3 Page 3 of 62 REPORT TO COUNCIL PLANNING DEPARTMENT AGENDA DATE: September 19, 2017 REPORT DATE: September 13, 2017 SUBJECT: Pubic Meeting: Rezoning of New Lot: Ontario Inc. RECOMMENDATION It is recommended that Counci hear comments from the pubic regarding an amendment to the Comprehensive Zoning By-aw that woud rezone a new residentia property and the retained parce resuting from a consent appication in Part of Lots 23 & 24, Concession III, Storrington District, and consider passage of the attached amending By-aw # BACKGROUND An appication has been submitted to amend the Township of South Frontenac Comprehensive Zoning By-aw to rezone a 52.8 acre property that was the subject of consent appication S S. Attachment #1 shows the ocation of the subject property and Attachment #2 indicates how the ot woud be divided. The and has frontage on Round Lake Road, and Inverary Lake. Sweetfern Lane runs through the property providing access to other adjacent properties. The ot is deveoped with a singe detached dweing and an accessory buiding. The consent appication was to divide the and into two arge portions where a new 15 acre ot woud be separated from the waterfrontage and woud become a non-waterfront rura ot containing the existing dweing and fronting on Round Lake Road. The retained 37.8 acre parce woud maintain its 434 metres (1,424 ft.) of waterfrontage on Inverary Lake and woud be accessed by Sweetfern Lane. Attachment #2 shows to new proposed ot ayout. Presenty this arge acreage is zoned Specia Rura Zone (RU-45) requiring a minimum setback from the highwater mark of the ake of 40 metres. Consequenty, the rezoning appication needs to maintain this mimimum ake setback. Aso, because the arge retained ot woud now be accessed by a private ane, it woud be zoned to Limited Service Residentia-Waterfront and, to retain the specia setback, it woud require a specia RLSW zone ie., RLSW-115. The newy created non-waterfront ot at the pubic road woud now be zoned Rura (RU). By-aw No woud effect this change. From a panning perspective the rezoning appication can be supported. No new waterfront ot is being created - the existing arge 57.8 acre waterfront is simpy being reduced in size to 37.8 acres and the specia setback from the ake is being maintained. Because the new ot at the pubic road is no onger a waterfront ot, the RU zoning described above is appropriate. KFL&A Pubic Heath and the Cataraqui Region Conservation Authority had no objections to the proposa at the consent stage. However, a etter dated September 14, 2017 was received from the Inverary Lake Resident s Association expressing concerns with the appication - see Attachment #3.The concerns mosty reate to proper procedure not being foowed during the consent appication stage, future division of the and and ake residents not being propery notified. These concerns can be discussed at the pubic meeting but it shoud be

4 emphasized that no new deveopment is being proposed at the waterfront and it wi remain mosty unchanged as a arge waterfront ot with 1,424 feet of waterfrontage on Inverary Lake. The concerns are as foows: (a) Notice of the pubic meeting on Juy 7fh at which the severance was discussed was not posted on the Inverary akefront, as required. Six members of the ILRA, who canoe, kayak and swim the ake reguary did not see any such notice prior to the meeting. The opportunity for residents to take part in discussions was, therefore, denied. Aso, the ILRA was not informed of the meeting, despite a prior agreement (OMB Settement PLO90746) that the ILRA be informed of any panned deveopments on nverary Lake that affect the ots in question. (b) The notice advertising the September 1gth pubic meeting was posted on nverary Lake but with an incorrect date. Errors is postings, and the faiure to post, woud seem to be common, and imit participation of concerned groups in pubic meetings. (c) The severed akefront ot must be rezoned to specia imited service residentia because it has no frontage on a pubic road. However, such rezoning cannot, and shoud not, be considered a formaity. We argue, therefore, that the origina severance shoud not have taken pace without consideration of