REZONING REQUESTS APPROVAL OF MINUTES OF LAST MEETING Motion was made by Greg Matherly and seconded by Mark Larkey to accept the minutes of the last meeting with an amendment made on Item 6 correcting the purchase price of the property leased by the Highway Dept. to $55, Motion passed with the following roll call vote: Sparks, Mark Larkey, Roger Nave, Evert Jarrett, David Shanks. Commissioners abstaining: Pat Wolfe due to conflict of interest REPORT OF HEALTH DEPARTMENT Oral report. Oral report. REPORT OF DIRECTOR OF SCHOOLS PROCLAMATION DECLARING THE WEEK OF OCTOBER 3-9 AS PUBLIC POWER WEEK Mayor Dan Eldridge presented the Johnson City Power Board with a Proclamation recognizing the week of October 3-9 as Public Power Week.

2 REPORT OF EDUCATION COMMITTEE REPORT OF COUNTY PUBLIC RECORDS COMMITTEE REPORT OF BUDGET COMMITTEE REPORT OF WASHINGTON COUNTY RULES COMMITTEE REPORT OF COUNTY MAYOR Item 1: Motion was made by Pete Speropulos and seconded by Ken Lyon to accept the request from the Washington County Election Commission to accept the $10, federal grant offer for the leasing of voting machines. Motion passed with the following roll call vote: Item 2: RESOLUTION TO REPEAL PRIOR RESOLUTION NO , WHICH INCREASED THE MINIMUM MONTHLY SERVICE RETIREMENT ALLOWANCE FOR FORMER, CURRENT AND FUTURE MEMBERS OF BOARDS, COMMISSIONS, COMMITTEES, COUNCILS AND THE LIKE WITH CREDITABLE SERVICE IN THE TENNESSEE CONSOLIDATED RETIREMENT SYSTEM AND TO RETURN TO THE PREVIOUS BENEFIT OF $8.00 PER MONTH FOR EACH YEAR OF CREDITABLE SERVICE Motion was made by Mark Larkey and seconded by Skip Oldham to repeal the prior Resolution which increased the minimum monthly service retirement allowance for former, current, and future members of Boards, Committees, councils and the like with creditable service in the Tennessee Consolidated Retirement System and to return to the previous benefit of $8.00 per month for each year of creditable service. Motion passed with the following roll call vote:

3 Item 3: Mr. Mike Rutherford, the Zoning Administrator, presented the County Commission with the following information regarding a State Fire Marshall Mandate: The mandate is that each county that doesn t have a building code in effect will automatically get a code through the state. The state of Tennessee will impose the building code as of October 1 st, The code will effect single and two family structures only. The presentation was for information purposes only, so there was no need for a motion. Item 4: Motion was made by Mark Larkey and seconded by Pete Speropulos to adjourn to Executive Session to review and discuss the case of Sneyd vs Washington County, Case # Motion passed with an all yes voice vote. Motion was made by Ken Lyon and seconded by Mark Larkey to proceed to defend the case of Sneyd vs Washington County and hire outside council. Mr. Rambo made the referral of Erick Herrin to represent the case. Motion passed with the following roll call vote: Pete Speropulos, Sam Humphreys, Skip Oldham, Joe Sheffield, Mitch Meredith, Sam Phillips, Lee Chase, Joe Corso, David Tomita, Ethan Flynn, Ken Lyon, Richard Matherly, Mark Ferguson, Joe Grandy, Gerald Sparks, Mark Larkey, Roger Nave, Evert Jarrett, and David Shanks Commissioners abstaining: Alpha Bridger and Doyle Cloyd Pat Wolfe Richard Shadden, Ben Bowman and Greg Matherly REPORT OF COUNTY ATTORNEY Item 1: RESOLUTION APPOINTING MEMBERS TO THE BUDGET COMMITTEE Motion was made by Skip Oldham and seconded by Joe Grandy to accept the Resolution appointing the following members to the Budget Committee: Commissioner Pat Wolfe Commissioner Mitch Meredith Mr. Dwight Ferguson Mr. Tom Krieger After much discussion, the motion failed with the following roll call vote: Skip Oldham, Mitch Meredith, Joe Corso, David Tomita, Ethan Flynn, Joe Grandy, and Pat Wolfe Doyle Cloyd, Greg Matherly, Pete Speropulos, Sam Humphreys, Joe Sheffield, Alpha Bridger, Sam Phillips, Lee Chase, Ken Lyon, Richard Matherly, Mark Ferguson, Gerald Sparks, Mark Larkey, Roger Nave, Evert Jarrett, and David Shanks Mayor Dan Eldridge will have 4 new appointments for the Budget Committee to go on the October agenda.

