1 NOTICE OF MEETING DICKINSON MANAGEMENT DISTRICT NO. 1 The Board of Directors of Dickinson Management District No. 1 will hold a regular meeting on Thursday, April 13, 2017, at 6:00 p.m., in Conference Room 2 at the City of Dickinson (the City ) City Hall, 4403 State Highway 3, Dickinson, Texas 77539, to discuss and, if appropriate, act upon the following items: 1. 6 MINUTES DICKINSON MANAGEMENT DISTRICT NO. 1 February 20, 2017 The Board of Directors (the Board ) of Dickinson Management District No. 1 (the District ) met in regular session, open to the public, on the 20 th day of February, 2017, at the City of Dickinson (the City ) City Hall, 4403 State Highway 3, Dickinson, Texas, inside the boundaries of the District, and the roll was called of the members of the Board: Perry Fulcher, M.D. President C. Wayne Browne, D.C. Vice President Mary Dunbaugh Assistant Vice President Renee Casey Secretary Kim Westerlage Assistant Secretary and all of the above were present thus constituting a quorum. Also present at the meeting were Julie M. Robinson, Executive Director for the District, Stephanie Russell, Bookkeeper and Investment Officer for the District, and City Council Liaisons Charles Suderman and William H. King, III. PUBLIC COMMENTS MINUTES There were no comments from the public. The Board considered approving the minutes of the August 29, 2016 meeting. After review and discussion, Director Dunbaugh moved to approve the minutes as submitted. Director Westerlage seconded the motion, and it passed by unanimous vote. QUARTERLY INVESTMENT AND FINANCIAL REPORTS FOR QUARTER ENDING SEPTEMBER 30, 2016 Mrs. Russell reviewed the investment and financial reports for the Quarter ending September 30, 2016 with the Board. Following discussion, Director Casey moved to accept the reports as submitted. Director Browne seconded the motion, and it passed by unanimous vote. 7 QUARTERLY INVESTMENT AND FINANCIAL REPORTS FOR QUARTER ENDING DECEMBER 31, 2016 Mrs. Russell reviewed the investment and financial reports for the Quarter ending December 31, 2016 with the Board. Following discussion, Director Westerlage moved to accept the reports as submitted. Director Browne seconded the motion, and it passed by unanimous vote. ANNUAL DISCLOSURE STATEMENTS FOR INVESTMENT OFFICER AND BOOKKEEPER Mrs. Robinson stated that the Public Funds Investment Act requires that any Investment Officer of the District disclose their relationships with banks and brokers who may seek to sell investments to the District. Consequently, Mrs. Robinson, as the District s Executive Director, and Mrs. Russell, as one of the District s Investment Officers and bookkeeper, must execute a Disclosure Statement on an annual basis. The Board reviewed Mrs. Robinson s and Mrs. Russell s disclosure statements. Following review and discussion, Director Browne made a motion to accept Mrs. Robinson s and Mrs. Russell s Disclosure Statements and direct that the Disclosure Statements be filed appropriately and retained in the District s official records. The motion was seconded by Director Westerlage, and it passed by unanimous vote HOLIDAY DECORATIONS AND PLAN FOR 2017 HOLIDAY DECORATIONS Mrs. Robinson reviewed the holiday decorations that had been implemented for the 2016 Holiday Season with the Board and requested feedback from the Board concerning the decorations that were used and any changes that the Board wished to make for the 2017 Holiday Season. Following discussion, the Board requested that Mrs. Robinson obtain information concerning other decorations that could be added to the Christmas tree decorations at the intersection of I-45 and FM 517, discuss the location of the installation of the Christmas trees by the company, and inquire about possibly increasing the number of shooting star decorations to be placed along FM 517. Mrs. Robinson indicated that she would bring the requested information back to the Board in April. No formal action was taken by the Board. FUTURE MEETING DATES Mrs. Robinson proposed a couple of future meeting dates in the upcoming months to review the District s FY audit and begin preparation of the District s FY budget. In September of 2012, the Dickinson City Council approved a contract with the firm of Belt, Harris Pechacek, LLLP to conduct an independent audit of all accounts of the City and to prepare the City and DMD#1 s Comprehensive Annual Financial Report ( CAFR ) for 3 years, including Fiscal Year Staff recommends approval of the report. 61 Dickinson Management District Number 1 Agenda Item Data Sheet MEETING DATE April 13, 2017 TOPIC: Review, Revise and Approve Resolution Authorizing Execution of Sponsorship Agreement with Del Papa Distributing Co. for 2017 Red, White & Bayou Crawfish and Texas Music Festival By Board President. BACKGROUND: For the last several years, the District has participated in sponsorship agreements in conjunction with participation by the City of Dickinson in Red, White & Bayou Crawfish and Texas Music Festival. Pursuant to such previous participation by the District, Del Papa Distributing Co. has submitted a Sponsorship Agreement for the 2017 Red, White & Bayou Crawfish and Texas Music Festival for the Board s consideration. The Sponsorship Agreement is identical to last year s Agreement approved by the Board. RECOMMENDATION: This Resolution would authorize President Fulcher to execute of the Sponsorship Agreement with Del Papa Distributing for the 2016 Red, White & Bayou Crawfish and Texas Music Festival. FOR 2017 RED, WHITE & BAYOU CRAWFISH AND TEXAS MUSIC FESTIVAL BY BOARD PRESIDENT WHEREAS, Dickinson Management District No. 1 (the "District") has been legally created and operates pursuant to the general laws of the State of Texas applicable to municipal management districts; and WHEREAS, the District has participated in sponsorship agreements in conjunction with participation by the City of Dickinson in Red, White & Bayou Crawfish and Texas Music Festival; and WHEREAS, pursuant to such previous participation by the District, the Board has been presented with a Sponsorship Agreement with Del Papa Distributing Co. for the 2017 Red, White & Bayou Crawfish and Texas Music Festival ( Sponsorship Agreement ), a copy of which is attached hereto as Exhibit A and incorporated herein; and WHEREAS, upon review and consideration of all matters attendant and related thereto, the Board of Directors finds and determines that the Board President should be authorized to execute the Sponsorship Agreement with Del Papa Distributing Co. for the 2017 Red, White & Bayou Crawfish and Texas Music Festival. 