2 sc The Reguar Bimonthy Meeting of the Town Board of the Town of Wappinger was hed on March 4th 1985 at the Town Ha Mi Street Wappingers Fas Dutchess County New York Supervisor Versace opened the Meeting at 8 08 P M L Present Frank Versace Supervisor Renata Baard Counciwoman Joseph ncoronato Counciman Counciman Gerard McCuskey rene Paino Counciwoman Eaine H Snowden Town Cerk Others Present Bernard Kesser Attorney Ronad Evangeista Engineer Kenneth Croshier Highway Superintendent The Meeting started with the Pedge of Aegiance to the Fag The Minutes of the Reguar Bimonthy Meeting of February 1985 and the Specia Meeting of February having previousy been forwarded to a Board Members were now paced before them for their consideration MRS PANO moved that the above stated Minutes be and they are hereby approved as submitted by the Town Cerk L Baard s Baard noted that at the Specia Meeting the Board discussed s Farnsworth s resignation but faied to take any action on it MRS BALLARD moved to accept s Farnsworth s resignation as the Zoning Administrator of the Town with thanks and pace it on fie Paino Motion UnanimoU3 y Carried s Baard brought another subject to the attention of the Board at the January Meeting during the discussion on the appointment of a Zoning Board of Appeas Member to fi the vacancy created by the expiration of Urciuoi s term the Board did not request the Town Cerk to send him a etter of thanks for his services to the Town MRS BALLARD moved to request the Town Cerk to send Urciuoi a etter of thanks for his years of service on the Zoning Board of Appeas Paino Unanimousy Carried

3 tj c2 Reports for the month of January were received from the Town Justices Receiver of Taxes and the Hydrant Report aso the Annua Report from the Historian MR MCCLUSKEY moved to accept these Reports and pace them on fie Baard James Kein forwarded a etter to the Town Board requesting approva on the revision of severa ots within the Kende Farms Subdivision Ronad Evangeista Assistant Engineer wrote to the Board regarding this revision indicating to the Town that his office had reviewed the amended deed description for the Conser vation at Kende Farms Subdivision which incude a tota of acres and found them to be correct Versace commented that the Board had hed a work shop session with Kein concerning the amended boundaries and since the deeds were acceptabe to the Engineer it was his opinion that the next step woud be to set a pubic hearing on these changes MR VERSACE moved to direct the Attorney to prepare the necessary resoution to set a pubic hearing and submit them to the Town Board prior to the March 18th 1985 meeting Paino A request from Attorney Thomas Haey representing s Tenno Laks Myers Corners Road in regard to rezoning their property was discussed at a work shop session When the Laks informed the Board that they intended to use the and for Medica Office Buidings they were referred to the Zoning Board of Appeas for a Specia Use Permit They then withdrew their rezoning request MRS PANO moved to receive this communication and pace it on fie Baard tems 5c and 5d etters from James Farre and Raph Ferrusi respectivey were in reference to the unavaiibiity of sewer ines to their homes on Od Hopewe Road and both home owners

4 0 were requesting reimbursement of the assessment fees they have paid over the years since they were not receiving the service MR VERSACE moved to direct Evangeista to notify Andros to incude in his study of Wappinger Sewer mprovement 1 L provision for sewer ine connection from the area of Eck Road westery of the present ines for WS in order to service these two homes with Town sewer faciities and further moved to request the Town Cerk to send etters to Farre and Ferrusi indicating that these monies cannot be refunded pursuant to State Law which requires that a homes within a district must pay an assessment however the Town coud consider owering their assessment to one third of the tota amount now being paid unti such time when they are provided with these faciities and aso inform these homeowners that the Engineer to the Town has been directed to conduct a study to provide a sewer ine connection to their homes Seconded by ncoronato L At the ast meeting the Town Board approved a resoution reating to Veterans ncome Tax Credit to repace provisions for Rea Property Tax Exemptions The Board requested that this reso ution be forwarded to a Supervisors and Mayors of Dutchess County as outined in the resoution A communication was received from the Town Cerk of Red Hook which was identica to what we had sent them two weeks ago MR VERSACE moved to receive the Memo from the Town 0f Red Hook and pace it on fie Seconded by McCuskey A Memo was received from Kenneth Duxbury Chairman of the Conservation Advisory Counci recommending the appointment of Edward Hawksey former Chairman of the Counci as an ex officio member of the Conservation Advisory Counci MR NCORONATO moved that Edward Hawksey be appointed as an ex officio member of the Conservation Advisory Counci as recommended by Duxbury