this fact. We request that the ILRA be suppied with evidence showing that due process was carried out in a aspects of the severance process, or an expanation as to why any departures from such processes were aowed. (d) Over the past seven years, the ots on the north shore of nverary Lake have been subject to severances and amagamations. attach a fie (S S) that shows the ot configuration as of attach another fie (North Shore Severances) that show the current Iot configuration. The map on the atter fie shows ots (A, B and C) that have been created and severed over the past 7 years. The shifting boundaries of these ots have confused the issue of severabiity given, in our understanding, that a property may be subdivided ony 4 times. It woud seem that a strategy of "ot additions" has circumvented this provision by creating new Iots that may be further severed (as in 14 to 4A; 18 to 3B; and IC to 4C). The most recent severance woud add ot 4B to the centra area of the map, creating a new waterfront ot with a different boundary from the origina waterfront ot. We woud ike carification on the egaity of the creation of ot additions to create new severabe ots, and how such division of and compies with the Officia Pan, especiay with respect to the conservation of wetands. (e) We request information concerning the future severabiity of the new 37 acre waterfront ot (which woud create 4B on my map). If this is rezoned as a specia imited service residentia ot, it is our understanding that the current owner woud not have the right to sever this ot further. However, if this property were to be sod, either to a business or to an individua, the future owner may have the right to sever the property into four waterfront Iots. As understand it, the same woud be true if Lot IC on my map were to change hands. If this is the case, it conficts, potentiay, with the assurance given under sworn testimony by you at the M B hearing that: "the Officia Pan wi not permit the creation of new further waterfront ots by Consent because the imit has been reached.? Coud you pease carify your statement about the "imit being reached". How many waterfront ots on nverary Lake are aowed under the Officia Pan? Has the Officia Pan 1

8 Page 8 of 62 ch.inged over the past seven years to aow more waterfront deveopment if so, coud you pease provide, or direct us, to a document showing the revisions? Responses to the above request for information wi determine whether or not members of the ILRA wi oppose the rezoning of the new waterfront ot. As aways, our concern is the environmenta heath of Inverary Lake, and that creeping waterfront deveopment wi jeopardise its fragie ecosystem. Given that time is imited before the September 1gth meeting, we request that the zoning appication be deiayeci to a future date so that we may have the opportunity to receive the answers to the above questions, and consider them in detai. If a deay is refused, the ILRA requests that they be aowed to address counci on September 1gth prior to a vote on the rezoning, to express concerns and, potentiay, opposition, before proceeding, perhaps, to an appea before the OMB. The road aowance woud add 0.1 acre onto the property but it woud increase the interior side yard where the septic system is ocated. Mayor Vandewa stated that if the neighbouring property owners have no objections, he fet the township shoud not have any concern with this road cosing. There were no comments from the pubic. c) Cosing of Unopened Road Aowance in Concession II and III, Lot 18, Bedford District-Doward Forbes Symon expained that the ten waterfront ots were created in 1968 through a series of and transfers, part of this transaction incuded a 2.7 metre wide roadway connecting a of the ots which inks with Hickey Lane providing their ega access. This is an extremey unusua property configuration in that the 2.7 metre wide traveed access road is actuay a part of the subject ot. Part of the Township road aowance was cosed by By-aw No by the Township of Bedford in 1996 where it crossed four of the residentia ots, however, the by-aw did not cose these two sma pieces. The owner is now requesting that they be cosed and transferred