Comments from the Public (Please limit comments to five minutes) Consent Agenda All matters listed within the Consent Agenda have been distributed to each member of the City Council for reading and study, are considered to be routine, and will be enacted by one motion of the council with no separate discussion. If separate discussion is desired on an item, from either the City Council or from the audience, that item may be removed from the Consent Agenda and placed on the Regular Agenda. 5. Approval of Minutes for the Work Session on March 20, Approval of Minutes for the on March 20, Re-appointment of Dr. Thomas Herrick to Hospital Board of Trustees Mayor Stielow has nominated Dr. Thomas Herrick for re-appointment to the Hospital Board of Trustees. His term will expire on April 3, Short-term Conditional Use Permit: Big Rip Brewing Company Anniversary Event The Big Rip Brewing Company is requesting a Short Term Conditional Use Permit for an event to be held on June 2, The event will take place in the parking lot to the south of the Big Rip location on the northwest corner of 9 th Avenue and Swift. A tent will be placed in the parking lot and alcoholic beverages will be served. The applicant will work with the Liquor Control Director and the Public Works Department to secure the necessary Temporary Caterers Licenses for the event. As per the application, the applicant estimates an accumulation of 200 customers at the event. The Fire Department will be inspecting all tents prior to each event.

2 Page 2 9. Short-term Conditional Use Permit: Teal Scooter Event Love4LindsayJ is requesting a Short Term Conditional Use Permit for an event called The Teal Scooter. The event will consist of a car show, concert and vendors. The purpose of the event is to raise awareness and funds for KU Ovarian Cancer Research. The event will last from 8:00 AM until 12:00 AM on May 19, 2018 and will take place at the AMF Bowling Alley located at 505 E 18th Avenue. The estimated accumulation of patrons is Short-term Conditional Use Permit: Cupid 5K Trenton Group, LLC is requesting a Short Term Conditional Use Permit for the Cupid 5K (formerly the Annual NKC School District Education Foundation 5K Walk/Run). The event will take place on February 9, 2019 from 7:30 AM until 9:30 AM. The format of the 5K will remain the same as in years past. As per the application, they are requesting assistance with traffic control from the Police Department. 11. Short-term Conditional Use Permit: Christmas Light Run The Running Well Store is requesting a Short Term Conditional Use Permit for the Annual Christmas Light 5K and 1 mile walk, which will be held on December 8, The 5K run and 1-mile fun walk will start at 4:00 p.m. in front of NKC City Hall and will take runners through the downtown area, through the historic neighborhood of North Kansas City, and through Macken Park. The applicant will utilize the library parking lot for porta-potties and have a heated tent next to the starting line. The race will pay overtime to the police officers needed for the event and will also work with NT Realty on utilizing the parking lot just south of Armour on Howell. 12. Short-term Conditional Use Permit: National Wrasslin League Event NWL National Wrasslin League has applied for a Short-Term Conditional Use Permit for an event on April 14, 2018 at 105 E 18 th Avenue. The event will consist of a wrestling match with concessions and will last from 6:00 PM until 11:00PM. It is expected that 300 people will attend the event which is higher than the normally permitted occupancy. The applicant is required to submit a detailed layout of the event for approval, hire security to maintain occupancy counts, and obtain an inspection of the event space by the Fire Marshal prior to the event.

3 Page 3 Regular Items 13. Appointment of Director of Liquor Control (Resolution No ) The City s previous Liquor Control Director resigned in March. Staff has recruited John Harbrucker to fill this vacancy. Before Council for consideration is an employment agreement, virtually the same as the one used for the previous Director of Liquor Control, with John Harbrucker. 14. Second Amendment to North Kansas City Destination Developers Master Development Agreement {Bill No (Ordinance No. 9080)} The City s Master Development Agreement (MDA) with the Master Developer of One North ( the Developer ) currently provides that, as Phase I the One North project, on or before the first anniversary of the effective date of the Spine Road contract (April 5, 2018), the Developer shall enter into a Component Development Agreement with a Component Developer for each of the Hotel, Grocery and Apartment Project Components. The Developer has communicated to the City that he has thus far been unable to locate a viable, experienced candidate willing to develop and operate a grocery store on the site. Under the provisions of the MDA, failure to meet the grocery store requirement in a timely manner could put the entire project into default, something that neither the City nor the Developer wants to happen. As described in the staff memo, an amendment to the MDA has been developed to deal with this issue. Staff recommends approval. 15. Adoption of Economic Development Incentive Policy (Resolution No ) At its work session of March 20, 2018, the City Council considered the adoption of a City Economic Development Incentive Policy to provide guidance to property owners and developers in North Kansas City on the use of public economic incentive tools, and instructed staff to place it on the Council s formal agenda for consideration. Staff recommends adoption of the policy. 16. Award of Contract Chemical Treatment of Ash Trees (Resolution No ) The Emerald Ash Borer (EAB) was first discovered in ash trees in North Kansas City in November 2014, when the City s arborist reported that over one hundred ash trees along the streets and throughout the parks in North Kansas City were infested. In May 2015, the City took a proactive approach to slow or stop the onset of EAB to minimize the loss of ash trees by contracting with a qualified landscape company to chemically treat 287 ash trees. Conservationists

4 Page 4 recommend that ash trees be treated every three years for approximately 12 years to improve the chances of surviving. It has been three years since the initial chemical injections. In its memo, staff summarizes the results of bidding for this work, and recommends award of contract to the lowest and best bidder. 17. Facility Usage Agreement Fire Department Training (Resolution No ) Presented for Council approval is an agreement that will allow the Fire Department to use the Southern Platte Fire Protection District live fire training facility in April, 2017 for practice on interior structural firefighting skills and training on self-rescue techniques under fire conditions. 18. Agreement with Landfill for Disposal of Contaminated Soil (Resolution No ) On October 17, 2017, the City Council approved a change order and budget amendment regarding the contract with Clarkson Construction for construction of the Vernon Street improvements in the Armour Road Redevelopment Area, which includes construction of Vernon Street south of Armour Road, the extension of Diamond Parkway to the east, and water, sanitary sewer, stormwater, and other infrastructure improvements. This change order provided for additional work necessary to comply with a Soil Waste Management Plan to manage environmental conditions, to protect workers on site, and to safely handle soil waste that exceeds limits for contamination. At this time, construction activity generating special waste is coming to an end. Removal will require loading the waste into trucks for hauling to the Courtney Ridge Landfill in Sugar Creek, which can accept this type of special waste. An agreement with Republic Services (the operator of the Courtney Ridge landfill) is presented for Council approval. 19. Approving Accounts Due and Payable by the City through March 30, 2018 {Bill No (Ordinance No. 9081)}. 20.
