ORIGINS The Australia Labor Party has its origis i: the aspiratios of the Australia people for a decet secure, digified ad costructive way of life; the recogitio by the trade uio movemet of the ecessity for a political voice to take forward the struggle of the workig class agaist the excesses, ijustices ad iequalities of capitalism; ad the commitmet by the Australia people to the creatio of a idepedet, free ad elighteed Australia. B. OBJECTIVES The Australia Labor Party is a democratic socialist party ad has the objective of the democratic socialisatio of idustry, productio, distributio ad exchage, to the extet ecessary to elimiate exploitatio ad other atisocial features i these fields. To achieve the political ad social values of equality, democracy, liberty ad social cooperatio iheret i this objective, the Australia Labor Party stads for: 1. The use of public power at all times with itegrity ad hoesty, ad always i the best iterests of the commuity. 2. Redistributio of political ad ecoomic power so that all members of society have the opportuity to participate i the shapig ad cotrol of the istitutios ad relatioship which determie their lives. 3. Establishmet ad developmet of public eterprises, based upo Federal, State ad other forms of social owership, i appropriate sectors of the ecoomy. 4. Democratic cotrol ad strategic social owership of Australia atural resources for the beefit of all Australias. 5. Maiteace of ad support for a competitive o-moopolistic private sector, icludig small busiess ad farmig, cotrolled ad owed by Australias, operatig withi clear social guidelies ad objectives. 6. The right to ow private property. 7. Recogitio ad ecouragemet of the right of labour to orgaise for the protectio ad advacemet of its iterests. 8. Commitmet to ad participatio i the iteratioal democratic socialist movemet as represeted by the Socialist Iteratioal. C. PRINCIPLES OF ACTION The Australia Labor Party believes that the task of buildig democratic socialism is a cooperative process which requires: 1. Party members, cadidates, elected represetatives ad party officials to act at all times with itegrity ad hoesty. 2. Costitutioal actio through the Australia ad State Parliamets, muicipal ad other statutory authorities; 3. Uio actio; ad 4. Ogoig actio by orgaised commuity groups. D. MEMBERSHIP AND ORGANISATION Membership of the Australia Labor Party is ope to all residets of Australia who are prepared to accept its objectives ad who have associatios with o other political party. Australia Labor Party policy is made by Natioal Cofereces comprisig the Natioal ad State parliametary leadership of the Party, together with elected delegates from all States, the Australia Capital Territory, the Norther Territory ad Australia Youg Labor. Party policy withi the States ad Territories is framed by cofereces of delegates elected by costituet braches ad affiliated uios. Policy withi the Australia Labor Party is ot made by directives from the leadership, but by resolutios, origiatig from braches, affiliated uios ad idividual Party members. 23. Recogitio of the right of citizes to work for progressive chages cosistet with the broad priciples of democratic socialism. 5

6 SECTION A Geeral A.1 The Australia Labor Party (NSW Brach), hereiafter termed The Party is a volutary ot-for-profit uicorporated associatio. A.2 The Party has the objective of: the democratic socialisatio of idustry, productio, distributio ad exchage, to the extet ecessary to elimiate exploitatio ad other ati-social features i these fields; ad (ii) the pursuit of social justice ad equality i all areas of huma edeavour. The Party seeks to achieve this objective through costitutioal actio through the Australia ad State Parliamets, Local Govermet ad other statutory authorities. A.3 The Party is made up of: A.4 affiliated trade uios; ad idividual members. The Party is a uicorporated etity. Ay trade uio watig to joi the Party should apply i writig to the Admiistrative Committee of the NSW Brach. The uio should iclude a copy of its costitutio, Rules ad a statemet of its fiacially paid-up membership. The Admiistrative Committee will cosider the applicatio ad may decide to make a report to the Party s Aual Coferece. With the authority of the Aual Coferece, the Admiistrative Committee may accept or reject the applicatio. Oce a uio has bee accepted it ca sed delegates to the Aual Coferece. The umber of delegates is give i Rule B.22. A.5 Ay perso 15 years ad over ca joi the Party. A.6 A perso who is a member of aother political party or oe of its affiliated orgaisatios caot joi the Party. Coutry Labor is ot icluded for the purposes of this Rule. A perso who was a member or a active supporter of aother political party or oe of its affiliated orgaisatios must provide details A.7 whe they apply for Party membership. A perso who has at ay time opposed a officially selected Party cadidate durig a electio must declare this fact. False statemets, or leavig out iformatio o the applicatio form, is grouds for the Admiistrative Committee to refuse, or withdraw, Party membership. A perso applyig for membership who has bee a member or a active supporter of aother political party or oe of its affiliated orgaisatios, or who has opposed a officially selected Party cadidate durig a electio, will have his/her applicatio cosidered by the Admiistrative Committee before a decisio will be made as to whether he/she ca joi the Party. It is a coditio of Party membership that a member must ot: Stad for public office, or omiate aother perso for public office, agaist a officially selected Party cadidate. (ii) Stad for public office, or omiate aother perso for public office, whe the Admiistrative Committee has decided that Party members should ot omiate. (iii) Actively oppose the Party or the Party s official cadidate durig a electio. (iv) Joi, or apply to joi, aother political party or oe of its affiliated orgaisatios. (v) Fail to omiate after beig selected as the Party s official cadidate i a electio. (vi) Resig from public office without obtaiig the permissio of the Admiistrative Committee. (vii) Egage i or have ever egaged i corrupt coduct. Note: Public Office meas ay public office for which a member may be officially selected or appoited to represet the Party. Ay member who fails to comply with the membership coditios set out i this Rule caot remai i the Party. He/she will be regarded as havig bee expelled from the Party. The expulsio from membership uder this Rule shall take effect at the time ad date 6

7 A.8 of ay breach of this Rule is subject first to otificatio to the Admiistrative Committee members by the Geeral Secretary. Ay member who has bee charged with: brigig the Party ito disrepute, disruptive tactics, disloyal or uworthy coduct, actio or coduct cotrary to the priciples ad solidarity of the Party; which causes immediate electoral damage to the Party may be suspeded by the Party Officers pedig charges beig referred to the Admiistrative Committee (Refer Rule A.33). A member s resigatio will ot be accepted if the Admiistrative Committee believes that it has bee put forward to avoid the cosequeces of the membership coditios beig broke as stated i Rule A.7. Such a perso will be regarded as a Party member util the time ad date whe the membership coditios were broke ad the Geeral Secretary otified the members of the Admiistrative Committee. A member expelled for breakig the membership Rules caot be readmitted to the Party uless allowed to do so by the Review Tribual. For more iformatio o the Review Tribual see Sectio J. Life Membership A.9 The Aual Coferece ca give Life Membership of the Australia Labor Party (NSW Brach). Someoe ca be omiated (put forward) for Life Membership if they have bee a active member of the Party for 40 years or loger ad have retired from public office. Oly the Admiistrative Committee, Electorate Coucils, Labor Actio Committees, braches ad affiliated uios ca omiate a perso for Life Membership. Nomiatios for Life Membership must be set to the Geeral Secretary before 15 Jue. They will the be cosidered at the followig Aual Coferece. Nomiatios should describe the backgroud ad history of service of the perso who has bee omiated. Party Officers will prepare a report for the Admiistrative Committee. This report will recommed which people are cosidered suitable for Life Membership. (f) (g) (h) The Admiistrative Committee ca recommed to the Aual Coferece those people it cosiders suitable for Life Membership, but three-quarters of the members of the Admiistrative Committee must agree o each recommedatio. The Aual Coferece ca oly make people Life Members if they have bee recommeded by the Admiistrative Committee. A Life Member will be preseted with a official badge ad certificate. Life Members may reew their Party membership free of charge. Their membership tickets will be edorsed Life Member. Joiig the Party APPLYING TO JOIN THE PARTY A.10 Except as provided i Rule A.23, a applicatio to joi the Party is oly valid if it is made i accordace with this Rule. A perso must persoally apply to joi the Party by: Completig a Membership Applicatio Form; (ii) Submittig the Membership Applicatio Form to the Party Office; ad (iii) Payig the correct Membership Fee. Uless they are applyig to joi the Party olie, a perso must sig their ow Membership Applicatio Form. A perso must submit their Membership Applicatio Form to the Party Office ad pay the correct Membership Fee by: Mailig the siged Membership Applicatio Form to the Party Office with the correct Membership Fee; or (ii) Persoally hadig i the siged Membership Applicatio Form at the Party Office with the correct Membership Fee; or (iii) Arragig for a perso to had i the siged Membership Applicatio Form at the Party Office with the correct Membership Fee; or (iv) Submittig the Membership Applicatio Form olie ad payig the correct Membership Fee by electroic fuds trasfer from their persoal accout, or with their persoal credit card; or 7

8 8 (f) (g) (h) (v) Persoally attedig a brach meetig, payig the correct Membership Fee to the Brach Secretary durig the meetig, havig the Membership Fee receipted, sigig the brach attedace book, ad arragig for the Brach Secretary to had i the siged Membership Applicatio Form at the Party Office with the correct Membership Fee. A perso who hads i a siged Membership Applicatio Form at the Party Office with the correct Membership Fee o behalf of aother perso uder subsectio (iii) must provide idetificatio. The Party Office must keep a record of the idetity of a perso who hads i a siged Membership Applicatio Form at the Party Office with the correct Membership Fee o behalf of aother perso uder subsectio (iii). A perso who hads i siged Membership Applicatio Forms o behalf of aother perso must fill i the declaratio form i Schedule B. The Party Office must keep a record of these forms. The Admiistrative Committee may establish procedures to esure that applicats are persoally applyig for their ow membership ad payig with their ow fuds. Each ew member of the Party shall be provided with a copy of the curret Rules. A member shall be provided a copy of the curret Rules o request. INSPECTION A.11 All Membership Applicatio Forms must be available for ispectio by a member of the Admiistrative Committee or the Iteral Appeals Tribual o request. All records associated with the paymet of Membership Fees must be available for ispectio by ay full-time Party Officer o request. JOIN DATE A.12 A Pedig Member is a perso: Who applies to joi the Party i accordace with Rule A.10; ad (ii) To whom Rule A.6 applies. A New Member is a perso who: Applies to joi the Party i accordace with Rule A.10; ad; (ii) Is ot a Pedig Member. A New Member s Party membership commeces o the day o which the Party Office receives their Membership Applicatio Form ad the correct Membership Fee. A Pedig Member s Party membership commeces o the day o which their applicatio is approved by the Admiistrative Committee. Withi thirty days of a perso s Party membership commecig, the Party Office must: Issue them a Party Membership Card; (ii) Iform them of their relevat brach ad other braches i the state electorate; ad; (iii) Notify the relevat Brach Secretary that the member has joied. ADMINISTRATIVE COMMITTEE TO BE PROVIDED INFORMATION A.13 At each Admiistrative Committee meetig, the Admiistrative Committee must be provided with: A list of all New Members who have joied the Party sice the last Admiistrative Committee meetig; ad (ii) A list of all Pedig Members who have applied to joi the Party sice the last Admiistrative Committee meetig. These lists must cotai the followig iformatio: Name; (ii) Address; (iii) Category of membership; (iv) Brach; (v) State/Federal Electorates; (vi) Occupatio; (vii) Uio membership; ad (viii) Details of ay membership of aother political party. Every third moth, the Admiistrative Committee must be provided with: Number of reewals (ii) Number of resigatios (iii) Number of deceased members (iv) Number of chages to residetial addresses

9 (v) Number of chages to postal addresses The iformatio shall be reported o the basis of State electorate. Every third moth, a list of residetial or postal addresses that have more tha 4 people usig that address must be provided to the Admiistrative Committee. These lists must be available for collectio by ay Admiistrative Committee Member at least oe hour prior to the commecemet of a Admiistrative Committee meetig. REFERRAL BY THE ADMINISTRATIVE COMMITTEE A.14 A Admiistrative Committee member may request that a New Member s applicatio to joi the Party be referred to the Membership Sub-Committee. A Admiistrative Committee member may request that a Pedig Member s applicatio to joi the Party be referred to the Membership Sub-Committee. MEMBERSHIP SUB-COMMITTEE A.15 The Membership Sub-Committee cosists of three Admiistrative Committee members selected by the Admiistrative Committee from time to time accordig to the priciples of proportioal represetatio. The Membership Sub-Committee cosiders applicatios to joi the Party referred to it by the Admiistrative Committee. The Membership Sub-Committee must be provided with: A copy of each Membership Applicatio Form; (ii) A breakdow of applicats by state ad federal electorate; ad (iii) If requested by the Sub-Committee, the paymet ad receipt details for idividual New Members, idividual Pedig Members, groups of New Members of groups of Pedig Members. The Membership Sub-Committee may decide that a New Member s applicatio to joi the Party be: Accepted effective from the day o which the Party Office received their Membership Applicatio Form ad the correct Membership Fee; or (ii) Deferred for further iformatio; or (f) (iii) Rescided. The Membership Sub-Committee may decide that a Pedig Member s applicatio to joi the Party be: Accepted effective from the day o which the Admiistrative Committee referred the applicatio to the Membership Sub- Committee; or (ii) Deferred for further iformatio; or (iii) Deferred; or (iv) Rejected. If a New Member s applicatio to joi the Party is referred to the Membership Sub-Committee, their Party membership remais valid ad effective uless ad util their applicatio to joi the Party is rescided by the Membership Sub-Committee. COUNTRY LABOR MEMBERSHIP A.16 A perso who is a Party member ad lives i the Desigated Coutry Area is also a member of Coutry Labor. Joiig your local brach APPLYING TO JOIN A BRANCH A.17 A Perso applies to joi a brach by: Attedig a ordiary brach meetig; (ii) Sigig the attedace book; ad (iii) If their Party Membership Card has bee issued, showig it to the Brach Secretary A perso s brach membership starts from the brach at which they: Apply to joi the brach i accordace with subsectio ; ad (ii) Are a Party member whe they atted the meetig or become a Party member withi 30 days of the meetig. All applicatios to joi a brach must be oted i the brach miutes. Note: Rule I.7 requires people applyig to joi a brach to live withi the state electorate ad be correctly erolled if they are a citize of votig age. Note: Rule I.9 provides that a differet process applies for a existig brach member who trasfers ito a ew brach. 9

10 SPECIAL RULE FOR MPS A.18 If a Member of Parliamet lives outside the electorate they represet, they may joi a brach i the electorate they represet i additio to a brach i the electorate i which they live. A Member of Parliamet who jois a brach uder this Rule does ot have votig rights i that brach. TRIPWIRE A. 19 (f) This Rule applies if: Five or more members apply to joi a brach at oe ordiary meetig; or (ii) More tha fifty members apply to joi a brach at oe formatio meetig; or (iii) Five or more members from oe SEC apply to joi the Cetral Policy Brach at oe ordiary meetig. A member applyig to trasfer from oe brach to aother is a member applyig to joi a brach for the purposes of subsectio. A Brach Secretary must sed the Geeral Secretary the followig iformatio about each of the applicats withi seve days of a brach meetig: Name; (ii) Address; (iii) Membership umber; (iv) Category of membership; ad (v) If the applicat is trasferrig from oe brach to aother, their former brach. If a member believes that the recruitmet of the applicats was ot boa fide, they may object to the Admiistrative Committee: Withi thirty days of the brach meetig; or (ii) If the Brach Secretary fails to comply with subsectio, withi seve days of the iformatio becomig available. If a member objects withi the time permitted uder subsectio, the Admiistrative Committee must determie whether the recruitmet of the applicats was boa fide. The member objectig must provide evidece that the recruitmet of the applicats was ot boa fide. (g) (h) (j) If the Admiistrative Committee fids that the recruitmet of the applicats was ot boa fide, the: If there were less tha twety applicats, their applicatios for Brach membership will be deferred for six moths from the date of the brach meetig; or (ii) If there were twety or more applicats, their applicatios for Brach membership will be deferred for twelve moths from the date of the brach meetig. A applicat is a member of a brach uless ad util it is foud that their recruitmet was ot boa fide. The Admiistrative Committee may refer a matter uder this Rule to the Iteral Appeals Tribual. If the Admiistrative Committee refers a matter uder this Rule to the Iteral Appeals Tribual, the Iteral Appeals Tribual must cosider the matter ad make a recommedatio to the Admiistrative Committee withi two moths of the matter beig referred. Joiig the Cetral Policy Brach A.20 A Party member jois the Cetral Policy Brach by attedig a meetig ad applyig for membership of the Brach. The applicat must sig the attedace book ad complete a applicatio to joi the Brach. (See Rule I.28) The applicatio will be passed to the Membership Sub-Committee of the Admiistrative Committee for cosideratio ad report to the ext meetig of the Admiistrative Committee for approval. The member will be admitted to the Cetral Policy Brach after beig approved by the Admiistrative Committee. A applicat must atted a meetig withi four caledar moths of applyig for membership of the Brach. If the applicat does ot atted a meetig withi this time, his/her applicatio will be regarded as havig lapsed. They the must make a fresh applicatio to joi the Brach. Party Membership Forms A.21 Subject to these Rules ad Aual Coferece, 10

11 the Admiistrative Committee may decide o the form of the followig documets: Membership Applicatio Form; (ii) Membership Reewal Form; (iii) Retired; or (iv) A pesioer. Cocessioal Members pay a reduced Membership Fee. (iii) Party Membership Card; (iv) Trasfer Clearace; (v) Brach Charter Applicatio; ad (vi) LAC Applicatio. The Membership Applicatio Form ad Membership Reewal Form must: Require the applicat or reewig member to sig the form; ad (ii) Cotai a declaratio by ay applicat or reewig member payig a cocessioal Membership Fee that they are etitled to that reduced rate, ad idicatig the basis o which the etitlemet is claimed. The Admiistrative Committee may: Establish levels of documetatio required to support a claim of etitlemet to a cocessioal Membership Fee; ad (ii) Implemet procedures to esure compliace with subsectio (ii). The Party Membership Card must show: Member ame; (ii) Member address; (iii) Member sigature; (iv) Membership umber; (v) Reewal date; ad (vi) Expiry date. The Party Membership Card must cotai a declaratio that the Party member supports the Party s Rules ad Platform. Party Membership Fee ADMINISTRATIVE COMMITTEE SETS MEMBERSHIP FEES A.22 Subject to these Rules ad Aual Coferece, the Admiistrative Committee sets the Membership Fee. A Cocessioal Member is a perso who is: Uder 18 years of age; or (ii) Uemployed; or (f) Life Members eed ot pay a Membership Fee. A perso who submits a Membership Applicatio Form o or after 1 July eed oly pay half of the relevat Membership Fee. Membership Fees are ot refudable. REQUIREMENTS IN RELATION TO MEMBERSHIP FEES A.23 (f) (g) A perso must pay their ow Membership Fee. The Admiistrative Committee may establish procedures to esure that applicats are payig their ow Membership Fee. A perso must pay the Membership Fee that applies to them as determied by the Admiistrative Committee. If it is foud after a applicat s Party membership has commeced that they paid a icorrect Membership Fee, they may remedy the defect by payig the outstadig amout withi thirty days. Membership Reewal MEMBERSHIP YEAR A.24 The Membership Year rus from 1 December each year to the followig 30 November. A aual membership expires o 30 November each year. A three year membership expires o the third 30 November occurrig after the Party Membership Card was issued, uless the Party Membership Card was issued i November, where the membership expires o the fourth 30 November occurrig o or after the Party 11

MEMBERSHIP RENEWAL FORM A.25 The Geeral Secretary is resposible for sedig a Membership Reewal Form to all Party members who are required to reew i a give Membership Year. Uless they are reewig their Party membership olie, a perso must sig their ow Membership Reewal Form. A perso must submit their Membership Reewal Form to the Party Office ad pay the correct Membership Fee by: Ay of the meas i Rule A.10; or (ii) Phoe, usig their persoal credit card; or (iii) Sigig a stadig authority for the reewal of their Party membership ad paymet of their Membership Fee by electroic fuds trasfer from their persoal accout, or with their persoal credit card. Despite subsectio, a Party member may reew the Party membership of a depedet family member residet i the same household. A Life Member eed ot complete a Membership Reewal Form. RENEWAL DATE A.27 A Party member is take to have reewed their membership o the day o which the Party Office receives their Membership Reewal Form. I the case of a Life Member or a Party member reewig uder Rule A.26(iii), the member is take to have reewed their membership o 1 November. Withi thirty days of receivig a perso s Membership Reewal Form, the Party Office must issue the member a Party Membership Card for the ew Membership Year. If a perso is a Life Member or a Party member reewig uder Rule A.26(iii), they must be automatically set their ew Party Membership Card by 1 November each year for the followig Membership Year. CONTINUITY A.28 A Party member oly retais cotiuity of membership if they reew their Party membership o or before 31 March i the Membership Year for which ew Party Membership Cards are beig issued. If a Party member fails to reew their Party membership i accordace with subsectio, they may reew their Party membership without havig to reapply to joi the Party if they pay two years worth of the correct Membership Fee o or before 31 March of the followig year. If a Party member fails to reew their membership i accordace with subsectio or, they must reapply to joi the Party. Cetral Roll A.29 The Geeral Secretary is resposible for compilig ad keepig a Cetral Roll of the Party membership. The Cetral Roll cotais the details supplied by members i their membership applicatios or reewals. The Cetral Roll ca be examied by ay member of the Admiistrative Committee. The Cetral Roll must be available as either a visual display or a pritout. Membership Disputes A.30 Ay member whose ame does ot appear o the Cetral Roll ca appeal to the Admiistrative Committee. The Admiistrative Committee, by uaimous decisio, ca put 12

