King III Chris Heard, City Administrator June 12, 2018 The Dickinson City Council met in a duly called and announced REGULAR MEETING on Tuesday, June 12, 2018, at 7: 00 p. m. The meeting was held in the City Council Chambers located at 4403 Highway 3, Dickinson, Galveston County, Texas, and was held for the purpose of considering the following items: ITEM 1.) CALL TO ORDER Mayor Pro Tem Deats called the meeting to order at 7: 00 p. m. ITEM 2.) INVOCATION Pastor Jarrod Dawsey from Bethel Evangelistic Church gave the invocation. ITEM 3.) PLEDGE OF ALLEGIANCE Council Member Suderman led the Pledge of Allegiance. ITEM 4.) ROLL CALL City Secretary Alun Thomas called roll and certified a quorum. Council Members present were as follows: Mayor Pro -Tem Wally Deats, and Council Members Charles Suderman, Bruce Henderson, Walter Wilson, Louis Decker, and William H. King, III. Mayor Julie Masters was absent. Also present were City Administrator Chris Heard, Assistant City Administrator/ Chief Financial Officer Stephanie Russell, City Attorney David Olson, Management Assistant Gabrielle Bernal, Director of Community Development Zachary Meadows, Director of Public Works Bryan Milward, Police Chief Ron Morales, Police Captain Jay Administrator Irma Rivera. Jaekel, and Court ITEM 5.) PROCLAMATIONS AND ANNOUNCEMENTS: A. Proclamations. B. Announcements. a. Council Comments. Welcome and thank you to all for attending the meeting. Congratulations to Council Member Suderman and his wife, who celebrated their 50th wedding anniversary on June 1. June 12, 2018 Regular Council Meeting Minutes Page 1 of 17

2 Hurricane season has begun, and everyone is asked to make their hurricane plans now, including looking into purchasing flood insurance. Please pay attention to the weather and be prepared. This year is expected to be a more active year than average for hurricanes. The City is aware of the drainage concerns and issues around Dickinson, takes them seriously, and is working to correct the problems. Preparations for the new Bayou Animal Services animal shelter have been progressing well, and we are working diligently to keep the building within the allocated budget. Donations to assist with the construction of the facility are welcomed. The Fifty Club of Galveston County presented a check for 10, 000 to an officer who was injured during the recent shooting at Santa Fe High School. The officer is on his way to recovery. The city is showing increasing signs of recovering from Hurricane Harvey. School is out for the summer, and there will be more children out and about in the city. Please take care while travelling through the area. Congratulations to Vicki Mims on her recent retirement from Dickinson Independent School District. Thank you to Police Chief Ron Morales and Sergeant Tim Cromie for keeping everyone abreast of the ongoing changes due to the construction occurring along Interstate 45. On Saturday, the National Association for the Advancement of Colored People will host a Juneteenth breakfast Mount Olive Missionary Baptist Church to honor the important day in our nation' s history. Thank you to the Council Members and citizens who attended the Houston - Galveston Area Council meeting last week regarding Hurricane Harvey recovery fund allocations. Condolences to the Clay and Calwell families on their recent losses. b. Update on Public Works Projects. Director of Public Works Bryan Milward gave an update on his department' s activities, and informed Council that Streets Foreman Mike Pilsner will be retiring soon. Mr. Milward expressed his appreciation for Mr. Pilsner' s work and support over the years. c. Update on Activities of the Dickinson Economic Development Corporation. Economic Development Director Angela Forbes gave an overview of the Corporation' s recent activities, and addressed questions. June 12, 2018 Regular Council Meeting Minutes Page 2 of 17

3 d. Houston -Galveston Area Council Method of Distribution Round Two Update. City Administrator Chris Heard provided a brief summary of the Houston -Galveston Area Council Method of Distribution Round Two process, and noted that any unexpended funds from other entities during Round Two will automatically by reallocated to the City of Dickinson before any other entity. The City is ready with projects and able to expend any funds that may be received through such an allocation. Mr. Heard also informed Council that Round Three of the process will begin soon, and approximately $ 5 billion will be allocated during that round. that another ITEM 6.) PUBLIC COMMENTS: At this time, any person with city -related business may speak to the Council. In compliance with the Texas Open Meetings Act, the City Council may not deliberate. Comments from the