1 RICHARDSON COUNTY BOARD OF COMMISSIONERS JANUARY 27, 2015 CALL TO ORDER The regular meeting of the Richardson County Board of Commissioners was called to order by Chairman Sickel at 9:00 a.m. on Tuesday, January 27, Roll call was answered by Standerford, Davidson and Sickel. The Invocation was given by Chairman Sickel and the Pledge of Allegiance was led by Vice- Chairman Davidson. Chairman Sickel announced that the open meeting laws have been posted at the entrance to the meeting room. Motion was made by Davidson to approve the minutes of the January 20, 2015 meeting as read. Motion seconded by Standerford. ROLL CALL VOTE: Standerford-aye, Davidson-aye, Sickel-aye. Motion carried. Motion was made by Davidson to approve the Board of Equalization meeting minutes of January 20, 2015 as presented. Motion seconded by Sickel. ROLL CALL VOTE: Standerford-aye, Davidson-aye, Sickelaye. Motion carried. Motion was made by Standerford to approve the agenda as posted. Motion seconded by Sickel. ROLL CALL VOTE: Standerford-aye, Davidson-aye, Sickel-aye. Motion carried. The agenda is posted at the Richardson County Courthouse on the First Floor Lobby, the Commissioner s Meeting Room, the Third Floor of the Sheriff s Office and on the Richardson County website NOXIOUS WEED CONTROL Motion was made by Sickel to approve the Annual Budget and Activity Report for the Richardson County Noxious Weed Control program to be submitted to the NE Dept. of Agriculture. Motion seconded by Davidson. ROLL CALL VOTE: Standerford-aye, Davidson-aye, Sickel-aye. Motion carried. ROAD & BRIDGE DEPT. Scott Huppert, Highway Superintendent, updated the Board on the routine maintenance being done on County roads and bridges this week. Bridge projects were reviewed. Information received at a workshop that Huppert attended last week was reviewed. Mr. Huppert also informed the Board that a safety meeting will be held at 7:30 a.m. on Friday, January 30 for all road employees Motion was made by Sickel to approve the right-of-way acquisition and easement documents for the culvert project C-74( ) with Nemaha County, Nebraska on 720 Road between 641 and 642 Avenue. Motion was made by Standerford to approve the right-of-way acquisition and easement documents for the project RC 35 located on 711 Road, approximately 1 mile west of Dawson. 2 Brian Dixon, EMA Director met with the Board to review the correspondence from the NE Emergency Management Agency regarding Local Emergency Operations Plan due for revision before May 31, Brian indicated that he would be reviewing the plan and making the necessary revisions to present to the Board for approval before the May 31 deadline. A brief review was held on the county owned radio reception and what plans are being made to improve the reception. SHERIFF POUNDS Sheriff Pounds requested to meet with the Board to receive approval for the hiring of SHERIFF POUNDS (Cont.) Steve Smith as a part-time deputy who resides out of the county and the state. Motion was made by Sickel to approve the hiring of Steve Smith who resides in Kansas to serve as a part-time deputy sheriff. Motion seconded by Standerford. JONES AIR CONDITIONING The Board requested to meet with Gary Jones to review a bill submitted for additional expenditures during the air conditioner replacement. RICHARDSON COUNTY FARM BUREAU Quinten Bowan and Justine Petsch of Nebraska Farm Bureau met with the Board on behalf of the Richardson County Farm Bureau to request a designation from the County Board of Commissioners to become a Livestock Friendly County. The Board indicated that they would pursue this designation. Chairman Sickel declared a recess for lunch at 11:55 a.m. The Board reconvened at 1:10 p.m. PROCHASKA & ASSOCIATES Doug Merz, County Attorney, reviewed with the Board and Prochaska & Associates concerns that he sees included in the proposed architectural services agreement that would obligate the county to pay the architect the full amount of the fees for the architect services based on the estimated project costs whether the project is approved for building or not and that the County should be able to keep the blueprints for the plan if a decision was made at a later date to proceed with the building. After a few changes were made to the agreement, 1) Article 9.6 strike an all Termination Expenses as defined in Section 9.7; 2) Article 9.7 strike the entire contents; 3) Article 11.9, second paragraph strike as part 508

3 of the Termination Expenses set forth in Section 9.7 ; a motion was made by Standerford to enter into an agreement with Prochaska & Associates for the architectural services for the construction of the Richardson County Law Enforcement Center. (Resolution Book 22, Page 20) Motion was made by Davidson to approve the release of the project for bidding of the Law Enforcement Center with bids to be received and opened on Tuesday, March 3, at 2:00 p.m. Motion seconded by Sickel. JET PLAIN, Demonstration of Equipment The Board was invited to watch a demonstration of equipment that Jet Plain had brought to the Falls City area. However, with the obligations that were needed at the meeting, the Board was unable to watch the demonstration. CORRESPONDENCE/OTHER Pearson Point Cemetery Motion was made by Sickel to set a public hearing date for February 17, 2015 at 11:30 a.m. to receive comment from the public to declare a cemetery abandoned and neglected which is (2 acres) located in the NE ¼ of the SE ¼ of the NW ¼ of Section 24, Township 1, Range 16E located approximately 1 mile east of Falls City on Hwy 159 to 653 Blvd then 1.25 miles south in Richardson County.