13 the member s ame back o the Cetral Roll without further equiry if it is satisfied that the ame was left out by mistake or it ca refer such appeals to the NSW Iteral Appeals Tribual. The NSW Iteral Appeals Tribual will report back to the Admiistrative Committee withi two moths with a decisio. A.31 Ay member whose local brach membership is refused, ad ay member who cosiders that a applicatio for local brach membership should have bee refused, ca appeal to the Admiistrative Committee. Whe the Admiistrative Committee has cosidered the appeal it ca direct the brach to allow the member to joi, or rescid the acceptace of the applicatio. A.32 A.33 Ay member of the Party ca appeal to the Admiistrative Committee agaist the admissio of a ew member. The appeal must state the reasos why the idividual is ot eligible to joi the Party. The Admiistrative Committee will refer ay appeals agaist a idividual membership applicatio to the NSW Iteral Appeals Tribual for cosideratio ad determiatio. The NSW Iteral Appeals Tribual will report its decisios back to the Admiistrative Committee withi two moths. Ay member ca charge aother member with: brigig the Party ito disrepute; actio or coduct cotrary to the priciples ad solidarity of the Party; disloyal or uworthy coduct; disruptive-tactics; makig public statemets about iteral Party matters which may harm the best iterests of the Party; ot supportig the Platform (policies) ad Rules of the Party to the best of the member s ability; or failig to vote ad work for officially selected Party cadidates. The charge whe lodged must be accompaied by a deposit of $50 plus $10 per member charged as a guaratee of good faith - the deposit will be retured if there are reasoable grouds for the charge beig made. (f) (g) (h) The Admiistrative Committee will refer ay charge agaist a idividual member to the NSW Iteral Appeals Tribual for cosideratio ad determiatio. The Admiistrative Committee may, prior to referrig a charge to the Iteral Appeals Tribual, decide that the member who is the subject of the charge be suspeded. (ii) A member affected by this type of decisio ca appeal the decisio to the Iteral Appeals Tribual. The member who has bee charged will be give fourtee days otice of the specific ature of the charge before the matter is referred to the NSW Iteral Appeals Tribual for cosideratio ad determiatio. The Iteral Appeals Tribual ca decide that the member charged be reprimaded, or suspeded, or suspeded with loss of cotiuity of membership, or expelled, or aother appropriate decisio, or the charge may be dismissed. I accordace with Rule A.7 the Admiistrative Committee may susped or expel a Party member. Where a charge has bee upheld agaist a member, that member ca appeal to the Review Tribual withi fourtee days of the decisio of the Iteral Appeals Tribual. Without limitig the geerality of above uworthy coduct icludes the followig coduct: fudig Party memberships for other idividuals or groups of idividuals who would otherwise be uwillig to pay their ow subscriptios; (ii) ecouragig perso(s) to take out reduced- rate Party membership kowig that those perso(s) may ot be eligible for that category of membership; (iii) kowigly recruitig member(s) who do ot live at their claimed addresses i a attempt to gai advatage at local Party meetigs or the outcome of Party ballots. 14 A.34 Ay perso expelled uder Rule A.33 (above) caot be admitted to the Party agai without the authority of the Review Tribual. Uless it is decided otherwise, members who are suspeded will ot lose cotiuity of membership. However, members who are suspeded betwee 1 Jauary ad 31 March must, to keep their cotiuity of membership, apply to the Admiistrative Committee for a membership ticket. If the Admiistrative Committee agrees to issue a membership ticket uder this Rule this will ot reduce or ed the period of suspesio. Suspeded members cotiue to be subject to the Rules ad Priciples of the Party. Credetial ad Ballot Protests A.35 A protest ca be made after a list of voters has bee prepared for a brach or Electorate Coucil ballot. A brach member ca oly protest about the list of voters for his/her brach. A Electorate Coucil delegate ca oly protest about the list of voters for his/her Electorate Coucil. From 1 July 2010 the uio affiliatio fee shall be idexed aually by icreases i the aual March quarter Sydey Cosumer Price Idex. Uios shall be otified by 1 May i each year of the proposed chage i the affiliatio fee. A form o which to make this retur is available from the NSW Party Office. For the purposes of calculatig uio delegatio sizes ad affiliatio fees, the umber of members of each affiliated uio must be determied each year by a idepedet audit by a registered auditor of: The umber of members eligible to vote i a ballot for a office i that uio at 31 December as coducted by the Australia Electoral Commissio or NSW Electoral Commissio; ad (ii) The umber of members idetified i subsectio for whom the uio received a amout of dues i relatio to the period betwee 1 October ad 31 December iclusive for that year. Each affiliated uio must by 4pm o the last Friday i February each year provide to the Geeral Secretary i a sealed evelope: the idepedet audit report for the previous year; ad (ii) advice o the umber of members that uio will affiliate o for the curret year (which must be equal to or less tha the (f) umber of members determied by the idepedet audit for the previous year); (iii) ad all such sealed evelopes must be opeed at the same time i the presece of scrutieers appoited by affiliated uios. Uio delegatio sizes must be based o the three year rollig average of that uio s affiliatio for the curret ad two precedig years. Affiliatio fees will be payable o a fiacial year basis. I the evet of a affiliated uio beig six moths i arrears i its affiliatio fees to the Party, the Admiistrative Committee may decide that such affiliated uio shall ot be etitled to be represeted at ay Aual Coferece or Special Meetig of Aual Coferece, util such arrears are paid. NSW Youg Labor A.41 NSW Youg Labor will operate i accordace with Schedule J. Ivolvig Uio Activists A.42 A member of the Party who is curretly workig for remueratio (icludig casual workers) ad who is eligible for membership of a registered trade uio is ecouraged to be a fiacial member of the relevat uio which covers the major ad substatial part of ay work performed. A employer who jois the Party must ecourage his or her employees to become ad remai members of the relevat trade uio coverig their work ad observe the applicable idustrial laws, awards ad agreemets. All Labor lower house MPs should establish dialogue with local activists from affiliated uios i their electorates, icludig frequet meetigs with those uio activists who work i their area. All Labor Seators ad MLCs should meet with local activists from affiliated uios i their duty electorates ad may also be ivited to meetigs i the electorate i which they are residet. All Local Govermet Labor Coucillors should meet with local activists from affiliated uios i their Local Govermet Areas (LGA). 15

17 SECTION B ANNUAL CONFERENCE Meetigs B.1 The Party will hold its Coferece aually ad the date will be decided by the Admiistrative Committee. Powers B.2 The Aual Coferece is the supreme policy makig ad goverig body of the Party i New South Wales. The Aual Coferece has the power: To alter or chage the Rules ad Platform (policies) of the Party; (ii) To elect the Party Officers, Orgaisers, Trustees ad Natioal Coferece Delegates, members of the Review Tribual, Coferece Policy ad Ageda Committee, Admiistrative Committee, Wome s Forum, Geeral Returig Officer ad eight Assistat Geeral Returig Officers ad to choose the various Officials ad Committees eeded to coduct Aual Coferece ad to receive ad cosider reports from those Committees. (iii) To pre-select cadidates for the NSW Legislative Coucil ad Australia Seate. (iv) Aual Coferece appoits a Auditor each year who must be a qualified practisig accoutat. Each year the Auditor presets a Report o the Statemets of Accout ad Balace Sheet of the Party for the previous fiacial year. The Geeral Secretary provides the Auditor with all books of accout, bak statemets, used cheques, duplicate receipts ad ay other documets or vouchers the Geeral Secretary may be asked to produce for such a audit. It is a coditio of the Auditor s appoitmet that the Auditor agrees to atted Coferece ad aswer ay questios from members about the accouts ad statemets that are preseted. (v) Aual Coferece ca decide that certai issues, which have moral ad social cosequeces, will be decided with a free vote rather tha beig subject to Caucus disciplie. Electios B.3 The Admiistrative Committee must call for omiatios for the positios to be elected at a Aual Coferece o less tha eight weeks before the opeig day of that Aual Coferece. B.4 To be eligible to omiate for a positio elected by Aual Coferece, a perso must have oe year of cotiuous fiacial Party membership immediately prior to the date of callig for omiatios. B.5 Cadidates stadig for electio by Aual Coferece must be omiated i writig by at least five members, each of whom must have bee a member of the Party for at least twelve moths. I determiig whether a term specified i these Rules is due to expire at the forthcomig Aual Coferece, the Aual Coferece at which the positio was last elected is ot couted. For example, a term of four aual cofereces meas a ew electio is required at the fourth Aual Coferece held after the last electio. (ii) Notwithstadig other provisios of these Rules a perso elected to a positio by the Aual Coferece holds office util the declaratio of electio of his/her successor, uless the positio falls vacat because the office-holder: dies; resigs the office by istrumet i writig addressed to the Geeral Secretary; becomes a metally icapacitated perso; or ceases to be a member of the Party, such a vacacy is called as casual vacacy i these Rules. A perso elected to a positio by Aual Coferece ceases to hold that positio if these Rules do ot require the cotiued existece of the positio ceases to exist. Notice (iii) Whe a casual vacacy occurs for ay reaso i ay of the positios ordiarily elected by Aual Coferece, the perso appoited or elected serves oly for the remaiig time of his/her predecessor s term. A exceptio is specified i D.9. The Aual Coferece also elects Orgaisers as they are eeded. The Orgaisers terms are four Aual Cofereces. Not less tha four weeks before the Coferece, the Admiistrative Committee seds out the Coferece Policy ad to all Party Uits represeted at Aual Coferece, so that the uits ca cosider these chages. Not less tha seve days before the Aual Coferece ay Party Uit or affiliated uio watig chages to the Coferece Policy ad Ageda Committee s report must sed them to the NSW Brach Office. Where practicable, those chages ad decisios will be prited ad set to Coferece delegates. Credetials (at Aual Coferece) B.11 All uits represeted at Coferece must sed the Geeral Secretary the ames ad addresses of their delegates. These ames ad addresses ca be ispected at the NSW Party Office by ay official coferece delegate durig office hours. This ca be doe for seve days before Aual Coferece. Ay Party member ca challege the credetials (the right to be at Coferece) of a delegate omiated by his/her Party Uit. This ca be doe by sedig the reaso for the objectio to the Geeral Secretary. The reasos for the objectio will be passed by the Geeral Secretary to the delegate who has bee challeged, ad also to the Party Uit which has omiated him/her. This will be doe as quickly as possible. The Review Tribual will hear the challege, ad also liste to the views of the delegate who has bee challeged, ad to ay other cocered Party member. The Review Tribual will decide who should be the delegate for that particular uit. The decisio of the Review Tribual will be reported to Coferece. If practicable, the meetig of the Review Tribual should take place prior to Coferece. If the credetials of a delegate from a trade uio is challeged o the grouds that the delegate is a ot a member of the trade uio he/she is to represet, a writte statemet from the Secretary of the affiliated trade uio is take to be fial ad coclusive evidece o the subject. Coferece Ageda Committee B.12 Aual Coferece will elect a Ageda Committee. The Ageda Committee will be made up of the Party Officers (that is, the Geeral Secretary, two Assistat Geeral Secretaries, the Presidet ad three Vice Presidets) ad five other Party members. It will hold office for two aual cofereces. A meetig of the Ageda Committee ca oly take place whe a quorum of at least six members of the Committee are preset. To be o the Ageda Committee a member must have bee a paid-up Party member for at least 12 moths before the closig date for omiatios. The powers ad duties of the Ageda Committee are: To decide o the Ageda ad the order of busiess at Aual Coferece. (ii) To recommed to Aual Coferece ay suspesio of Stadig Orders or urgecy motios. Ageda Committee Proxy Pael B.13 Iability to atted If a Coferece Ageda Committee member is uable to atted all or part of a meetig, they may appoit a perso from the Ageda Committee Proxy Pael to replace them. Ay proxy appoited uder subsectio B.13 has the full rights of the member whom they are replacig. The Ageda Committee Proxy Pael will be appoited by the Admiistrative Committee. 19

The Aual Coferece will elect: A Chair of the Wome s Forum; (ii) A Deputy Chair of the Wome s Forum; (iii) A Secretary of the Wome s Forum; ad (iv) Fiftee members of the Wome s Forum. The Chair ad Deputy Chair must be elected i a sigle ballot. The first elected is the Chair ad the secod elected is the Deputy Chair. (f) (g) to time, delegate resposibility for matters relatig to orgaisig, recruitmet ad traiig to the Orgaisig, Recruitmet ad Traiig Committee. The Committee s objectives are (but ot limited) to: Propose strategies to icrease membership of the Labor Party; (ii) Icrease participatio of party members i Campaigs; ad (iii) Advise o effective orgaisig, recruitmet ad traiig methods to the Party Officers. The Aual Coferece will elect: A Chair of the Orgaisig, Recruitmet ad Traiig Committee; (ii) A Deputy Chair of the Orgaisig, Recruitmet ad Traiig Committee; (iii) A Secretary of the Orgaisig, Recruitmet ad Traiig Committee; ad (iv) Nie members of the Orgaisig, Recruitmet ad Traiig Committee. The Chair ad Deputy Chair must be elected i a sigle ballot. The first elected is the Chair ad the secod elected is the Deputy Chair. People elected to the Orgaisig, Recruitmet ad Traiig Committee hold office for two cofereces. Members of the Orgaisig, Recruitmet ad Traiig Committee may appoit ay other fiacial Party member as their proxy for ay meetig or series of meetigs. Orgaisig, Recruitmet ad Traiig Committee B.15 The Orgaisig, Recruitmet ad Traiig Committee will report regularly to the Admiistrative Committee ad to each Aual Coferece o matters relatig to orgaisig, recruitmet ad traiig. The Admiistrative Committee may from time Fiace ad Compliace Committee B.16 The Fiace ad Compliace Committee is made up of: The Geeral Secretary ad the two Assistat Geeral Secretaries (ii) The three Trustees (iii) Three members elected by a three quarters majority vote of the Admiistrative Committee. To be eligible to stad as a cadidate for the Fiace ad Compliace Committee, a omiee must have professioally recogised fiacial, accoutig, legal, regulatory or compliace qualificatios as prescribed by the Admiistrative Committee, the 20

Members o the Rules Committee hold office for two Aual Cofereces. The Rules Committee is resposible for cosiderig proposals to chages i the Rules of the Party. The Geeral Secretary, or someoe represetig the Geeral Secretary, ca atted Rules Committee meetigs with the same rights as a Committee member, but he/she caot vote. Rules Committee B.18 The Rules Committee is elected by Aual Coferece. NSW Policy Forum B.19 The NSW Policy Forum has the followig objectives: Facilitate policy debate ad developmet amogst the State Parliametary Labor Party, Party Uits ad Affiliates, icludig makig recommedatios to the Federal Parliametary Labor Party; (ii) Provide a framework for the partership betwee the State Parliametary Labor Party ad the wider labour movemet; (iii) Provide guidace o the causes ad aspiratios of the moder Labor movemet; (iv) Iclude Party Uits, Party members ad Affiliates i the debate o the directio of the Party; (v) Maitai the relevace of the Labor Platform by coductig reviews; (vi) Udertake log-term plaig for the implemetatio of Labor policy; ad (vii) Provide leadership o matters of public cocer ad iterest. The NSW Policy Forum is resposible for: Keepig our Platform relevat by coductig Platform Reviews ; ad (ii) Leadig Party debates by formig Policy Commissios. Durig each State Parliametary term, the NSW Policy Forum shall udertake a complete review of the Party Platform, ad recommed Platform amedmets to the Coferece. 21

22 (f) (g) (h) (j) (k) The NSW Policy Forum shall ivolve the Coferece Policy ad Ageda Committee i ay review of the Platform. I particular, members of the Coferece Policy ad Ageda Committee shall be ivolved i draftig Platform amedmets to be recommeded to the NSW Aual Coferece. The NSW Policy Forum may at ay time form a Policy Commissio to cosider matters referred to it by the: Leader of the State Parliametary Labor Party; or (ii) Admiistrative Committee. Policy Commissios formed uder subsectio must cosist of ie members, with three represetatives each from the groups i subsectios (m) (v), (vi) ad (vii). Oe represetative each from the groups i subsectios (m) (v) ad (vii) shall act as cochairs of a Policy Commissio. The membership of a Policy Commissio must be determied by a ballot of the whole NSW Policy Forum. A Policy Commissio s membership must satisfy affirmative actio requiremets uder these Rules. Ay report or recommedatio of a Policy Commissio must be cosidered ad decided upo by the NSW Policy Forum as a whole before beig trasmitted to the State Parliametary Labor Party ad/or the NSW Aual Coferece for approval. The NSW Policy Forum will issue a majority ad miority report from a Platform Review or a Policy Commissio to the NSW Aual Coferece where there is a sigificat differece of opiio. The NSW Policy Forum may co-opt ay perso as a ex-officio o-votig member of the Forum as a whole or a Policy Commissio. The NSW Policy Forum shall: (ii) Be subject to the ordiary Rules of debate i Schedule I; (iii) Require a quorum of a majority of members i order to meet; (iv) Meet at least three times per year; ad (v) Decide which of its meetigs, or parts of meetigs, are ope to the wider Party, geeral public ad media. (m) The NSW Policy Forum cosists of the followig votig members: () (o) (p) (q) The NSW Labor Presidet ad Leader of the NSW Labor Parliametary Party, who shall act as Co-Chairs; (ii) Two Deputy Chairs, elected by NSW Aual Coferece; (iii) The NSW Labor Geeral Secretary; (iv) The two NSW Labor Assistat Geeral Secretaries; (v) The NSW Labor Cabiet or Shadow Cabiet; (vi) A umber of trade uioists who are also fiacial Party members, appoited by the Admiistrative Committee; ad (vii) A umber of fiacial Party members, to be selected accordig to the priciples of proportioal represetatio every four years by a ballot of all Party members with oe year of cotiuous fiacial membership prior to the date of callig for omiatios. (viii) Two members of the Federal Parliametary Labor Party (FPLP), appoited by the Admiistrative Committee o the priciples of proportioal represetatio, from amog the FPLP members represetig NSW; ad (ix) The Platform Committee. The umber of fiacial Party members selected uder subsectio (m)(vii), the umber of Trade Uioists selected uder subsectio (m)(vi) ad the umber of members of the Shadow Cabiet or Cabiet uder subsectio (m) (v) must be equal i umbers ad must be determied by the NSW Labor Admiistrative Committee. The Admiistrative Committee will determie the rules for selectig fiacial Party members uder subsectio (m) (vii) to esure represetatives from outside of Sydey, icludig Coutry Desigated Areas, are elected to the forum. This may iclude regioal based votig models. Members of Parliamet are ot eligible to be appoited or selected uder subsectios (m), (vi) or (vii). The total votig membership of the Forum must satisfy affirmative actio requiremets uder these Rules. Where these requiremets are ot met, the Returig Officer must adjust 22

23 (r) the selectio result uder subsectio (m) (vii) i accordace with Rule 11 i sectio 5 of Schedule G of these Rules. The NSW Policy Forum may adopt procedures to assist i fulfillig its objectives ad resposibilities, so log as they are ot icosistet with ay express provisios of the Rules. Platform Committee B.20 The Platform Committee cosists of a: Chair; (ii) Deputy Chair; ad (iii) Secretary. The Aual Coferece will elect the Platform Committee at the first Aual Coferece after each NSW Geeral Electio. The Chair ad Deputy Chair must be elected i a sigle ballot. The first elected is the Chair ad the secod elected is the Deputy Chair. The Platform Committee is resposible for assistig with draftig the NSW Labor Platform. Policy Committees B.21 The Admiistrative Committee will establish Policy Committees from time to time. The Admiistrative Committee decides o the areas of policy resposibility of each Committee. These policy areas ca be chaged by the Admiistrative Committee. The Admiistrative Committee will create a maximum of 8 Policy Committees. Each Policy Committee will cosist of sevetee members icludig: A Chair; (ii) A Deputy Chair; (iii) A Secretary; (iv) Oe SPLP represetative; (v) Oe FPLP represetative; (vi) Two subject matter experts ad; (vii) Te ordiary members. The Policy Committee shall be elected at every secod Aual Coferece, with the exceptio of: the Parliametary represetative, (f) (g) (h) (j) who shall be appoited by the respective Federal ad State Parliametary Caucuses; ad the subject matter experts who shall be elected by the Admiistrative Committee at meetig withi three moths of the coclusio of the Aual Coferece that has elected the ordiary committee members. For the purposes of this rule subject matter expert shall mea a party member, who is perso employed by a uiversity, thik tak or research orgaisatio ad/or is a perso who has recogised expertise i a subject area relevat to the policy focus of the committee. The subject matter experts must be omiated by members of the relevat policy committee. The Aual Coferece will elect: A Chair of the Policy Committee; (ii) A Deputy Chair of the Policy Committee; (iii) A Secretary of the Policy Committee; ad (iv) Te ordiary members of the Policy Committee. The Chair ad Deputy Chair must be elected i a sigle ballot. The first elected is the Chair ad the secod elected is the Deputy Chair. Members of the Party who have bee members for twelve moths ca become members of Policy Committees. No member ca serve o more tha oe Policy Committee at the same time. The Party s Affirmative Actio Rules will apply to each Policy Committee membership ad at least oe member of each Policy Committee must be of Youg Labor age. If a Policy Committee member misses three meetigs i a row, their membership automatically lapses. If a Policy Committee fails to meet, it must explai to the Admiistrative Committee the reasos for ot meetig. Policy Committees will meet at least four times aually. Oe evet must be held outside of Sydey. Evets may be ope to the public ad iterested stakeholders. The aim of the Committees is to promote policy discussio ad debate withi the Party through forums, olie discussios, research papers, Brach discussios ad to provide recommedatios to the Aual Coferece o Policy motios from Party Uits. Committees ca cosider correspodece, call 23

