ROLL CALL Council Members present Dr. Ramona Becker, Guy MacDonald, Betty Martine, and Peggy O Donnell. Also present City Attorney Alison McKenney-Brown, City Manager Ty Lasher, and City Clerk Jamie Hayes. III. IV. MOMENT OF SILENT PRAYER - A moment of silent prayer was led by Mayor David Austin PLEDGE OF ALLEGIANCE TO THE AMERICAN FLAG V. DETERMINE AGENDA ADDITIONS: VI. CONSENT AGENDA A. Minutes of the September 15, 2015 City Council Meeting. MOTION: Mrs. O Donnell made a motion to approve the consent agenda as listed and authorized the Mayor to sign. Dr. Becker commented that she wanted to table the minutes to have more time to go over them and write out what she believes she said during the meeting since it was not recorded. There was no second to Mrs. O Donnell s motion and she rescinded the motion. MOTION: Dr. Becker made a motion to table the minutes of the September 15, 2015 Council Meeting to allow more time for review. Seconded by Mr. MacDonald. Motion carried 4-0. VII. DISCUSSION AND APPROVAL OF APPROPRIATIONS ORDINANCE A. Appropriations Ordinance in the amount of $1,434, MOTION: Mr. MacDonald made a motion to approve appropriations Ordinance Seconded by Mrs. O Donnell. Motion carried

2 VIII. CITY REQUESTED APPEARANCES: Mayor Austin presented Mrs. O Donnell with the first Mayor s Community Cares Certificate of Thanks. Mayor hopes to recognize someone each month who go out of their way to help out our fellow citizens. Mayor Austin believes its very important to help out our neighbors in their time of need and hopefully encourages more to do so with this award. Mrs. O Donnell was awarded this month for her generous donation to the utility account discussed last month that fell on a hardship with the sewer bill after her mother passed away. IX. CITIZEN CONCERNS: Oral communication from the audience (Please move to the podium and state your name & address so that you can be clearly heard by the viewing public as well as the Governing Body. Comments are limited to three (3) minutes unless additional time is granted by the Mayor). X. REPORTS: A. Mayor s Report Mayor Austin let the citizens and Council know that the reason the flags are at halfstaff today is because of the mass shooting at the Community College in Oregon. Mayor Austin also explained some changes that are happening with the new laws that were passed in July in regards to the open City Council seat. According to the new law the governing body must appoint the vacant seat within 60 days or hold a special election for the seat. He has spoken to several people interested in the vacant seat and has received several letters of interest as well. Mayor Austin will present his suggested appointment to the Council at the workshop next week and appoint that person at the next City Council meeting. Mayor Austin was also very pleased to report that the City is able to make an additional principle payment on the land debt this year! The City will be sending an additional $825,000 with the regular November 1 st land debt payment. B. Council Member Reports Ms. Martine said that last Friday when she came up to City Hall she noticed the new signs in Central Park and is very pleased with them and the look wonderful. Ms. Martine did suggest maybe making the signs double sided so you can see it from both ways as well. She said they are very nice and let the people know where the areas are. Ms. Martine attended the ground breaking for Factory Direct Copper and Graite, LLC and SKEDD, she said they are very excited and ready to build. They got done with all of the ground breaking stuff as soon as it started to pour rain. On Saturday Ms. Martine attended the Goddard Fall Festival, it was all day long and was a wonderful day. She toured City Hall, the parade lasted an hour, she had breakfast and lunch with the Lions Club. They had arts and crafts and several kid type things. Ms. Martine said 2

