1 2013 ANNUAL REPORT TO THE CITY COUNCIL BY THE PLANNING COMMISSION This report summarizes the activities and actions of the City of Falls Church Planning Commission during calendar year The Planning Commission was established by the City Charter, Section It is composed of seven (7) members. Members are appointed by the City Council for renewable four-year terms. Those serving as Planning Commissioners for 2013 were: Ruth Rodgers, Chair; Robert Meeks, Vice Chair; Kwafo Djan; Lindy Hockenberry; Andrew Rankin; Melissa Teates; and Russell Wodiska. The Planning Commission advises the City Council and the City Manager on a variety of planning matters. The Commission studies and recommends changes to the City s Comprehensive Plan. The Planning Commission is delegated the authority to review and approve all site plans, subdivisions, and easement acceptances. The Planning Commission makes recommendations to the City Council on the Capital Improvements Program (CIP), the capital budget, rezonings, Zoning text amendments, acquisitions and vacations of public rights-of-way, and the disposal of City-owned property. The Planning Commission also makes recommendations to the Board of Zoning Appeals (BZA) on special use permits and variances related to site plans. The Planning Commission held 22 meetings: 7 January; 22 January; 4 February; 19 February; 4 March; 18 March; 1 April; 15 April; 6 May; 20 May; 3 June; 17 June; 15 July; 19 August 3 September; 16 September; 7 October; 21 October; 4 November; 18 November; 2 December; and 16 December. The Planning Commission met in 37 worksessions: 4 February; 11 February; 25 February; 4 March; 18 March; 1 April; 15 April; 20 May; 3 June; 19 August; 3 September; 16 September; 30 September; 4 November; 18 November; 2 December; and 16 December. 2 South Washington Street Department of Public Works Planned Transportation Elements South Washington Street Small Area Plan Draft (2) South Washington Street Small Area Plan Community Meeting #2 Stormwater Ordinance 301 West Broad Street Special Exception Application 301 West Broad Street Site Plan Application (3) The following is a comprehensive itemization of planning and zoning related issues on which the Planning Commission took action during 2013: CITY CODE AMENDMENTS Ordinance TO13-01, An Ordinance to Amend Chapter 48, Zoning, Article IV, Districts, of the City Code to Create Section , Decertification of Properties Listed on the City of Falls Church Official Register of Protected Structures and Sites Official Register and Section , Register of Protected Sites and Structures, Official Register. Recommended to the City Council support of this Ordinance amendment; passed on voice vote with all members present. Ordinance TO13-12, An Ordinance to Amend and Revise Chapter 15 in Part II Code of Ordinance Article II, Department of Development Services, Sections 15-20, 27, and 29 and Article III, Department of Public Works, Section Public Works Applications Engineering and Section Public Works Urban Forestry, to Include Updates to Fees and Language. Recommended to the City Council adoption to include consideration of establishing a fee for a tree removed during development if that tree had been marked for preservation on the grading plan. Motion passed with Mr. Rankin absent. Ordinance TO13-16, An Ordinance to Amend Chapter 48, Zoning, Article V Supplementary Regulations, Division 6 Height, Lot and Yard Regulations, Section 1102 to Bring Redevelopment of Existing Substandard Lots into Closer Alignment with the Comprehensive Plan of the City of Falls Church. Recommended to the City Council to affirm in part and to overturn in part. Motion passed with Mr. Rankin absent. Ordinance TO13-18, Ordinance to Create Chapter 35, Stormwater management, Article 1, Stormwater Management of the Falls Church City Code to Clarify and Reorganize Existing Stormwater Management Regulations. Recommended to the City Council adoption of the Ordinance, as required by the State of Virginia. Additionally, that the Planning Commission recommended that the new language be added to Chapter 48, Zoning, including the impervious coverage definition and the maximum of 35% lot coverage with impervious surfaces. Motion passed unanimously on voice vote with all members present. Ordinance TO13-21, Ordinance to Amend Chapter 48, Zoning, to Removed Assisted Living as a By-Right Use in the B-1, Limited Business Zoning District and Require a Conditional Use Permit Approved by City Council. Recommended to the City Council approval; motion passed on roll call vote with Mr. Djan absent. Ordinance TO13-22, Ordinance to Amend Chapter 48, Zoning, to Require a 20-Foot Front Yard Setback for Commercial Zoned Properties on Broad Street and Washington Street. Held 2

