1 FULLERTON CITY COUNCIL SUCCESSOR AGENCY PUBLIC FINANCING AUTHORITY AGENDA - MAY 16, West Commonwealth Avenue, Fullerton, CA MEETINGS: The Fullerton City Council / Successor Agency / Public Financing Authority meets on the first and third Tuesday of the month, convening for Closed Session at 5:00 p.m. and Regular Session at 6:30 p.m. PUBLIC COMMENT: The public may comment on Closed Session items at the beginning of the Closed Session meeting. The public may comment on matters not appearing on the agenda as well as request removal of Consent Calendar items for further discussion during Public Comments at the Regular Session meeting. Those wishing to speak on a regular business or a public hearing item on this agenda may do so when the Mayor calls that specific item for consideration. Each speaker addressing non-agenda and consent calendar items shall have three minutes to make their remarks. City Council will allow no more than a total of 30 minutes at the beginning of the Regular Session for non-agenda comments. Those speaking on regular business and public hearing items shall have no more than five minutes per item to address City Council. No person shall speak more than one time to the same item. The Mayor may request that a spokesperson represent a group wishing to address City Council. The Mayor or majority of the Council may grant an extension of time for a speaker. No speaker may yield their time to another speaker. PERSONS ADDRESSING CITY COUNCIL: Please complete a speaker slip and submit the slip to the Assistant City Clerk in the lobby prior to approaching the podium. State your name and city of residence for the record at the beginning of your remarks. All speakers shall observe civility, decorum and good behavior. Any item submitted to the City Council during the meeting shall become public record and subject to applicable disclosure laws. RESOLUTION NO XX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING AN AFFORDABLE HOUSING / DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF FULLERTON, IN ITS CAPACITY AS THE HOUSING SUCCESSOR AGENCY, AND JAMBOREE HOUSING CORPORATION 2. Authorize $3,920,000 payment from 2010 Taxable Tax Allocation Housing Bond proceeds and $600,000 from the Low and Moderate Income Housing Asset Fund to pay costs associated with acquisition and development of proposed affordable housing project and professional services including legal counsel and consultant costs for the preparation of the Affordable Housing / Disposition and Development Agreement. 3. Authorize disposition of City-owned property located at 312, 324, 336 & 406 West Valencia Drive, 407 & 413 West West Avenue and 518, 524 & 530 South Ford Avenue to Richman Park Housing Partners, LP for development of 46 affordable housing units per the Affordable Housing / Disposition and Development Agreement. Authorize Interim City Manager and Special Counsel to the City of Fullerton to finalize and execute Affordable Housing / Disposition and Development Agreement and any other documents necessary to implement said agreement. REGULAR BUSINESS (Items 4 6) 4. HILLCREST PARK FOUNTAIN RESTORATION & GREAT LAWN / SIDEWALK IMPROVEMENTS AND PURCHASE ORDER OF PREFABRICATED BRIDGE Consideration of construction contract award to Environmental Construction, Inc. for Hillcrest Park Fountain Restoration & Great Lawn / Sidewalk Improvements project and approval for purchase of prefabricated bridge. Recommendation by the Public Works Department: 1. Approve plans and specifications for Hillcrest Park Fountain Restoration & Great Lawn / Sidewalk Improvements Project. 2. Award $3,962,944 construction contract for Hillcrest Park Fountain Restoration & Great Lawn / Sidewalk Improvements Project to Environmental Construction, Inc. 3. Authorize $85,279 purchase order to Big R Bridge for prefabricated bridge for Hillcrest Park Fountain Restoration & Great Lawn / Sidewalk Improvements Project. 5. ACTUARIAL ANALYSIS OF OTHER POST EMPLOYMENT BENEFITS LIABILITIES John Botsford of Milliman, the City s consulting actuary, will present the City s updated actuarial analysis of Other Post-Employment Benefits (OPEB) liabilities. In addition, Mr. Botsford will present an analysis of the potential impacts of changes to the City s health plans including analysis of potential impacts of migrating employees from City sponsored medical plans into the CalPERS Public Employees Medical and Hospital Care Act plans. Recommendation by the Human Resources Department: 1. Receive and file Actuarial Valuation of Post-Employment Benefits as of January 1, Receive and file analysis of potential impacts to OPEB liability arising out of migrating employees to the Public Employees Medical and Hospital Care Act program. 6. NOTICE OF FUNDS AVAILABLE FOR CALRECYCLE PROGRAM FUNDING City Council directed staff to develop a Notice of Funds Available (NOFA) allowing Fullerton non-profit organizations to apply for CalRecycle funds received by the City and provide a listing of parks and facilities in need of replacement furnishings as an alternative use of the CalRecycle funds. City Council continued this item on April 18, 2017 and May 2, 2017 due to a tie vote. Recommendation by the Parks and Recreation Department: 1. Approve NOFA for use of remaining CalRecycle funds and authorize Director of Parks and Recreation to sign and enter into agreements with grant award recipients. May 16, Page 6

8 and / or 2. Direct Parks and Recreation staff to purchase park furnishings made from recycled beverage containers for public park and park facilities with remaining CalRecycle funds. JUDE HOSPITAL AUTOMATED ELECTRONIC DEFIBRILLATOR GRANT Recommendation by the Fullerton Police Department: Accept $50,000 grant from St. Jude Hospital on behalf of the Police Department and increase Police Department appropriations by the same amount, to be placed in Grants Fund 32. NINTH AMENDMENT TO EXCLUSIVE NEGOTIATION AGREEMENT BETWEEN FULLERTON REDEVELOPMENT AGENCY AND FTC ACQUISITION, LLC, TO PLAN FOR DEVELOPMENT OF THE FULLERTON TRANSPORTATION CENTER Request from FTC Acquisition, LLC for extension of the negotiation period currently provided in the Exclusive Negotiation Agreement (ENA) between the Fullerton Successor Agency and FTC Acquisitions, LLC. Recommendation by the Community Development Department: 1. Approve extension of the ENA total negotiation period for an additional twelve months to June 30, 2018 plus an additional six month optional extension to December 31, Authorize City Manager, as Executive Director of the Fullerton Successor Agency, to execute the Ninth Amendment. 13.
