3 BILL No:03P.L.03 1 NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS 37TH CONSTITUTIONAL REGULAR SESSION, 2016 s Repubic of the Marsha Isands Jepipiin Ke Ejukaan JUDICIARY (AMENDMENT) ACT 2016 AN ACT to amend the Judiciary Act 1983, 27 MIRC Chp. 2, for the foowing four purposes: to amend 210(2) the Judiciary Act to expressy provide that associate justices of the High Court can be part-time justices; to amend 219 of the Judiciary Act to expressy mandate Court Rues for continuing ega education; to amend 219 of the Judiciary Act to expressy mandate Court Rues for the provision of pro bono and reduced-fee ega services; and to amend the Judiciary Act to add a new Section 279 that expressy provides for a code of judicia conduct. BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS 1. Short Tite. This Act may be cited as the Judiciary (Amendment) Act Amendment. (1) 210(2) of the Judiciary Act 1983, 27 MIRC Chp. 2 ( Judiciary Act ), is amended to read as foows: (2) The High Court sha consist of a Chief Justice and one or more other judges who sha be designated as Associate Justices of the High Court. An Associate Justice may be empoyed to work fu time or part time. An Associate Justice empoyed to work part time sha be paid such amounts as may be agreed upon by the Chief Justice and such judge; provided, however, that the amount of paid sha not exceed the pro rated saary of an Associate Justice based upon the highest saary payabe, and, if the judge is resident in the Repubic, pro rated Page3

4 BILL No:03P.L Judiciary (Amendment) Act 2016 monetary benefits, or, if the judge is non-resident, air fare and per diem. (2) 219 of the Judiciary Act is amended to read as foows: 219. Admission rues. Subject to this Chapter and any other aw the Chief Justice of the Supreme Court, with the concurrence of the Chief Justice of the High Court, or if the position of the Chief Justice of the High Court is vacant, then the Chief Justice of the Supreme Court acting aone, sha adopt rues that: (a) (b) (c) reguate the admission of persons to practice as an attorney at aw or tria assistant before any court and their continuing quaification to practice, incuding requirements for continuing ega education and requirements for pro bono or reduced-fee work in the Marsha Isands for the peope of the Marsha Isands who cannot afford ega counse or obtain free ega counse; estabish the standards of professiona responsibiity and conduct for any person practicing aw in the Repubic; and provide for the discipine, incuding suspension or disbarment, of any person practicing aw in the Repubic. (3) A new 279 is added to the Judiciary Act that reads as foows: 279. Code of Judicia Conduct. Consistent with the Constitution and any Act, the Chief Justice of the Supreme Court and the Chief Justice of the High Court sha adopt a code of judicia conduct for a courts, with provisions for the Judicia Service Commission to hande compaints. 3. Effective Date. This Act sha take effect on the date of certification in accordance with Artice IV, Section 21 of the Constitution. Page4 r