5 Paino esignation was received from Richard Conte from his position as a member of the Town Fire Prevention Bureau due to his inabiity to attend the required meetings MR MCCLUSKEY moved to accept Conte s resignation and pace it on fie aso send a etter of thanks to Conte Paino Severa communications were received from the New York State Department of Transportation regarding the approva of a 30 MPH in the Hughsonvie Area 40 MPH in the North East Area of Wappinger incuding Maoney Road Smith Crossing Road t and Didde Road and 45 MPH on Route 9D at Ketchamtown Road to the Town ine MR NCORONATO moved to receive this correspondence and pace it on fie and requested the Highway Superintendent to insta the proper signs if h ot aready done so Seconded by McCuskey Correspondence was received from both the Attorney and the Engineer regarding submission of maps and deed descriptions from Corbrew and Lange for road widening purposes on Spook Hi Road Both officers found these documents to be in order and recommended acceptance by the Town Board MR VERSACE moved to approve and accept the deeds as presented upon recommendation of the Attorney and the Engineer to the Town Seconded by s paino A request was received from Recreation Commission Members Hugh J Maurer Frank Presti Wiiam Wood and Director Robert Bose to attend a one day Seminar at West Point on March MR VERSACE moved to grant permission to the Recreation Members

6 03 to attend the one day Seminar at West Point on March at the expense of the Town Paino L Versace and s Paino noted that the purpose of the Seminar was to provide an in depth discussion on athetic fied maintenance concerning the atest information about fertiizing irrigation thatching aerifying pest contro and correcting drainage probems a subjects of interest to the Recreation Commission and shoud prove to be very beneficia to them A verba request was received from Leo Lowney Viage Cerk for permission to use 3 of the Town Voting Machines for their March Viage Eection MR MCCLUSKEY moved to grant permission to the Viage Cerk to use 3 Town Voting Machines for their Eection Paino L Prior to going on with Committee Reports Versace recognized Sandra Godberg Wappinger County Legisator and asked her to report on County activities of interest to our Town Some of the items s Godberg spoke on incuded County approva of a ease on a buiding on Market and Church Street in Poughkeepsie for the Socia Service Department a engthy report on the issue of the PASNY 345 Power Line andthejcourtbattte thit was initiated by municipaities and the PROTECT organization a County study reveaed the need of a traffic ight at the intersection of Jackson Road and Vassar Road very frequenty used by Town of Wappinger residents traveing to Poughkeepsie and a signa ight at Jackson Road and New Hackensack Road At this time McCuskey commented that there were two speed imits in the area of Jackson Road and New Hackensack Road and Jackson Road and Vassar Road which he fet was not we panned it shoud be more consistent He aso noted whie discussing this area that the dumping activity was sti going on there was nothing to stop peope from enter the property in the eary hours and getting rid of their junk