69 Dickinson Management District Number 1 Agenda Item Data Sheet MEETING DATE April 13, 2017 TOPIC: Review, Revise and Approve Resolution Ratifying Execution of Agreement for Services with Cahoon Consulting for Community Rating System 2017 Cycle Visit by Executive Director. BACKGROUND: In March of 2012, the District approved an Agreement for Services with Cahoon Consulting for the Community Rating System 2012 Cycle Visit. As a result of the services provided by Cahoon Consulting, the City of Dickinson received a Class 8 CRS rating under the National Flood Insurance Program ( NFIP ) and properties within the District were able to obtain a 10% savings on flood insurance premiums. RECOMMENDATION: Every 5 years, the NFIP requires cities to come into compliance with the next version of floodplain management regulations, which for the City of Dickinson would mean it has to come into compliance with NFIP s 2013 regulations. The City has been notified that ISO (the entity that conducts the compliance reviews for NFIP) will be on site to conduct the City compliance review in early November. Consequently, it was necessary to retain Cahoon Consulting to begin the review all of the City s current activities and regulations as quickly as possible so any changes thereto that must be made in order to comply with the 2013 floodplain management regulations could be identified and implemented. At a minimum, the City will maintain the Class 8 CRS rating, and the goal would be to reach a Class 6 CRS rating which would result in a 20% savings on flood insurance premiums for properties within the District and the City. This Resolution would ratify Executive Director Julie Robinson s execution of the Agreement with Cahoon Consulting for the Community Rating System 2017 Cycle Visit. Staff recommends approval of the Resolution. 72 RESOLUTION RATIFYING EXECUTION OF AGREEMENT FOR SERVICES WITH CAHOON CONSULTING FOR THE COMMUNITY RATING SYSTEM 2017 CYCLE VISIT BY EXECUTIVE DIRECTOR WHEREAS, Dickinson Management District No. 1 (the "District") has been legally created and operates pursuant to the general laws of the State of Texas applicable to municipal management districts; and WHEREAS, the District has entered into an agreement with Cahoon Consulting for services related to the Community Rating System cycle visits in the past; and WHEREAS, pursuant to such previous agreement by the District, the Executive Director executed an Agreement for Services with Cahoon Consulting for the Community Rating System 2017 Cycle Visit on March 20, 2017 ( Agreement ), a copy of which is attached hereto as Exhibit A and incorporated herein; and WHEREAS, upon review and consideration of all matters attendant and related thereto, the Board of Directors finds and determines that the actions of the Executive Director related to executing the Agreement with Cahoon Consulting for the Community Rating System 2017 Cycle Visit should be ratified in all respects. 80 Proposal for the City of Dickinson Community Rating System 2017 Cycle Visit INTRODUCTION The City of Dickinson (City) joined the Community Rating System (CRS) program in The initial application resulted in a class 8 rating which translates to a 10% discount on flood insurance premiums for citizens located inside the floodplain, and some areas outside of the floodplain (excluding Preferred Risk Policy areas) receive a 5% discount. The table below illustrates the total savings of citizens as a result of the City s participation in the CRS (data current as of October 17, 2016). 81 Proposal for the City of Dickinson Community Rating System 2017 Cycle Visit CRS TRANSITION When the City applied and joined the CRS program, it fell under the requirements of an earlier edition of the CRS Coordinator s Manual (Manual). In the summer of 2013, a revised Manual took effect following the completion of a major update to the CRS program. All participating CRS communities approaching their reverification cycle or wishing to make a modification to improve their classes must meet the updated requirements in the 2013 Manual. The City of Dickinson will be required to transition to the 2013 Manual at their five-year cycle visit in SCOPE OF WORK The Consultant will conduct an assessment of the credit received under the previous Manual and compare it to the available credit under the 2013 Manual. Estimated points will be based on existing documentation with or without minor edits and/or assumption of the City s capabilities to fulfill the 2013 requirements. The Consultant will develop materials to be used as documentation for some activities including, but not limited to, specific outreach projects, flood inquiry logs, website content, and activity worksheets. (Such materials will be sent to the City for review and approval before submittal to ISO.) The Consultant will coordinate with the appropriate City staff to assist, review, and assemble specific documentation for all potential activities, the extent to which shall be determined by the City. The Consultant will be able to estimate an achievable class rating once the project is underway; however, because all documentation is evaluated by a third party and is subject to individual review, the final rating cannot and will not be guaranteed by the Consultant. During the preparation for the 2017 cycle visit, the Consultant will identify specific CRS activities to help the City make future improvements to its class rating. The Consultant will produce a Plan of Action outlining these activities for the City to consider implementing at its own pace. COST ESTIMATE Cahoon Consulting proposes a cost estimate of $15,200 to Dickinson Management District Number One to assist the City in transitioning to the 2013 CRS Coordinator s Manual for the purpose of maintaining the current class 8. This estimate is based on the number of hours projected to complete the tasks associated with each CRS activity.