public should be limited to a maximum of three ( 3) minutes per individual speaker. Before comments from the public were heard, Mayor Pro Tem Deats received clarification from City Attorney David Olson concerning the rules regarding Council' s interaction with the public during the public comments item. Libby Moreno, 2307 Hughes Road, Dickinson, Texas Ms. Moreno asked that Council reappoint Dr. Darrell Carney to the board of Dickinson Economic Development Corporation ( Item 25A on this agenda), as she feels that he is a great asset to Dickinson in that capacity. Lashandrea Johnson, 9415 Coast Bridge, Houston, Texas Ms. Johnson plans to open a driving school ( as will be addressed in Items 10 and 11 on this agenda), and would like the Council' s approval to do so. ITEM 7.) CONSENT AGENDA: CONSIDERATION AND POSSIBLE ACTION: The following items are considered routine by the City Council and will be enacted by one motion. There will not be a separate discussion on these items unless a Council member requests, in which event, the item will be removed from the consent agenda and discussed after the consent agenda. A. Approval of the Minutes of the Regular Council Meeting of May 22, B. Resolution Number A RESOLUTION OF THE CITY OF DICKINSON SUSPENDING THE JULY 5, 2018 EFFECTIVE DATE OF TEXAS -NEW MEXICO POWER COMPANY' S ( TNMP' S) REQUESTED RATE CHANGE TO PERMIT THE CITY TIME TO STUDY THE REQUEST AND TO ESTABLISH REASONABLE RATES; June 12, 2018 Regular Council Meeting Minutes Page 3 of 17

4 APPROVING COOPERATION WITH OTHER TNMP CITIES; HIRING LLOYD GOSSELINK ATTORNEYS AND CONSULTING SERVICES TO NEGOTIATE WITH THE COMPANY AND DIRECT ANY NECESSARY LITIGATION AND APPEALS; FINDING THAT THE MEETING AT WHICH THIS RESOLUTION IS IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; REQUIRING NOTICE OF THIS RESOLUTION TO THE COMPANY AND LEGAL COUNSEL. C. Quarterly Investment Report & Financials for Period Ending March 31, Council Member Wilson made a motion to approve the Consent Agenda, and Council Member King seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. OLD BUSINESS NEW BUSINESS At this time, Mayor Pro Tem Deats asked that Items 22 and 23 be considered before continuing to Item 8. There were no objections. ITEM 22.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Resolution Number A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DICKINSON, TEXAS, PROVIDING FOR THE TERMINATION OF THE AGREEMENT BETWEEN THE CITY OF DICKINSON AND GREGG GREGG P. C. TO PROVIDE PROSECUTORIAL SERVICES EFFECTIVE ON JUNE 30, 2018 TO ALLOW FOR THE APPOINTMENT OF DICK H. GREGG, III, AS THE PRESIDING MUNICIPAL COURT JUDGE TO BE EFFECTIVE ON JULY 1, 2018; ESTABLISHING THE TERMS AND CONDITIONS FOR THE PROVISION OF MUNICIPAL COURT JUDGE SERVICES; PROVIDING FOR THE INCORPORATION OF PREMISES; AND PROVIDING AN EFFECTIVE DATE. Court Administrator Irma Rivera introduced the item, and informed Council that both Judge Cope and City staff support passing the resolutions in Items 22 and 23. 5 Member Henderson confirmed with City Attorney David Olson that it was legally acceptable to both terminate an agreement and make an appointment to a different position in the same resolution. CONSIDERATION AND POSSIBLE ACTION CONCERNING: Resolution Number A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DICKINSON, TEXAS, APPOINTING LATICIA FUHR AS MUNICIPAL COURT PROSECUTOR FOR THE CITY OF DICKINSON; PROVIDING FOR THE INCORPORATION OF PREAMBLE; APPROVING AN AGREEMENT FOR PROFESSIONAL MUNICIPAL COURT PROSECUTION SERVICES BY AND BETWEEN THE CITY OF DICKINSON, TEXAS AND LATICIA FUHR; AUTHORIZING EXECUTION OF THE AGREEMENT BY THE MAYOR; AND PROVIDING AN EFFECTIVE DATE. Council Member Suderman made a motion to approve the resolution, and Council Member Decker seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. At this time, Mayor Pro Tem Deats returned to Item 8. ITEM 8.) CONDUCT A PUBLIC HEARING CONCERNING: SUP , A Request For A Specific Use Permit On Approximately Acres, For Automotive Sales" In The " GC" ( General Commercial) Zoning District, Legally Described As Abstract 19 Perry & Austin North 1/ 2 Of South % Of Block 149 Addition D Dickinson, Generally Located West of Highway 3 and North of Holly Drive, With The Address Being 3618 Highway 3, Dickinson, Texas Mayor Pro Tem Deats opened the public hearing at 7: 43 p. m. A. Staff Presentation Director of Community Development Zachary Meadows presented the item to Council and informed Council that the Planning and Zoning Commission recommended in a 6-1 vote to deny the Request for a June 12, 2018 Regular Council Meeting Minutes Page 5 of 17

