1 THIRD REGULAR SESSION, 1390 AN ACT To make partial appropriations for the operations and activities of the Commonwealth Government and to provide budget authority for Fiscal Year 1991; and for other purposes. IT ENACTED BY THE NORTHERN MARIANAS COMMONWEALTH LEGISLATURE: CHAPTER 1. TITLE AND PURPOSE. Section 1. Short Title. This Act may be cited as the "Commonwealth First Partial Appropriations and Budget Authority Act for Fiscal Year 1991." Section 2. Purpose. This Act appropriates local funds from the General Fund for the operations and activities of the Government listed hereunder and provides budget authority for Fiscal Year 1991 commencing October 1, 1990 and ending September 30, Section 103. Definitions. As used in this Act: (a) "Local Funds" means locally generated.revenues and revenues received pursuant to Section 701(a) of the Covenant. (b) "Operations" means appropriations for all lawful activities other than personnel. (c) "Personnel" means appropriations for the base salaries, employer's contribution to the Northern Marianas Retirement Fund, overtime, night differential, hazardous pay and other employee benefits. (d) "Position" or ''Full Time Equivalent" (FTE) means a full time employment position in which only one 22 individual can be employed.

2 section 104. Estimated Revenues. House Concurrent Resolution 7-3 approves the revenues and resources identified by the Governor as available for appropriation in Fiscal Year 1991 and is hereby reiterated and classified for immediate reference: A. Local Funds: 1) Internal Revenues...$ l09,578,300 2) covenant Funds(Operations).$ 11,000,000 3) on-resident Workers Fee Fund (P.L. 5-32).... $ 3,000,000 Total Local Revenue and Resources subject to Appropriation...$ 123,578,300 Section 105. Allocation of Revenues. For the activities and operations of the Legislative and Judiciary Branches, the Office of the Washington Representative, and other activities of the commonwealth of the Northern Mariana Islands, there is hereby appropriated out of the Total Projected Revenues the sum of $7,920,500. CHAPTER II. PPROPRIATIONS. Section 201. Appropriation. Funds for personnel and operations for all activities are hereby appropriated as per the following Summary of Appropriations and the attached detail Appropriation Worksheets which are incorporated by reference in this Act. The FTE's identified are the maximum number of positions approved and authorized and shall not be exceeded.

ADMINISTRATION OF APPROPRIATED FUNDS Section 301. Administrative Guidelines. Funds appropriated under Chapter II of this Act shall be distributed and allotted by the Planning and Budget Affairs Office in accordance with the expenditure Class Codes approved in the individual activities' appropriation worksheets which are attached hereto. The funds appropriated shall be allotted at the beginning of each quarter to each budget activity at a rate not to exceed twenty-five percent (25%) of the amount

4 appropriated. (Consistent with the nature and need of each operation or activity, the Speaker of the House in the case of the House of Representatives, the President of the Senate in the case of the Senate, the Chief Justice of Supreme Court in the case of the judicial branch, and the Washington Representative in the case of the office of the Resident Representative to the United States may approve a quarterly allotment in excess of the twenty-five percent (25%) authorized for that operation or activity; provided, however, the aggregate amount allotted during the quarter for all activities shall not exceed twenty-five percent (25%) of the total appropriation. Section 302. Appropriation Worksheets. The detailed budget worksheets submitted by the Governor, as modified on May 30, 1990, may be used only as a guide. The detailed appropriation worksheets incorporated in this Act are the guidelines for the funds appropriated and shall be used as guidelines for the allotment and expenditure of funds. Unless otherwise provided in this Act, the funds appropriated shall be expended in compliance with the provisions of the Planning and Budgeting Act of 1983, 1 CMC Section 7101, et seq. Section 303. Legislative Budqet Authority. The budget authority for funds appropriated to the Legislature pursuant to the Summary of Appropriations shall be vested in the Senate president for funds allocated for the Senate, and in the Speaker of the House of Representatives for funds allocated for the House of Representatives. However, the authority to allocate and expend funds appropriated to the Minority in each

5 House shall be vested in the Minority Leader of each House. The President of the Senate and the Speaker of the House of Representatives shall allocate funds, each for his respective House, among the various members, and shall cause the establishment of allotment accounts over which the individual members shall have expenditure authority; provided, that each Minority Member of the House shall be allocated not less than $60, exclusive of that member's salary; and provided further that the remainder of the funds appropriated for the operations and activities of the House of Representatives shall be divided equally among the members of the majority of the House. The spending authority for the Legislative Bureau shall be vested in the Director of the Bureau. Funds appropriated to the Legislative Bureau shall not be expended other than for activities and operations of the Legislative Bureau. The salaries of the Legislative Bureau Director, Administrative Officer(s), and the professional staff of the Legislative Bureau shall be exempted from the provisions of public Law 4-32, as amended. Section 2 (b) of Public Law 4-32, as amended, shall not apply to the Legislators 1 salaries. Section 304. Resident Representative to the United States. The Resident Representative to the United States, referred to as the Washington Representative in the appropriation worksheet, may establish a compensation schedule for the salaries of the staffs hired pursuant to 1 CMC Section The salary schedule may be one comparable

6 to salaries established in the District of Columbia for similar positions, a schedule that may exceed the salary of the Resident Representative to the United States. section 305. Management of Funds. the Director of Finance shall not permit any branch, department, or division to expend more funds than are appropriated to it. section 306. Expenditure of Appropriated Funds. The Funds appropriated under Chapter II of this Act shall be expended by the expenditure authority provided in 1 CMC Section 7401 except as otherwise provided herein. Section 307. Reprogramming of Funds. Except for the Legislative Branch, reprogramming of funds appropriated under this Act shall be made in accordance with 1 CMC, Section section 308. Lapsed Appropriations. (a) Funds appropriated under this Act for new or vacant positions shall not be reprogrammed. (b) Funds appropriated for other categories and not obligated as of September 30, 1991, shall revert to the General Fund. Section 309. Building Improvement. The appropriation under Section 201 (d) of this Act shall be spent for government building improvements to the Commonwealth government building now occupied by the Legislature, and for renovation of the government housing assigned tot he Legislature. the spending authority shall be vested with the Director of Public Works. The funds appropriated shall not be reprogrammed for any other purposes and shall be available until fully expended and without fiscal year limitation.

If any provision of this is held invalid by a court of competent jurisdiction, the remainder of this Act shall not be affected thereby. Section 312. Effective Date.
