1 Shepherdstown Town Council Meeting Minutes Tuesday, October 10, 2017 Shepherdstown Town Hall 6:30 p.m. DRAFT Present: Jim Auxer (Mayor), Lori Robertson (Recorder), Jim Ford, Mark Everhart, Cheryl Roberts, Jim Ford, David Rosen, and Deb Tucker. Absent: None Staff: Chief Mike King, Public Works Director Frank Welch Visitors: Marianne Davis, Andrew Temple, Adam Solich, Carol Asam, Terry Fulton, Peter Smith, Jessie Ward, and Chris Cifiero. Agenda Items 1 and 2-Call to order/approval of Town Council Minutes (vote required): Call to order by Mayor Auxer at 6:31 pm. M. Everhart - If there are no objections, move to approve the Town Council Minutes of September12, 2017 with the venue correction from the Community Club to Town Hall. None noted. Agenda Item 3 Public Comment Period: Comments are listed under each agenda item. A. Solich with the VFW is looking to recruit members, and a venue that can accommodate members. He detailed what the VFW does. They help younger vets, support dogs, insurance claims, job placement, and suicide issues. Mayor suggested he check with Shepherd University for a meeting space. D. Tucker suggested the new owners where Shaharazades used to be could be a meeting place as well. C. Roberts suggested contacting volunteer services at the VA. 2 B. J. Ward mentioned the Hands Across the Potomac event Sat. October 14 th noon-2pm. This is in opposition of the pipeline. Agenda Item 4 - Visitors: Visitor s comments, if any, are logged in under the specific agenda items. a. Visitor s Center Report M. Davis handed out new brochures about the Cement Mill and The Battle of Shepherdstown. The VC numbers are still down location is the issue. It was suggested the VC have Open on both sides of their sign outside. Upcoming events include the Suicide Awareness March, Am. Conservation Film Festival, BooFest, Halloween, Xmas in Shepherdstown, and the Book Sale at the Community Club. Agenda Item 5 Public Hearings: a. Second Reading of an ordinance to amend Chapter 10, Title 9 of the Code of Shepherdstown in accordance with the Code of the State of West Virginia. Mayor a clarification for the Board of Appeals. M. Everhart if there are no objections, move to approve the Second Reading of an ordinance to amend Chapter 10, Title 9 of the Code of Shepherdstown in accordance with the Code of the State of West Virginia. None noted. Agenda Item 6 Unfinished Business: Agenda Item 7 New Business: A. Event requests Shepherdstown Visitor s Center Christmas in Shepherdstown November 24-December 24, M. Davis the theme is the 18 th Century. They hope to nail down the lights in the next ten days. They don t have the money in the VC budget for the lights. D. Tucker the VC needs town assistance in purchasing lights and paying for the lift. The lift and 2

3 electrician has a max. of $2K budgeted. The lights are on for BooFest. Mayor the finance committee set aside some money. D. Rosen the town should invest in permanent lights for the tops of the buildings and keep them on year around. L. Robertson agreed. Should use larger bulbs with a central on /off switch. D. Rosen will inquire about an estimate. L. Robertson if there are no objections, move to approve Christmas in Shepherdstown. None noted. CASA of the Eastern Panhandle, Inc. CASA River Century Bike Ride - May 19, 2018 Carol Asam This ride helps abused and neglected children. D. Tucker if there are no objections, move to approve the CASA Bike Ride May 19, None noted. Black Box Arts Center Fife and Drums Corps. For parade to Colonial Tea Party December 9, This event has been withdrawn. Approval of Recycling Task Force - L. Robertson this is to explore the potential ban of Styrofoam, plastic bags, and possibly plastic straws. The members include L. Robertson, Chris Stroech, Liz McGowen, and Shane Broadwater all residents of the corporation. It was suggested to implement slowly. D. Tucker if there are no objections, move to approve the Recycling Task Force. None noted. Jefferson County Emergency Operations Plan Resolution F. Welch explained this has to be adopted every year. It is quite an extensive plan. We work with the county, and Barb Miller has been excellent to work with. C. Roberts - if there are no objections, move to approve the Jefferson County Emergency Operations Plan Resolution. None noted. 3

4 Agenda Item 8. Mayor s Report: Recognition of the Shepherdstown Rotary Club for cleanup efforts of the Rumsey Bridge. Mayor Rotary did a great job on the bridge. It is a gateway into town from Maryland. Thanks to F. Welch for hauling away the debris from the bridge. We are also working on the bridge lights. The events have been great this year. Thank you to: Freedom s Run was awesome, Shepherdstown Street Fest had super donations to their charities, and SAIL helps people stay in their homes. The Century Bike Ride spent a lot of money in town and donated to good causes. Agenda Item 9 Reports of Committees: A. Finance Committee: 1. No meeting in September 29, Finance Reporting: 3. Recommendations: a. Participate in the Eastern WV Community Foundation Program. D. Rosen - This program assists homeowners with sidewalk repairs through the granting of funds. Shepherdstown would have input on the grant guidelines. A manager would manage it. The foundation will administer it and we can get people to donate to it. The corporation has $45K set back from the now defunct Housing Authority. No vote tonight. b. Investment towards CATF Economic Impact Study in the amount of $5K for FY and $5K for FY with conditions. J. Ford many interviews will be conducted and real data will be gathered as to how CATF impacts the town. This is meaningful data, and money well spent. It will show how to make more money for the town. A town rep will be part of this process, and J. Ford has volunteered to do it. M. Everhart if there are no objections, move to approve $5K for and $5K for investment towards the CATF Economic Impact Study. None noted. 4

5 B. Police Committee 1. Meeting minutes of September Police Department Monthly Report September Recommendations: a. Adoption of domestic violence ordinance b. Adoption of stalking ordinance Chief this gives the SPD more latitude on punishment and mimics everything in the state statute. D. Tucker if there are no objections, move to approve the adoption of the domestic violence ordinance, and the adoption of the stalking ordinance. None noted. C. Parks and Recreation Committee: 1. Meeting minutes of September, Recommendations: None Agenda item 10 Report of Commissions, Authority and Boards: A. Recommendations: None C. Planning Commission: 1. Meeting minutes of September 18, Recommendations: a. Appointment of two new members: Christopher Cafiero and Terrence Fulton T. Fulton lived in town for 5 years, does land acquisitions and real estate. J. Ford if there are no objections, move to approve Terrence Terry Fulton to the Planning Commission. None noted. 5