6 Specific Use Permit because the proposal does not comply with the Highway 3 Overlay District requirements and goals. B. Applicant' s Statement The Applicant, Mousa Ennab Issa, addressed Council and explained his proposed use of the property. C. Those In Favor D. Those Opposed David Robinson, 2503 Holly Drive, Dickinson, Texas Mr. Robinson lives adjacent to the property, and he is not necessarily opposed to the proposal, but would like more information about the Applicant' s intentions. E. Applicant' s Rebuttal The Applicant informed those present that the rear of the lot is zoned for residential use, and would be fenced off from the commercial lot. F. 7 Council Member King made a motion to approve the first reading of the ordinance, and Council Member Henderson seconded the motion. The Applicant informed those present that the rear of the lot is zoned for residential use, and would be fenced off from the commercial lot. At some point in the future, he may wish to build himself a home on the residential portion. He plans to have approximately 50 vehicles for sale on the commercial part of the lot, and understands that he is not allowed to use the lot for vehicle storage. The Applicant also clarified the intention of having a garage on the property, informing Council that the garage would only be for simple maintenance and repairs of vehicles that are already owned by the dealership. Council discussed the additional requirements of the Highway 3 Overlay District and the additional burdens that property owners face. City Attorney David Olson reminded Council that they must only consider the use and merit of the application. There being no further discussion, Mayor Pro Tem Deats called for the vote. 1 AYE ( King) 5 NAYS ( Suderman, Henderson, Wilson, Deats, Decker) City Attorney David Olson asked that, for the sake of clarity, Council make a motion to deny the proposed amendment. Council Member Henderson a motion to deny the proposed amendment, and Council Member Wilson seconded the motion. A. Staff Presentation Director of Community Development Zachary Meadows presented the item to Council and described the proposed use for the property. He noted that the Planning and Zoning Commission recommended approval of the Specific Use Permit during its June 5, 2018 meeting. B. Applicant' s Statement None; the Applicant was not in attendance at the meeting. C. Those In Favor D. Those Opposed Mary Dunbaugh, 2701 Colonial Drive, Dickinson, Texas Ms. Dunbaugh likes the idea of the business, but is concerned about its proximity to the Little League baseball fields, and about the congestion that the business might bring. Council Member Wilson made a motion to approve the first reading of the ordinance, and Council Member Henderson seconded the motion. Council Member Henderson confirmed that the Specific Use Permit would only be granted if the barbed wire is removed and additional landscaping is installed. CONDUCT A PUBLIC HEARING CONCERNING: A Request To Amend The Official Zoning Map Of The City Of Dickinson On Approximately ± Acres, To Change The Zoning From General Commercial ( GC) To Interstate Commercial ( IC) On Property Generally Located Along the East and West Sides of Interstate 1-45, North of Dickinson Bayou, More Particularly Described By Metes and Bounds and Included As Exhibit A & B, In The City Of Dickinson, Galveston County, Texas. Mayor Pro Tem Deats opened the public hearing at 8: 26 p. m. A. Staff Presentation Director of Community Development Zachary Meadows presented the item to Council. B. CONSIDERATION AND POSSIBLE ACTION CONCERNING: Ordinance Number XXX AN ORDINANCE OF THE CITY OF DICKINSON, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, ORDINANCE NUMBER , AS HERETOFORE AMENDED, SO AS TO REZONE APPROXIMATELY +/ ACRES, GENERALLY LOCATED ALONG THE EAST AND WEST SIDES OF INTERSTATE 1-45, NORTH OF DICKINSON BAYOU, MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AND INCLUDED AS EXHIBIT A & B, IN THE CITY OF DICKINSON, GALVESTON COUNTY, TEXAS, FROM GENERAL COMMERCIAL ( GC) TO INTERSTATE COMMERCIAL ( IC); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $ 2, 000 FOR EACH DAY OF VIOLATION HEREOF; AND PROVIDING A REPEALER CLAUSE, A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE Council Member Henderson made a motion to approve the first reading of the ordinance, and Council Member Decker seconded the motion. Director of Community Development Zachary Meadows explained the potential impact to the area from the ongoing widening of Interstate 45. There being no further discussion, Mayor Pro Tem Deats called for the vote. ITEM 16.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Decision And Order On Application For Variance Regarding the Allowable Signage, On Property Legally Described As Abstract 19 Perry & Austin Survey Lot 1 McDonalds At FM 517 & IH 45 ( 2002), Generally Located West of Interstate 45 and South of FM 517, With the Address Being 3706 Gulf Freeway, Dickinson, Texas Council Member Henderson made a motion to approve the variance, and Council Member Suderman seconded the motion. After a discussion concerning the reason for the sign being moved ( the widening of Interstate June 12, 2018 Regular Council Meeting Minutes Page 11 of 17