to him. Councior Barbeau questioned the necessity of fencing and was it dependent on the ot size. Emiy Aan noted that fencing woud be best as the dogs' age and the training of the dog are factors to consider. It was recognized that this request was presented at South Frontenac Recreation and there was not any support for it from that committee. Councior Schjerning indicated that it wi be discussed again at the September 18 meeting. The new ane was required to access the northern ot through the south ot from Petworth Road. The appicant who sti owns the retained portion of and wishes to dedicate the ane to the Township so that it can be fuy maintained as a pubic road and has requested that the new road be named "Bus Line Road". This woud faciitate a severance off the retained portion. Counci was supportive of assuming the road once it has been constructed to pubic road standards, based on the recent approved poicy for road assumption. Recognizing that the road name request is not incuded on the pre-approved road names, Counci was supportive of the proposed road name recognizing that the appicant must pay for the costs associated with the administration and advertising. b) Forbes Symon, Manager of Deveopment Services, re: Proposed Road Aowance Cosing, Concession III, Lots 5 & 6, Bedford District Lindsay Mis expained that a portion of the unopened road aowance that was thought to form part of the subject property may not have been formay cosed and transferred to the property. A search of historica by-aws that affected this cosure and transfer coud not be found. The survey from 1985 defines the property boundary and describes it as Parts 1, 2 and 3, thus, identifying the ots as one ot comprised of a three parts. Counci was generay supportive of moving forward with the request as ong as the associated costs are covered by the appicant. Counci was support of waiving the purchase price. c) Forbes Symon, Manager of Deveopment Services, re: Frontenac Provincia Park Boundary Adjustments Lindsay Mis noted that it is uncear as to the intent of the Frontenac Provincia Park in acquiring the road aowances athough the Park Superintendent has cited "Provincia Parks and Conservation Reserve Act" as the basis for the acquisition. Mr. Mis carified that the act states "within" the park noting that this is not the case for a of the road aowances identified. Counci directed staff to seek carity on the request before considering the sae of the unopened road aowances. d) Wayne Orr, Chief Administrative Officer, re: Counci Meeting Schedue Counci was uncertain of committing to any immediate change. They expressed concerns about not having opportunity for discussion if there were no Committee of the Whoe meetings and did not support the idea of three members of Counci on committees making decisions that are not approved by the entire Counci. Earier start times were not supported as they fet this affected members of the pubic abiity to attend. There was a sense that a tria period may be hepfu. The CAO was directed to bring back a report based on the broad spectrum of ideas provided by Counci. Page 2 of 4

The mode of the "Verona Community Association" was discussed as a comparator. Counci appreciates the efforts of community groups as they take ownership in projects. Counci was supportive of creating a committee of Counci using the VCA framework and guideines. 7. Reports for Information a) Mark Segsworth, Pubic Works Manager, re: Bedford Road Project Counci was supportive of the temporary road cosing of Bedford Road on September 29 to aow for Hydro One to compete necessary work. Notification wi be incuded on the website and banner advertising. Hydro One wi be responsibe for notifying their customers of the power outage. b) Mark Segsworth, Pubic Works Manager, re: Roads and Bridges - 5 Year Capita Pan There was ots of discussion about the 5 Year Capita Pan. Mark Segsworth reminded Counci that the needs are greater than the funds avaiabe. He indicated that the staff recommendation is that the upgrading of grave roads be discontinued to focus on arteria roads. Whie it is acknowedged that eected officias shoud have input on what district roads are incuded, the budget is for a of South Frontenac and takes into account that each district sees improvements each year. If there is not an agreement about a project within a district, there has to be trade off in order to keep the budget baanced. There wi be more discussion on this at the Pubic Services Committee meeting on September 21. c) Mark Segsworth, Pubic Works Manager, re: Project Updates Councior Barr supported the competion of the steps at Gendower Ha as soon as possibe. 