The Speaker is happy to welcome, as guests of the LORL (Legislative Office for Research Liaison) Committee of the House, the 1989 University of Delaware Legislative Fellows, who are cosponsored by the Delaware General Assembly and the University of Delaware. Our guests are here today to study the Pennsylvania General Assembly as part of their yearlong program in the political decisionmaking process. The minority leader of the Delaware Senate, the Honorable Myrna Bair, is here as a program adviser; the program director, Dr. Jerome Lewis, is here; the director's assistant, Audrey Helfman, is here, and seven Legislative Fellows - Kim Burdick, Regina Gray, Leticha Hill, Angus Macdonald, John Nored, Reginald Tabor, and Dr. Danilo Yanich from Steelton. Mr. BATTSTO. No, it would not, Mr. Speaker. t is not intended to deal with anyone hauling his or her own household waste or the Boy Scouts, any activity like that. t is strictly to regulate and control commercial haulers, period. Mr. FARCHLD. How about, Mr. Speaker, would it affect municipal-owned vehicles other than a specifically defined garbage truck vehicle? Mr. BATTSTO. t would affect a municipal vehicle if it were hauling garbage and refuse to a landfill. However, it would not affect a municipal vehicle if it were, let us say, on a cleanup day picking up refrigerators and other appliances like that. No, it would not. Mr. FARCHLD. Would it affect a private company that was in, let us say, the landscaping or construction business in that they would be picking up some types of demolition debris? n the case of a landscaper, it could be trees or whatever might be a stock of their trade. Mr. BATTSTO. No, sir. t is specifically designed to affect commercial haulers of solid waste, so it would not affect that type of person, nor would it affect, for example-and want to put this on the record-nor would it affect anyone hauling waste that is animal waste from a farm, because if you use the words "waste" and "refuse" and "garbage," it certainly would not affect any kind of waste from a farm, animal waste or anything like that. Mr. FARCHLD. As far as materials going to or from a construction site? Mr. BATTSTO. No, no, it would not, because they would not be in the business of being a commercial hauler of solid waste. Mr. Speaker, think realize the intent of your legislation; however, am concerned that the words "commercial hauler" are not included anywhere in your legislation. As read this, even though you put it on the record, am fearful that some private individual who has a small dump truck and wants to haul some personal trash to the local landfill may come under this provision, and am not sure you want to put that person under this provision. Mr. BATTSTO. think, Mr. Speaker, made it very clear that that was not the intent. The intent is strictly to deal with commercial haulers. This came up in the Transportation Committee, by the way, and there was a thought about someone preparing an amendment to indicate only commercial haulers. had no problem with that. That was not prepared. But want to make it clear in the record that we are dealing with commercial haulers, haulers who either go through the State or haul within the State. Mr. BOWLEY. Mr. Speaker, would you be opposed to tabling this bill until tomorrow when we could have such an amendment drafted? Mr. BATTSTO. Well, is it not sufficient, sir, for the record to indicate that we clearly mean only commercial haulers? think that is clear in the record, just as put in the record that we are not dealing with animal or farm waste. think everyone understands that. Mr. BOWLEY. Mr. Speaker, it is my opinion that just because it is in the record is not going to stop some State Police officer out there from stopping me hauling trash in my 1-ton dump truck to the Warren County landfill someday, and think if you want commercial haulers in there, you should put it in there. Mr. BATTSTO. Well, frankly, there was opportunity to prepare those amendments, sir, and had no problem with that. think, since we want to move the bill, why do you not amend it in the Senate? Mr. BOWLEY. Mr. Speaker? The SPEAKER. Does the gentleman, Mr. Bowley, wish to comment on the bill? Mr. BOWLEY. No, Mr. Speaker. would like to make a motion to table the bill. Upon application of any person who is a survivor of Pearl Harbor, accompanied by a fee of $20 which shall be in addition to the annual registration fee and by such documentation as the department shall require by regulation, the department shall issue to such person a special registration plate designating the vehicle so licensed as belonging to a person who is a survivor of Pearl Harbor. The special registration plate may be used only on one passenger vehicle or one other vehicle with a registered gross weight of not more than 9,000 pounds. This amendment requires that anytime windshield wipers are on, your headlights will be on. originally wanted to put that in in the Transportation Committee but was talked out of it at the time, and said that would address it on the floor. was looking for a trigger mechanism to sort of remind citizens of the need to have their headlights on during inclement weather that would go along with the legislation that have in front of you today. The windshield wiper is not new; it is done in Florida and North Carolina, and they are working on it in a couple other States. t is a commonsense action to help protect people so that they can see the other automobiles coming their way. think for anybody driving today, it is a good example of inclement weather and the need to have headlights on during this type. would appreciate affirmative support for my amendment. Thank you. The SPEAKER. On the question of agreeing to the amendment, from