7 01 o He asked s Godberg to check on the possibiity of reopening Airport Park as a recreation area in the near future next year or even beyond that Another item s Godberg mentioned concerned a possibe ease with the Richmore Company to operate at the airport this woud not be brought on the foor to vote in March but it coud come before them in Apri Committee Reports s Baard Dia A Ride forwarded a brochure on this program for transporting senior citizens to a Board Members and its contents outined their new schedues for the bus route and the increased service for these peope The new system is work ing out better now that they are used to it New poster in the Town Ha and other pubic paces she wi distribute some of the brochures to the K of C Drop n Center New Vans white with orange yeow and bue striping the same as the Loop Bus System wi be in service within the next two weeks wi hod 23 passengers with whee chair capacity s Baard Eection Committee wi take up unfinished business under 8A at the appropriate time forwarded copies of a etter received from Arthur Weit Grand Knight of the Knights of Coumbus indicating that the Board of Trustees have given permission to the Town to use one of the rooms atthek of C Ha on East Main Street as a Poing Piece to repace the od Town Ha presenty used for Ward One District Two effective May 1st 1985 MRS BALLARD moved to notify the Dutchess County Board of Eections that voters in Ward 1 District 2 wi use the Knights of Coumbus Ha on East Main Street Wappingers Fas New York and a newy formed district Ward 4 District 6 formed from spitting up Ward 4 District 3 wi use the mmanue Christian Reformed Church on Myers Corners Road effective May 1st 1985 Paino At the Association of Town s Meeting in New York s Baard attended severa Town Board sessions and aso went to a Town Cerk s session befause it pertained to eection district

8 00 boundary aterations and other eection ward changes They pointed out that between January and December they woud ike to freeze the voting districts so no changes woud take pace during that period of time in the eection districts in 1990 there wi be a census and the municipaities wi have the right to redistrict again She suggested to the Board Members that if they anticipate spitting up any of the present districts in their area due to voter registration over they shoud pan to do so in 1986 probaby after they view the situation on Eection Day Another point brought up at this session was that the State Legisature has authorized an expenditure of for a study on voter computorization The Town shoud ook into the possibiity of buying one or two new voting machines but they shoud keep in mind that eventuay we wi have computerized voting and the present voting machines wi no onger be in use MRS BALLARD moved to send a etter t6 the Chairmen of the L Repubican and Democratic Parties informing them of the change in the Poing Pace and the addition of one new district as of May and they wi need two additiona Eection nspectors Seconded by Meenekey s Baard Recreation Committee reported on February Recreation Commission meeting which she attended and istened to discussion on the position of maintenance director as recommended by the Citizens Advisory Committee The Commission authorized the Director to put an ad in his weeky coumn for a person for this position The Commission suggested that the Tree Seeding Program which has been handed by them for many years be passed on to the Conservation Counci The CAC at their meeting ast Wednesday evening agreed to take over this program of distributing tree seedings to the residents which wi probaby be sometime in Apri s Baard Town Ha Cornrnittee the project is moving aong on schedue the we has been dried The contractor pans to move his fied office in this week The footings wi be put in the second week of March On March Hayward and Pakan

9 f pb p wi attend a work shop session to discuss their suggestions on security ock systems The Town Board can take action on this phase at their first meeting in Apri s Baard Aquifer Test a work shop was hed on February with Dunngeoscience Morris Andros and Camo Poution Contro for the purpose of answering questions posed by the Board on this matter These agencies wi meet at the Hitop J we site to review the suggestions and recommendations made by Dunngeosciencei Camo and Morris Andros wi report their recom mendations to the Board reating to this test toward the end of March MRS BALLARD moved to send a copy of the report from Dunngeoscience to the Dutchess County Executive Lucie Patterson to be used by the Dutchess County Department of Panning in conjunction with the U S Geoogica Study being conducted in the Mid Hudson Area Paino n concusion s Baard noted that the Association of Town s Meeting was very informative and she took ots of notes When she sorts them out she wi type a report and eave it at the Town Cerk s Office for anyone interested in reading them s Paino Association of Town s Meeting very informative she aso took ots of notes and gave a brief report on some of the topics Buiding and Fire Prevention Code the instructor indicated that any municipaity can opt out of enforcing the Code by passing the authority on to the County f this is their intent it must be done by adoption of a Loca Law six months prior to the year they intend it to be effective The County may aso opt out of this enforcement of the Code by transferring it to t the State no time imit for them to change this authority t was recommended that oca governments enforce the Code themseves since they coud do a better job and it woud be ess expensive than the State performing this service Variances to these Codes no matter who enforces it must be reviewed by the State They do provide some financia aid to oca govern

