Kelly Administration Building, in the DRC Conference Room, DeLand, Florida. Roll was called by Mary Schnebly. All members were present or represented. APPROVAL OF MINUTES Chair Beamer called for a motion to approve the minutes from the September 20, 2005, DRC meeting. Member Cheney MOVED for APPROVAL of the DRC minutes from September 20, 2005.

Member Cheney MOVED for APPROVAL of Item "A" and Item "F" as described in the Land Development Manager's memorandum to the DRC and for DENIAL of the balance of the items in the said memorandum. Item "A" (Ref. Eng. Response #1) Waive the requirement to provide 70 feet of right-of-way for a rural roadway and accept the existing 60 feet previously deeded. Item "F" (Ref. Eng. Response #4 & Plans) Waive the requirement to construct a 24 foot wide roadway and allow the construction of a 20 foot roadway. This request is not immediately obvious in the appeal. The original plans depicted a 24 foot wide pavement section. The revised plans depict a 20 foot pavement section, and the engineer's response letter acknowledges the proposal to construct a 20 foot roadway. 10:25 A.M. D. 7 None. The following discussion was held: DISCUSSION 1. Humphries Appeal - The packet prepared for Humphries Appeal to County Council was distributed to the DRC. 2. Subdivision Exemption Application Review In the case of newer subdivisions that front on a road that has been paved through the "Dirt Road Reduction Plan": a. Are the roads still considered to be substandard to the requirements of paved publicly maintained? OR Do they fulfill the LDC requirements because the County did the upgrading? b. It was agreed that the divisions would be looked at on a "case by case" basis. However, a substandard road was not acceptable for a new subdivision to access from and therefore, the road must be upgraded. The paving of prescriptive dirt roads through the Dirt Road Reduction Plan does not relieve the developer from the requirement to upgrade. c. The State Exemption for paving of dirt roads is for no additional trips to be generated. Therefore, in the case of the creation of additional lots (Trips) the exemption would be eliminated and the developer would be required to upgrade the road to public standards.