24 (k) (l) for ad hear evidece ad co-opt ay Party member whose expert experiece may seem valuable. They do this by takig a majority decisio at the meetig. A meetig of ay Policy Committee ca oly take place whe at least 8 members of that Committee are preset. Reports of Policy Committees are to be preseted to the Aual Coferece by the Chair of each Committee. (m) Each Policy Committee will provide three Delegates to Aual Coferece, the Chair, Deputy Chair ad Secretary of each Committee. If ay Delegate caot atted, they may appoit a geeral member of the committee i their place. () (o) (p) (q) (r) At least two members of each Policy Committee must live i the Desigated Coutry Area. The Executive of the Policy Committee ca grat approval for a member of the Committee to take part i a meetig by telephoe coferece. The Policy Committee meetigs will be advertised i the Political Briefig. Policy Committees will be ope to all Party members to participate i the developmet of NSW Labor s Policy. If a Policy Committee Member is uable to atted all or part of a meetig, they may appoit aother party member as their proxy to replace them. Represetatio (at Aual Coferece) B.22 Aual Coferece cosists of the followig votig delegates: (f) (g) Affiliated uio delegates determied i accordace with Rules B.22 ad B.23; Two delegates from each State Electorate Coucil; Three delegates from each Federal Electorate Coucil; Sixtee delegates from NSW Youg Labor. Sixtee delegates from the Federal Parliametary Labor Party (FPLP) elected by members of the FPLP represetig NSW; Sixtee delegates from the State Parliametary Labor Party (SPLP); The Party Officers; (h) (j) (k) B.23 Chair, Deputy Chair ad Secretary of each Policy Committee; The Platform Committee; The Chair, Deputy Chair ad Secretary of the Wome s Forum; ad The Chair, Deputy Chair ad Secretary of the Coutry Labor Committee. At least 50 per cet of the delegates to the Coferece must be uio delegates. All other delegates are approximately 50 per cet of the total. This is the procedure for decidig trade uio represetatio at the Coferece: The total umber of uio members affiliated by trade uios to the Party, calculated by referece to the rollig average of each uio affiliatio (as per Sectio A), is divided by the total umber of aticipated trade uio delegates. (ii) The figure, resultig from the above calculatio, will be rouded off to the earest umber, ad (iii) That figure will be divided ito the umber of members affiliated by each trade uio which has 1000 or more members who are affiliated, ad (iv) That figure will be rouded off to the earest umber ad will be the umber of delegates from each trade uio cocered who ca atted Aual Coferece as represetatives of their uio. Each uio with at least 1000 members, but with fewer members tha the figure arrived at i the calculatio i (ii) above, will be etitled to oe delegate. Those trade uios which have fewer tha 1000 members affiliated joi together to elect a umber of delegates to the Coferece. They do this by dividig the quota i (ii) above, rouded off to the earest whole umber, ito the total affiliated membership from uios which have fewer tha 1000 members. If the umber of members of these uios are less tha half of a quota, they are ot etitled to represetatio at Coferece. The total umber of aticipated trade uio delegates referred to i above, represets 50 per cet of the total umber of Coferece delegates. Other delegates (except Party Officers) represet 50 per cet 24

25 B.24 B.25 (f) of the total umber of delegates. The total umber of aticipated trade uio delegates must be adjusted to maitai this 50/50 divisio. Each year, the Geeral Secretary decides the umber of delegates to represet each uio. Uio delegates are appoited by affiliated trade uios. The trade uios follow their ow procedures except that: All uio delegates must be fiacial members of the Labor Party; All uio delegates must be fiacial members of the Uio which they are represetig; A uio ca choose to have each positio o the delegatio filled by oe perso or it ca appoit oe delegate to represet two positios. All delegates to Coferece elected by State Electorate Coucils ad Federal Electorate Coucils, ad all delegates to Coferece appoited by trade uios, must have bee fully paid-up members of the Party for the twelve moths immediately prior to the first day of Aual Coferece. Delegates represetig NSW Youg Labor are elected at the NSW Youg Labor Aual Coferece. Delegates represetig the State or Federal Parliametary Parties must be members of the Caucus cocered. Each Caucus ca decide how it wats to elect its delegates. A delegate ca represet oly oe orgaisatio at Aual Coferece. A delegate from oe Party Uit or affiliated uio caot at the same time be a alterate delegate from ay other Party Uit or affiliated uio. Not less tha the miimum percetage of a uio s delegatio to Aual Coferece must be wome. Provided that if the level of male or female membership of a uio is less tha the miimum percetage, the miimum represetatio must be set at that level. (h) B.26 If a perso holds office as a delegate to Aual Coferece because he/she is a member of the Admiistrative Committee, or is a Chair, Deputy Chair or Secretary of a Committee ad that perso ceases to hold that office durig the course of a give Aual Coferece that perso, oetheless, cotiues to hold office as delegate util the coclusio of the give Aual Coferece. (ii) Similarly, aperso who has ot previously bee a member of the Admiistrative Committee, a Chair, a Deputy Chair or a Secretary of a Committee who assumes such a office durig the course of a give Aual Coferece, does ot take office as a delegate to Aual Coferece by virtue of that ew positio util the coclusio of the give Aual Coferece. NSW Aual Coferece delegates represetig State Electorate Coucils ad Federal Electorate Coucils are elected for oe year at a time. NSW Aual Coferece delegates represetig State Electorate Coucils ad Federal Electorate Coucils must: Live i the electorate they represet; (ii) Not be a Member of Parliamet; (iii) Be a fiacial Party member; ad (iv) Be a member of a Brach affiliated to the Electorate Coucil cocered. Uless it decided otherwise uder subsectio, a Electorate Coucil elects its delegates ad alterate delegates to NSW Aual Coferece at its Aual Geeral Meetig i the same way as it elects Electorate Coucil positios. A Electorate Coucil may decide to elect its NSW Aual Coferece delegates ad alterate delegates pursuat to the provisios of Rule M.9. (g) It is the right of each uio to determie the criteria ad procedures for selectio of its delegates i accordace with these Rules, subject to those delegates beig members of that uio ad fiacial members of the Party. 25

26 SECTION C Resposibilities C.1 These Rules are bidig o all Party members. SECTION D Admiistrative Committee D.1 C.2 Rights Every Party member has the right to: Equality before the Rules; (ii) Be heard; (iii) Iformatio regardig Party matters that directly affect them; (iv) Receive a prompt respose to their correspodece; (v) Stad for public office, subject to these Rules; (vi) Seek redress of grievaces before the Iteral Appeals Tribual, Review Tribual ad Ombudsma; (vii) Appeal to the justice system whe their rights have bee ifriged; ad (viii) Be treated with digity ad respect by other Party members. C.3 Resposibilities Every Party member has a resposibility to: Uphold the Party s values ad priciples; (ii) Comply with these Rules; (iii) Allow others to be heard; ad (iv) Treat other Party members with digity ad respect. The Admiistrative Committee is resposible for the maagemet ad admiistratio of the Party betwee Aual Cofereces. The Admiistrative Committee decides all matters which affect the welfare of the Labor movemet, except that it: Caot make ay Rule ieffective; (ii) Caot overtur ay decisio of the Aual Coferece; ad (iii) Caot create ew policy. The Admiistrative Committee ca call a special meetig of Coferece. The powers of the Admiistrative Committee are also held by Aual Coferece. The Party Officers (who are the Presidet, Seior Vice-Presidet, Juior Vice-Presidets, Geeral Secretary ad Assistat Geeral Secretaries) are resposible for: the maagemet ad admiistratio of the Party betwee meetigs of the Admiistrative Committee; ad (ii) for matters delegated to them by the Admiistrative Committee. (iii) Ay decisio of the Party Officers uder this Rule must be reported to the Admiistrative Committee at its ext meetig. (iv) A official meetig of the Party Officers ca oly take place whe a quorum of either: at least four are preset, icludig the Geeral Secretary or the first elected Assistat Geeral Secretary; or at least two are preset, icludig the Geeral Secretary (or the first elected Assistat Geeral Secretary) ad the secod elected Assistat Geeral Secretary. (v) The Party Officers shall be automatically elected as delegates to the Natioal Coferece. (vi) The miutes of Party Officers meetigs must be reported to the Admiistrative Committee. 26

The first elected Assistat Geeral Secretary is the oe who holds the positio first elected i a ballot coducted uder the method of proportioal represetatio. The o-votig members of the Admiistrative Committee may atted meetigs of the Party Officers i a o-votig capacity to advise o issues of goverace. The Admiistrative Committee cosists of: The Party Officers; (ii) 18 members elected by affiliated uio delegates at Aual Coferece; (iii) 18 members elected by all delegates who are ot affiliated uio delegates at Aual Coferece; (iv) The State Parliametary Leader ad Federal Parliametary Leader, or someoe amed to represet them, who must live i NSW ad be a member of the Leader s Parliametary Party; ad (v) Three o-votig members elected by a three-quarters majority vote of the Admiistrative Committee. The Party s website shall iclude a list of Admiistrative Committee members, icludig their date of their first electio. The Admiistrative Committee, uder the priciples of proportioal represetatio, will appoit ie Proxy Members of the Admiistrative Committee. These Proxy Members shall have the full rights of the member of the Admiistrative Committee whom they are replacig ad votig rights as detailed i Rule D.12. Followig the electio of members of the Admiistrative Committee ad appoitmet of the Admiistrative Committee Proxy Pael, ay ew members shall receive a formal iductio ad exteral traiig program outliig their roles ad resposibilities as members of the Admiistrative Committee. A official meetig of the Admiistrative Committee ca oly take place whe a quorum of at least sevetee members is preset. If sevetee members are ot preset after thirty miutes the meetig will ot take place. At least three of the members elected uder (g) (h) (j) subsectio (iii) must live i the Desigated Coutry Area at the time of their electio. Despite ay other provisio of these Rules, the results of the separate ballots to elect Admiistrative Committee members uder subsectios (ii) ad (iii) are to be couted together for the purposes of Rule M.7. Members of the Admiistrative Committee ad Fiace ad Compliace Committee shall complete a material persoal iterest declaratio as prescribed by the Admiistrative Committee to be held by the Presidet. To be eligible for electio as a o-votig member uder subsectio (v), a perso must have served o a Board of Directors for o less tha two years at the time of their electio. The o-votig members elected uder subsectio (v) must: Focus exclusively o goverace matters; (ii) Advise the Admiistrative Committee o goverace best practices; ad (iii) Esure adherece to the highest goverace stadards. D.3 The State Parliametary Leader ad the Federal Parliametary Labor Leader have a automatic right to address the Admiistrative Committee meetig. D.4 D.5 The Admiistrative Committee is i charge of electio campaigs for public office except whe this power has bee haded o to a Electorate Coucil or aother Party Uit. Subject to other provisios of these Rules, the Admiistrative Committee will ot iterfere with the way ay Electorate Coucil selects cadidates for local govermet, State or Federal electios as log as they keep to the Platform, Rules ad Costitutio of the Party. I its report to Aual Coferece the Admiistrative Committee icludes a record of how may meetigs each member atteded. This report will at least iclude the umber of meetigs held durig the period covered by the report, the attedace of each member, ad ay leave or apologies grated. The Admiistrative Committee calls ad closes omiatios for Party selectio for public 27

28 (f) office, icludig for Coutry Labor, i the way decided i the Rules. The Admiistrative Committee decides o edorsemet for Party selectio for public office. It ca decide to edorse or ot to edorse the Party s officially selected cadidate or cadidates for public office i the way stated i the Rules. I electorates where the local brach or Coucil has ot take the ecessary steps as laid dow by the Rules to select a cadidate, i accordace with a resolutio of the Admiistrative Committee, the Admiistrative Committee will select a cadidate. Where o Electorate Coucil exists, the Admiistrative Committee is i charge of all matters relatig to the selectio of parliametary ad local govermet cadidates. Whe the Admiistrative Committee has called for omiatios for Party selectio for public office ad o omiatios have bee received by the time omiatios close, the the Admiistrative Committee will, after discussios with the Electorate Coucil cocered, fid ad choose a suitable cadidate or cadidates to represet the Party. The Admiistrative Committee sets omiatio fees for selectios for public office. D.6 The Admiistrative Committee ca authorise the Presidet ad Geeral Secretary to issue a charter to create a ew brach. The Admiistrative Committee ca also authorise the Geeral Secretary to withdraw the charter of ay brach if it is i the best iterests of the Party. The Admiistrative Committee will refer ay cocers regardig braches to the Iteral Appeals Tribual which will cosider the matter ad report back to the Admiistrative Committee. D.7 Ay Party Officer or member of the Admiistrative Committee may place a item o the meetig ageda. If a member wishes to do so, they must give at least seve days otice to the Geeral Secretary. D.8 The Admiistrative Committee will, i the maagemet of the fiaces of the Party betwee Aual Cofereces, be assisted by the Fiace ad Compliace Committee. The Fiace ad Compliace Committee shall: Assist the Admiistrative Committee i the preparatio of budgets ad cosideratio of ay proposals affectig the fiace of the Party; (ii) Assist the Admiistrative Committee to esure that the Party s maagemet accouts ad the accouts preseted at the Aual Coferece give a true ad fair view of the Party s fiaces; (iii) Assist the Admiistrative Committee to esure the Party s statutory accouts are completed i accordace with the Party s legal obligatios; ad (iv) Assist the Admiistrative Committee to maitai appropriate cotrols over the fiaces of the Party. (v) Assist the Admiistrative Committee to implemet ad maitai purchase orders to cotrol expediture with appropriate limits set for the Geeral Secretary ad Assistat Geeral Secretaries ad ay other relevat employee of the NSW Labor Office. For this purpose, the Fiace ad Compliace Committee shall: Assist the Party Officers to develop aual budgets for the Party ad make recommedatios to the Admiistrative Committee about the adoptio of those budgets; (ii) Approve budgets ad expediture of amouts of $100,000 or more. (iii) Advise the Admiistrative Committee i accordace with terms of referece give by it i relatio to ay proposals affectig the fiace of the Party; (iv) Assist the Party Officers to develop the accouts for the Party to be preseted at each Aual Coferece ad make recommedatios to the Admiistrative Committee about the adoptio of those accouts; (v) Assist the Party Officers to develop the statutory accouts for the Party i accordace with the Party s legal obligatios ad make recommedatios to the Admiistrative Committee about the adoptio of those accouts; (vi) Report to each meetig of the Admiistrative Committee o the Party s 28

(xi) Report to the Admiistrative Committee i relatio to the appropriate cotrols over the fiaces of the Party. I its report to Aual Coferece, the Admiistrative Committee will from time to time preset a statemet of moey received ad paymets made which has bee certified by the Auditor. The Admiistrative Committee will also preset Aual Coferece with a balace sheet which has bee audited ad also a statemet of the geeral fiacial positio of the NSW Brach. Copies of the reports described i ad above will be give to Coferece delegates. The fiacial year will ed o 30 Jue. Ay fiacial Party member may petitio the Admiistrative Committee as log as fifty fiacial Party members have siged the petitio. The Geeral Secretary must advise the ext meetig of the Admiistrative Committee that the petitio has bee received ad it will be dealt with at the followig meetig. The members who siged the petitio must be told of the result. Either 50 members or 25% of the members i a federal electorate (whichever is the lesser) may petitio the Admiistrative Committee to ivestigate ay allegatio of breaches of these Rules relatig to membership recruitmet i that electorate. D.10 Members of the Admiistrative Committee have the right to be preset at all cofereces ad meetigs of braches, Electorate Coucils, Policy ad Machiery Committees ad Regioal Assemblies. They ca take part i those cofereces ad meetigs but caot vote, or move or secod ay motio i ay Party Uit uless they are a member of that uit. D.11 D.12 Wheever a casual vacacy occurs for a positio ordiarily elected by the Aual Coferece by use of proportioal represetatio, it must be filled by the Admiistrative Committee, o these coditios: The vacacy caot be filled at the meetig of the Admiistrative Committee whe the vacacy is first reported. Whe there is isufficiet time, the Party Officers ca expedite the process. (ii) The vacacy is filled i a way which follows the practices of proportioal represetatio. Wherever a casual vacacy occurs for ay other positio ordiarily elected by the Aual Coferece, it must be filled by a perso selected by the Admiistrative Committee. A electio for the positio must the be coducted at the ext Aual Coferece, except i the case of the Secretary of a Committee. A perso appoited as Secretary of a Committee serves the remaider of his/ her predecessor s term. Where a member of the Admiistrative Committee is etitled to vote i a ballot by reaso of beig a member of the Admiistrative Committee (other tha a ballot coducted at Aual Coferece) the member of the Admiistrative Committee, if they will be located outside the Sydey metropolita area o the ballot day, may (o the member s request) be set the ballot paper facsimile or ad may retur it i the same way. Such a ballot paper is ot a secret ballot ad must, whe retured by the voter by facsimile or , clearly bear the ame ad sigature of the perso who cast it. For this purpose, the Returig Officer may iclude provisio for a ame ad sigature o ballot paper set by facsimile or uder this Rule (but oly o such ballot papers). 29

30 D.13 A ballot paper must actually be received by the Returig Officer prior to the close of votig for the ballot. Where it is ot practicable for a member of the Admiistrative Committee to vote i a ballot i which they are etitled to vote by reaso of beig a member of the Admiistrative Committee (other tha a ballot coducted at Aual Coferece) the member may appoit, i writig, a Admiistrative Committee Proxy to vote o the member s behalf. The Proxy whe seekig to exercise the right to vote must preset the writte letter of appoitmet to the Returig Officer. A Proxy may oly vote oce i a ballot uder this provisio. Seators ad Members of the Legislative Coucil are required to provide Reports to the July ad December meetigs of the Admiistrative Committee. These Reports shall iclude iformatio o: D.15 The Admiistrative Committee is resposible for approvig membership of the Cetral Policy Brach. D.16 The Admiistrative Committee will appoit the Proxy Delegates to the Natioal Coferece, accordig to the priciples of proportioal represetatio ad affirmative actio. D.17 The Admiistrative Committee, uder the priciples of proportioal represetatio will appoit 12 Proxy Members to the Ageda Committee Proxy Pael. These Proxy Members shall have the full rights of the members of the Ageda Committee. D.18 The Admiistrative Committee may require Members of Parliamet to make cotributios to or raise moey for the Party. ay visits to Duty Seats for aoucemets, meetig or forums; Correspodece or ewsletter/leaflets set to members i Duty Seats; ad Issues about which represetatios have bee made. D.14 The Admiistrative Committee may refer ay orgaisig, recruitmet or traiig matter to the Orgaisig, Recruitmet ad Traiig Committee. If the Fiace ad Compliace Committee approves a budget for local orgaisig ad recruitmet grats, the Admiistrative Committee may delegate to the Orgaisig, Recruitmet ad Traiig Committee the power to approve paymets for these purposes withi the budget approved by the Fiace ad Compliace Committee. The Orgaisig, Recruitmet ad Traiig Committee will report aually to the Admiistrative Committee o the umber of people who received traiig, ad the type of traiig they received. The Admiistrative Committee will preset these reports to the Aual Coferece. 30

31 SECTION E Ombudsma E.1 PURPOSE The positio of Ombudsma is established uder these Rules to: E.2 Provide a iformal way for Party members to have grievaces heard; ad (ii) Mediate disputes betwee Party members. A Party member may complai to the Ombudsma about decisios made by Party Uits or the coduct of Party members. APPOINTMENT The admiistrative Committee must appoit a Ombudsma ad Deputy Ombudsma i accordace with this Rule. The Ombudsma ad Deputy Ombudsma must be elected by a three-quarter majority vote of the Admiistrative Committee. To be eligible for electio ad to remai i office as Ombudsma or Deputy Ombudsma, a perso must: Be a fiacial Party member; (ii) Not hold a positio o the Iteral Appeals Tribual, Review Tribual, Admiistrative Committee, Fiace ad Compliace Committee, Rules Committee, Platform Committee or Coferece Policy ad Ageda Committee; (iii) Not hold public office; (iv) Not be actively seekig electio or appoitmet to public office; ad (v) Be of good fame ad character. The Ombudsma ad Deputy Ombudsma hold office for two years. The Ombudsma may delegate ay of their powers to the Deputy Ombudsma o whatever terms they cosider appropriate. E.3 Decisio to ivestigate or refer The Ombudsma may ivestigate a complait made uder Rule E.1. The Ombudsma may discotiue a ivestigatio commeced uder subsectio. (f) (g) E.4 The Ombudsma may refer a complait made uder Rule E.1 to the Admiistrative Committee, Party Officers or Iteral Appeals Tribual. I decidig whether to ivestigate a complait, discotiue a ivestigatio, or refer a complait, the Ombudsma may have regard to ay matter they cosider relevat. The matters that the Ombudsma may have regard to uder subsectio iclude, but are ot limited to, whether, i their opiio: The complait is frivolous, vexatious or ot i good faith; (ii) The subject matter of the complait is trivial; (iii) The coduct complaied of occurred at too remote a time to justify a ivestigatio; (iv) There is or was a alterative ad satisfactory meas of redress available to the complaiat; ad (v) The complaiat has o iterest or isufficiet iterest i the coduct complaied of. The complaiat or the perso whose coduct is complaied of, may request that reports of the Ombudsma to the Admiistrative Committee be aoymised ad subject to cofidetiality. The Ombudsma must comply with ay requests for cofidetiality. If the Ombudsma decides ot to ivestigate a complait, or to discotiue a ivestigatio, they must provide the complaiat with a writte reaso for their decisio. REPORTS If the Ombudsma decides to ivestigate a complait, they must report their fidigs to: The complaiat; (ii) Ay perso whose coduct is complaied of; ad (iii) The Party Officers. The Ombudsma must provide Aual Coferece with a report o their work. The Ombudsma may advise Aual Coferece ad the Admiistrative Committee o ways to improve compliace with the rights ad resposibilities uder sectio C. 31

32 (f) I a report uder this Rule, the Ombudsma may make ay commet or recommedatio that they cosider appropriate i the circumstaces. The Admiistrative Committee must otify the Ombudsma of ay actio take, or proposed to be take, as a result of a report uder this Rule. Except as provided i this Rule, a report uder this Rule must be kept cofidetial. SECTION F Regioal Assemblies F.1 Regioal Assemblies will be held each year throughout New South Wales, uless the Admiistrative Committee decides otherwise. F.2 The Admiistrative Committee shall set the date for each Regioal Assembly. F.9 Ageda items must reach the Geeral Secretary four weeks before a Regioal Assembly begis. F.10 A Regioal Assembly Committee will be elected at each Regioal Assembly from amog the participatig members. The Regioal Assembly Committee will be resposible for orgaisig the ext Regioal Assembly i that area. F.11 The Regioal Assembly Committee shall be chaired by a Coveor who will also be elected by the participatig members at the Regioal Assembly. The Coveor will also chair the Regioal Assembly. F.12 The Admiistrative Committee shall appoit Coveors ad Regioal Assembly Committees where oe curretly exist. F.13 The Admiistrative Committee may make ay other decisios ecessary for holdig Regioal Assemblies. F.3 A Regioal Assembly cosists of all Party members withi the regio. A member ca atted a Assembly if they have a curret Party ticket. F.4 There shall be Regioal Assemblies i the followig regios: Cetral Coast; Huter; Illawarra; Ier Sydey; Norther Sydey; (f) South-Easter Sydey; (g) South-Wester Sydey; ad (h) Wester Sydey. F.5 The Admiistrative Committee shall determie the boudaries for each regio, ad may subdivide the regios. F.6 Coutry FECs shall have the optio of holdig a Regioal Assembly i additio to attedig Coutry Coferece. F.7 The Geeral Secretary shall call for ageda items at least two moths before a Regioal Assembly begis. F.8 Ageda items ca be put forward by Braches, State Electorate Coucils, Federal Electorate Coucils ad Affiliated Uios i the regio. 32