10 r 7 ments and this year nine miion doars wi be distributed throughout the State so the Town shoud expect to receive the same amount as ast year for the Fire nspector Additiona engineers wi be provided by the State for technica assistance to the Towns Risk Management geared toward urban Towns and s Bookets were provided Paino wi pass one on to the Comptroer for her infor mation Municipaities are advised to review areas of past and current itigation aso areas of possibe itigation and determine their insurance needs The Attorney shoud check hod harmess causes in contracts Towns shoud reduce any area of iabiity and if possibe pace a cap on pain and suffering award and monetary cap on recovery A resoution under item 7a for this purpose wi be considered by the Town Board at the time it is paced in front of them The second item was discussion on municipa insurance rates wi continue to escaate at east L to 1987 Town shoud be aware of potentia iabiity regarding water poution and consider passing aquifer quaity protection aws Part of the aquifer test prepared by Dunngeoscience suggests an outine for rues and reguations for protection from contamina tion of pubic water suppy of the Town MRS PANO moved that a copy of this report be sent to the Conservation Advisory Counci for review of the rues and regua tions for a report to the Town Board and subsequent recommendation from them Baard Pubic Labor Reations update Since the Town Highway Department is panning to join the CSEA s Paino fet she coud get some input from the session A court case in the Town of Evans determined that empoyees engaging in poitics cannot be fired for poitica affiiations uness it affected their job performance A court case in Putnam County cautioned Town Board Members not to be directy invoved in the negotiations simce if they were invoved in a fairness this member woud have to vote in agreement with t

11 wg 0 the items incuded in the contract Negotiations may be open to the pubic and the press provided that both parties invoved in the negotiations agree to their presence s Paino Water and Sewer Committee at their February meeting with Camo Poution Contro they discussed the idea of couping costs to paint the tanks at Hitop Water Suppy and Maxwe Drive Water Tank both in CWWA and requested costs on sand basting i r the interiors paint and disinfect Mike Tremper recommended that they put costs together with other recommendations the Town may want to pursue per the Dunngeoscience report According to Tremper the D E C recommends that water tanks be painted every ten years and these two tanks have exceeded that time imit ncoronato Association of Towns gave the foowing report As the Wappinger Deegate to this Meeting he summarized his position on key resoutions voted on at the deegation The 16 proposas wi be presented to Governor Cuomo and the State Legisature for their consideration and support 1 Voted to use 1980 Census popuation statistics in the financia formua for determing State Aid to municipaities 2 Favored imiting court awards in suits against Towns Viages to maximum except where negigent death is at issue 3 Voted to urge that a ocay impemented state egisation such as senior citizens and veterans rea property exemptions be funded from state tax coffers rather than ocay 4 Voted for additiona state financia and technica assistance for estabishment and operation of regiona andfis 5 Voted to increase maximum fine for vioations of Town Law incuding zoning ordinance infractions from 250 to Defeated by majority but he voted for a change in state aw enabing Towns to set speed imits from 30 MPH to 55 MPH 7 Against aw to re estabish the State Advisory Commission on intergovernmenta reations Passed by majority ncoronato reported on repeated vioation of the Zoning Ordinance reating to the pacement of signs by Lawrence Farms 7 Despite the issuance of an Order to Remedy by our Zoning Administra tor this firm has not compied with our aw and now adding insut to injury have erected a fashing sign arger than the first one ocated on the shouder of Route 9 Athough ncoronato stopped and requested the manager to remove the sign by the end of ast week it was sti standing and fashing ast night prior to their cosing

