Ayes: Bockenstedt, Sauser, Wagner Council Member Bockenstedt moved to approve the Monday, agenda as amended seconded by Council Member Sauser. Ayes: Bockenstedt, Sauser, Wagner, Breitbach Nays: English Matt Mescher, Lansing Road, is concerned with committee meeting scheduled for Tuesday, January 19th and questioned whether under Iowa Code the committee could go into closed session. Pat Meinert, 529 8th Avenue SE, with it being MLK Day she has a dream that we can all work together. She feels people are afraid to be heard and that too much happens behind the scenes. 4 ===Total=== $ 3,290, Ayes: All Mike Murphy, 911 6th Street SW, mentioned five reasons why he feels the council should not proceed with the sidewalk project. 1. Nobody is against a sidewalk they are against the location and the price; 2. There are two other locations to put the sidewalk; 3. Could save money if went on 9th Avenue SW since would not need lighting; 4. It is safer along the street instead of back in the corner and in backyards; 5. The City won t face a potential lawsuit if put in a difference location. Kathy Leibold, nd Street SW, has worked at Mercy Medical Center for 40 years. She feels everyone would appreciate the sidewalk and really enjoy it. As the crow fly s the proposed route is the shortest distance. She is for the sidewalk. Kevin McDermott, 903 6th Street SW, feels there is a better, safer and more cost effective route that the Council should consider. Molly Evers, 582 6th Avenue SW, said she is not afraid to say something. She is concerned that a precedent could be set if do not proceed with the sidewalk with only three households who don t want it. She is in support of the sidewalk and feels the opposition to the sidewalk gives the impression that Catholic school supporter didn t want a sidewalk to a public school. Pat Meinert, 529 8th Avenue SE, thanked Mercy Medical Center for the easement and would have loved to take residents out for a walk on the sidewalk when she worked there years ago. It all goes back to one thing over the concept that some people feel they are better than others. Mike Murphy, 911 6th Street SW, indicated that people are not listening; nobody is talking against a sidewalk. It is because of the location. Tammy Then, 635 Deerwood Court, is on Xavier school board and wants to make it clear that this is not an issue of the sidewalk going to a public school. Teachers and parents have done a great job teaching that everyone is one. She feels the sidewalk needs to go on the street and should not go in anyone s backyard. Council Member Bockenstedt moved to approve RESOLUTION NO A RESOLUTION AWARDING AND APPROVING CONTRACT FOR THE CONNECTION FROM WD ELEMENTARY SCHOOL TO WESTSIDE PARK RE-ISSUE PROJECT to Eastern Iowa Excavating & Concrete, LLC, Cascade, Iowa in the amount of $254, seconded by Council Member Sauser. Roll call vote: Ayes: Sauser, Bockenstedt, Wagner Council Member Wagner moved to approve RESOLUTION NO A RESOLUTION APPROVING AMENDMENT 1 TO THE AGREEMENT FOR RESIDENTIAL WASTE COLLECTION SERVICES FOR 2013 TO 2016 CONSISTING OF TRASH, RECYCLING AND YARD WASTE CONTRACT to Bi-County Disposal, Dyersville at the following rate Year 1 $10.35, Year 2 $10.75, Year 3 $11.18 per month per resident account seconded by Council Member Breitbach. Roll call vote: Ayes: English, Bockenstedt, Wagner, Sauser, Breitbach Council Member Breitbach moved to approve RESOLUTION NO A RESOLUTION AMENDING CERTAIN PARK & RECREATION FEES FOR THE CITY OF DYERSVILLE seconded by Council Member Sauser.