33 SECTION G Electorate Coucils G.1 State or Federal Electorate Coucils ca be set up by the Admiistrative Committee i ay electorate. The umber of delegates (members) from each brach to a Electorate Coucil is worked out as follows: Brach Membership of Delegates Number For each additioal twety-five members (or part of twety-five), the brach has oe extra delegate. Brach membership is described i Rule I.2 ad worked out yearly by coutig the brach membership o 30 November of the previous year. Where oly oe brach exists i a electorate it is called a Electorate Brach ad acts as a Electorate Coucil. Composite braches which have fewer tha fiftee members livig i a electorate have the followig umber of delegates: Brach Membership of Delegates Number Delegates from composite braches are elected by all members who ca vote i their brach, but they themselves must live i the electorate for which they are elected. Note: A Composite brach is a brach whose borders cross two or more State or Federal Electorate Coucils. Braches which have bee allowed by Aual Coferece to operate with fewer tha fiftee members (as allowed i Rule I.5 below), are represeted o the same scale as composite braches described i above. A brach is ot etitled to sed delegates to a Federal Electorate Coucil if the brach s boudaries do ot iclude some part of the Federal Electorate Coucil area. (f) Note: This Rule is ot iteded to disefrachise preselectio voters whose brach is ot etitled to sed delegates to a FEC. The Cetral Policy Brach is ot etitled to sed delegates to ay State or Federal Electorate Coucil. G.2 Delegates to Electorate Coucils take office from 1 April as log as the coditios of Rule I.25 ad (below) have bee met. G.3 Uless it is decided differetly, the busiess at Electorate Coucil meetigs is carried out i the followig order: G.4 Roll call of delegates: uaffiliated braches (braches which have ot set their retur sheets ad list of registered brach members to the Secretary of the Coucil - see Rule G.10 below). (ii) Cofirmatio of miutes. (iii) Correspodece. (iv) Reports, icludig reports from braches ad orgaisers. (v) Motios o otice of which members have already bee advised. (vi) Geeral busiess. Each Coucil must meet at least oce every three moths i a place decided by the Coucil, uless the Coucil is i the desigated coutry area, i which case it must meet at least oce every four moths. Seve days before a meetig, otice of the meetig must be give by the Secretary to Brach Secretaries ad credetialed delegates. Notice of a meetig eed ot be give whe the Coucil meets o the same date ad time ad i the same place. For example, the Electorate Coucil always meets o the fourth Moday of each moth, at 7:30pm i the Tow Hall. Full details of the meetigs arraged for the comig year must be set to each brach ad all delegates after the Aual Geeral Meetig of the Coucil. At least seve days before the Coucil meetig, ay chages to those details, icludig cacellatio of meetigs, must be set to braches ad delegates. A official meetig ca be held whe a majority of the braches are represeted or whe a majority of the delegates, if the delegates are from more tha oe brach, are 33

If sufficiet umbers are ot preset after thirty miutes the meetig caot take place. research, discussio groups ad semiars, guest speakers, weeked schools ad ay other activity the Coucil decides it wats. G.5 For Federal ad State Electorate Coucils i the desigated coutry area, the Admiistrative Committee ca grat approval for the Electorate Coucil to coduct its meetigs, other tha the Aual Geeral Meetig, by telephoe coferece. Uless the Admiistrative Committee decides differetly, each Coucil holds it Aual Geeral Meetig betwee 15 April ad 31 May. At the Aual Geeral Meetig the Coucil hears a aual address from the Presidet of the previous year ad receives the Secretary s aual report for the previous year. At its Aual Geeral Meetig each Coucil elects a Presidet, two Vice-Presidets (oe is the Seior Vice-Presidet), a Secretary, a Treasurer, a Fud Raisig Officer, a Assistat Secretary, two Auditors, (for a State Electorate Coucil) two delegates ad two alterate delegates to the NSW Aual Coferece (ad for a Federal Electorate Coucil) three delegates ad three alterate delegates to the NSW Aual Coferece, three delegates ad three alterate delegates to Coutry Coferece from each Coutry SEC ad Coutry FEC, ad all other represetatives eeded for the followig year. The duties of the Secretary ad Treasurer ca be combied but, i that case, a extra Vice-Presidet is elected. At the ed of the electio of officers, a Coucil Returig Officer ad Deputy Returig Officer are elected. No Returig Officer or scrutieer shall be allowed to omiate for ay positio i ay ballot i which he/she is actig as Returig Officer or scrutieer. Note: A electorate coucil ca resolve i accordace with Rule B.25 to elect Aual Coferece delegates i accordace with the provisios of Rule M.9. As well as the officers listed i above, the Federal Electorate Coucil ca also elect a Political Educatio Officer, a Wome s Cotact Officer, a Commuity Activities Officer ad a Policy Developmet Officer. As part of his/her duties, each of these officers becomes a ovotig member of the Coucil Executive. The Political Educatio Officer is resposible for orgaisig ad coordiatig educatioal activities, icludig (f) G.6 (ii) The Commuity Activities Officer ad Wome s Cotact Officer assists the local braches to idetify the major issues withi the commuity withi which they should be active. (iii) The Policy Developmet Officer is resposible for co-ordiatig policy iput o federal matters ad works i accordace with resolutio of the Federal Electorate Coucil. Each Federal Electorate Coucil will elect oe Natioal Coferece delegate, the Party Officers will automatically be elected Natioal Coferece delegates with the balace of the Natioal Coferece delegatio elected by Affiliated Uio delegates to Aual Coferece. (ii) Natioal Coferece Delegates elected by Federal Electorate Coucils are elected i the same year as Natioal Coferece Delegates elected by Aual Coferece, ad hold office for the same term. A Federal Electorate Coucil elects oe Natioal Coferece delegate for its area pursuat to rule M.9.. The preferetial votig system (described i Schedule G at the back of this book) applies to all Electorate Coucil electios. The Presidet, Vice-Presidets, Secretary, Assistat Secretary, Treasurer ad Fudraiser (ad, i a Federal Electorate Coucil, the Political Educatio Officer) are the Coucil Executive ad as part of their duties are members of all committees of the Coucil. The Electorate Coucil Secretary must give writte otice of the date, time ad place for the closig of omiatios for its aual electios. (ii) The otice must also give the date, time ad place of the meetig at which the electio is to take place. (iii) The otice must be give at least seve clear days prior to the close of omiatios. (iv) Nomiatios for positios must close 34

35 (f) (g) (h) with the Returig Officer o less tha seve days prior to the Aual Geeral Meetig at a time ad place agreed by the Electorate Coucil Executive. (v) The otice must be give to: Secretaries of local braches ad Credetialed delegates (as per G.6. Nomiatios must be i writig ad siged by the cadidate ad two members of the Party who live i the electorate. However, whe there are ot eough omiatios, writte or spoke omiatios ca be made at the electio meetig. Oly credetialed Delegates (that is, those who have a right to be Delegates) ca hold official positios i ay Coucil, except that: The positios of Delegate or Alterate Delegate to NSW Aual Coferece or Coutry Coferece ca be held by ay fiacial member residig i the electorate; ad (ii) If the Secretary stops beig a delegate, he/she caot vote, but ca go o beig Secretary util the followig Aual Geeral Meetig. At least fourtee days before the Aual Geeral Meetig the Secretary gives the Returig Officer a list of the ames ad addresses of the members who ca vote. Ay cadidate is etitled to be give the list. If the umber of wome elected as coferece delegates or alterate delegates i accordace with G.5 does ot meet the requiremets i M.7, a ew electio must be called for all positios ad held withi two moths of the first electio. If the umber of wome elected to the coucil executive i accordace with G.5 does ot meet the requiremets i M.7, a ew electio must be called for all executive positios ad held withi two moths of the first electio. The otice requiremets i cotiue to apply to ay electios called pursuat to or (f). The Secretary of the Coucil must otify the Geeral Secretary if a ew electio is called pursuat to or (f). If after two electios, a Electorate Coucil does ot meet the requiremets of M.7, the Coucil will ot be etitled to seat delegates at the Aual Coferece or Coutry Coferece. G.7 Notwithstadig other provisios of these Rules Electorate Coucil officials ad delegates represetig Electorate Coucils hold office util the declaratio of electio of their successors, uless their positio falls vacat because the office-holder: dies; (ii) resigs the office by istrumet i writig addressed to the Secretary of the Electorate Coucil; (iii) becomes a metally icapacitated perso; (iv) ceases to reside withi the boudaries of the Electorate Coucil; (v) ceases to be a member of the Party; or (vi) if a member of the Electorate Coucil Executive is abset without permissio for three ordiary meetigs of the Electorate Coucil i a row. A perso elected to a positio by a Electorate Coucil ceases to hold that positio if these Rules do ot require the cotiued existece of the positio ad the positio ceases to exist. Nothig i this Rule prevets a perso who ceases to hold office uder (vi) above from re-omiatig ad beig reelected to the same positio. If a delegate to the Coucil misses three ordiary meetigs i a row without permissio the Coucil ca ask the delegate s brach to elect a ew delegate. G.8 Whe a positio of a Electorate Coucil official or delegate represetig the Electorate Coucil is vacat or a positio is ot filled at the aual electios the Coucil will fill the vacacy i this way: It will declare a time, date ad place for omiatios to close, as log as delegates are give at least seve days otice that omiatios have bee called for. Notice should be give by sedig out a circular to Secretaries of local braches. (ii) At the ext ordiary Coucil meetig the vacacy will be filled. Presidet G.9 At all meetigs at which he/she is preset, the Presidet is the Chair. The Presidet keeps order ad makes sure that the meetig follows the Rules of debate. Whe the Presidet is ot preset or is sick the the most seior Vice- 35

36 Presidet who is preset takes the Chair. The Chair does ot have a castig vote. Secretary G.10 The Secretary (or the Assistat Secretary whe he/she is ot there): (f) Keeps proper records of Coucil busiess, icludig the delegates roll, attedace ad miute books, ad takes care of icomig ad outgoig letters for the Coucil. The attedace ad miute books used by the Coucil should be the official books which are available from the NSW Brach Office. SEC Secretaries must keep a list of the braches i their electorate, as certified by the Admiistrative Committee. Pays over to the Treasurer at each meetig or as soo as possible after the meetig ay moey which has bee received for the Coucil. No later tha 7 May each year provides the Geeral Secretary with a retur sheet with the ames ad addresses of the delegates as at 30 April, ad a up-to-date list of people holdig official positios. Failure to lodge required Brach or Electorate Coucil Aual Fiacial Returs to the NSW Brach Office may result i the Admiistrative Committee suspedig the charter of the Brach or Electorate Coucil. Util they have set i the retur sheets eeded by the Geeral Secretary, Coucils do ot have the right to be represeted at Aual Coferece. If a delegate elected to represet a Electorate Coucil at the Aual Coferece or the Coutry Labor Coferece is uable to perform a fuctio as a delegate, the Coucil Secretary may appoit a alterate delegate elected by Coucil for the Coferece to exercise that fuctio. G.12 G.13 icome ad expediture. The Fudraisig Officer is resposible for co-ordiatig all fudraisig activities for the Electorate Coucil. The Fudraisig Officer must report to the Coucil o a regular basis. Moey raised must be looked after by the Treasurer i the way described i above. The sum of $30 ca, from time to time, be voted to the Secretary for petty cash. Whe ecessary, the Electorate Coucil ca put a fair levy o all costituet braches to cover workig expeses. All costituet braches must cotribute equally per member for those members who live i the electorate except life members. The levy caot be more tha $2 per member uless all costituet braches agree. A Coucil has the power to appoit members of the Party as orgaisers, or local agets, to help the work of the Coucil i orgaisig ad advacig the Policy ad Rules of the Party as approved by the Admiistrative Committee. Followig Rules G.14 ad G.15 (below), a Coucil ca oly deal with matters passed o to it i writig by a costituet brach, the Coucil Executive, the Youg Labor Associatio, ad the Admiistrative Committee. Coucils ca draw up Rules for their ow guidace as log as they do ot coflict with the priciples ad geeral Rules of the Party. Rules made by a Coucil must be approved by the Admiistrative Committee. Coucils act as campaig committees whe eeded. State Electorate Coucils G.14 Treasurer ad Fudraisig Officer G.11 The Treasurer keeps accurate accouts of all moey which belogs to the Coucil. The sigature of the Treasurer is eeded to take out ay fuds ad he/she will give that sigature oly after this has bee decided by the Coucil. At the ed of the fiacial year the Treasurer will preset the Coucil with a audited balace sheet ad statemet of State Electorate Coucils are resposible for formig braches withi their electorates ad defiig the boudaries i which each brach operates. Ay suggestios to chage the boudaries of costituet braches will be placed o otice ad a decisio will ot be take for two moths by the State Electorate Coucil. All costituet braches affected by ay suggested chages to brach boudaries will be told i writig by the Electorate 36

Ay Party member or Party Uit, affected by a ew brach beig formed or by brach boudaries beig chaged, ca appeal to the Admiistrative Committee i writig. The chaged boudaries will come ito effect immediately after the State Electorate Coucil adopts the ew boudaries. Members who are affected by a chage i the brach boudaries ca trasfer to their ew brach followig Rule I.9 or ca stay i their old brach if it falls withi the State Electorate i which they live. A Brach may request to affiliate to more tha oe State Electorate Coucil ad become a composite Brach (where its boudaries cross two or more State Electorate Coucils. (ii) If the State Electorate Coucil approves this request, the Secretaries of the State Electorate Coucil ad relevat Brach must otify the Geeral Secretary who will refer the matter to the Admiistrative Committee. The Admiistrative Committee may decide, at its discretio, to approve or dey the request. Brach Mergers G.15 Two or more Braches with boudaries that iclude the same State Electorate may request that the State Electorate Coucil approve a merger of the Braches. If the State Electorate Coucil approves the merger, the Braches ad the State Electorate Coucil may request that the Admiistrative Committee approve the merger. The Admiistrative Committee may decide, at its discretio, to approve, alter or dey the request. If the Admiistrative Committee approves the merger, the ewly formed Brach must hold a Aual Geeral Meetig to elect the positios required uder Rule I.19. The Admiistrative Committee may appoit a perso to act as the Returig Officer for a Aual Geeral Meetig held uder subsectio. Federal Electorate Coucils G.16 Federal Electorate Coucils deal with matters associated with their Federal Electorates, Federal Parliametary represetatio, Federal refereda ad other Federal matters. However, the Admiistrative Committee ca refer ay matter to Federal Electorate Coucils. Braches G.17 Media Ay brach whose retur sheets ad certified list of brach members are ot received by the Coucil Secretary o or before 1 April i ay year, will be regarded as uaffiliated by the Coucil. The delegates from uaffiliated braches will ot be able to vote at ay meetig of the Coucil or to hold office util their brach affiliates. The ames of uaffiliated braches will be read out by the Secretary at each Coucil meetig. Whe the retur sheets ad certified list of brach members have bee received by the Secretary of the Coucil, a brach is cosidered to be affiliated ad its delegates are able to vote o the Coucil. Notwithstadig Rule G.17, i istaces where the retur sheets ad certified list of brach members are received after 1 April, the delegates from that brach will ot be able to vote i the Aual Geeral Meetig of the Electorate Coucil. G.18 The media are ot allowed ito Coucil meetigs but, if the Coucil decides to do so, the Presidet ad Secretary ca issue a media release. FEC Forums G.19 A Federal Electorate Coucil must covee two Forums each year ad these Forums must be held i May ad November, subject to ay other decisio of the Admiistrative Committee. If the FEC so desires, additioal Forums may also be held. All Party members i the electorate must be ivited. The oly two speakers at each Forum shall be the Federal Member of Parliamet or the Duty 37

38 Seator ad the Guest Speaker. The speeches of the Federal Member of Parliamet/Duty Seator shall be limited to te miutes. The Guest Speaker may also take questios from members. The Geeral Secretary s represetative will liaise with FECs/Federal Members/Duty Seators to esure these Forums are beig coducted as required uder this Rule. Oly Party members ad ivited guests may atted these forums. The Guest Speaker eed ot be a Party member. The FEC attedace book must be made available for all those i attedace to sig. Party members should idicate the brach to which they belog i the attedace book. At the coclusio of the meetig the FEC Presidet (or i the absece of the Presidet, the Vice Presidet or other officer chairig the meetig) must declare the meetig closed ad permit ay members i attedace to witess the sigig off of the attedace book. (ii) Photocopies of the attedace records must be provided to the Secretary of each costituet brach withi seve days who must the affix the pages ito their brach attedace book. (iii) Attedace at a FEC Forum will cout towards attedace requiremets for existig Brach members for local selectio ballots ad the reewal of brach registratio. (iv) Applicatios to joi ad admissios to a brach caot be made at a FEC Forum. (v) Brach membership ca be reewed by attedig a FEC Forum. to atted FEC Forums. Duty Seators are required to assist their Duty FECs i orgaisig ad coductig the Forums. Electorate Assemblies G.20 A Electorate Coucil may covee a Electorate Assembly of all Party members i the Electorate to discuss Labor s policy priorities. Braches ad Party Uits are ivited to sed all relevat ageda items to the Electorate Coucil, which will determie the ageda for the assembly. The Electorate Coucil will esure that all braches are give otice of the Assembly. If the usual brach meetig is held i the same moth as a FEC Forum, attedace at the brach meetig ad the FEC Forum will both cout towards attedace requiremets for Brach members. (ii) If the brach meetig is held o the same day as the FEC Forum, oly oe attedace will be couted towards attedace requiremets for Brach members. Federal Members of Parliamet ad Duty Seators are required to make every effort 38

39 SECTION H Local Govermet H.1 The Party will edorse cadidates for local govermet electios. After cosultatio with local Party Uits, the Admiistrative Committee will decide i which local govermet areas to edorse cadidates. Oly members with at least 12 moths membership i the Party ca be edorsed as cadidates for local govermet electios. A exceptio ca be made whe a majority of the Admiistrative Committee decides that a sigificat advatage would be gaied for the ALP if a perso with less tha 12 moths membership i the Party stood as a cadidate i a selectio ballot. I areas where Coucillors have embarrassed the Party, edorsemet will ot be give to cadidates util the Admiistrative Committee is sure that the Party would be best served by allowig those cadidates to be edorsed. Labor Coucillors shall ot caucus o: Developmet Applicatios (i.e. a applicatio uder Sectio 79c of the EPAA Act or its equivalet); ad Spot rezoigs. (ii) Labor Coucillors shall caucus o Party policy, local electio policy, coucil estimates, fiace ad rates, staff matters, the electio of Mayor, Presidet, Chairpersos ad Deputies ad members of Stadig Committees ad other represetative bodies. (iii) Whe Labor has a majority o a Coucil ad whe elected represetatives are required to serve i a positio o Coucil, icludig Coucil committees or other represetative bodies, support must be give to a Labor majority of represetatives o such committees or bodies, as log as eough Labor represetatives are willig to serve. For this Rule, a majority will be uderstood as a simple majority. Coucillors should report regularly to local braches. (f) (g) (h) H.2 H.3 (ii) Local Govermet Committees must meet at least oce every three moths so that coucillors ca meet with ad iform the Committees about coucil matters. I retur Coucillors eed iformatio about the problems of the local govermet area as a whole from these Committees. Braches should give proper cosideratio to the local eeds of the people, but care must be take to make sure that local govermet does ot take more time ad attetio tha importat Federal ad State issues. Where Youg Labor Associatios exist i local govermet areas, they will be etitled to sed oe o-votig member to the local govermet committee meetig. Also the committee ca cosider correspodece from Youg Labor Associatios. Coucillors ad members ivolved i Local Govermet Campaigs must comply with decisios of the Admiistrative Committee o local govermet doatios as resolved from time to time. At Coucil meetigs Coucillors who are members of the Party must support ad vote for caucus decisios. Breaches of this Rule should be immediately reported by the Secretary of caucus to the Geeral Secretary of the NSW ALP. The Iteral Appeals Tribual shall hear complaits relatig to caucus breaches ad local govermet disputes. Where four members of the Party are elected to ay Coucil, these Coucillors shall caucus. Where three or less are elected, they should cosult. Where a deadlock occurs i a Coucil caucus, the Chair of caucus has the decidig vote. The Chair does ot has a castig vote i electios for Mayor, Deputy Mayor, Coucil Committees ad other represetative bodies. Deadlocks for these must be determied as specified i Schedule H.4(5). At the commecemet of each Coucil term ad the aually the caucus shall elect a Presidet ad Secretary. (ii) Where a popularly elected Mayor is a caucus member, that perso shall be caucus Presidet for the term of the Coucil. 39