8. RECOMMENDATION That the Township of South Frontenac submit an Ontario Triium Fund appication on behaf of the Fermoy Ha Community Group for restoration work to the historic Fermoy Ha. BACKGROUND Counci s Procedura By-Law estabishes the process for Notice of Motion as outined beow. At the Counci meeting of September 5, 2017, Councior Barr served notice of motion to have Counci support an Ontario Triium Fund appication on behaf of the Fermoy Ha Community Group. A notice of motion requires a seconder at the next reguar Counci meeting. If seconded, the motion is debated and then voted upon. Since 2016 ony initia restoration work has been competed. Other work has been deferred due to the identification of asbestos in the buiding. The grant appication wi be deveoped by committee members and submitted by staff. Ony one Triium Grant may be appied for by an organization in each round of submissions. This project woud be the Township ony submission this round. FINANCIAL and STAFFING CONSIDERATIONS The 2017 budget contains an aocation of $30,000 for restoration work to the Fermoy Ha. 25 Page 25 of 62 REPORT TO COUNCIL PLANNING DEPARTMENT AGENDA DATE: September 19, 2017 REPORT DATE: September 14, 2017 SUBJECT: Proposed Road Aowance Cosing: See RECOMMENDATION: It is recommended that Counci waive the requirement under Notice By-aw No for a pubic meeting and consider passage of By-aw No to cose and transfer ownership of a portion of unopened road aowance between Lots 5 & 6, Concession III, Bedford District. BACKGROUND: As part of the sae of a property in the District of Bedford the rea estate awyer for the buyer discovered that a portion of unopened road aowance that was thought to form part of the subject property may not have been formay cosed and transferred to the property. Township staff were not abe to find any by-aw that effected this cosure and transfer. Attachment #1 shows the ocation of the subject property. The parce is 0.9 hectares (2.3 ac.) in size (incuding the former road aowance) with 179 metres (587 ft.) of waterfrontage on Thirty Isand Lake. It is accessed by McGowan Lane which is routed around the north portion of the ot. As iustrated on the attachment, the unopened road aowance that forms the boundary between Lot 5 and Lot 6 in Concession III appears to have been stopped up and cosed and ownership transferred to the property through which it passed. Survey Pan #13R-6339 from 1985 defines the property boundary and describes it as Parts 1, 2 and 3, thus, identifying the ot as one ot comprised of a three parts - Part 2 being the former portion of road aowance. Attachment #2 shows these three parts forming the subject ot. The deed for the subject property describes the ot as being made up of Part of the Road Aowance between Lot 5 and 6, and Part of Lot 5 and 6, Concession 3, Township of South Frontenac, Bedford, County of Frontenac, designated as Parts 1, 2 and 3 on Reference Pan 13R Part 2 refers to the former road aowance as noted above. The matter came before the Committee of the Whoe on September 12, 2017 where it was expained that the deed and a other Township records dating back to 1983 indicate that the property is indeed one parce of and comprised of these three parts but, as noted, no by-aw cosing and transferring the road was found. In ight of the above information and discussion, the Committee was favourabe to passing of a new by-aw to effect the road cosure and transfer and that the norma process in the road cosure byaw for advertising and hoding of a pubic meeting was not necessary in this case. The Committee did agree though that an administration fee is sti warranted. The owners were advised that $ woud cover this fee.

