2 0 0 0 NORTHWEST OF LONESOME DOVE TRAIL, BETWEEN RUDMAN ROAD AND LOPEZ ROAD, SOUTHEAST OF LAKE ASHBY APPROXIMATELY SIX MILES TO THE WEST OF THE CITY OF DELTONA AMENDING THE FLUM FROM ENVIRONMENTAL SYSTEMS CORRIDOR AND FORESTRY RESOURCE TO CONSERVATION; AMENDING CHAPTER, FUTURE LAND USE ELEMENT, SECTION F, SPECIFICALLY AMENDING THE FUTURE LAND USE MAP ON APPROXIMATELY ACRES WITHIN THE DAYTONA BEACH INTERNATIONAL AIRPORT LOCATED TO THE SOUTH AND EAST OF BELLEVUE AVENUE APPROXIMATELY,00 FEET EAST OF WILLIAMSON BOULEVARD ON THE NORTH SIDE OF BEVILLE ROAD WITHIN THE MUNICIPAL LIMITS OF THE CITY OF DAYTONA BEACH FROM CITY OF DAYTONA BEACH LEVEL TWO RESIDENTIAL, GENERAL INDUSTRY, RETAIL COMMERCIAL, OFFICE TRANSITIONAL, AIRPORT, AND EXISTING/POTENTIAL PARKS TO COUNTY PUBLIC/SEMI- PUBLIC; AMENDING CHAPTER, INTERGOVERNMENTAL COORDINATION ELEMENT, SECTION B, RELATING TO COORDINATION WITH CITY OF DAYTONA BEACH AS TO DAYTONA BEACH INTERNATIONAL AIRPORT; BY AUTHORIZING INCLUSION IN THE VOLUSIA COUNTY COMPREHENSIVE PLAN; PROVIDING FOR SEVERABILITY; BY PROVIDING AN EFFECTIVE DATE. WHEREAS, Section., et seq., Florida Statutes, created the Local Government Comprehensive Planning and Land Development Regulation Act, hereinafter referred to as the Act ; and WHEREAS, Section., Florida Statutes, requires each county in the State of Florida to prepare and adopt a Comprehensive Plan as scheduled by the Florida Department of Community Affairs; and WHEREAS, the Volusia County Council has adopted the Volusia County Comprehensive Plan Ordinance No. 0-0, pursuant to the Act; and Ordinance 00- Page of

3 0 0 WHEREAS, Section., Florida Statutes, provides for amendments to the adopted Comprehensive Plan by the local government not more than twice during each calendar year; and WHEREAS, the County Council of Volusia County, Florida desires to take advantage of this statute and amend the Volusia County Comprehensive Plan; and WHEREAS, the County Council of Volusia County, Florida has provided for broad dissemination of this proposed amendment to this Plan in compliance with Florida Statutes Sections. and.(); and WHEREAS, pursuant to Section., Florida Statutes, Volusia County Zoning Ordinance No. 0-, as amended, has designated the Volusia County Planning and Land Development Regulation Commission as the local planning agency for the unincorporated area of Volusia County, Florida; WHEREAS, said Planning and Land Development Regulation Commission has held a public hearing on said Comprehensive Plan amendment; and WHEREAS, the County Council of the County of Volusia has conducted an adoption public hearing on said amendment to the Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY COUNCIL OF VOLUSIA COUNTY, FLORIDA, AS FOLLOWS: The Volusia County Comprehensive Plan, Ordinance No. 0-0, as previously amended, is further amended as follows: SECTION I: All Chapters and Elements of said Plan, including maps, map series, tables and figures, are hereby amended to make them internally consistent; to make them Ordinance 00- Page of