40 (iii) A true record of all decisios take at caucus meetigs is to be kept by the Secretary. These records shall be set to the NSW ALP Geeral Secretary o request. Where Labor has a majority the Labor Mayor, Presidet or Chair will be selected by caucus for the term of the Coucil or Shire. This is ot the case i the City of Sydey. These Rules ad the stadig orders of State Electorate Coucils apply where practicable for caucus meetigs. H.4 The official cadidate to represet the Party i the electios for the Lord Mayor of Sydey is elected by a commuity selectio ballot as per Rule N.47. The official cadidate so selected is automatically the edorsed umber oe cadidate i electio of Sydey City Coucil coucillors. H.5 Where a Coucillor ca be elected uder the Local Govermet Act to ay Board, Commissio or Committee, the Labor Coucillors i the group cocered should meet to select ad support a Labor cadidate for the positio. Where Coucillors are elected to ay board, commissio or committee, the Labor members i the group cocered shall meet ad caucus as per Rule H.2. H.6 Whe a vote is beig recorded for a edorsed cadidate all Coucillors who ca vote should be able to show a resposible Party official that their votes have bee recorded i favour of the edorsed Labor cadidate. H.7 Day labour will be used by all Coucils where Labor has a majority, ad trade uioists will get preferece for all coucil work. The exceptio will be where the Admiistrative Committee, allows a cotract system rather tha day labour. Where the cotract system is chose, preferece will be give to cotractors whose employees are members of a registered trade uio. H.8 Labor Coucillors will esure that award rates or higher are paid for coucil work. H.9 Local orgaisatios that put forward or support Parliametary or coucil cadidates are political orgaisatios. Uder these Rules, Party members are ot allowed to be members of such orgaisatios. Party members ca joi commuity orgaisatios uless proscribed (ot allowed) by the NSW Admiistrative Committee. H.10 Where Labor has a majority i a Coucil or Shire, Labor Coucillors must limit their reports at braches, Local Govermet Committees, or other orgaisatios iside ad outside the Party, to explaiig ad supportig caucus decisios ad promotig the carryig out of official Party Local Govermet policy. Local Govermet Committees H.11 A majority of braches may request the Admiistrative Committee of the NSW ALP to approve the formatio of a Local Govermet Committee i that local govermet area. Such a Committee shall comprise two delegates from each brach elected aually ad shall elect office bearers as per a electorate coucil. Local Govermet Committees shall meet every three moths so the Coucillors ca meet with ad iform the Committees about Coucil matters. I retur, Coucillors eed iformatio about the problems of the local govermet area as a whole from these Committees. The Local Govermet Committee ca advise but ot direct caucus members as to how to vote o a issue. The primary role of each Local Govermet Committee is to act as a Campaig Committee for Coucil electios to esure that Labor represetatio is maximised. The Local Govermet Committee shall orgaise selectio ballots for the local govermet area whe required to do so uder these Rules. Coucillors may ot be elected as delegates to Local Govermet Committees but may atted such meetigs with all the rights of delegates except votig rights. H.12 At least oce each term, Local Govermet Committees may covee a local govermet assembly of all Party members i the local govermet area, to discuss Labor s policy ad approach i local govermet. All Labor coucillors, or cadidates if appropriate, will be expected to atted. Braches ad Party Uits are ivited to sed 40

41 all relevat ageda items to the LGC, which will determie the ageda for the assembly. The LGC will esure that all braches are aware of the assembly. LGCs i a area may decide to hold a combied coucils assembly. LGCs will have the resposibility of orgaisig the assembly, subject to the approval of the Admiistrative Committee. H.13 The Committees will arrage selectio ballots for Coucil electios, whe this is ecessary, ad will act as a orgaisig committee i such electios. The Committees caot tell Coucillors how they should vote o Coucil busiess. Coucillors must report back to the braches. Where a Local Govermet Committee is ot fuctioig the Admiistrative Committee of the NSW ALP may appoit a local SEC Returig Officer to act as Deputy Returig Officer for a preselectio ballot as required. Cadidates must meet with the Local Govermet Committee to decide the policy for Coucil electios. These Rules, ad the stadig orders of State Electoral Coucils, apply where eeded for Local Govermet Committees. H.14 Whe it cosiders it is i the best iterests of the Party to do so, the Admiistrative Committee ca decide ot to edorse ay cadidate as a official Party cadidate. H.15 The Admiistrative Committee ca decide o the selectio of ay official Party cadidate or cadidates, i ay local Govermet electorate, as it thiks suitable i the best iterests of the Party. Cosultatio must first be made with the relevat Local Govermet Committee. NSW Labor Local Govermet Caucus H.18 Coucillors elected to a NSW local govermet body outlied i Sectio H, ad fiacial members of the Party (NSW Brach) elected to Aborigial Lad Coucils i NSW must form a separate Local Govermet Caucus. The NSW Labor Local Govermet Caucus shall adopt its ow stadig orders ad rules, determie its ow structure, ad adopt procedures to facilitate its busiess ad evets. The NSW Labor Local Govermet Caucus Executive shall be required to meet with represetatives from affiliated uios at least oce yearly to: Facilitate policy developmet betwee the Local Govermet Caucus ad affiliated uios; (ii) Provide a framework for the partership betwee the Local Govermet Caucus ad affiliated uios o matters of commo cocer; (iii) Udertake log-term plaig for the implemetatio of Labor policy i local govermet; ad (iv) Provide a forum for leadership o matters of public cocer ad Iterest related to local. H.16 All Party members who ru uedorsed must gai the approval of the Admiistrative Committee for their cadidacy ad for their preferece distributios. Where Coucillors are elected to official positios i Local Govermet but are ot officially selected or edorsed cadidates, they must keep to these Rules just as if they had bee officially selected or edorsed. H.17 The Secretaries of the Coucil caucus ad Local Govermet Committee must let the Geeral Secretary kow as soo as possible whe a by-electio is eeded. 41

Braches I.2 All Party members who have bee admitted to membership of the brach (see Rule I.7 below) are members of a brach. Oly those who have bee admitted to the brach i the way set out i the Rules ca take part i the affairs of the brach ad receive the beefits of membership. I.3 A brach which has ot met for three moths caot meet agai uless: oe caledar moth s otice is give to the Geeral Secretary ad to the local State Electoral Coucil, where oe exists, ad the first meetig is advertised i the official joural of the Party or a local ewspaper. Where a objectio is made to the brach startig up agai the Admiistrative Committee will look ito the matter. I.4 Where a tow is divided ito several electorates the Admiistrative Committee ca allow members to meet as oe brach. I.5 A brach of the Australia Labor Party ca be set up i ay cetre as log as at least fiftee eligible people wat to form a brach. I a coutry area the umber of eligible people required to start a ew brach is te. Settig up a ew brach I.6 This is the way to set up a brach: A meetig should be called ad advertised i the official joural of the Party or a local ewspaper. The otice must iclude the time, date ad veue for the meetig. At least two weeks otice of the meetig should be give i the advertisemet. (ii) At least oe moth s otice should be give to the Geeral Secretary ad to the Secretary of the State Electorate Coucil. The Geeral Secretary will appoit a represetative to oversee the coduct of the formatio meetig. (iii) The people meetig together (ad there must be at least fiftee eligible people or te i a coutry area) must accept the Platform ad Costitutio of the Australia Labor Party (NSW Brach) ad move a resolutio to set up a brach. (iv) The meetig should the elect a Presidet (for the time beig) ad a Secretary (for the time beig). (v) The Presidet ad Secretary should fill i the Form of Declaratio supplied by the Geeral Secretary ad sed it back to the Geeral Secretary, alog with applicatios for membership filled i by people who were at the first meetig ad who wat to become members. After the Brach formatio meetig ad before the Brach charter meetig, the local State Electoral Coucil should decide without delay if it wats a ew brach to be set up, takig ote of the area for which it is suggested, the members or those applyig for membership who wat to set up the brach, 42

43 (f) (g) ad the eed for such a brach. Whe the State Electoral Coucil has made its decisio it should let the Geeral Secretary kow what that decisio is without delay. The Geeral Secretary will refer the applicatio from those who are actig as Presidet ad Secretary, ad the applicatios for membership, together with the decisio of the State Electorate Coucil, to the Admiistrative Committee for a decisio. I the case of brach formatio meetigs, where more tha fifty people apply to joi, the matter will be referred to the Iteral Appeals Tribual for report prior to a decisio beig made. The Admiistrative Committee may the allow a charter to be issued to the ew brach ad Party membership grated. Whe the charter has bee received the actig Presidet ad Secretary will call a meetig of people who ited to be members by advertisig it i the official joural of the Party or local ewspaper ad iformig the Secretary of the State Electorate Coucil of the meetig i writig. At least two weeks otice of the meetig must be give. At this meetig electios will take place for the official positios withi the brach ad members who wat to joi the brach will be admitted to membership. Oly members preset at the formatio meetig may become members of the brach at this meetig ad vote for positios. Joiig a Local Brach I.7 Brach members ad those watig to joi the brach must live withi the State electorate. Members must, at the time of joiig or trasferrig to a Brach either be correctly erolled with the Australia Electoral Commissio to vote i a federal electio at their stated address or ot be so etitled because they are uder 18 years of age or ot a Australia citize. Uless there is overwhelmig evidece agaist this, proof of where a brach member or a applicat for brach membership lives is take from the upto-date Commowealth Electoral Roll or by productio of a up-to-date Commowealth Erolmet Card. For the purpose of this Rule, the Commowealth Electoral Roll icludes supplemetary rolls ad computer pritouts. I the case of people who are ot citizes, a passport or other documetary proof of o- Australia atioality cofirmig permaet residecy must be produced, alog with documetary proof of residece. I the case of people who are uder eightee years of age, a birth certificate or the certified copy of etry of birth must be produced. If there is o brach i a state electorate, Party members may joi the brach earest to where they live. Local brach membership I.8 Members who wat to keep their membership with the brach must do so by attedig a meetig of the brach every membership year ad sigig the attedace book. Note: The membership year for braches starts o 1 December ad fiishes o 30 November. Where members of the brach are sick, disabled, abset or caot for some other legitimate reaso sig the attedace book at a Brach meetig for the purpose of reewig their brach membership, the members of that Brach ca give the Secretary the authority to reew their brach membership whe a applicatio i writig to do so has bee received from the member. This provisio does ot apply to reewig membership of the Cetral Policy Brach. The member cocered must sig a separate page i the Brach attedace book at the home of the Brach Secretary withi a reasoable time after permissio to sig has bee give by the Brach. Members who are chroically ill or disabled may sig the attedace book at their ow home or i hospital or ay other place i which they are beig treated. Details of such Brach membership reewals must be recorded i the Brach miutes, must be o a separate page dated the date of the meetig at which permissio was grated ad the Secretary must give full particulars to the Geeral Secretary. If o objectio is raised withi twety oe days of iformig the NSW Brach office everythig will be cosidered to be i order. The date of the member s reewal of brach membership will be the date o which the authority to reew was give by the Brach. 43

44 Trasferrig from a Brach I.9 A existig brach member who wishes to trasfer out of a existig brach must first otify the Geeral Secretary of their itetio to trasfer i writig or via the Party s website. Withi fourtee days of receivig a otificatio uder subsectio, the Party Office must: Issue the trasferrig member a Trasfer Clearace; ad (ii) Notify the trasferrig member s old brach ad ew brach of the pedig trasfer. A existig brach member applies to trasfer ito a ew brach by: Attedig a ordiary brach meetig; (ii) Sigig the attedace book; (iii) Showig their Party Membership Card to the Brach Secretary; ad (iv) Showig their Trasfer Clearace to the Brach Secretary. A trasferrig member s membership of the ew brach starts from the brach meetig at which they apply to trasfer ito the ew brach i accordace with subsectio. A perso may trasfer their membership iterstate by otifyig the Geeral Secretary of their itetio to trasfer i writig or via the Party s website. The Geeral Secretary must forward this iformatio to the Secretary of the iterstate brach to which the perso is trasferrig. I.10 Durig April the Geeral Secretary seds all braches a complete list of the ames, addresses, ticket umbers, categories of membership ad membership fees paid, for Party members who live i each brach area or state electorate ad are members of the brach ad have reewed their membership by 31 March. Brach Meetigs I.11 Each Brach i NSW must meet at least oce every three moths at a place decided by the Brach. Meetig veues (f) I.12 must be as accessible as possible for all members. The Secretary must let each Brach member kow the time, date ad place of meetigs ad may sed this advice by . All braches must otify the relevat local Labor member of Parliamet, State Duty MLCs ad Duty Seators of the meetig times, date ad place of brach meetigs. Ay variatios to brach meetigs, times, dates ad locatios shall be otified with the appropriate otice (ie: 7 days). The Geeral Secretary must be advised of a permaet chage to the meetig time, date ad place of a brach. Where a Brach usually holds oe meetig a moth, i Jauary ad February that Brach ca hold two ordiary meetigs to make it easier for members to reew their brach membership. (ii) Oe meetig must be held at the usual meetig time, date ad place. The other ordiary meetig will be held at the usual meetig place whe that is possible, at a time ad date decided by the Brach. Meetigs must be at least seve days apart whether these are special or ordiary meetigs ad all members must be advised of the meetigs. All meetigs must be held i accordace with the priciples outlied i Schedule K Wome s Participatio. Uless a Brach has resolved to susped stadig orders or ormal brach busiess to hold a geeral discussio, traiig, policy forum or social evet, the busiess at Brach meetigs is carried out i the followig order: Cofirmatio of meetig miutes, which ca be read or provided electroically or i hard copy prior to the meetig; (ii) New Members; (iii) Policy discussio; (iv) Correspodece; 44

45 I.13 (v) Accouts; (vi) Reports; (vii) Motios which have bee provided i writig to the meetig; ad (viii) Geeral Busiess. The miutes of the previous meetig may be circulated to brach members by rather tha posted, ad must be available for ispectio at the meetig prior to cofirmatio. This must be give priority at each ordiary Brach meetig. (ii) The Presidet, or whoever is presidig at the meetig, shall sig the miutes immediately after they have bee cofirmed. Where the miutes are typed, the siged copy shall be pasted ito the miute book by the secretary. The Secretary is required to give oly a brief overview of ay major items of correspodece received ad table all other correspodece for circulatio durig the meetig. If at least twelve members ask for oe, a special Brach meetig must be arraged by the Secretary. The request must be made i writig ad state what issues the members wat to discuss. The Secretary must tell all local Brach members of the special meetig by sedig out a circular seve days before it will take place. If, after fourtee days from receivig the request, the Secretary has ot orgaised a special Brach meetig, the Geeral Secretary should be told. A special Brach meetig caot overtur a decisio made at a Brach meetig durig the previous three moths. A special Brach meetig ca oly discuss the matters raised whe the meetig was first called for. New items caot be added to the ageda. The busiess of a special meetig caot iclude applicatios for or acceptace of ew members to the brach ad attedaces at special meetigs will ot cout for preselectio purposes. Items other tha those raised whe the meetig was first called for, will be ruled out of order. The Brach Executive ca call a special Brach meetig but must follow this Rule. I.14 A brach meetig ca oly take place if a quorum is established ie if seve members are preset, or five members i a coutry area. If a quorum is ot established after 30 miutes the meetig caot take place. The quorum must be maitaied at all times durig the meetig or the meetig will lapse. I.15 The media are ot allowed i to Brach meetigs but, if the Brach decides, the Presidet ad Secretary ca issue a media release. I.16 A member, or a perso applyig for membership, is preset at the meetig if he/ she sigs the official attedace book durig the meetig. The Secretary shall esure that the attedace book is circulated amog the attedees at a meetig i a way that allows attedees to peruse the book. The clampig of books with clips is prohibited. At the coclusio of the busiess of a Brach meetig, the Presidet (or i the absece of the Presidet, the Vice Presidet or other officer chairig the meetig) must declare the meetig closed ad must permit ay members i attedace to witess the sigig off of the attedace book. The chair s sigature must go immediately uder the last sigature ad the page must be ruled off. I.17 Ay member who behaves i a uruly or disorderly way ca be ordered to leave the meetig by the Chair. I.18 Ay Party member ca atted ay other Brach meetig, but they ca oly speak durig discussios with the agreemet of the Brach they are visitig. Brach Aual Geeral Meetig ad Officials I.19 At its Aual Geeral Meetig i March each Brach must elect: a Presidet; two Vice-Presidets (oe of whom is the Seior Vice-Presidet); a Secretary; a Treasurer; 45

46 a Fudraisig Officer; a Assistat Secretary; A New Member Officer; with the Returig Officer at the date, time ad place agreed by the Brach. Members must be give seve days otice by circular before omiatios close. I.20 Two Auditors (oe of whom is the Seior Auditor); Delegates ad Alterate Delegates to Federal ad State Electorate Coucils, Local Govermet Committee; a Brach Returig Officer; a Deputy Returig Officer; ad ay other Brach represetatives eeded for the followig year. The jobs of Secretary ad Treasurer ca be combied, but if that happes a extra Vice- Presidet must be elected. A member of the Brach Executive other the the Presidet or Secretary ca also hold the positio of New Member Officer. The role of the New Member Officer is to metor ew Brach members ad explai how the Brach ad other Party Uits work. The Presidet, Vice-Presidets, Secretary, Assistat Secretary, Treasurer or Secretary- Treasurer ad Fudraisig Officer are the Brach Executive ad are also members of all Brach committees. Electorate Braches (that is where there is oly oe Brach i the electorate) elect the delegates they eed at their Aual Geeral Meetig. I electig the positios set out i, each Brach should be midful that the ALP is committed to me ad wome workig i equal partership at all levels of the Party, as outlied i rule M.7. (ii) The otice must advise the umber of delegates ad alterate delegates to be elected to Electorate Coucils from the Brach. (iii) Nomiatios must be made i writig ad siged by two other Brach members ad the perso omiated, showig that the perso accepts the omiatio. If ot eough omiatios are received i advace, writte or verbal omiatios ca be made at the meetig durig the electios. (iv) The Returig Officer or his/her Deputy must be preset at the time ad place whe it was stated omiatios would close. After omiatios close the Returig Officer (or Deputy) must immediately check that all the omiatios are correctly completed (valid). The Returig Officer (or Deputy) must tell the cadidates or scrutieers which omiatios are correct ad which are icorrect. If the Returig Officer (or Deputy) decides certai omiatios are icorrect (ivalid) he/she must explai why he/she has made that decisio. If a ballot is eeded the Returig Officer must immediately decide the order of the ames o the ballot paper. This should be doe by drawig lots. Cadidates ca appoit scrutieers to oversee the drawig. (v) No Returig Officer or scrutieer shall be allowed to omiate for ay positio i ay ballot i which he/she is actig as Returig Officer or scrutieer. Brach officials are elected at the Aual Geeral Meetig held i March, or aother moth determied by the Admiistrative Committee. However if a Brach Aual Geeral Meetig takes place i a moth other tha March, eligibility to vote ad be a cadidate at the Aual Geeral Meetig uder these Rules is determied as if the Aual Geeral Meetig is takig place i March. A preferetial votig system is to be used (see Schedule G at the ed of this book). Nomiatios for Brach positios close If a member wats to stad for a positio i the Brach he/she must be a fully paid-up member by 31 Jauary ad have reewed their Brach membership before 1 March. If there are ot eough omiatios a member ca stad for a positio as log as he/she is a fully paidup member before beig omiated. (ii) A member must either be preset at the meetig whe he/she is omiated or, if he/she is ot able to atted, make it clear i writig that he/she wats to be omiated. 46

47 (f) (iii) A member caot hold ay Brach positios uless he/she has bee a member of the brach for ot less tha six moths immediately before the electios. A exceptio to this Rule is made whe there are ot eough omiatios from members who have bee i a Brach for more tha six moths. (iv) The previous Rule does ot apply to ew Braches which have existed for less tha 12 moths. (v) Coucillors caot be elected as delegates to the Local Govermet Committee. To vote i Brach electios members must be: fully paid-up by 31 Jauary, must have reewed their membership of the Brach before 1 March ad a member of the Brach for at least three moths before the electios. The Geeral Secretary seds each Brach Secretary a complete list of the ames, addresses, ticket umbers ad categories of membership for all members i the Brach area, or who have joied the Brach, who have reewed their membership by 31 Jauary. This list should be received by 14 February. At least seve days before the electios the Secretary gives the Returig Officer a list of the ames ad addresses of members who ca vote. Ay cadidate is etitled to be give the list. I.21 Notwithstadig other provisios of these Rules Brach officials ad delegates represetig Braches hold office util the declaratio of electio of their successors, uless their positio falls vacat because the office-holder: (f) (g) dies; resigs the office by istrumet i writig addressed to the Brach Secretary; becomes a metally icapacitated perso; ceases to be a member of the Party; ceases to be a member of the Brach; if a member of the Brach Executive is abset without permissio for three ordiary meetigs of the Brach i a row; or if a delegate represetig the Brach is abset without permissio from three ordiary meetigs of the Electorate Coucil/Local Govermet Committee i a row. A perso elected to a positio by a Brach ceases to hold that positio if these Rules do ot require the cotiued existece of the positio ad the positio ceases to exist. Nothig i this Rule prevets a perso who ceases to hold office uder (f) or (g) above from re-omiatig ad beig re-elected to the same positio. I.22 If a positio of a Brach official or delegate represetig the Brach is vacat, or a positio is ot filled at the Aual Geeral Meetig, the the vacacy is filled by the Brach as follows: I.23 A time, date ad place is set for omiatios, but members must be give seve days otice. This ca be doe by a circular beig set to members or by advertisig it i the official joural of the Party. (ii) The vacacy is filled at the ext ordiary Brach meetig. If a electio is eeded preferetial votig should be used (see Schedule G at the ed of this book). Whe a perso applies to joi or trasfer ito the Brach, the Secretary should esure that the perso is eligible to joi the Brach ad should ote how may people are applyig to joi at each Brach meetig. Ay challeges to the eligibility of a perso to joi the Brach must be referred i writig to the Geeral Secretary who will make a determiatio withi oe week of receivig the referral. The determiatio of the Geeral Secretary may be challeged i writig i accordace with Rule A.32. Brach Presidet I.24 The Presidet chairs Brach meetigs whe he/ she is preset. The Presidet must keep the meetig i order ad make sure that the Rules of debate are followed. (The Rules of debate are prited as Schedule I at the ed of this book.) If the Presidet is away, the most seior Vice- Presidet at the meetig takes the chair. Brach Secretary I.25 The Secretary (or if he/she is away, the Assistat Secretary) must: 47

