6 TO: FROM: Honorable Mayor and City Council Members Kellis George, Director of Public Works DATE: February 1, 2013 SUBJECT: Monthly Project Report January 2013 Culvert Cleaning The Department cleaned storm culverts at the following location(s) in January for a total of 980 feet in culvert cleaning: Ohio Ave 124 Bayou Crest Cir 102 Easy St Commodore Dr th Ave th Ave 52 Pothole Repairs A pothole patching crew has been continuously out repairing potholes. Street Light Outages Staff is continually working on identifying and tracking the progress of street light outages. Civic Services The Public Works staff is continually working on handling all requests submitted on Civic Services. Incentive Program Princeton Rideaux had the most points for the 1 st quarter, Initiative, Tommy Hernandez was second. The objective for the second quarter of FY is Team Work. Training Kellis George and Jennifer Fisk attended the Olson & Olson seminar in Stafford on January 31 st. PUBLIC WORKS MONTHLY PROJECT REPORT JANUARY 2013 Page 1

7 Fair Housing Meeting Ms. Fisk attended the Fair Housing Work Group Meeting on January 17 th. Light Equipment Operator Staff advertised for the Light Equipment Operator position. Few applications were received and none were qualified. Mr. George has decided to promote from within the department and hire one of the part time employees as full time. Dickinson Street Rehabilitation 2013 Kellis George met with Rayferd Colburn, General Superintendent of AAA Asphalt on January 28 th to discuss the Street Maintenance Sales Tax projects and the schedule. Reconstruction on Yacht Club Dr and 42 nd St has started. Lime has been mixed and AAA will begin setting forms on February 11 th. Multi-Year Financial Plan - Kellis George met with the Finance Department to submit and discuss the multi-year plan for the Public Works Department. Storm Water Inspections As part of the new storm water permit, inspections were done at the site of 4 new homes being built - 3 on Coral Cliff Dr. and 1at 4314 E 30 th St. Contractors were notified of violations and all corrections were made soon after. 10 TEXAS DEPT OF PUBLIC SAFETY 2 RESERVE OFFICER 2 Total Violations 222 Court calendar for February 2013 as follows: February 6 th & 13 th Adult Arraignment Hearings February 4 th Attorney 1:00 p.m. February 25 th Non-Attorney with City Prosecutor February 18 th Juvenile Hearings February 27 th Bench Trial Judge Richard Cope will be attending the Regional Judges Seminar on February at the San Luis Resort in Galveston, Texas. The Regional Judges Seminars offers up to 16 hours of judicial education, including the optional 4-hour pre-conference session offered the day before the seminar. The seminar is the required continuing education hours need yearly for judges Great Texas Warrant Round Up is set for February 16 th through March 10 th once again the Municipal Court in conjunction with the Police Department will be participating in the event. AGENDA FOR WARRANT ROUND UP 2013 February 15, 2013 Press conference held will be at Herbert W. Gee Municipal Courthouse located at 1400 Lubbock Street, Houston, TX with all participating agencies. Flyers will be mailed out from the Court Department and Collection Company. February 16, 2012 Thru March 1, 2013 Officers are ordered not to serve warrants for the next two weeks. During these two weeks defendants are permitted to contact the court in person or phone to obtain information on how to handle their warrants without the fear of being arrested. It is the court s hope that the defendants will come in or call, to request options/agreements with the office. Court officials are ordered to update all information and list defendant as a possible arrestee if he or she does not come in to take care of warrant. Capias Warrant will be treated as usual with at least half down. A credit application will be required along with verification of all information presented by defendant before a new payment plan will be instated. Page 2