12 J G9 time t was time to dea more stringenty with them ncoronato decided and urged the Attorney to the Town to issue an Order to Remedy and bring them to court if necessary to mandate compiance of the Town aw Resser responded that he woud work in conjunction with the Zoning Administrator in this matter McCuskey Association of Towns had contact with the Chairman of the New York State Commission of Cabe Wiiam Finneran He discussed the probems the Town has with cabe vision and evidenty the Town of Wappinger is not aone with their compaints on this service He obtained a copy of the new Federa Law which is difficut to interpret They discussed McCuskey s recommendation on a cabe committee with neighboring towns and Finneran was receptive to this idea and requested further information on its progress Next year McCuskey expects to speak at the sessions on this subject He obtained a copy of the Executive Law on Cabe TV and expects to confer with Kesser on interpreting ts contents He istened to a speech on assessing cabevision abeed drop ines and con nections as rea property The Assessor of a Town can tax tee phone company ines eading to a residence and the equipment attached to the buiding because it is considered a utiity the cabe companies brought this to the courts and won in the highest court due to a weak ink in the State Law which stated that cabe companies unike phone companies and eectric companies are not utiities The Town Officias were encouraged to contact their state representatives to request their consideration of a change in the aw whereby the cabe companies coud be considered a utiity and taxabe as such He sat in on a ong discussion on water probems and taxes throughout the stshe and obtained information on how to estabish part townwide districts and fu townwide districts and the ramifications invoved in their forma tion McCuskey found the Association of Town s meeting to be a very beneficia seminar Resoutions

13 1tJ d The foowing resoution was offered by COUNCLWOMAN PANO who moved its adoption WHEREAS in recent years the cost of tort iabiity for oca government has increased dramaticay especiay in New York State and WHEREAS New York is one of ony a few states with un imited iabiity exposure for oca government entities and WHEREAS such unimited iabiity has caused serious fisca probems for oca government budgets which combined with reductions in federa assistance and vo1iti1e economic conditions threatens the financia heath of pubic treasuries and diverts imited tax doars from the provision of essentia services and WHEREAS the unpredictabi1ity of arge damage awards and settements is a constant threat to many of the State s smaer jurisdictions which may simpy not be abe to afford a catas trophic oss and WHEREAS the State Legisation can take action to moderate oca government iabiity at no cost to the state be it RESOLVED that the Town of Wappinger respectfuy requests the New York State Legisature to pass and the Governor to sign into aw a bi s for the purpose and effect of 1 Amending the doctrine of joint and severa iabiity to imit damages governmenta defendants are required to pay to their equitabe share of judgements 2 Limiting recovery for non economic osses e g pain and suffering to cases where significant injury is proven according to objective standards 3 Estabishing a reasonabe cap on recovery against governmenta tort defendants or some other appropriate means of imiting oca government iabiity and be it further RESOLVED that this Town of Wappinger urges the State Legisature to act favorabe on the egisation currenty pending before it or a comparabe aternative thereto which woud accompish the aforementioned goas and be it further RESOLVED that this re S01ution pen GoveEn6ra tiario entutqt Cuomo and the members of the New York State Legisature Seconded by Counciman McCuskey Ro Ca Vote 5 Ayes 0 Nays A request was received from Morris Andros for payment of engineering costs for drainage improvement on Phase 5 in the amount of s Paino requested that this matter be tabed for further information on the vouchers invoved for thei work performed MRS PANO moved to direct a etter to Morris Andros requesting more specific breakdown on a vouchers and in regard to the three vouchers submitted for payment they woud ask that the hours invoved on these items be isted and the

14 dates that the services were performed Seconded by ncoronato s Paino noted that she had requested specific breakdowns on these vouchers ast year and spoke to the Comptroer regarding this matter but has seen no change in the vouchers Versace pointed out that these vouchers were for work requested by Town Board Members and there were charges invoved The drainage projects have a been approved by this Town Board or the previous Town Board and these bi is are egitimate expenses of the firm McCuskey agreed that vouchers shoud be more ceary carified he had no objections to paying for services rendered t woud ike to know exacty what they were paying for hours invoved and dates invoved it had nothing to do with Morris Andros individuay but a vouchers submitted to the Town shoud ceary state this information He disagreed with Versace s opinion that the disagreeing Board Members were insinuating that Morris Andros were padding their bis not so no such idea merey wanted further carification VetsaoentdirQcted that this item be tabed to the March 18th 1985 meeting The foowing resoution was offered by SUPERVSOR VERSACE who moved its adoption WHEREAS Southand Corporation made an appication for a specia use permit to have gasoine saes as we as a 7 Eeven Food Store at the corner of Route 9 and Od Hopewe Road in the Town of Wappinger and f t WHEREAS February 23 appication such specia use permit was issued on or about 1984 in accordance with a site pan contained in 715 and WHEREAS the Zoning Board of Appeas in acting on the appication for a specia use permit set forth certain conditions in the granting of the said specia one permit of which states There sha be no eft turn onto Hopewe Road permitted WHEREAS the Department of Pubic Works of the County of Dutchess has indicated that it does not have any objection to the aforementioned prohibition with respect to said condition