48 (f) Keep proper Brach records. These records iclude: Brach Attedace Book; ad Brach Miute Book. The Secretary also deals with letters to ad from the Brach (correspodece). Pay all moies over to the Brach Treasurer. This should happe either at Brach meetigs or as soo as possible afterwards. Before 31 March each year sed the retur sheets listig Brach members to the Secretaries of the State ad Federal Electorate Coucils, Local Govermet Committees, ad to the Geeral Secretary. The retur sheets must iclude ames ad addresses. Failure to lodge required Brach or Electorate Coucil Aual Fiacial Returs to the NSW Brach Office may result i the Admiistrative Committee suspedig the charter of the Brach or Electorate Coucil. Braches ca oly be represeted o State or Federal Electorate Coucils or Local Govermet Committees if they have set i their retur sheets. As soo as the Electorate Coucils have give the Brach Secretary the details of the date, time ad place for omiatios ad the details of the Aual Geeral Meetig, he/she must tell the Brach delegates to each Electorate Coucil. If a delegate elected to represet a Brach, a Electorate Coucil or Local Govermet Committee is uable to perform a fuctio as a delegate, the Brach Secretary may appoit a alterate delegate elected by the Brach for the Coucil or Committee to exercise that fuctio. (ii) I every other way the Brach fiaces are to follow the Rules i Sectio K of this book. The Fudraisig Officer co-ordiates all Brach fudraisig. He/she should report to the Brach regularly. All moey raised must be give to the Treasurer see of this Rule. The Treasurer must esure that the Brach complies with requiremets of the Electio Fudig, Expediture ad Disclosures Act At the ed of each fiacial year, the Treasurer must provide the NSW Labor Office with a schedule ad details of all icome received ad expeses paid out by the Brach ad associated iformatio durig that fiacial year. Brach Records I.27 The Admiistrative Committee ca demad to see the books, documets, moey ad busiess records of ay Brach. If that happes the Brach Secretary must deliver the books, documets, moey ad busiess records to the Geeral Secretary of the NSW Brach. If a Brach Secretary igores or refuses to meet the Admiistrative Committee s request, the Geeral Secretary ca take proceedigs agaist him/her to obtai the books, documets, moey ad busiess records. As explaied i Sectio L of the Rules, all local Brach books, documets, moey ad other material belog to the NSW Brach of the Australia Labor Party. Policy Braches Cetral Policy Brach I.28 Brach Treasurer ad Brach Fudraisig Officer I.26 The Treasurer must keep accurate accouts of all Brach moey. No moey ca be withdraw from Brach fuds without the Treasurer s sigature ad he/she will oly sig after a Brach decisio. At the ed of the fiacial year the Treasurer must preset the Brach with a audited balace sheet ad statemet of icome ad expediture. From time to time $30 ca be voted for use as petty cash by the Secretary. The Cetral Policy Brach will meet mothly ad hold meetigs i both the Cetral Busiess District ad from time to time i other areas, icludig rural ad regioal areas. Each meetig shall focus o oe policy issue. The Cetral Policy Brach will ot be coducted i the same maer as existig local braches. Ope meetigs ad forums of Policy Committees, as well as Cetral Policy Brach forums, will be deemed meetigs of the Cetral Policy Brach ad a attedace book will exist for the Cetral Policy Brach. The purpose of the Cetral Policy Brach is to allow members who are iterested i policy developmet ad discussio, outside the 48

49 (f) (g) existig brach structures, to participate i Party affairs. A Cetral Policy Brach meetig is oly deemed to take place if a quorum is established i.e. if seve members are preset. If a quorum is ot established after 30 miutes the meetig is ot deemed to have take place. The quorum must be maitaied at all times durig the period i which the attedace book is ope for sigature. Ay member of the ALP (NSW Brach) ca apply to joi the Cetral Policy Brach. At the first meetig they atted they must complete a applicatio to joi the Brach ad must provide proof of their electoral erolmet to the Secretary as detailed i Rule I.7. A member trasferrig from ad/or to aother brach must comply with the provisios of Rule I.9. The Geeral Secretary will be the Secretary of the Cetral Policy Brach ad will appoit a Chairperso ad may appoit a actig Secretary for each meetig ad be resposible for the keepig of the Cetral Policy Brach attedace book. Policy Committees ca orgaise forums ad policy discussios that will be cosidered meetigs of the Cetral Policy Brach. The Cetral Policy Brach does ot hold a Aual Geeral Meetig, elect officer bearers, sed delegates to electorate coucils, keep miutes or have special meetigs. Members of Cetral Policy Brach may propose, secod, speak to, amed, adjour, vote o ad pass motios at Cetral Policy Brach pursuat to sectios 4 to 10 of Schedule I. Regioal Policy Braches (h) (j) A State Electorate Coucil or State Electorate Coucils may request that the Admiistrative Committee grat a charter for a Policy Brach i their area, so log as it would ot detract from existig Brach structures. The Admiistrative Committee may decide, at its discretio, to approve, alter or dey a request uder subsectio (h). The Admiistrative Committee may approve o more tha three Regioal Policy Braches uder this subsectio i the first twelve moths after it becomes operative. Regioal Policy Braches operate i the same way as the Cetral Policy Brach, except that oly Party members residig i the State (k) (l) Electorates requestig a charter may joi a Regioal Policy Brach. For the avoidace of doubt, subsectio (j) meas that members of Regioal Policy Braches are eligible to vote i local selectio ballots pursuat to Rule N.21(h). For the avoidace of doubt, subsectio (j) meas that Regioal Policy Braches may ot sed delegates to Electorate Coucils, as per Rule G.1(f). (m) A copy of the relevat pages of a Regioal Policy Brach s attedace book shall be forwarded to the NSW Brach Office withi seve days of each meetig. () The NSW Brach Office shall maitai a register of the iformatio provided uder subsectio (m). This register shall be available for ispectio by ay member of the Admiistrative Committee. Olie Policy Braches (o) (p) (q) (r) (s) (t) The Admiistrative Committee may grat a charter for a Olie Policy Brach. The Admiistrative Committee may grat o more tha oe charter for a Olie Policy Brach uder this subsectio i the first twelve moths after it becomes operative. The Olie Policy Brach will meet quarterly ad focus o oe policy issue. Except as provided for i this Rule, Olie Policy Braches operate i the same way as the Cetral Policy Brach. A member of a Olie Policy Brach may cocurretly be a member of a Brach i their local area, the Cetral Policy Brach, or a Regioal Policy Brach. Despite Rule N.21(h), members of Olie Policy Braches are ot eligible to vote i local selectio ballots i their capacity as a Olie Policy Brach member, but may be eligible if they are cocurretly a member of a Brach i their local area, the Cetral Policy Brach, or a Regioal Policy Brach. For the avoidace of doubt, subsectio (p) meas that Olie Policy Braches may ot sed delegates to Electorate Coucils, as per Rule G.1(f). The NSW Brach Office shall maitai a register of attedace for Olie Policy Braches. This register shall be available for ispectio by ay member of the Admiistrative Committee. 49

50 Labor Actio Committees I.29 OBJECTIVES Labor Actio Committees ( LACs ) have the followig objectives: CHARTER (f) To discuss ad develop policy o a defied subject, or affectig a defied demographic; (ii) To orgaise evets o a defied subject, or for a defied demographic; (iii) To commuicate ad egage with the commuity; ad (iv) To grow the Party. The Admiistrative Committee may grat a charter for a LAC where a group submits a valid LAC Applicatio. To be valid, a LAC Applicatio must cotai the followig iformatio: A statemet of the group s ame, objectives ad Rules; (ii) A declaratio siged by 30 fiacial Party members that the group accepts the Party Rules ad Platform; (iii) The ame of a patro from the State Parliametary Caucus; (iv) The ame of a patro from the Federal Parliametary Caucus; ad (v) The ames of the two Party Office Liaiso Officers required i I.29(h). To maitai its charter, a LAC must at all times have 30 members who are also fiacial Party members. The followig people are ot eligible for membership of a LAC: A perso who is a member of aother political party or oe of its affiliated orgaisatios (Coutry Labor does ot costitute aother political party for the purposes of this subsectio); or (ii) A perso who has bee expelled from the Party ad has ot bee readmitted as a member. The Party Office must maitai a register of the ames ad membership umbers of the members of each LAC. This register must be available for ispectio by a member of the Admiistrative Committee o request. The Admiistrative Committee may withdraw DUTIES (g) (h) POWERS (j) (k) (l) the charter of a LAC i a maer cosistet with Rule D.5. A LAC must be as iclusive as possible. A LAC must elect two Party Office Liaiso Officers aually accordig to the priciples of proportioal represetatio. A LAC must operate its fiaces i the same way as a brach uder the Rules. Subject to these Rules, Aual Coferece ad the Admiistrative Committee, a LAC may: Determie its ow structure; (ii) Determie how a perso becomes a member of the LAC; (iii) Adopt procedures to facilitate its busiess; (iv) Promote itself as beig associated with the Party; (v) Discuss ad develop policy o a defied subject, or affectig a defied demographic; (vi) Orgaise evets o a defied subject, or for a defied demographic; (vii) Request that its evets be publicised by the Party; (viii) Put motios directly to Aual Coferece, Coutry Labor Coferece, the NSW Policy Forum ad the Natioal Policy Forum; ad (ix) Request that the Admiistrative Committee approve a Membership Applicatio Form or a Membership Reewal Form with the LAC s bradig. If the Admiistrative Committee approves, a LAC may charge a membership fee. A LAC may ot: Sed delegates to electorate coucils; or (ii) Sed delegates to Aual Coferece or Coutry Labor Coferece. (m) A member of a LAC eed ot be a fiacial Party member, but a member of a LAC who is ot a fiacial Party member will ot cout towards the LAC s membership for the purposes of maitaiig its charter uder subsectio. 50

51 () A member of a LAC may cocurretly be a member of a brach i their local area, the Cetral Policy Brach, or a Regioal Policy Brach. SECTION J Tribuals (o) A member of a LAC is ot eligible to vote i local selectio ballots i their capacity as a member of the LAC, but may be eligible if they are cocurretly a member of a brach i their local area, the Cetral Policy Brach, or a Regioal Policy Brach. Ausla Brach Trial I.30 (f) The Admiistrative Committee may grat a charter for a Trial Ausla Laguage Brach followig a request siged by te (10) members. A Ausla Brach must meet at least oce per three moths. A meetig is oly deemed to take place if a quorum is established, i.e. if seve members are preset as per the requiremets of rule I.14. A Ausla Brach must elect a Brach Presidet, Secretary ad Treasurer i accordace with rules I.24 I.27, ad maitai a Brach Attedace Book to be maitaied as per I. 28. A Ausla Brach will ot be coducted i the same maer as existig local braches, but will be a ope forum to allow members to participate i Party affairs ad policy debate ad developmet i the Ausla laguage. A Ausla Brach is ope for membership to all members of the NSW Labor Party. A member of a Ausla Brach may cocurretly be a member of their local brach, the Cetral Policy Brach or a Regioal Policy Brach. Attedace at a Ausla Laguage Brach will ot cout towards meetig attedace requiremets for public selectio ballots. Right of appeal J.1 A Party member, Party Uit or Affiliated Uio may appeal decisios made by Party Uits or the coduct of Party members to the Iteral Appeals Tribual ad Review Tribual. A appeal to the Iteral Appeals Tribual or Review Tribual is oly valid if it: is addressed to the Secretary as per Rule J.11 ; (ii) Is provided i writig; (iii) States the grouds for the appeal uder the Rules; ad (iv) Provides evidece to substatiate the claim. Subject to these Rules ad Aual Coferece, the Iteral Appeals Tribual ad Review Tribual may determie the form ad maer i which appeals must be made. Jurisdictio J.2 The Iteral Appeals Tribual has jurisdictio to hear: Appeals regardig the list of voters for a ballot; (ii) Appeals regardig the coduct of a ballot; (iii) Appeals regardig credetials for ay Coferece uder these Rules; (iv) Appeals agaist decisios made by a meetig of the Party Officers; (v) Appeals agaist decisios made by the Admiistrative Committee; (vi) Matters referred to it by the Admiistrative Committee; (vii) Matters referred to it by the Ombudsma; (viii) Matters regardig a alleged breach of these Rules; (ix) Applicatios for cotiuity of membership; ad (x) Applicatios for re-admissio to membership. 51

52 A appeal to the Iteral Appeals Tribual agaist a decisio made by the Party Officers or Admiistrative Committee must be lodged withi two caledar moths of the decisio. The Review Tribual has jurisdictio to hear: Appeals agaist decisios made by the Iteral Appeals Tribual; ad (ii) Matters referred to it by the Admiistrative Committee. A appeal to the Review Tribual agaist a decisio made by the Iteral Appeals Tribual must be lodged withi fourtee days of the decisio. Members J.3 ELECTION The Iteral Appeals Tribual ad Review Tribual each cosist of: A Chair; (ii) A Deputy Chair; (iii) Three members; ad (iv) Three associate members. The positios i subsectio must be elected by a three-quarters majority vote of the Admiistrative Committee. A perso elected to a positio i subsectio holds office for two years. J.4 ELIGIBILITY To be eligible for electio ad to remai i office as a Chair or Deputy Chair of the Review Tribual, a perso must: Not hold public office; (ii) Not be actively seekig electio or appoitmet to public office; (iii) Be admitted as a lawyer i the state of New South Wales; (iv) Be a Quee s Cousel, Seior Cousel, parter at a law firm, or retired judge; ad (v) Be of good fame ad character. To be eligible for electio ad to remai i office as a Chair or Deputy Chair of the Iteral Appeals Tribual, a perso must: Be a fiacial Party member; (ii) Not hold public office; (iii) Not be actively seekig electio or appoitmet to public office; (iv) Be admitted as a lawyer i the state of New South Wales; ad (v) Be of good fame ad character. To be eligible for electio ad to remai i office as a member or associate member of the Iteral Appeals Tribual or Review Tribual, a perso must: Be a fiacial Party member; (ii) Not hold public office; (iii) Not be actively seekig electio or appoitmet to public office; (iv) Be admitted as a lawyer i the state of New South Wales or possess other relevat skills or experiece; ad (v) Be of good fame ad character. A perso who holds a positio o the Review Tribual must ot hold a positio o the Iteral Appeals Tribual. J.5 AFFIRMATIVE ACTION At least oe third of Iteral Appeals Tribual ad Review Tribual members must be wome. At least oe third of Iteral Appeals Tribual ad Review Tribual associate members must be wome. J.6 ROLE OF ASSOCIATE MEMBERS Iability to atted If a member of the Iteral Appeals Tribual or Review Tribual is uable to atted all or part of a meetig, they may appoit a associate member to replace them. (ii) If a Chair or Deputy Chair of the Iteral Appeals Tribual or Review Tribual is uable to atted all or part of a meetig, they may ot appoit a associate member to replace them. (iii) A associate member appoited uder subsectio has the full rights of the member whom they are replacig for that meetig or part of that meetig. Coflict of iterest If a Chair, Deputy Chair or member of the Iteral Appeals Tribual or Review Tribual is directly ivolved i ay matter beig cosidered by the Tribual, they must ot participate i the meetig whe that matter is beig cosidered or vote o that matter. 52

53 Powers (ii) If a member of the Iteral Appeals Tribual or Review Tribual is directly ivolved i ay matter beig cosidered by the Tribual, they may appoit a associate member to replace them for that matter oly. (iii) If both the Chair ad Deputy Chair of the Iteral Appeals Tribual or Review Tribual are directly ivolved i ay matter beig cosidered by the Tribual, they may appoit a associate member to replace them for that matter oly, but ot otherwise. (iv) A associate member appoited uder subsectio (ii) or (iii) has the full rights of the member whom they are replacig for that matter oly. A associate member of the Iteral Appeals Tribual or Review Tribual is ot etitled to participate i a meetig or vote uless they have bee appoited to replace a Chair, Deputy Chair or member of the Iteral Appeals Tribual or Review Tribual uder subsectios or. J.7 PARTY MEMBERS TO PROVIDE INFORMATION ETC The Iteral Appeals Tribual ad Review Tribual may require ay Party member to provide: A statemet of iformatio; or (ii) Ay documet or other thig that the Tribual cosiders relevat to a matter it is hearig. A request made uder subsectio must: Be provided i writig; (ii) Describe the iformatio, documet or thig required; ad (iii) Specify a time ad place for compliace. J.8 MAY MAKE DECISIONS OR DISMISS PROCEEDINGS The Iteral Appeals Tribual ad Review Tribual may make decisios o matters referred to them uder these Rules. I makig a decisio o a matter referred to them uder these Rules, the Iteral Appeals Tribual ad Review Tribual may make ay order or determiatio that they cosider appropriate i the circumstaces. (ii) I makig a decisio o a matter before it the Tribuals shall give primacy to the broader iterests of the party. The Iteral Appeals Tribual ad Review Tribual may dismiss proceedigs at ay time if they cosider that: The appeal is frivolous, vexatious or ot i good faith; or (ii) The subject matter of the appeal is trivial; or (iii) The decisio or coduct uder appeal occurred at too remote a time to justify a hearig; or (iv) The appellat has o iterest or isufficiet iterest i the decisio or coduct uder appeal. I ay proceedigs before them, the Iteral Appeals Tribual ad Review Tribual must act accordig to the substatial merits of the case without regard to techicalities or legal forms. The Iteral Appeals Tribual ad Review Tribual may advise the Admiistrative Committee o ways to improve the Party s Rules ad procedures. J.9 WRITTEN REASONS The Iteral Appeals Tribual ad Review Tribual must provide writte reasos for their decisios. The Iteral Appeals Tribual ad Review Tribual must report their decisios ad reasos to the: Appellat, withi fourtee days of the decisio; (ii) Respodet, withi fourtee days of the decisio; (iii) Next subsequet Admiistrative Committee meetig; ad (iv) Next subsequet Aual Coferece. The Iteral Appeals Tribual ad Review Tribual s decisios ad reasos must be available for ay fiacial Party member to ispect durig office hours. J.10 ANNUAL CONFERENCE MAY OVERRULE Except as provided i subsectio, decisios made by the Review Tribual are fial. Aual Coferece may overrule decisios made by the Review Tribual. 53

54 Procedures J.11 MEETINGS Quorum A meetig may take place oly whe a majority of members, icludig the Chair or Deputy Chair, are preset. (ii) If a majority of members are ot preset after thirty miutes, the meetig must ot take place. Guidelies for coduct of appeals J.14 THE INTERNAL APPEALS TRIBUNAL AND THE REVIEW TRIBUNAL: must prescribe guidelies for the coduct of appeals, icludig the gratig of leave by the Tribual to hear appeals, ad make these guidelies available to all Party members; ad, may otherwise regulate its ow procedure; subject to these rules ad the Aual Coferece. Secretary The Geeral Secretary provides a Secretary for the Iteral Appeals Tribual ad Review Tribual. (ii) The Secretary is ot etitled to vote. (iii) The Secretary must ot be couted for the purposes of quorum uder subsectio. J.12 EVIDENCE All evidece must be made available to the appellat ad respodet o less tha twety four hours before a hearig of their case. Ay evidece ot made available i accordace with subsectio is iadmissible. The Iteral Appeals Tribual ad Review Tribual are ot boud by the rules of evidece. J.13 RIGHTS AND RESPONSIBILITIES OF THE PARTIES The appellat ad respodet have the right to: Appear at ay hearig of their case; (ii) Have their case heard expeditiously; (ii) Provide a statemet of iformatio; (iv) Questio witesses; (v) Preset evidece; ad (vi) Procedural fairess. 55 SECTION K Fiace, Property ad Fuds K.1 All property, icludig fuds, books, furiture, equipmet ad other assets of the NSW Brach of the Australia Labor Party, is held i the ames of three Trustees. The Trustees are elected as i Rule B.6 ad have the power to take legal actio to recover all or ay property of the NSW Brach. K.2 After they have bee elected the Trustees hold assets ad property o behalf of the NSW Brach. NSW Brach moies are baked i the ames of the Trustees. NSW Brach moies are to be used for political, idustrial ad local govermet work ad the efficiet ruig of the Party offices. A paymet exceedig the sum of $1000 may oly be made from the bak by: a cheque siged by oe or more of the Trustees ad also siged by the Geeral Secretary; or (ii) a electroic trasfer of fuds specifically approved by oe or more of the Trustees ad by the Geeral Secretary. A paymet ot exceedig the sum of $1000 may be made from the bak: by a cheque siged by the Geeral Secretary ad oe Assistat Geeral Secretary or; (ii) a electroic trasfer of fuds approved by the Geeral Secretary ad oe Assistat Geeral Secretary. Moey caot be withdraw from the bak except by cheque or electroic trasfer i accordace with this Rule. K.4 The Brach Presidet must agree to all amouts ad bills before they are paid. K.5 If for ay reaso a Brach, Coucil or Local Govermet Committee ceases to exist all fuds, books, documets ad other materials become the property of the NSW Brach of the Australia Labor Party. K.6 Lad owed by the Party or ay of its Braches should be held i the ames of three Trustees. For example, i the case of Braches, Coucils ad Local Govermet Committees the three could be the Presidet, oe of the Vice- Presidets ad the Secretary. The Trustees hold the lad o trust as directed by the Admiistrative Committee. Ay Trustee of the NSW Brach ca be removed by a motio passed at a Aual or Special Coferece. If oe or more of the Trustees resigs, is removed or dies, the Admiistrative Committee ca omiate a ew Trustee or Trustees. A special meetig of the majority of the Admiistrative Committee will be held to take the decisio. Uder Sectio 6(4) of the 1925 Trustee Act 55