11 Arrest Warrants the defendant is allowed to post his or her cash bond or bail bond without being arrested at the Court Office during the court s working hours. If defendant wants a payment agreement for the Arrest Warrant he or she will be ordered to fill out a court payment application along with a plea of guilt or nolo contender. The application along with the plea form will be given to the Judge for approval. The terms of the agreement will be set forth by the Judge. Once approved the defendant is then called back to sign payment agreements along with whatever payment is required to start said agreement. Update names and address of all who call or come in to inquire about warrants. March 2, 2013 March 10, 2013 Submit Statistics March 29, 2013 Officers are permitted to arrest defendants for outstanding warrants. The defendants that fail to follow up after their initial contact during the two week period, will be the first to be arrested. A list of defendants with updated address will be provided to the officers. The hope is that early Saturday morning officers will have defendants arrested and brought to jail. 12 To: Mayor & Council Members From: Chief Ron Morales Date: Re: February 4, 2013 January News Administrative Services Completed the installation of the new narrowband base VHF radio for Fire & EMS paging to be in compliance with the January 1, 2013 mandate. Attended the GHAC Grant Workshop for the FY2014 VOCA Grant application. Met with staff to discuss the program agenda for the upcoming National Crime Victim s Rights Week program too be held at City Hall on April 24, 2013 from 10:00am 12 noon. Attended the annual Olson & Olson Local Government Seminar in Stafford, Texas. Attended a local workshop with users of the League City OSSI Consortium to discuss maintenance costs associated with joining their system. Patrol Division On 01/01, officers investigated a reported shooting and weree successful in the apprehension of the suspect. Thee 18 year male victim was transported to UTMB for treatment of minor injuries to his abdomen; he was released several days later. Officers investigated a reported sex crime in the 3900 block of Cinnamon Cove. An unidentified Hispanic male suspect dragged a juvenile female into a woodedd area. The suspect sexually assaulted the female and was successful in fleeing the area prior to the arrival of officers. The victim was later taken to UTMB Hospital for evaluation. The case was turned over to CID for further investigation. On 01/15, officers investigated an auto pedestri an accident in the 3600 block of IH 45, main lanes. A 1999 Nissan was traveling northbound when it accidently stuck an 18 year old male pedestrian attempting to cross the freeway. The victim was pronounced dead on the scene. No charges were filed at the time of the accident. Criminal Investigation Division A burglary of a habitation occurred at Pine Forest Apartments. A suspect was identified and charged with Criminal Trespassing. Trace evidence from the burglary is being processed at the DPS Laboratory that may lead to an additional charge of Burglary of a Habitation. In 2012, a series of Business Burglaries occurred. One individual was suspected of committing 14 of the burglaries in a one month period. The suspect was arrested with the DA ss Office accepting charges in the two best cases. In January, lab results were received which identified the individual as the actor in the 2011 Burglaryy

13 of Dr. Shrader s Office. The DA s Office is adding additional years to the plea bargain being offered to the suspect. More burglaries are expected to be cleared as additional lab results come back. A suspect entered the detailing shop of Gay Family Auto and stole a new 2013 vehicle that was being cleaned. The theft was captured on video. The vehicle was recovered, the suspect was identified in photo lineups and an arrest was made for 3rd Degree Theft with a $250,000 bond. The investigation assisted other agencies that have also filed charges on the suspect for similar criminal actions in their jurisdictions. On 01/16, Detectives executed a search warrant at a residence in the 3000 block of Crest Dr. Detectives had conducted a 1 ½ month long investigation on a Registered Sex Offender and recovered evidence proving the subject was living at the unregistered location. Additionally, Detectives located an elaborate indoor Marijuana grow in a hidden room inside the residence. Detectives recovered 15 Marijuana plants in various stages of growth, along with 10 seedlings. The raw weight on the Marijuana was over 20 pounds. A 34 year old W/M from Dickinson was charge with Failure to Comply with Sex Offender Registration and Felony Possession of Marijuana ; his bonds totaled $50,000. The subject s wife, a 34 year old B/F from Dickinson, was charged with Felony Possession of Marijuana ; her bonds totaled $5,000. The street value of the marijuana was valued at over $500,000. The Narcotic Unit, with assistance from DEA, executed a search warrant at a residence in the 1300 block of Sunset. Officers recovered a large quantity of commonly abused prescription medications that were not in properly labeled bottles. A 72 year old B/M from Dickinson was charged with one Felony and two Misdemeanor counts of Possession of Controlled Substance with bonds totaling $30,000. A 27 year old W/F from Dickinson was charged with one Felony and two Misdemeanor counts of Possession of Controlled Substance and 2 Misdemeanor counts of Possession of Dangerous Drugs ; her bonds totaled $17,000. Crime Prevention & Community Policing Attended Texas Crime Prevention Conference in Kerrville. Met with the staff of True Cross School to assist with a safety and security plan for the property. Began recruiting citizens for the next Citizen s Police Academy. VOCA Grant Activities Assisted 50 Families (total of 54victims served). Contacted 27 victims by mail; 14 by phone; held 13 personal visits. Information Technology Attended a webinar at City Hall to examine the feasibility of purchasing ipads for use during City Council meetings. Prepared paperwork for replacement PC s at the Central Fire Station and the Police Department.