3 she asked the City Administrator how they got a Walmart there and she said that they kept pushing and they are the smallest town in Kansas to have a Walmart Superstore. Mr. MacDonald noted that Goddard has a population of 4,962 people so its almost half of the size of Bel Aire. Mr. MacDonald asked who cleaned the monument at 45 th and Rock. There was a streak of rust down the middle and its now gone so whoever did it he wanted to thank. Mrs. O Donnell thanked the Mayor for the Certificate. She said she didn t do it to get recognized but is honored and thanks everyone for it. Mrs. O Donnell thinks it would be great if we could recognize someone every month for this award. Mrs. O Donnell is very pleased with how quickly the work on Edgemoor is going and it might be done before the 3 week projection. She also noted that the SCAC meeting is cancelled on Saturday due to the LKM Conference. Dr. Becker Bel Aire s official population as of July 2015 is 7,284 according to KS Dept of Revenue. This is wonderful news and shows the growth that Bel Aire has experienced in the past few years. I am looking forward to attending the Kansas League of Municipalities in Topeka Kansas City this weekend where we will increase our knowledge of current issues affecting all the cities of our state. Once again I d like to remind everyone about the Fall Festival coming up on the next weekend of October 17 from 10-2:00 at the Rec Center with a car show and numerous activities for the entire family we ll have a petting zoo, face painting, a boucehouse, a health screening by the Lyons Club, food, music and something for everyone! Be sure to put it on your calendar! I attended the Ground breaking on Sept 19 at Sunflower Commerce Park. Council President, Guy MacDonald did a great job of welcoming the new construction for buildings that will house two new enterprises in Bel Aire that are Factory Direct Copper & Granite LLC, and the South Central Kansas Economic Development District. On Saturday, I visited a couple of the 16 Bel Aire homes listed on the Parade of Homes this year. Bel Aire has by far the most homes on the Parade this year of any of the other cities surrounding Wichita. I also, attended the new Iron Gate neighborhood Grand opening on Saturday morning it was fantastic with the radio station there and the most beautiful donuts I have seen in ages! I encourage everyone to go to visit the models up there to see some of the most unique and gorgeous bathrooms, kitchens and basements ever! We have a wide variety of homes in Bel Aire in all different price ranges! And following all that I would like to reiterate and emphasize what I said from this bench (that unfortunately was lost forever due to a technical difficulty at our last Council meeting), I am absolutely sure that no one on this Council is against growth and planned development for the city of Bel Aire. That is strongly evident by our consistently progressive voting record on all types of issues. However, it must be pointed out that our city does have zoning regulations and this Council has a vital responsibility to PROTECT the exceptional quality of life for all our citizens here in this city. We must weigh the benefit of every project that comes before us on the merits for the applicant and the 3

4 profits of outside companies vs the harm that would be done to longtime Bel Aire neighborhoods and the homeowners and families in those neighborhoods. Bel Aire is a city that is not only progressive but a city that takes care of its citizens and will not sacrifice the sanctuary of peaceful, beautiful, safe, family-friendly neighborhoods for the arbitrary profits of an out-of-state company who wants to plow in here and to encroach on and profit at the expense of our longtime protected residential neighborhoods and the quality of life for our Bel Aire families. C. City Attorney Report City Attorney Alison McKenney-Brown had no formal report. D. City Manager Report Mr. Lasher reminded everyone that Saturday is the blood drive at City Hall from 8am to noon, please call the Red Cross to schedule. Also the brush site is open from 9am to 1pm this weekend. The City received a letter yesterday informing us that we have won an Excellence in Concrete Paving Award for the roller compacted concrete on 45 th street. Mr. Lasher received a letter the other day from the US Secretary of Transportation about our support for the TIGER grant and they plan to announce the winner this fall. Lastly he also received a letter from WAMPO about the Zoning Area of Influence, they have voted to keep the zoning area of influence to meet the growth boundaries of each city based on the 2035 growth map that they have established. E. Committees/Boards/Commissions Reports XI. ORDINANCES, RESOLUTIONS AND FINAL ACTIONS: A. Consideration of AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM "C-1" TO "R-5" ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. MOTION: Dr. Becker moved to approve AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM "C-1" TO "R-5" ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS Seconded by Mr. MacDonald. 5 MOTION: Dr. Becker made a motion to approve AN ORDINANCE VACATING 45' OF AN EXISTING UTILITY EASEMENT ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. Seconded by Ms. Martine. Motion carried 4-0. Roll Call: Dr. Ramona Becker: yes Betty Martine: yes Guy MacDonald: yes Peggy O'Donnell: yes XII. DISCUSSION AND FUTURE ISSUES: MOTION: Mr. MacDonald made a motion to have all Council sessions recorded by an audio recorder in addition to the video recordings. Seconded by Ms. Martine. Motion carried 4-0. Workshop October 14 th at 4:30pm XIII. EXECUTIVE SESSION: MOTION: Mr. MacDonald made a motion to go into executive session for attorney client for a period of 30 minutes and to invite in the City Manager, City Attorney, and Marlin Penner. Seconded by Mrs. O Donnell. Motion carried 4-0. Executive session began at 7:36pm Executive session ended at 8:07pm and no binding action was taken. MOTION: Dr. Becker made a motion to approve a contract between the City of Bel Aire and Holistic Psychiatric Services and authorize the City Manager to sign. Seconded by Ms. Martine. Motion carried 4-0. XIV. ADJOURNMENT MOTION: Ms. Martine made a motion to adjourn. Seconded by Mrs. O Donnell. Motion carried 4-0.
