4 PUBLIC COMMENTS Craig Allen Sheets spoke about drug trafficking and fishing at Laguna Lake. Cynthia Peck asked City Council to pull Consent Item 6. Jason Martinez spoke about homeless shelters. Paul Broden and Irene Shaw Broden thanked Police Chief Hughes for assisting with a recent Pathways to Hope auction. Steve Helgestad spoke about a recently granted Conditional Use Permit and related parking issues. Sean Paden asked to pull Consent Calendar Items 6 and 7. Kaylynn Gravina spoke about the Conditional Use Permit issued to the Gama Phi Beta Sorority. Jane Rands spoke about the Hunt Branch Library. Faith spoke about homeless issues. Matt Leslie reported on upcoming events at the Muckenthaler Cultural Center. CITY COUNCIL / SUCCESSOR AGENCY / STAFF COMMUNICATIONS City Manager Felz responded to comments made during Public Comments and spoke about the local impact of the federal government shutdown. Council Member Flory reported on the opening of the Conservation Corps facility, asked for presentations on Hillcrest Park improvements, Fox Fullerton and the Muckenthaler Center and spoke about the City's camping ordinance. APPOINTMENTS None. CONSENT CALENDAR ( Items 1 through 11) Flory moved, seconded by Sebourn, to approve Consent Calendar Items 1, 2, 3, 5, 8, 9, 10 and 11. Motion carried 5-0. Approved 1. APPROVAL OF ENGINEERING CONSULTANTS FOR AS- NEEDED ENGINEERING SERVICES Recommendation by the Public Works Department: 1. Authorize Director of Public Works to execute consultant Agreement with Harris & Associates, DMS Consultants Inc., Mark Thomas & Company Inc., Civiltech Engineering Inc., RBF Consulting, RMC Water and Environmental and KDM Meridian for engineering design and survey services in a form approved by the City Attorney. 2. Authorize Director of Administrative Services to issue purchase orders to these firms for individual projects on as- needed basis. 1200) Resolution No RESIDENT ONLY PERMIT PARKING 200 BLOCK adopted BERKELEY AVENUE ( F. Sean Paden expressed concerns with some terms of the lease. Leland Wilson acknowledged the parking challenge in the area and spoke about property rental. LAS VEGAS RAILWAY EXPRESS MEMORANDUM OF UNDERSTANDING EXTENSION REQUEST Sean Paden asked how this would impact parking at the Transportation Center. Fitzgerald moved, seconded by Sebourn, to authorize City Manager, or designee, to execute proposed Memorandum of Understanding extension on behalf of the City Council in a form approved by the City Attorney. AFFORDABLE HOUSING AGREEMENT WITH RICHMAN GROUP OF CALIFORNIA, LLC FOR THE DEVELOPMENT OF A 95- UNIT AFFORDABLE SENIOR HOUSING PROJECT LOCATED AT 345 EAST COMMONWEALTH AVENUE Flory moved, seconded by Fitzgerald, to: 1. Approve Affordable Housing Agreement by and between City of Fullerton and TRG Pacific Development, LLC substantially in the form drafted by the Special Counsel to the City of Fullerton. 2. Authorize payments totaling $ 8, 972, 000 from the 2010 Tax Taxable Allocation Housing Bond proceeds ( Fund 80) to pay costs associated with development of proposed project and professional services for preparation of Affordable Housing Agreement subject to 3% interest rate to be paid over 8- year term. 3. Authorize City Manager and Special Counsel to finalize and execute Affordable Housing Agreement and any other documents necessary to implement Agreement.