CALL TO ORDER AND CERTIFICATION OF A QUORUM: Invocation and Pledge of Allegiance Mayor Julie Masters called the meeting to order at 7:00 p.m. Councilman Charles Suderman gave the Invocation and Councilwoman Dunbaugh led the Pledge of Allegiance. City Secretary Carolyn Anderson called roll and certified a quorum. Council Members present were as follows: Mayor Julie Masters, Mayor Pro Tem Walter Wilson and Council Members Charles Suderman, Mary Dunbaugh, Mark Townsend, and Louis Decker. Councilman William King arrived at 7:13 Also present were City Administrator Julie Johnston, City Attorney Loren Smith, Building Official Kevin Byal, Public Works Director Kellis George, Management Assistant Jessica Rogers, and Chief Ron Morales. ITEM 2.) PROCLAMATIONS AND COUNCIL COMMENTS: Welcome and thanks to all for coming Councilman Decker asked that the money that the Dickinson Volunteer Fire Department is paying for maintenance and an in-depth audit be placed on the next agenda Knights of Columbus Lent Fish Frys on Feb 1 st, 8 th 15 th and 22 nd and March 8 th, 15 th and 22 nd. There will not be a Fish Fry on Good Friday Festival of Lights no contract with Galveston County for Paul Hopkins Park next year ITEM 3.) PUBLIC COMMENTS: At this time, any person with city-related business may speak to the Council. In compliance with the Texas Open Meetings Act, The City Council may not deliberate. Comments from the public should be limited to a maximum of three (3) minutes per individual speaker. Carol Dean, 402 Ave L, Dickinson Ms. Dean asked about the jurisdiction of 2 nd Avenue on the west side. Ms. Dean expressed concerns about organizations that Incredible Edibles is supporting through company contributions and how the citizens of Dickinson shopping at the business would also be contributors to what she described as questionable causes and groups. Mary Stringer, th Street, Dickinson Ms. Stringer shared that she has followed up on suggestions from Council from the last meeting January 22, 2013 Regular Council Meeting Minutes Page 1 of 5

34 regarding obtaining information about the impact of the revisions to the FEMA Floodplain Maps will have on her property. She updated Council on her research. She stated that there will be no change on Nicholstone with regard to the floodplain rating. She stated that she believes that she pays double for flood insurance than friends in Tropical Gardens. She stated that she had ed Mr. Byal two weeks ago and that Mr. Byal had requested a copy of an elevation certificate from her, which will cost her over $600. City Administrator Julie Johnston shared with Ms. Stringer that she will visit with Mr. Byal about contacting her. ITEM 4.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Review of Updated Street Prioritization Program. Kellis George presented Council with the updated street prioritization program. Mr. George explained the current status and how the program is working. Mr. George and City Administrator Julie Johnston addressed the questions of Council. Ms. Johnston explained the process of identifying funding sources for the different street projects. Funding will be found for the streets that have moved up in change of ranking. Councilman King asked for a clarification on the Street Maintenance Sales Tax Fund. Ms. Johnston explained that the tax provides a constant funding source for repair of the streets.