From this meeting, Counci requested that updated figures be brought forward at the September meeting. FINANCIAL and STAFFING CONSIDERATIONS In August 2016, the Township invested $5,658,000 in the One Investment Program in ine with our Investment poicy and the avaiabe funds based on our ong range financia pan. A funds were invested beyond a five year horizon and met a egisative requirements. Attached is a summary comparing the Township s origina investment to the investments as of September 8th, 2017 aong with its aocation mix. At the end of 2016, the net change in the investment vaue was $11,936 compared to an estimated RBC interest cacuation of $25,013. Vaues presented at the ast meeting up to June 30 th showed a ife to date net change in investment vaue of 79,953 compared to an estimated RBC interest cacuation of $54,842. As of September 8 th, the ife to date comparison refects an overa investment change of $18,115 compared to an estimated RBC interest cacuation of $65,027. The net change in our investments is now beow the interest that woud have been received if the funds woud have been in our RBC bank account. This information was presented to the Corporate Services committee where the recommendation was to ook at aternatives to how our investments are being managed. Currenty a our funds are within the LAS One Fund investment program as directed by our investment poicy as these funds are targeted as ong term investments. The 2017 pan was updated in 2016 as part of the 2017 budget process and a fu day session took pace on October 14, 2016 to go over questions about the pan. A summary of the 2017 Long Range Financia Pan assumptions is attached to this report as Attachment A. These figures were used as the baseine prior to inputting any updates. For the 2013 to 2016 budget years, Counci s direction was a 2.0% taxpayer impact based on average phase-in. The direction received from Counci for the 2017 budget was a 2.2% taxpayer impact with maintaining reserves at an average of 15 miion based on the scenarios presented from the Long Range financia pan. Counci refined the parameters and the fina approved 2017 budget had a 2.0% taxpayer impact based on average phase-in. The fina version of the ong range financia pan incorporates a items in Attachment A aong with increasing the capita budget for the fire ha by $500,000 and removing the soid waste charge as a oca improvement and making it a rate base charge. This activity woud cost roughy $ and done by a icensed drone operator known to Linda Bates. This initiative woud further expand on the Recreation s origina idea of having this happen at Sydenham High Schoo and Loughborough Pubic Schoo ony. New Business: A guest speaker Peter Muncy attended the meeting to expain and discuss the benefits of deveoping a dog park in South Frontenac. Mr. Muncy mentioned that there are a ot of peope in South Frontenac that find it necessary to trave out of the township to bring their dogs to a dog park. The benefits of a dog park are it is a socia time for oca peope and their animas. It coud aso cut down on crime if paced in an existing park as there woud be more of a presence in the park. Aso it woud increase park usage. Mr. Muncy is aware of the necessary requirements to create a dog park space. Once the space is decided a that is necessary is a doube gate a rues sign describing the rues of usage and a 4 foot fence around the perimeter, extra garbage pais A possibe site at Centennia Park was discussed. The site between the Trai and park and was mentioned as a possibe site as we as in the treed area of the park. A were interested and in favor of this project moving forward by pacing it on the suggestions for next year s budget. McMuen Park and the further deveopment of that property was discussed. DELEGATION REMARKS- Heidi and David thanked the committee for having them and our work. They want to reinvigorate tennis in South Frontenac. They say there is room for improvement, and drawing from Kingston s popuation. They say the numbers in Kingston have doubed in the ast few years. They beieve a courts are in a state of disrepair. As we, our courts are not advertised. There are no indoor courts in the area- cosest is Beevie, and it is Heidi and David s beief that cay courts woud draw peope from a arge area. They have been to Gerad Ba and Ken Garrett Park. The committee noted that Ken Garrett is not Township property. What they are suggesting is to have a four-court cay compex with a dome encosure. Avin suggested composite instead of cay. David and Heidi beieve they coud get sponsors and investors for the project. The deegates exited the meeting at 7:24 pm. This committee fees that we need more information before moving forward with the tennis revitaization idea. It is noted that we aready have tennis courts, perhaps we coud fix them up. Is there a demand for a 4-court covered compex? Amanda wi check the Recreation Survey from ast year and see if any interest was expressed through that. BUSINESS ARISING- Storrington Retirees- The members are wondering when the renovations are going to start at the Ha. The jam nights have been moved to Piccadiy to accommodate the renovations but they have not even started yet. Norm says that the Township is in the midde of a ot of projects right now, and they wi get to the center when those are done. Roberta and Sharron had to cean the oven in the kitchen. It is agreed that users shoud have to cean the oven after they use it, as it is not in a reguar ceaning schedue. Baseba- Two teams sti have not paid. Soccer- 4 weeks to go. The Funday is coming aong we. Everyone gets a shirt, trophy, socks and a picture. A but two nets have been anchored. Concerns regarding iabiity have caused a risk of oosing executives on the soccer committee. Horseshoes- A good, there are no cans and they sti need sand.