56 the Chair of the Admiistrative Committee meetig has to omiate the ew Trustee or Trustees. The Chair appoits by deed the ew Trustee or Trustees. The 1925 Trustee Act applies to these appoitmets. K.7 All moey must be baked or ivested i the ame of the Australia Labor Party ad the Party Uit i questio. K.8 Oly the Presidet, Vice-Presidets, Secretary, Assistat Secretary, Treasurer or Secretary- Treasurer ca: ope a bak accout; make a bak deposit; ad buy ay securities (ivestmets). K.9 Moey is ot to be deposited i the private bak accouts of officials or members. K.10 Whe Party moey is ot beig used it must be baked or ivested as follows: Deposited o ay coditio with fiacial istitutios or trusts recommeded by the Fiace ad Compliace Committee ad approved by the Admiistrative Committee. Ivested i securities or loas issued by the Australia or NSW Govermets ad semigovermet authorities which are guarateed by the Australia or NSW Govermets. Examples of semi-govermet authorities are Australia Post, Elcom ad Telstra. K.11 Moey ca oly be withdraw from a bak accout or a ivestmet after a Party Uit has passed a resolutio decidig to do so. Resolutios to sped fuds must be either: moved by a member of the Brach Executive; or Where a Brach or Electorate Coucil has a accout with a fiacial istitutio or trust that is ot approved by the Admiistrative Committee, that Brach will be give thirty days to trasfer all fuds to a accout with a approved fiacial istitutio or trust. Failure to bak or ivest with a approved fiacial istitutio or trust may result i the Admiistrative Committee suspedig the charter of the Brach or Electorate Coucil. moved o otice i accordace with the Stadig Orders i Schedule H10. K.12 Whe a bak accout has bee opeed the Secretary must iform the Geeral Secretary. The Secretary must also provide the Geeral Secretary with the ames, titles ad specime sigatures of the members authorised to ru the accout. K.13 Whe moey is to be withdraw from a bak accout it should be doe as follows: K.14 The ame of the Party Uit must be clearly writte o the cheque. Cheques must be siged by ay two Brach Officials actig as trustee of the fuds, but oe of them must be Treasurer or Secretary- Treasurer. Authority forms ad specime sigatures (examples of the perso s sigature) must be give to the bak. This is ecessary whe a umber of people ca sig cheques. After aual Party Uit electios the people who ca sig cheques or documets may chage. The ew specime sigatures must be set to the bak or istitutio where moey is deposited or ivested. The Party Rules isist that Rules K.13, ad are strictly followed. All Party Uit books ad vouchers (these are the documets which explai how moey was spet) must be audited each year. (A audit is a official check of statemets of accouts made by a perso or persos appoited by the Party Uit to do so). The auditors must make a report to a meetig of their Party Uit ad a copy of the report must be set to the NSW Brach Office. The fiacial year for the books of Party Uits rus to 30 Jue. The books are to be made up to that date. By 31 July each year all Party Uits must sed the Admiistrative Committee a copy of the audited balace sheet ad a statemet of icome ad expediture for the previous year which eded o 30 Jue. This iformatio will be used by the NSW Brach to prepare a cosolidated Aual Retur for the Australia Electoral Commissio ad the Party s aual icome taxatio retur. K.15 Secretaries of Party Uits are resposible for keepig Party records safe. All books, documets, letters, reports ad records of ay kid, whether they are writte, audio or visual, belog to the NSW Brach. Secretaries 56

57 K.16 of Party Uits must keep all records i a safe place ad make sure they remai i good coditio. Secretaries must ot get rid of records. Whe a ew member becomes Secretary all records must be haded over to him/her. A Party Uit ca decide to place its old records (those ot curretly i use) i the archives sectio of the State Library of New South Wales. If a Party Uit decides to do this it must iform the Geeral Secretary ad sed the records to the NSW Brach office. A cetral register is kept of such records i the NSW Brach office. A report will be give to the Admiistrative Committee ad, if they agree, the records will be set to the State Library. Oly Party Uits have the authority to use the ame of the Australia Labor Party whe eterig ito fiacial commitmets. These fiacial commitmets should be recorded i a resolutio of the Party Uit cocered. Clause below is a exceptio to this Rule. Whe expediture or budgets have bee decided o by Party Uit Campaig Committees, the expediture or budgets should be approved by that Party Uit or its executive withi two weeks. The Geeral Secretary, or someoe amed by the Geeral Secretary, ca sped moey i the ame of the Australia Labor Party (New South Wales Brach). A perso show to have spet moey i the ame of the Australia Labor Party (New South Wales Brach) without the authority (permissio) described i this clause, ca be suspeded or expelled from the Party at a meetig of the Admiistrative Committee. The perso accused of uauthorised spedig must have fourtee days otice i writig of this meetig, ad be told exactly what the charge or charges are. Such members ca appeal to the Review Tribual. Ay member suspeded i this way will ot have the right to take part i Brach activities durig the time he/she is suspeded. Rule A.33(g) will apply to members suspeded uder this Rule. Not-for-profit Clause K.18. The assets ad icome of the Party shall be applied solely i furtherace of the Party objective set out i Sectio A ad o portio shall be distributed directly or idirectly to the members of the Party except as boa fide compesatio for services redered or expeses icurred o behalf of the orgaisatio. Dissolutio Clause K.19 I the evet of the Party beig dissolved, the amout that remais after such dissolutio ad the satisfactio of all debts ad liabilities shall be trasferred to aother orgaisatio with purposes similar to those i the Party objective set out i Sectio A, which is ot carried o for the profit or gai of its idividual members. K.17. Party Uits ad campaigs must obtai the approval of the Geeral Secretary for ay raffles, guessig competitios or similar fudraisig vetures offerig a prize, the value of which is greater tha $

58 SECTION L Party Joural L.1 There shall be a Party joural called the Political Briefig which shall be the official joural of the Party. L.2 The Political Briefig shall be issued at least oce i the period betwee each meetig of the Admiistrative Committee. L.3 The Political Briefig will be posted to each Party uit ad shall be ed to each member for whom the Party has a valid address. L.4 The Political Briefig will cotai matters cosidered relevat by the Admiistrative Committee, icludig otices of meetigs of Aual Coferece ad Regioal Assemblies ad other matters required to be otified i the Party joural by these rules. L.5 The Geeral Secretary shall set a closig date for Party uits to submit items for iclusio i the Party joural. This ca be a regular date. The Geeral Secretary shall advise Party uits of whe items eed to be submitted for iclusio i the ext editio of the Party joural. Home Page / Website L.6 The NSW Brach is the oly Party etity to have the right to establish a official home page, website or blog represetig the Party. Other Party Uits or groups of members may establish a home page, website or blog but this shall ot purport to represet the NSW Brach of the Party. Other Party Uits or groups of members may establish websites, home pages, Facebook groups, blogs or other such similar social media sites o the followig coditios: That they are authorised by a idividual or icorporated orgaisatio; ad (ii) That they display the followig disclaimer: This site ad the cotet cotaied herei does ot represet the views policies or opiios of the Australia Labor Party (NSW Brach). SECTION M Party Electios RETURNING OFFICERS M.1 The Aual Coferece will elect a Geeral Returig Officer. The Aual Coferece will elect eight Assistat Geeral Returig Officers to: Assist the Geeral Returig Officer; ad (ii) Udertake other duties as directed by the Admiistrative Committee or Geeral Secretary. The term of office for the Geeral Returig Officer ad Assistat Geeral Returig Officers will be four (4) years. M.2 The powers ad duties of the Geeral Returig Officer are: To coduct all electios at Aual Coferece (where the retirig Geeral Returig Officer is agai stadig for the office of Geeral Returig Officer the the cout ad the declaratio for that positio will be udertake by a Assistat Geeral Returig Officer appoited by the Geeral Secretary). (ii) To give geeral advice to Party Uits o how to ru electios. (iii) To report to Aual Coferece o matters which relate to how electios are ru. (iv) To orgaise other ballots decided o by the Admiistrative Committee. (v) To atted meetigs of the Rules Committee with the same right as a committee member, but he/she caot vote. ALTERNATES M.3 Alterates will be elected whe omiatios are called for the followig positios: M.4 Membership delegates to Aual Coferece; ad (ii) Uio delegates to Aual Coferece. The ordiary members of the followig committees are the alterate delegates to Aual Coferece for the Chair, Deputy Chair 58

SECRET BALLOTS M.5 Where practicable electios should take place i a pollig room or part of a room set aside for this. Where practicable the pollig room should have separate votig compartmets so that voters caot be watched while they are markig their ballot papers. A cadidate caot take part i the ruig of a electio i ay way, ad obody will be allowed to come ito or stay i the pollig room durig the pollig except with the returig officer s permissio. The exceptios to this are the Geeral Returig Officer, the Assistat Geeral Returig Officers ad members votig or about to vote. Voters caot leave the pollig room or the part of the room set aside for pollig durig the time betwee receivig ad depositig their ballot papers. VOTING SYSTEMS M.6 Electios at Aual Coferece ad NSW Youg Labor Aual Coferece, Electios for the Leader of the NSW Parliametary Party, ad direct electios uder Rule M.9, must take place i accordace with Schedule H. All other electios, icludig (without limitig the geerality of the foregoig) those at Braches, Electorate Coucils, Local Govermet Committees, Youg Labor Associatios, Regioal Assemblies, selectio ballots (other tha at Aual Coferece) ad Admiistrative Committee ballots must take place i accordace with Schedule H. AFFIRMATIVE ACTION M.7 The ALP is committed to me ad wome i the Party workig i equal partership. It is our objective to have at least 50 per of Party orgaisatio ad public office positios held by wome. To achieve this from 1 July 2016, the Party adopts the affirmative actio model i this rule: Miimum percetage I this clause, miimum percetage meas 40%. From 2022 it meas 45%; ad from 2025 it meas 50%. Party positios For all Party ad office bearer positios (other tha public office preselectios ad party employees), appoited or elected o a statewide basis, where 3 or more positios are to be elected or appoited, at least the miimum percetage of the positios must be filled by wome. (ii) For all Electorate Coucil Executive positios listed i G.5(f), at least the miimum percetage of the total positios must be filled by wome. (iii) For all NSW Aual Coferece Delegates ad Alterate Delegates, ad Coutry Coferece Delegates ad Alterate Delegates, at least the miimum percetage of positios elected together, must be filled by wome. (iv) For all Brach delegates elected to Electorate Coucils, at least the miimum percetage of the positios must be filled by wome. Uio delegatios For all uio delegatios to Party cofereces ad forums, at least the miimum percetage of the delegates must be wome, uless the proportio of wome who are members of the uio is less tha the miimum percetage, i which case the umber of delegates who are wome must be at least equal to that proportio. Public office preselectios For all public office preselectios, at least the miimum percetage of the cadidates preselected for each of the followig groups of seats must be wome: the seats curretly held by the ALP, (ii) the seats that would be wo by the ALP with a 5% icrease i its two party preferred vote sice the last electio ( wiable seats ), ad (iii) all other seats to be preselected. For the purposes of paragraph, the relevat seats shall be cosidered i each of 59

60 (f) (g) (h) (j) (k) the followig separate groups: The seats curretly held by the ALP. This must be implemeted over three preselectio cycles. (ii) The wiable seats ot held by the ALP as defied by those that received a two party preferred vote betwee 45% ad 49.99% at the last electio. (iii) The Admiistrative Committee must declare the wiable seats for each preselectio before omiatios for preselectio ope. (iv) All other seats to be preselected. Upper ad lower house seats shall be grouped together for the purpose of subsectio. For casual vacacies i the Seate ad the House of Represetatives, if less tha the miimum percetage of the remaiig positios are held by wome, the vacacy must be filled by a woma. For casual vacacies i the Legislative Coucil ad the Legislative Assembly, if less tha the miimum percetage of the remaiig positios are held by wome, the vacacy must be filled by a woma. If at the close of omiatios for a preselectio for a group of seats or positios the requiremets of paragraphs - (h) caot be met, omiatios for that group of seats or positios must be reopeed. If after a ballot for a preselectio for a group of seats or positios the requiremets of paragraphs (h) are ot met, omiatios for that group of seats or positios must be reopeed ad a fresh ballot (if ecessary) coducted. I calculatig the miimum percetage for the purposes of this clause, a fractio of oehalf or more must be rouded up to the ext whole umber, ad a fractio of less tha oehalf must be rouded dow to the ext whole umber. (l) The Geeral Secretary must o later tha 1 November each year provide a report to its Admiistrative Committee ad to the Natioal Executive o the progress of implemetatio of this clause. (m) It is the fuctio of the Admiistrative Committee to esure that the NSW Brach is i a positio to fully comply with above. This meas that the Admiistrative () Committee may, i co-operatio with local Party members, determie the outcome i ay public office preselectio progressively betwee ow ad the year 2023 to esure that the NSW Brach will be i full compliace with Rule M.7. I (m) above, co-operatio with local Party Members meas the Party s cadidate is selected by a ballot i which members of the Admiistrative Committee ad, where practicable, the local electorate coucil are the eligible voters. The votes cast by members of the Admiistrative Committee ad the local electorate coucil will be proportioately adjusted by the Returig Officer, such that the total votes cast by those two groups are equal. RETURNING OFFICER DELEGATION M.8 M.9 The Returig Officer of a Party-Uit may delegate to his/her Deputy Returig Officer ay of the fuctios coferred or imposed o the Returig Officer by or uder these Rules (other tha this power of delegatio). The Geeral Returig Officer may delegate ay of the fuctios coferred or imposed o the Geeral Returig Officer by or uder these Rules (other tha this power of delegatio) to: oe or more of the Assistat Geeral Returig Officers; or (ii) a Deputy Returig Officer for a selectio ballot Where the Rules expressly provide, a Electorate Coucil may decide to elect positios pursuat to the provisios of this Rule. Except as provided for i this Rule, the provisios of Sectio G goverig electios i Electorate Coucils shall apply to electios uder this Rule. A perso is eligible to vote i a ballot uder this Rule if they: Live i the electorate; ad (ii) Have oe year of cotiuous fiacial membership immediately prior to the date of callig for omiatios. For the electio of delegates from a 60

61 (f) (g) (h) (j) (k) (l) Federal Electorate Coucil to the Natioal Coferece, omiatios will ope at a time ad date determied by the Admiistrative Committee; ad (ii) For all other electios coducted uder this rule, omiatios will ope o later tha fourtee days after the AGM of the electorate coucil, or as decided otherwise by the Admiistrative Committee. Nomiatios will close o sooer tha seve days after they opeed. Where a ballot is required, it will be coducted by the Geeral Returig Officer or a perso to whom they delegate the resposibility. The perso to whom they delegate eed ot be a perso specified i Rule M.8. The Returig Officer will provide cadidates with a list of eligible voters ot less tha seve days before votig opes. Votig will remai ope for o less tha three weeks. A cadidates forum may be held cosistet with the provisios relatig to Public Office Selectio Forums i Sectio N. The Returig Officer will arrage for the ballot papers to be couted i the presece of scrutieers appoited by the cadidates, if there are ay. The Admiistrative Committee may determie ay other matters required for coductig a ballot. The Returig Officer will iform the Geeral Secretary of the result of the ballot. SECTION N Edorsemets ad Selectios for Public Office N.1 SENATE N.2 The Admiistrative Committee is resposible for arragig the selectio of cadidates, icludig Coutry Labor cadidates, throughout New South Wales for the House of Represetatives, the Legislative Assembly ad Local Govermet. Nomiatios will be called at least oe year before a Geeral Electio is expected, uless there are exceptioal circumstaces that justify actig otherwise. If ecessary, for example, if there is a redistributio of electorates, omiatios ca be reopeed ad the Admiistrative Committee shall call for fresh omiatios. Nomiatios for public office ca be called over differet periods if the Admiistrative Committee agrees that it is i the Party s best iterest. A eligible member ca omiate for more tha oe electorate i Lower House selectio ballots as log as the Admiistrative Committee agrees. The first three Seate cadidates will be selected by Aual Coferece followig Schedule G (at the ed of this book). Seate Cadidates for additioal positios may be appoited by the Admiistrative Committee subsequet to the selectio referred to i above. LEGISLATIVE COUNCIL N.3 The Admiistrative Committee will call for omiatios to the Legislative Coucil at least six moths before the electio date of each ew pael of twety oe members. After edorsemet Aual Coferece will select the cadidates usig Schedule F. Legislative Coucil cadidates for positios cosidered by the Admiistrative Committee to be uwiable may be appoited by the Admiistrative Committee subsequet to the selectio referred to i above. 61

62 CASUAL VACANCIES N.4 Uder certai circumstaces the Admiistrative Committee ca orgaise selectio ballots. These circumstaces iclude: by-electios; whe the call for omiatios has failed; ad whe the cadidates are ot approved. At the request of the local Party Uit, the Admiistrative Committee ca select a cadidate if there is o time to hold a selectio ballot. The Admiistrative Committee ca make a selectio if the local Party Uits do ot act. SELECTION PROCEDURES N.5 All selectios remai i force, subject to the Rules, util the electio for which the selectio was made. N.6 If a geeral electio for Federal or State Parliamet occurs withi twelve moths of the previous electio, the sittig Member of Parliamet will be the cadidate. I this case, cadidates must be re-edorsed by the Admiistrative Committee. AFFIRMATIVE ACTION N.7 Util the Admiistrative Committee certifies that the NSW Brach has achieved the miimum affirmative actio target set out i Sectio M, i ay lower house selectio ballot, primary votes for or prefereces distributed to wome cadidates i ballots must be weighted by a factor of 20% (i.e. valued at 1.2). This weightig does ot apply i ballots where cotested by cotiuig male Labor member of parliamet uless that member is excluded durig the course of the cout. N.8 Util the Admiistrative Committee certifies that the NSW Brach has achieved the miimum affirmative actio target set out i Sectio M at a local govermet level, i ay local govermet selectio ballot for coucillors or a popularly elected mayor, primary votes for or prefereces distributed to wome cadidates i ballots must be weighted by a factor of 20% (i.e. valued at 1.2). CALLING OF NOMINATIONS N.9 There are two ways to call for omiatios. Either a advertisemet must be placed i a local ewspaper or a circular set to members. I both cases there must be: at least seve days otice of the date that omiatios close; ad a clear statemet of whe, where ad at what time omiatios will be received. These advertisemets or circulars must also state that omiatios will be accepted by the Geeral Returig Officer at the NSW Brach Office. Immediately after omiatios close, all omiatios will be give to the Admiistrative Committee for their edorsemet or otherwise. N.10 Members whose omiatios are received at the NSW Brach Office will be give a receipt. This receipt is a detachable part of the omiatio form. Cadidates for Selectio ELIGIBILITY N.11 To be eligible for selectio ad edorsemet as a cadidate for public office, a perso must: (f) (g) Have oe year of cotiuous fiacial Party membership immediately prior to the date of callig for omiatios; Be a fiacial member of a trade uio, if eligible; Be omiated i writig by five people, each of whom: Has oe year of cotiuous fiacial Party membership immediately prior to the date of callig for omiatios; ad (ii) Lives i the electorate or ward for which the omiee is omiatig. Sig declaratios statig that they accept the: Nomiatio; (ii) Public Office Cadidates Pledge i Schedule D2; ad (iii) Pledge o Campaig Fuds i Schedule D3 Submit their omiatio to the Returig Officer o the official form i Schedule C before the close of omiatios; Pay the omiatio fee before the close of omiatios; Be eligible to omiate as a cadidate uder the relevat electoral laws; 62

EXCEPTIONS N.12 Despite Rule N.11, a perso must have bee a fiacial Party member for at least five years prior to the opeig of omiatios to be eligible for selectio ad edorsemet as a cadidate for public office if they have bee readmitted to the Party after beig expelled for: Opposig a Labor cadidate; or (ii) Not votig for a Labor cadidate; or (iii) Not votig i lie with a caucus decisio. The Admiistrative Committee may waive the requiremets uder Rules N.11, N.11, N.12 ad N.13 if they cosider that allowig the perso to cotest the selectio ballot would be a sigificat beefit for the Party. I a local govermet selectio ballot, the Admiistrative Committee may decide that a omiator eed oly live i the local govermet area for which the omiee is omiatig for the purposes of Rule N.11(ii) if there are less tha te people who would otherwise satisfy Rule N.11. The Admiistrative Committee may waive the requiremet to pay a omiatio fee uder Rule N.11(f) if they cosider that doig so would be i the best iterests of the Party. PROOF OF ELIGIBILITY N.13 Except as provided i this Rule, it is the Geeral Returig Officer s resposibility to determie whether a perso is eligible for selectio ad edorsemet as a cadidate for public office i accordace with Rules N.11 ad N.12. Nomiee uio membership A omiee must before the close of omiatios: Provide proof that they satisfy Rule N.11; or (ii) Sig a declaratio statig that they are ot eligible to be a member of a trade uio, ad the grouds o which they are ot eligible. Nomiee eligibility uder relevat electoral laws A omiee must provide proof that they satisfy Rule N.11(g) before the close of omiatios. (ii) The Admiistrative Committee may establish the form of proof required to satisfy Rule N.11(g). The ous is o the omiee to demostrate that they satisfy Rules N.11 ad N.11(g) i accordace with this Rule. The ous is o the omiee to provide the documetatio ad pay the fee required uder Rules N.11, ad (f). CANDIDATE DISCLOSURE N.14 Statemet of itet A omiee for public office must submit a statemet as to why they wat to represet the Party. (ii) All statemets submitted uder subsectio must be disclosed to the Admiistrative Committee, the Cadidate Review Committee, selectio voters ad the public. Refereces A omiee for public office must submit two writte character refereces. (ii) All refereces submitted uder subsectio must be disclosed to the Admiistrative Committee, the Cadidate Review Committee ad selectio voters. Matters of itegrity A omiee for public office who is ot curretly a Member of Parliamet must disclose matters relatig to their itegrity. (ii) The Admiistrative Committee may determie what matters relate to itegrity for the purposes of subsectio. (iii) A omiee for public office must be afforded the opportuity to explai the circumstaces surroudig ay disclosure uder subsectio. (iv) All refereces submitted uder subsectio must be disclosed to the Admiistrative Committee ad the Cadidate Review Committee. Disclosures by omiees for public office uder this Rule are to be made i the form ad maer determied by the Admiistrative Committee. 63