15 r i 1J NOW THEREFORE BE T RESOLVED that the Southand Corporation be instructed to obtain insta and maintain a sign indicating that no eft turn sha be aowed onto Od Hopewe Road from the 7 Eeven Food Store ocated on O Hopewe Road and Route 9 within thirty days of passage of this resoution and BE T FURTHER RESOLVED that a certified copy of this resoution be forwarded to the Department of Pubic Works Director of Engineering of the County of Dutchess at 38 Dutchess Turnpike Poughkeepsie New York Seconded by Counciwoman Paino j Ro Ca Vote 5 Ayes 0 Nays The origina resoution required the instaation of this sign by the Town Highway Superintendent however Versace fet it was the responsibiity of the owner according to the Panning Board s requirement and requested that the wording be changed to that effect t was McCuskey s opinion that due to the danger invoved in that access road they shoud not be providing any ertramce L or exib emm thed7 Eeven Store on to Od Hopewe Road this sit uation shoud be reviewed Versace fet that at a ater date this resoution coud be amended and suggested that McCuskey check with the County on possibe change for ingress and egress at that ocation but for now this resoution wi serve in the interim McCuskey sought a ega opinion from the Attorney on the procedure to fobwon changing certain conditions set forth by the Zoning Board of Appeas on the issuance of the Specia Use Permit Kesser responded that the ZBA woud have to initiate the procedure by motion to amend the S U P and hod another pubic hearing after notifying the Southand Corporation The foowing resoution was offered by SOPERVESOR VERSACE who moved its adoption WHEREAS the Town of Wappinger is in the process of having a ew Town Ha buiding constructed and WHEREAS it is intended that the present Town Ha Buiding is to be sod by the bwn of Wappinger Now BE T RESOLVED that the present Town Ha Buiding and premises ocated at Mi Street Wappingers Fas New York Grid more particuary described in a certain deed dated December and recorded in the Dutchess County Cerk s office as Liber 1161 at pg 147 be paced on the market

18 15 A request was received from C1assey Town Fire nspector to amend Loca Law 3 of 1983 Fire Prevention Code MR VERSACE moved to request the Attorney to prepare the necessary resoution for the Town Board to consider setting a pubic hearing on this amendment at the March meeting Seconded by ncoronato n response to McC1uskey s invitation to adjoining municipc ities to join with us in the formation of a Cabe Committee a etter was received from the Fishki11 Town Cerk forwarding the name of Peter Pastorini as the Town of Fishki1L s representative in the Committee if Wappinger proceeded with this idea Versace forwarded this communication to McCuskey as repre sentative of the Town of Wappinger A new Letter of Credit was forwarded from Buyakowski and M Godbout for Woodcrest Subdivision from the Fishki11 Nationa Bank in the amount of Evangeista had concerns on this Letter of Credit and had returned the origina Letter to the Bank unti these concerns were resoved The first pertained to two sanitary manhoes that did not appeared to be covered this was the second request and had not at this time seen compied with the second concern was the expiration date of June and he suggested an expiration date of six to nine months from acceptance of the etter by the Town which woud be anytime from September 30th to December expiration Versace recommended that the Attorney and the Engineer contact the attorney for the principas of Woodcrest Subdivision to resove these probems MR VERSACE moved to tabe this item to the March meeting Seconded by ncoronato A request was received from Wiiam MacGeorge to become tenant to the Watch Hi Water District at the ast meeting and referred to Evangeista to determine if this property was within the district Evangeista had not been abe to obtain a map of the district and requested additiona time to compete his investigation