4 Item 2: RESOLUTION APPOINTING MEMBERS TO THE STANDING COMMITTEES OF THE WASHINGTON COUNTY BOARD OF COUNTY COMMISSIONERS Motion was made by Mark Ferguson and seconded by Mark Larkey to accept the resolution appointing the following members to the standing committees of the Washington County Board of County Commissioners: CIA (INSURANCE COMMITTEE) Mark Ferguson, Greg Matherly, Richard Shadden, David Shanks and Ken Lyon GENERAL HEALTH AND WELFARE COMMITTEE Pat Wolfe, Joe Sheffield, Alpha Bridger, David Tomita and Joe Grandy PUBLIC SAFETY COMMITTEE Sam Phillips, Pete Speropulos, Sam Humphreys, Roger Nave, and Mitch Meredith PUBLIC WORKS AND PLANNING COMMITTEE Evert Jarrett, Richard Matherly, Gerald Sparks, Doyle Cloyd and Mark Larkey EDUCATION COMMITTEE Skip Oldham, Joe Corso, Lee Chase, Ben Bowman, and Ethan Flynn Item 3: RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE WASHINGTON COUNTY REGIONAL PLANNING COMMISSION Motion was made by David Tomita and seconded by Lee Chase to accept the Resolution confirming the Mayor s appointments to the Washington County Regional Planning Commission and to accept the decision by the Mayor to increase the membership on the Washington County Regional Planning Commission to 15 members, with the terms for the two additional members to begin immediately and expire on August 31, The appointments are as Gerald Sparks, Joe Corso, Skip Oldham, Ken Lyon, Alpha Bridger, and Mark Larkey Item 4: RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE COUNTY RULES COMMITTEE Motion was made by Joe Grandy and seconded by Sam Humphreys to accept the Resolution confirming the Mayor s appointments to the County Rules Committee as Lee Chase, David Tomita, Evert Jarrett, Joe Corso, and Roger Nave RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE ZONING COMMITTEE Motion was made by Lee Chase and seconded by Doyle Cloyd to accept the Resolution confirming the Mayor s appointments to the Zoning Committee as Pete Speropulos, Greg Matherly, Richard Matherly, Mitch Meredith, and Joe Sheffield RESOLUTION COMFIRMING MAYOR S APPOINTMENTS TO THE WATER TASK FORCE COMMITTEE Motion was made by Doyle Cloyd and seconded by Joe Grandy to accept the Resolution confirming the Mayor s appointments to the Water Task Force Committee as

5 Pat Wolfe, Ben Bowman, Joe Grandy, Janice White, Marion Light, Tom Witherspoon, and Mike McCracken., with the exception of Janice White, who asked not to serve another term. RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE COUNTY- OWNED PROPERTY COMMITTEE Motion was made by Greg Matherly and seconded by Roger Nave to accept the Resolution confirming the Mayor s appointments to the County-Owned Property Committee as Doyle Cloyd, Mark Ferguson, Richard Shadden, Mitch Meredith, and David Tomita RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE CITY/COUNTY LIAISON COMMITTEE Motion was made by Mitch Meredith and seconded by Pete Speropulos to accept the Resolution confirming the Mayor s appointments to the City/County liaison Committee as Alpha Bridger, Lee Chase, Skip Oldham, Pete Speropulos, and Richard Matherly RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE COUNTY ETHICS COMMITTEE Motion was made by Sam Humphreys and seconded by Doyle Cloyd to accept the Resolution confirming the Mayor s appointments to the County Ethics Committee as Joe Sheffield, Richard Shadden, Ben Bowman, Karen Guinn, and John Keiner RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE COUNTY SOLID WASTE COMMITTEE Motion was made by Mark Larkey and seconded by Evert Jarrett to accept the Resolution confirming the Mayor s appointments to the Solid Waste Committee as Roger Nave, Evert Jarrett, David Shanks, Richard Matherly, and David Tomita RESOLUTION CONFIRMING MAYOR S APPOINTMENTS TO THE WASHINGTON COUNTY BEER BOARD Motion was made by Sam Phillips and seconded by Evert Jarrett to accept the Resolution confirming the Mayor s appointments to the Washington County Beer Board as Sam Humphreys, Doyle Cloyd, Greg Matherly, Ken Lyon, and Mark Ferguson RESOLUTION ELECTING A MEMBER OF THE LIBRARY BOARD Motion was made by Mitch Meredith and seconded by Ken Lyon to accept the Mayor s recommendation of Skip Oldham to the Washington County Library Board.

6 RESOLUTION CONFIRMING MAYOR S APPOINTMENT AS THE COUNTY HISTORIAN Motion was made by Doyle Cloyd and seconded by David Tomita to accept the Resolution confirming the appointment of Judge John Kiener as the County Historian of Washington County. RESOLUTION APPOINTING MEMBERS TO THE COUNTY PURCHASING COMMISSION Motion was made by Sam Phillips and seconded by Mark Ferguson to accept the Resolution appointing members to the County Purchasing Commission as Joe Grandy, Sam Humphreys, Gerald Sparks,and Richard Matherly Also, Mayor Eldridge selected Ken Lyon to serve on the Purchasing Committee in his place. 7 Item 1: The Commissioners would like to review the entire benefits package for Washington County Commissioners. Item 2: The Commissioners would like to review the salary of the Washington County Commissioners. Item 3: The Commissioners would like the Ethics Committee to take into consideration whether or not we should have ATM Machines in the Justice Center and in the Courthouse, because a County Employee ( an Elected Official) owns the machines, and some of the Commissioners feel as though it is a conflict of interest. Item 4: Commissioner Joe Sheffield presented to the Commission, a motion for the consideration of the complete inventory of all vehicles owned by the Washington County Government, this includes ALL departments. Commissioner Sheffield also requested information on who is in charge of the vehicles, drivers of the vehicles, do they drive the vehicles home, what is the drivers position, and why it is necessary the employee takes the vehicle home. Mr Sheffield also stated that he feels the policy should be that every vehicle owned by the Washington County Government should carry the County Seal, the Department name and should be identified as for official use only. Mr. Sheffield requested that the issue be placed on the October meeting agenda for further discussion. Motion was made by David Tomita and seconded by Joe Grandy to suspend the rules in order to consider the motion as presented by Mr. Sheffield. Motion passed with the following roll call vote: Tomita, Ethan Flynn, Ken Lyon, Richard Matherly, Mark Ferguson, Joe Grandy, Mark Larkey, Roger Nave, Evert Jarrett, David Shanks, and Pat Wolfe. Richard Shadden, Gerald Sparks, and Ben Bowman Motion was made by Joe Sheffield and seconded by Sam Humphreys to send the request made by Commissioner Sheffield to the Public Safety Committee and amend it until the December meeting, so that the Public Safety Committee will have ample time to gather the information requested.