39 Page 39 of 62 Canada Day- T-shirts were a no-go. The O.P.P. are good for the road cosure, there wi be changes for next year to accommodate other parades. The tents go up Friday. Parade wi be touch and go depending on the weather, it eaves at 1:00 pm and participants are to gather at 12:30 pm at the Fire Ha. There are two tents, 10 tabes and 50 chairs to set up, Avin wants a hand. Food permit is good. It is asked if we shoud charge for the popcorn- yes, $1.00. Thanks to Kevin for the hard work on the grant. The fireworks shooter is coming from Nova Scotia. It is asked what happens if it rains and the fireworks cant go off. Avin wi ask Tim. Soccer tournament is coming aong, but registration is down. Urban Laces is booked and ready to go, but wont pay in a thunderstorm. No uck on the food. SOUTH FRONTENAC RECREATION COMMITTEE- Soccer nets- signs and warning wi go up at the fieds and notices wi go out to parents regarding the dangers of paying on the nets. Vounteer recognition was awarded to 5 peope this year. Heathy Kids Community Chaenge wi suppy fruits and veggies for Canada day, but they need to be bought and prepped by vounteers- we wi pass this year because of the short notice. It is noted that they wi suppy fruits and veggies for other summer programs through the township. Lorraine Lobe from Sydenham made historic panes that wi be dispayed in Bedford ha for Canada Day, they are avaiabe for dispay this summer if anyone woud ike to have them. The Recreation Department is working on a time capsue project for Canada 150. COUNCIL REPORT- Nothing. NEW BUSINESS- A worker from KFL&A Pubic Heath wi be going to Gerad Ba to check and see if it is up to code. The committee fees strongy about making a donation to the cause of Bi Hinch s memoria fund because of a the work and impact he had on the community. Annie moved to donate $50 on behaf of the committee to the memoria fund of Bi Hinch, seconded by Ewood. OTHER BUSINESS- Avin asked the Township about the Coins Lake pubic access inquiry from the ast meeting. The Township does not have any deveoped access. There are 3 road aowances. They did not incude an access in the new subdivision. Kevin moves to encourage Counci to reinforce the poicy of taking and instead of money when there is water access invoved with new deveopments, seconded by Dave Ewood received another compaint about the ack of privacy in the change rooms at Gimour s Point. Amanda wi have approximatey two days per week for the museum specific hours to be determined. She can spend up to two days per week at the museum serving as interpreter and doing some curatoria tasks. She can aso attend specia events at the museum. More detais on her roe wi be worked out over the next days and wi be circuated to the executive when carified. It was fet that Sundays did not bring in many visitors, but that a second week-day might be worth trying. Experience indicated that more peope dropped in on days when the Library (next door) was open. 58 Page 58 of 62 REPORT TO COUNCIL CLERKS DEPARTMENT AGENDA DATE: September 19, 2017 SUBJECT: Seniors Housing Update RECOMMENDATION For information ony. BACKGROUND Counci has struck a Senior s Housing Work Group that has continued the work of the County Committee. In May of this year the Township responded to a Request for Information from the City of Kingston as City Manager for a senior s housing project. The submission was based on the business mode competed by Ken Fouds and funded by the County and in conjunction with input from Southern Frontenac Community Services and Loughborough Community Housing. The submission identified the potentia for a project in Sydenham. At the end of June the City wrote to advise us that we were not accepted for the initia round of funding and to advise us to contact them when we were coser to being ready. On this news the committee s efforts ceased. Since that time two things have happened: Southern Frontenac Community Services has written (see Information Items on Agenda) to indicate that they have voted to abandon the idea of participating in estabishing Seniors Housing at this time on the Grace Center property citing that present programs are a more reaistic focus for our efforts Concurrenty the City of Kingston has contacted the Township to indicate that they have received another round of funding and that our project coud be a suitabe option. The project woud need fina approvas by December 2018 and a shove in the ground by March With a municipa eection in 2018 this creates a tight time frame to move forward.
