Plat for the Englert Addition to the City of Bel Aire and authorize the appropriate signatures. Seconded by Mrs. O Donnell. Motion carried

5 F. Consideration of approving the Development Agreement for the Englert Addition of Bel Aire. MOTION: Mr. MacDonald made a motion to approve the Development Agreement for the Englert Addition to Bel Aire and authorize the Mayor to sign. Seconded by Ms. Wynn. Motion carried 5-0. G. Consideration of AN ORDINANCE APPROVING A SPECIAL USE ON CERTAIN PROPERTY ZONED R-4 LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. MOTION: Dr. Becker made a motion to approve AN ORDINANCE APPROVING A SPECIAL USE ON CERTAIN PROPERTY ZONED R- 4 LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS authorize the Mayor to sign. Consideration of accepting the Water and Paving Petitions for Phase 4 of the Rock Spring Addition to the City of Bel Aire. MOTION: Ms. Martine made a motion to accept the Water and Paving Petitions for Rock Spring Phase 4. Seconded by Mrs. O Donnell. Motion carried 5-0. I. Consideration of accepting a Right of Way and Utility Easement from the Bel Aire Land Bank for property along 53 rd Street. MOTION: Ms. Wynn made a motion to accept the Right of Way and Utility Easement from the Bel Aire Land Bank for property along 53 rd Street. Seconded by Ms. Martine. Motion carried 5-0. XIII. DISCUSSION AND FUTURE ISSUES: Workshop April 12 at 6:30 pm. XIV. EXECUTIVE SESSION: MOTION: Mr. MacDonald made a motion to go into executive session for Attorney 5

6 Client for a period of 10 minutes and to invite in the City Manager and City Attorney. Seconded by Mrs. O Donnell. Motion carried 5-0. Executive Session began at 7:47 pm Executive Session ended at 8:01 pm and no binding action was taken. MOTION: Dr. Becker made a motion to go into executive session for 30 minutes. Mrs. O Donnell asked if we could adjust it to 15 minutes instead and come back out and request more if more time was needed. Seconded by Ms. Martine. Dr. Becker and Ms. Martine recalled their original motion. MOTION: Dr. Becker made a motion to go into executive session for 20 minutes for Non-elected Personnel and invite in the City Attorney. Seconded by Ms. Martine. Motion carried 5-0. Executive Session began at 8:02 pm Executive Session ended at 8:28 pm and no binding action was taken. XIV. ADJOURNMENT MOTION: Ms. Martine made a motion to adjourn. Seconded by Mr. MacDonald. Motion carried 5-0.