3 public hearing on 7 October 2013 and continued to 21 October The Planning Commission considered this amendment at its October 7, 2013 meeting. The Planning Commission and staff discussed adding language providing authority to waive or reduce the proposed 20 foot setback during review of a project that involves a special exception and site plan. That language is not included here, but deserves consideration. Without a waiver, existing structures made nonconforming by this amendment would have to seek a setback variance from the BZA in order to expand or replace. It is thought a provision that would allow the City Council and/or Planning Commission to provide a waiver as part of its consideration of a project requiring a Special Exception and site plan would be consistent with similar authority already granted to the Planning Commission, and would allow flexibility for each specific site as they come up for redevelopment. If agreed, language enabling such a waiver is required at this time. TO13-27, Ordinance to Amend Chapter 48, Zoning, Article V, Supplementary Regulations, Division 1, Generally, to Add Section , Mobile Food Service Units. Received presentation on 7 October. Recommended to the City Council approval of TO The motion passed on roll call vote with Mr. Rankin absent. COMPREHENSIVE PLAN AND AMENDMENTS Chapter 3 Community Appearance and Design 18 March Resolution to Amend the Comprehensive Plan of the City of Falls Church, Virginia, to Change the Designation of Approximately 2.2 Acres of Land Located at 540 and 580 South Washington Street (Real Property Code Numbers and ) from Business to Mixed- Use on the City s Future Land Use Map (TR13-17) ZONING TEXT AMENDMENTS Ordinance TO13-01, An Ordinance to Amend Chapter 48, Zoning, Article IV, Districts, of the City Code to Create Section , Decertification of Properties Listed on the City of Falls Church Official Register of Protected Structures and Sites Official Register and Section , Register of Protected Sites and Structures, Official Register. SPECIAL EXCEPTIONS Resolution to Grant a Special Exception for Residential Development and Height Bonus for a Mixed Use Development on the Approximately 2.2 Acres of Land Located at 540 and 580 South Washington Street (Real Property Code Numbers and ) Known as Reserve at Tinner Hill by Lincoln Property Company (TR13-06). Recommended to the City Council that Resolution TR13-06 be approved at Second Reading. The motion passed with Ms. Rodgers absent. Resolution to Grant a Special Exception for Residential uses within a Mixed-Use Development and Height Bonus for the Mixed-Use Development on the Approximately 2.6 Acres of Land Located at 255 and 301 West Broad Street, Real Property Code Numbers , , and for a Mixed-Use Development Known as 301 West Broad Street by Rushmark Properties, LLC. Recommended to the City Council adoption of TR13-10 and expressed strong support for the staff edits to the Voluntary Concessions. The motion passed on roll call vote with all members present. SITE PLAN/SUBDIVISION REVIEWS Eden Center, Good Fortune Grocery Store, Site Plan Waiver Request Approved Site Plan and the waivers listed on page 1 of Attachment 3 of the January 30, 2013 staff report and for the design criteria of new landscaping islands, with the condition that staff review and administratively approve a resubmission that shows the revised layout from Attachment 3; addresses outstanding staff comments from the January 30, 2013 staff report; and complies with all applicable Code regulation and approved waivers. Passed unanimously on roll call vote with all members present (7-0-0). 604 South Oak Street Subdivision One Residential Lot to Create Three Residential Lots Zoned R-1A 4