12 45 necessitates it), it was the consensus of Council that such an involuntary relocation of the sign should allow the property owner to move their existing sign as -is, and not compel them to come into compliance with the existing sign regulations. Council Member Henderson made a motion to approve the resolution, and Council Member Decker seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. ITEM 18.) CONDUCT A PUBLIC HEARING CONCERNING: To Consider Proposed Assessments Against Bayou Maison Section One Properties In The City Of Dickinson Public Improvement District Number Three Established By City Council Resolution No Mayor Pro Tem Deats opened the public hearing at 8: 52 p. m. 14 NECESSARY TO EFFECTUATE AN AGREEMENT FOR SUCH SERVICES IN AN AMOUNT NOT TO EXCEED $ 315, ; PROVIDING FOR THE INCORPORATION OF PREAMBLE; AND PROVIDING AN EFFECTIVE DATE. Council Member King made a motion to approve the resolution, and Council Member Decker seconded the motion. City Administrator Chris Heard and Assistant City Administrator/Chief Financial Officer Stephanie Russell agreed to review the bid to determine if a deadline is included. There being no further discussion, Mayor Pro Tem Deats called for the vote. As Items 22 and 23 were considered earlier in the meeting, Mayor Pro Tem Deats proceeded to Item 24 at this time. ITEM 24.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Resolution Number A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DICKINSON, TEXAS, APPROVING THE SUBMISSION OF AN APPLICATION FOR FEDERAL ASSISTANCE SF -424 FROM THE USDA, NATURAL RESOURCES CONSERVATION SERVICE, EMERGENCY WATERSHED PROTECTION PROGRAM; AND PROVIDING FOR INCORPORATION OF PREAMBLE AND AN EFFECTIVE DATE. Council Member Wilson made a motion to approve the resolution, and Council Member King seconded the motion. City Administrator Chris Heard informed Council that he is working with the State of Texas to secure the matching funds, so the program would likely be cost -neutral to the City. If the city is offered funding, the approval of the agreement and an analysis of the true cost to the City would come at a later time. There being no further discussion, Mayor Pro Tem Deats called for the vote. ITEM 25.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Appointments/ Reappointments to Boards and Commissions: City Secretary Alun Thomas informed Council that, since the agenda packet was sent out, Chris Tucker confirmed his desire to continue to serve on the Dickinson Education Finance Corporation. 15 Shamarion Barber would like to continue to serve on the Board of Adjustments. A. Dickinson Economic Development Corporation. Council Member Henderson made a motion to reappoint Mark Townsend and Darrell Carney, and to appoint Chris Heard. Council Member Suderman seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. B. Dickinson Education Finance Corporation. Council Member Wilson made a motion to reappoint Chris Tucker, Margaret Carney, Deborah Fortner, and Jonathan Rodriguez; and to appoint Joan Malmrose. Council Member Suderman seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. C. Dickinson Management District No. 1. Council Member Henderson made a motion to appoint Garland Copelin. After a brief discussion about a possible conflict due to Mr. Copelin' s current position on the Board of Directors for Galveston County Water Control and Improvement District No. 1, Council Member Henderson rescinded his motion. Council Member Wilson made a motion to appoint Johnnie Simpson, and Council Member Suderman seconded the motion. There being no discussion, Mayor Pro Tem Deats called for the vote. 16 D. Board of Adjustments. Council Member Suderman made a motion to reappoint all listed members, and Council Member King seconded the motion. After receiving clarification that no vacancies on the Board currently exist and that reappointments were therefore not necessary, Council Member Suderman withdrew his motion. Council Member Deats made a motion to remove H Scott Apley from the Board, and Council Member Wilson seconded the motion. There being no further discussion, Mayor Pro Tem Deats called for the vote. ITEM 26.) EXECUTIVE SESSION: The City Council will now hold a closed executive meeting pursuant to the provision of Chapter 551, Government Code, Vernon' s Texas Codes annotated, in accordance with the authority contained in: A.