4 0 0 consistent with objections, recommendations, comments and conditions imposed by state agencies and by the Volusia County Growth Management Commission; and to change dates as appropriate for consistency. SECTION II: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories from Environmental Systems Corridor, Forestry Resource and Agricultural Resource to Conservation for approximately, acres located approximately on the north side of Pioneer Trail, adjacent to the western intersection with State Road approximately three miles to the west of the City of New Smyrna Beach. The subject property is identified as CPA-0-- and depicted as shown on EXHIBIT A, attached hereto and made a part hereof. SECTION III: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories from Environmental Systems Corridor and Forestry Resource to Conservation for approximately, acres located on the north side of State Road, west of the intersection with Pioneer Trail approximately five miles to the west of the City of New Smyrna Beach. The subject property is identified as CPA-0-- and depicted as shown on EXHIBIT A, attached hereto and made a part hereof. SECTION IV: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories from Environmental Systems Corridor, Forestry Resource, Rural and Agricultural Resource to Conservation for approximately acres located on Ordinance 00- Page of

5 0 the west side of Tomoka Farms Road, adjacent to the intersection with H.L. Ainsley Drive approximately one and one-half miles to the west of the City of Port Orange. The subject property is identified as CPA-0-- and depicted as shown on EXHIBIT A, attached hereto and made a part hereof. SECTION V: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories from Environmental Systems Corridor and Agricultural Resource to Conservation for approximately 0 acres located south of Rudman Road and adjacent to the eastern end of Prideaux Road, southeast of Lake Ashby approximately six miles to the west of the City of Deltona. The subject property is identified as CPA-0-- and depicted as shown on EXHIBIT B, attached hereto and made a part hereof. SECTION VI: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories amend the Future Land Use Map from Environmental Systems Corridor and Forestry Resource to Conservation for approximately 0 acres located northwest of Lonesome Dove Trail, between Rudman Road and Lopez Road, southeast of Lake Ashby approximately six miles to the west of the City of Deltona. The subject property is identified as CPA-0-- and depicted as shown on EXHIBIT B, attached hereto and made a part hereof. 0 SECTION VII: Chapter, The Future Land Use Element, Section F, specifically amending the official Future Land Use Map of said ordinance is hereby amended to change the Future Land Use categories from City of Daytona Beach Level Two Residential, Ordinance 00- Page of

6 0 0 General Industry, Retail Commercial, Office Transitional, Airport and Existing/Potential Parks to County Public/Semi-Public with a limitation for development to, Average Daily Trips (ADT) on approximately acres within the Daytona Beach International Airport. The property is located to the south and east of Bellevue Avenue approximately,00 feet east of Williamson Boulevard on the north side of Beville Road within the municipal limits of the City of Daytona Beach. The subject property is identified as CPA-0- - and depicted as shown on EXHIBIT C, attached hereto and made a part hereof. SECTION VIII: Chapter of the Plan, Intergovernmental Coordination Element at Section B, Goals, Objectives and Policies, adding Policy...0, providing that the County will coordinate with the City of Daytona Beach on future development plans for the Daytona Beach International Airport to promote a joint vision for the area and satisfy any "gateway" standards established by the city. Said amendment is appended hereto as EXHIBIT D, and by reference made a part hereof. SECTION IX: SEVERABILITY. Should any section or provision of this Ordinance, or application of any provision of this Ordinance, be declared to be unconstitutional, invalid, or inconsistent with the Volusia County Comprehensive Plan, such declaration shall not affect the validity of the remainder of this Ordinance. SECTION X: EFFECTIVE DATE. A certified copy of this Ordinance shall be filed in the Office of the Secretary of State by the Clerk of the County Council within ten (0) days after enactment. This Ordinance shall take effect upon the later of the following dates: a) issuance of a certificate of consistency or conditional certificate of consistency by the Volusia Growth Management Commission, and issuance of a final order by the State of Ordinance 00- Page of

7 Florida Department of Community Affairs determining this Ordinance to be in compliance with Florida Statutes Section.(), or b) issuance of a final order by the State of Florida Administration Commission determining this Ordinance to be in compliance with Florida Statutes Section.(0).