5 Granted preliminary and final approval for the subdivision as shown on Attachment 2. Passed unanimously on roll call vote with all members present (7-0-0) South Washington Street Subdivision One Residential lot to Three Residential Lots Granted preliminary and final approval for Subdivision application as presented. Motion passed with Mr. Meeks absent. 301 West Broad Street (Rushmark/ Harris Teeter ) Site Plan Granted preliminary and final approval to the site plan and the subdivision consolidation plat, contingent upon administrative staff approval of any pending items specified in the staff report. Further, the Planning Commission strongly supports the retention of the existing island and tree in West Broad Street and the Commission desires the opportunity to review the situation if VDOT denies the retention of either the existing island or the existing tree or both so that the Planning Commission could review potential options. Motion passed on roll call vote with all members present. 540 and 580 South Washington Street, The Reserve at Tinner Hill, Site Plan Gave preliminary and final approval, contingent upon (i) that the landscaping plan come back during a worksession for final approval if it is not in final form as of this date; (ii) that the staff have the option to work with the developer on the final colors and materials of the structure; and (iii) that administrative staff review (be done) to make minor technical changes to the site plan as needed, including the approved subdivision consolidation plat associated with the site plan. The motion was approved with all members present. VARIANCE Easter Seals Project, 300 Hunton Avenue Supported Variance Application V by Easter Seals coming before the Board of Zoning Appeals on May 16, 2013, to permit a reduction of the off street parking requirements from 28 spaces to 13 spaces on the premises known as 300 Hunton Avenue located at RPC Motion passed with Mr. Meeks absent GENERAL PLANNING/DEVELOPMENT A. Adoption of Annual Report to the City Council for 2012 on 7 January B. Appointments of Planning Commissioners to Boards, Commissions, and Committees. Recommended to the City Council endorsement to name the City s Community Center as the Falls Church Community Center, Kenneth R. Burnett Building. K. City Center Small Area Plan Community Meeting #2 L. North West Street Pedestrian Safety and Accessibility Project (2232 Review) M. Roosevelt Street Pedestrian Safety and Accessibility Project (2232 Review) N. Stream Restorations for Coe Branch and for Pearson Branch ACQUISTIONS/VACATIONS OF LAND TO13-23, Ordinance to Vacate a Portion of the City of Falls Church Owned and Improved Public Right-of-Way in the 300 Block of West Broad Street, to 301 West Broad Street Limited Partnership, Adjacent Property Owner at 301 West Broad Street, Real Estate Assessment Parcel ID: Recommended to the City Council approval of the vacation requested. The motion passed unanimously on voice vote. SPECIAL USE PERMITS/VARIANCES None this period. CAPITAL IMPROVEMENTS PROGRAM (CIP) 6

7 Meetings and worksessions held: 22 January (meeting); 4 February (meeting) and (worksession); 11 February (worksession); 19 February (meeting); and 15 April (meeting) Recommended that the City Council approve, pursuant to Section 6.19 of the City Charter and Section of the City Code, the FY CIP as presented on January 22, 2013 for all projects except the Schools Public Facilities Projects. The motion passed unanimously on roll call vote with all members present. Recommended to the City Council moving the $2.4M for the Cherry Street projected listed in FY 2014 to be combined with, and moved to, the $5M for the future Mount Daniel School Expansion Project in FY The motion passed 5-2 on roll call vote. Mr. Djan, Ms. Hockenberry, Mr. Meeks, Ms. Rodgers, and Ms. Teates voted Yes. Mr. Ranking and Mr. Wodiska voted No. Further, the Planning Commission recommended that the Schools prepare a comprehensive plan for all school buildings that would best meet the long term needs of the Schools. The Commission supported a referendum, or a series of referendums, for additions and alterations to School facilities to achieve a greater long term benefit for all Schools facilities rather than continuing piecemeal projects each year and including providing funding for planning at Mary Ellen Henderson School and George Mason School in the Operating Fund for REGIONAL COOPERATION None this period.