64 CANDIDATE REVIEW COMMITTEE N.15 The Cadidate Review Committee cosiders the suitability of omiees for public office referred to it by the Admiistrative Committee or the Party Officers. The Cadidate Review Committee has three members elected by a two-thirds majority of the Admiistrative Committee accordig to the priciples of proportioal represetatio. A member of the Cadidate Review Committee must be a perso who: Has represeted the Party i public office; (ii) Is retired from public office; ad (iii) Is of good fame ad character. Despite ay other provisio of these Rules, a member of the Cadidate Review Committee is ot eligible for selectio ad edorsemet as a cadidate for public office. WITHDRAWAL OF CANDIDATURE N.16 proper perso for public office; or (iii) The omiee or cadidate s past behaviour makes them uworthy of cofidece. A decisio by the Admiistrative Committee uder subsectio must be passed by a three-quarters majority. N.17 The Admiistrative Committee ca withdraw ay cadidates from a pre-selectio, ca refuse their edorsemet or withdraw their edorsemet if they cosider: he/she is ot fit for the positio; or the member s past career makes them uworthy of cofidece. N.18 After a cadidate is edorsed by the Admiistrative Committee, he/she caot withdraw uless it is foud that he/she is ot qualified accordig to the Party Rules or it is agreed by the Admiistrative Committee. N.19 A cadidate caot take ay official part i the selectio process other tha votig. Breakig this Rule may mea disqualificatio. The Cadidate Review Committee may recommed that the Admiistrative Committee withdraw a omiee for public office from a selectio ballot, refuse edorsemet to a omiee for public office, or withdraw edorsemet from a cadidate for public office if it cosiders that: The omiee or cadidate would brig the Party ito disrepute; or (ii) The omiee or cadidate is ot a fit ad proper perso for public office; or (iii) The omiee or cadidate s past behaviour makes them uworthy of cofidece. A decisio by the Cadidate Review Committee uder subsectio must be passed uaimously. If the Cadidate Review Committee makes a recommedatio uder subsectio, the Admiistrative Committee may withdraw the omiee for public office from the selectio ballot, refuse edorsemet to the omiee for public office, or withdraw edorsemet from the cadidate for public office if it cosiders that: The omiee or cadidate would brig the Party ito disrepute; or (ii) The omiee or cadidate is ot a fit ad Selectio Ballots ad Cadidate Forums N.20 I a cotested selectio ballot for public office all affected Braches which meet betwee the close of omiatios ad the day of the selectio ballot must hold a cadidates forum at their meetig. (ii) The cadidates forum must, as far as practicable, be the first item of busiess after the omiatio ad acceptace of ew members. (iii) All cadidates must be ivited to address the forum, may be asked to aswer questios ad must be give approximately equal time. (iv) Outside of the official Brach cadidates forums, persos who have declared themselves to be cadidates (whether omiatios have closed or ot) for a public office selectio ballot may address Brach or Uio meetigs, provided that all cadidates are give the same opportuity. Such cadidates, ad Party members who support them, ca cavass for further support. However, cadidates are ot allowed to 64

65 employ, directly or idirectly, agets to campaig o their behalf, or ca they, or their supporters, make persoal commets about other cadidates. Failure to comply with the provisios of this Rule may result i a cadidate beig excluded from cotestig the preselectio. SELECTION VOTERS (ELIGIBILITY TO VOTE IN SELECTION BALLOTS) N.21 I order to vote i a local selectio ballot a Brach member must: Live i the electorate; (ii) Be correctly erolled with the Australia Electoral Commissio to vote i a federal electio. The member s address for the purposes of preselectio will be their erolled address. (iii) If a member challeges the right of aother member to vote i the ballot (see Rule A.38) he/she must produce firm evidece that the member does ot live at the address claimed. (iv) Ay iformatio produced for the Iteral Appeals Tribual must be publicly available. Aecdotes will oly be accepted if they are i the form of a statutory declaratio. The member beig challeged ca produce ay evidece to support his/her claim that he/ she lives i the electorate. If a member has paid the wrog Party membership fee, give his/her uio membership, the he/she will be give five workig days from the date of credetialig to joi the uio or pay outstadig dues. I order to vote i a local selectio ballot: a member must have bee a member of a brach for ot less tha two years prior to the date of callig for omiatios, the brach attedace book must show that the member has atteded four meetigs i this period ad have cotiuous fiacial membership for the same period; or (ii) a member must have bee a member of a brach for a period ot less tha four years prior to the callig of omiatios, the brach attedace book must show that the member has atteded four meetigs i this period ad have cotiuous fiacial membership for the same period; ad (iii) a member must satisfy the requiremets of Rule I.8. (iv) I the evet that the member has trasferred from a iterstate brach durig the two year period required uder or the four year period required uder (ii), if the requisite attedace requiremets uder,(ii) ad (iii) are met, the the period of Party membership ca be accepted rather tha the period of requisite local Brach membership. (v) Where a brach has become defuct uder Rule I.3 durig the last complete Membership Year or the curret Membership Year, a member of that brach does ot fail to satisfy subsectio or (ii) oly by reaso that they are o loger a member of a brach. (vi) Where a brach has become defuct uder Rule I.2 durig the last complete Membership Year, attedace at a brach meetig prior to the brach s failure to meet for three moths may be couted for the purposes of subsectio (iii). I order to vote i a local selecto ballot a brach member must also have joied the Brach accordig to the Rules. I establishig that a member was admitted to membership of the Brach accordig to the Rules, i the case of a member relyig o the two year Rule [Rule N.21], it will be sufficiet to establish that, ay member who commeced to be a Brach member i the three years prior to the date of callig for omiatios, is eligible provided that they atteded the Brach ad siged the attedace book ad did so agai withi four caledar moths, ad it is oted i the Brach Miute Book that the Brach admitted that member; the they shall be placed o the list of eligible voters. (ii) I establishig that a member was admitted to membership of the Brach accordig to the Rules, i the case of a member relyig o the four year Rule [Rule N.21(ii)], it will be sufficiet to establish that, ay member who commeced to be a Brach member i the five years prior to the date of callig for omiatios, is eligible provided that they atteded the Brach ad siged the attedace book ad did so agai withi 65

(iii) Where all the criteria described above have bee complied with but the Brach has failed to record the admissio of a ew member i the miutes, the they will be eligible. This provisio does ot apply to the Cetral Policy Brach. A member caot be left off the Official Votig List because of problems with his/her Party membership which are: i the case of the two-year Rule, more tha three years old, (ii) i the case of the four-year Rule, more tha five years old, except that he/she must meet the requiremets of to above. Life members ad members with te years of cotiuous fiacial membership immediately prior to the date of callig for omiatios are automatically etitled to vote i local selectio ballots i the electorate i which they live. Provided he/she meets the requiremets of this Rule ad Rule I.9, a Brach member trasferred to aother electorate o clearace will be allowed to vote i the selectio ballot. This will iclude cases where the trasferee has applied for but has ot yet bee admitted to membership of the ew brach at the time of the callig of omiatios. Cetral Policy Brach members will be eligible to vote i a local selectio ballot i the State ad Federal Electorates ad Local Govermet Areas i which they reside. This paragraph has bee iserted for the avoidace of doubt. (ii) I relatio to the Cetral Policy Brach, a record of the decisio of the Admiistrative Committee to admit a member to the Cetral Policy Brach must be used i lieu of a referece to a miute book i this Rule. (iii) Cetral Policy Brach members will ot be etitled to vote i local selectio ballots held uder Rule N.45. N.22 Notwithstadig Rule N.44, a perso who is ot erolled with the Australia Electoral Commissio to vote i a federal electio is uable to vote i a joit selectio ballot (ie. a N.23 ballot uder the aforemetioed Rules). The member s address for the purposes of the preselectio will be their erollig address. The Secretary of each Brach should prepare a list of members who the Secretary believes are able to vote ad this should be preseted, together with all of the ecessary brach records, to the Returig Officer at the credetiallig. The time, date ad place of the credetiallig is determied by the Admiistrative Committee. The Admiistrative Committee may set a differet time, date ad place for credetialig for the Cetral Policy Brach, ad the credetaillig for more tha oe selectio ballot may be combied i a sigle credetialig, so log as callig of omiatios for each ballot occurred at the same time. N.24 It is the fuctio of the Returig Officer to prepare a list of members who ca vote as a cosequece of the credetiallig. This must be doe o the official votig sheets supplied by the NSW Brach Office. The Secretary of each Brach must assist ad co-operate with the Returig Officer i this process. Cadidates may appoit scrutieers (by letter addressed to the Returig Officer) who ca be preset throughout the credetiallig. The Returig Officer may set a uiform limit o the umber of scrutieers each cadidate may appoit. Each cadidate may obtai a copy of the list from the Returig Officer oce the credetiallig has bee completed. POLLING PROCEDURES N.25 The Returig Officer of the Electorate Coucil will act as Deputy Returig Officer for selectio ballots i the electorate. He/ she may be assisted by a represetative of the Electorate Coucil Executive. The Deputy Returig Officer is (subject to ay directio of the Returig Officer) resposible for the supervisio ad coduct of the selectio ballot i the electorate. N.26 The Presidig Officer at a pollig place for a selectio ballot is: where there is o cetral pollig place the Brach Returig Officer; where there is a cetral pollig place ad there are separate Brach ballot boxes the Brach Returig Officer i relatio to the ballot box 66

67 for his/her brach; ad i all other circumstaces the Deputy Returig Officer. The Presidig Officer is (subject to ay directio of the Returig Officer or Deputy Returig Officer) resposible for the supervisio ad coduct of the selectio ballot at the pollig place cocered. N.27 The Admiistrative Committee ca istruct the Geeral Returig Officer to take complete charge ad orgaise ay selectio ballot i ay electorate. N.28 The Geeral Returig Officer will sed each Deputy Returig Officer the correct umber of ballot papers for their electorate. The Deputy Returig Officer the gives the correct umber of ballot papers to the Presidig Officer. The umber of ballot papers will be the same as the umber of members who ca officially vote plus 10% or four (whichever is the greater umber). The Presidig Officer will also be give writte istructios about returig the used ad uused papers i separate ad sealed packets, alog with the official votig list. The list must be siged by all members who have bee give ballot papers. N.29 The Party Uit orgaisig the selectio ballot ca decide to have a cetral pollig place ad the time of the pollig. But pollig must be for at least four cosecutive hours, uless the Admiistrative Committee agrees otherwise. N.30 Subject to Rule N.29, the time ad place of Brach ballots are decided by the Brach but pollig must be for at least four cosecutive hours, uless the Admiistrative Committee agrees otherwise. Also, a Brach ballot caot start before or fiish after the hours of votig decided by the Party Uit cotrollig the ballot i the electorate. Brach members must be told seve days i advace by circular of the date, time ad place of the ballot. Prepoll votig for State ad Federal lower house seats will be available for two hour periods each day at the ALP Office for the first three days i the week precedig the ballot. The times ad dates will be determied by the Admiistrative Committee whe settig the preselectio timetables. either cast their vote by pre-poll votig or at a local pollig place determied by the Returig Officer ad advised i writig to the Cetral Policy Brach voter. N.31 At least oe week before the ballot takes place the date, time, place ad ames of the Brach Presidig Officers must be advertised. The Geeral Secretary may waive this requiremet if he/she is satisfied that the requiremet is ot practicable. N.32 Where practicable, the ballot ad the coutig of votes must take place i the presece of a represetative or represetatives of the local Party Uit. Each cadidate ca appoit oe scrutieer (by letter addressed to the Returig Officer) who ca be preset throughout. The result of the ballot must be set to the Admiistrative Committee. The Admiistrative Committee ca decide to appoit a perso to supervise the ballot. N.33 A cadidate s scrutieer must be a member of the Party ad have the cadidate s authorisatio i writig. N.34 Before pollig begis the Presidig Officer must show those preset that the ballot box is empty. The ballot box is the sealed. N.35 The ballot box, or boxes, must ot be moved durig the ballot. N.36 Members ca vote oly oce. They must vote durig the agreed votig hours ad at their Brach pollig veue. Before a ballot paper ca be give to a member he/she must give his/her address ad sig the official votig list. N.37 The Presidig Officer must check that each member sigs the official votig list correctly. If there is ay doubt the sigature should be compared to the voter s sigature i the Brach Attedace Book. N.38 The Brach Secretary must provide the Brach Attedace Book to the Presidig Officer. N.39 The ame of each member who votes must be marked off the official votig list i a clear way. N.40 Scrutieers, the Returig Officer, or Deputy Returig Officer or Presidig Officer ca challege ay vote. If there is a challege, that vote must be put i a sealed evelope ad the reaso for the challege writte o the outside. Eligible Cetral Policy Brach members ca 67

68 N.41 APPEALS N.42 If there is more tha oe pollig place, the ballot boxes must be sealed ad take to the cetral pollig place to be couted after votig eds. The Deputy Returig Officer must give scrutieers reasoable otice of the time whe the votes are to be couted. Uder o circumstaces ca the Returig Officer break or iterfere with the seals o the ballot boxes prior to the appoited time uless scrutieers for all cadidates i the ballot are preset. After recocilig the umber of ballot papers for each brach, the ballot papers will be combied ad couted i oe lot, except as provided i Rule N.45. If it is show that the Rules for a selectio ballot have bee broke, the Admiistrative Committee ca: susped the offeder from the Party for ay legth of time; withdraw the cadidate s ame from the poll; order a ew ballot; refuse to edorse the selected cadidate; take ay steps to esure that the Rules are followed correctly. The Admiistrative Committee ca isist that ay evidece about a disputed selectio ballot be supported by a statutory declaratio. N.43 A member of the Iteral Appeals Tribual caot hold a official positio i coectio with a selectio ballot. SUSPENSION OF SELECTION BALLOTS N.44 The Admiistrative Committee may, i cosultatio with the Parliametary Leadership ad the local Electorate Coucil, coduct a selectio for public office pursuat to the provisios of this Rule: I the case of a State by-electio, uless determied otherwise by the Joit Campaig Committee; or (ii) I the case of ay other by-electio; or (iii) I exceptioal circumstaces. (iv) I order to meet the Affirmative Actio requiremets set out i rule M.7. Where the Admiistrative Committee decides to coduct a selectio for public office uder this Rule, the cadidate will be selected by a Committee made up of equal umbers from the Admiistrative Committee ad the Local Electorate Coucil. The Committee s cadidate will become the edorsed Labor cadidate. SELECTION BALLOTS IN FOWLER N.45 I this Rule the desigated area is the Federal electorate of Fowler as it existed i The Admiistrative Committee may cap (o a brach basis) the value of the votes cast by residets of the desigated area i a selectio ballot. (ii) Whe this occurs, a cap must be set for each brach participatig i the give selectio ballot. The Admiistrative Committee (havig regard to the historical participatio i the brach) sets each brach s cap. Where the umber of voters residet i the desigated area appearig o the votig list for a brach exceeds its cap, there must be a separate ballot box specific to those voters i that brach. (ii) The ballot papers for those voters must ot be combied with other ballot papers durig the cout util their value has bee adjusted as provided below. Where the umber of formal votes cast by the voters residet i the desigated area referred to i above exceeds the cap, the Returig Officer must adjust the value of each of the formal votes, so the total formal vote cast by those voters i that brach equals the relevat cap. (ii) The adjustmet referred to above must occur prior to the elimiatio of ay cadidate ad prior to the applicatio of the affirmative actio weightig required by Rules N.7 or N.8. (iii) No adjustmet is required uder this Rule to votes cast by residets i the desigated area i a give brach if 68

69 (f) the umber of formal votes they cast i that brach is equal to or less tha the relevat cap. Despite the provisios of Rule G.1, if a brach s actual membership residet i the desigated area exceeds a cap, it is deemed oly to have membership i the desigated area equal to the cap whe workig out the umber of delegates a brach may elect to a local Electorate Coucil. This Rule oly applies util the Admiistrative Committee determies it is o loger ecessary. N.46 I this sectio, i relatio to a selectio ballot for a local govermet public office a referece to a Electorate Coucil is a referece to the Local Govermet Committee. COMMUNITY SELECTION BALLOTS N.47 The Admiistrative Committee may, i cosultatio with a Electorate Coucil or Local Govermet Committee, coduct a selectio for public office by a commuity selectio ballot pursuat to the provisios of this Rule. Subject to subsectios ad, ay Australia citize o the electoral roll i the electorate for which a cadidate is beig selected is eligible to vote i a commuity selectio ballot. The followig people are ot eligible to vote i a commuity selectio ballot: A perso who is a member of aother political party or oe of its affiliated orgaisatios (Coutry Labor does ot costitute aother political party for the purposes of this subsectio); or (ii) A perso who has bee expelled from the Party ad has ot bee readmitted as a member. I order to be icluded o the list of voters for a commuity selectio ballot, ay perso who is ot a fiacial Party member must first sig a declaratio statig that they: Are a Labor supporter; (ii) Will assist the Labor cadidate selected i the ballot for which they are registerig as a voter; ad (iii) Are ot a member of aother political party or oe of its affiliated orgaisatios (f) (g) (h) (j) (Coutry Labor does ot costitute aother political party for the purposes of this subsectio). Votig i a commuity selectio ballot must close at least three moths before Electio Day for the electio for which a cadidate is beig selected. Subject to subsectios to, the Admiistrative Committee may determie: Procedures for callig omiatios; (ii) Eligibility criteria for cadidates; (iii) Rules ad doatio ad expediture limits for campaigig; (iv) Eligibility criteria for voters; (v) Procedures for voter registratio; (vi) Procedures for credetiallig voters; (vii) Procedures for hadlig disputes; (viii) The weightig of votes betwee fiacial Party members ad other voters; (ix) How votig will take place; ad (x) Ay other matters required for coductig a ballot. Decisios made by the Admiistrative Committee uder subsectio (f) eed ot be cosistet with provisios i sectio N of the Rules, other tha the provisios of this Rule. The priciples of Affirmative Actio, as outlied i Rule N.7, shall be applied to all compoets of a commuity selectio ballot. The Admiistrative Committee will report to the NSW Aual Coferece o each selectio for public office that is coducted by a commuity selectio ballot. The Admiistrative Committee will report to Aual Coferece after the 2015 State Electio o campaigs ad results i the seats where commuity selectio ballots were held. PUBLIC OFFICE SELECTION FORUMS N.48 A Electorate Coucil or Local Govermet Committee must hold a Public Office Selectio Forum pursuat to the provisios of this Rule before votig opes for a selectio for public office, uless the Admiistrative Committee provides otherwise. A Electorate Coucil holdig a Public Office Selectio Forum must decide to have a cetral pollig place, as per Rule N.29. The Public 69

70 (f) (g) Office Selectio Forum must take place at that cetral pollig place o the same day that votig takes place, uless the Admiistrative Committee provides otherwise. A Local Govermet Committee holdig a Public Office Selectio Forum must either decide to have a cetral pollig place, as per Rule N.29, or decide to have o more tha oe pollig place per ward. The Public Office Selectio Forum must take place at that pollig place o the same day that votig takes place, uless the Admiistrative Committee provides otherwise. Cadidates i the selectio ballot for which a Public Office Selectio Forum is beig held are etitled to address the Forum, with the speakig order to be settled by lot. The Presidig Officer will the divide the attedees ito small groups ad orgaise for the cadidates to have a equal amout of time with each group for discussio. Ay perso who is eligible to vote i the selectio ballot for which a Public Office Selectio Forum is beig held is eligible to atted ad participate i the Forum. All fiacial Party members who live i the electorate for which a cadidate is beig selected are eligible to atted ad participate i the Public Office Selectio Forum, whether or ot they are eligible to vote. SECTION O NSW Parliametary Party O.1 Members elected to the NSW Parliamet uder the auspices of the NSW Brach (officially represetig ad supported by the NSW Brach) must form a separate Parliametary Party. O.2 I Parliamet oly edorsed members of the NSW ALP ca joi the Parliametary Labor Party. O.3 After 28 March 2015, the Leader of the NSW Parliametary Party, i the Legislative Assembly, will be elected 50% by a ballot of rak-ad- file Labor members ad 50% by the State Parliametary Party, subject to ay criteria i the NSW Parliametary Labor Party rules. For the rak-ad-file ballot, the Admiistrative Committee may determie: Rules ad doatio ad expediture limits for campaigig; (ii) Eligibility criteria for voters; (iii) Procedures for voter registratio; (iv) Procedures for credetiallig voters; (v) Procedures for hadlig disputes; (vi) How ad whe votig will take place; ad (vii) Ay other matters required for coductig a ballot. Where a ballot is required of the rak-ad-file Labor members, it will be coducted by the Party Geeral Returig Officer or a perso to whom they delegate resposibility. The perso whom they delegate eed ot be a perso specified i Rule M.8. A cadidates forum may be held cosistet with the provisios relatig to Public Office Selectio Forums i Sectio N. The Party Returig Officer will arrage for the ballot papers to be couted i the presece of scrutieers appoited by the cadidates, if there are ay. The Party Returig Officer will be resposible for the Party Ballot, the SPLP will appoit a Parliametary represetative as the Returig Officer of the State Parliametary Party ballot, ad together they will determie the overall result of the ballot. 70

71 (f) The Returig Officers will iform the Geeral Secretary of the result of the ballot. O.4 The Deputy Leader i the Legislative Assembly ad the Leader ad Deputy Leader i the Legislative Coucil are elected by members of the Parliametary Labor Party. O.5 All other members of the Miistry (whe i Govermet) or Shadow Miistry (whe ot i govermet) will be appoited by the Leader of the NSW Parliametary Labor Party. O.6 The Leader of the Parliametary Labor Party ad two other elected members of the Parliametary Labor Party, plus the Party Officers, are resposible for preparig the policy speech durig a electio campaig. The speech must be edorsed by the Admiistrative Committee. O.7 Members of the NSW Labor Parliametary Party are required to atted NSW Parliamet iductio programs ad ay educatio or traiig offered o NSW electoral fudig ad disclosure obligatios. SECTION P Parliametary Levy P.1 NSW Members of the State ad Federal Parliamets pay a levy of 4% of base salaries ad 6% of salaries of office to the NSW Brach of the Party. The Local Govermet levy shall be kept i a separate accout ad used to assist i local govermet campaigs. The release of fuds will be the resposibility of the Geeral Secretary i cosultatio with the Assistat Geeral Secretaries. P.6 The Parliametary Levy Advisory Committee exists as a body to decide about the Levy ad is made up of: two members elected by the State Parliametary Labor Party i the Legislative Assembly; oe member elected by the State Parliametary Labor Party i the Legislative Coucil; two members elected by the NSW represetatives i the Federal Parliametary Labor Party; the Geeral Secretary ad Assistat Geeral Secretaries.