Somerset County, the Chair recognizes Representative Lloyd. Mr. LLOYD. Thank you, Mr. Speaker. Mr. Speaker, rise to oppose the amendment. What ask members to do is to think what they do in their own cars when there is a little bit of rain or there is a little bit of snow but there is not enough that really makes things look dark, but they turn on their intermittent windshield wiper or they turn it on and they turn it off and they turn it on and they turn it off as they go down the road and drive through a little space where there is rain and into an area where there is not. f this amendment goes into the bill, at the same time you are working your windshield wiper you are going to turn on your lights. Now, in my opinion, there are going to be many occasions where that is not necessary. Furthermore, in my opinion, what is going to happen is that people are going to forget to turn off their lights. Also what is going to happen is that you are going to have glare created by the headlights, and that, in my opinion, is as big a distraction as the problem that the gentleman is trying to correct. Furthermore, under this amendment, if you turn on your windshield wiper to wash the window, you are in violation of Mr. Wozniak's amendment unless you also turn on your lights. Now, do not think that is what he intends, but that is what the language says. All this is, Mr. Speaker, is an inconvenience, a full-employment amendment for people who charge batteries and sell new ones, and a revenue-raising tool for some police officer who wants to harass motorists. We voted this down before, and suggest we do the same thing again today. Thank you, Mr. Speaker. The SPEAKER. The question is, will the House agree to the amendment? That will be one of the conditions under this amendment. s that correct? Mr. WOZNAK. That is not my intention. Very possibly, if you read it into the letter of the law, somebody could pull you over for that, but highly think that is very, extremely unlikely. think the reality dictates that that will not occur, that somebody will get pulled over for turning their windshield wipers on to clean their window. The intention is that this would be the trigger mechanism that would remind people that their headlights should be on. f the windshield wipers are on, obviously we have an effect of bad vision, and think it is important to use that as the trigger mechanism. t is not my intention to make a full-employment act out of the people that are going to recharge your batteries or anything iike that, and it is not my intention thai when you turn your windshield wipers on to wash your window, that you have to turn your headlights on, no. Mr. DAVES. Well, Mr. Speaker, to alleviate that concern, just like in the last bill, would it not be better if you specifically spelled out your intent in the legislation rather than the intent where some overzealous local gendarme may take an opportunity to give a citation when somebody, you know, is not under the other process of the bill or the other conditions of the bill and has to have the lights on? Mr. WOZNAK. All right. Well, Mr. Speaker, will tell you what. am not going to be as magnanimous as the previous individual. am going to run my bill and would like to run the amendment. f a correction needs to be made, will talk to my Senator over on the other side over there and see if we can put the corrective language in there. But would like to have this as a trigger mechanism. The gentleman discussed that headlights on during inclem- ent weather causes glare. - would recommend that perhaps he should see his eye physician and that something must be wrong there. Mr. Speaker, would appreciate- The SPEAKER. The gentleman does not have the floor. He was answering an interrogation and only had the floor for that purpose. You can be recognized again if you want. When you turn your ignition on, your headlamps go on; when you turn your ignition off, the headlamps go off. have since corresponded with people in Finland to find out the effect on safety. t is the best safety measure going, and it will prevent a lot of accidents. What this bill does is require that headlights be on during times of inclement weather, not just dawn and dusk and nighttime as it is required by law now, but during rain, sleet, snow, fog, smog, et cetera - anytime that vision is impaired for up to 1,000 feet, give or take a few feet-that is a call that individuals have to make. t is a safety measure that makes sense. do not think it is a full-employment act. think if you left your headlights on once, you would not do it a second time, and think statistically it is proven that many times you believe you can see the other person. A lot of accidents are caused by that. Anybody driving out this morning in the fog and the rain can fully understand the circumstances that am addressing. would appreciate very much if can have an affirmative vote from each and every member of this distinguished body. The SPEAKER. Will the House please be in order. Let us understand the colloquy here. Let us hear the question and the answer. Please be in order. Mr. LEE. Specifically, address my question to the phrase "OR the visibility of the vehicle to others is impaired." What exactly does that mean and what does that include? Mr. WOZNAK. That is exactly what we mean - when the visibility of the vehicle is impaired to others. That is when you are driving; you are trying to pull out in front of somebody, and there is a car coming down and it is one of these type situations - fog, smoke, hail, sleet, or any other kind when the visibility is poor. Sometimes you do not see that car and you pull out in front of it. That means the visibility of that car is impaired by not having its lights on. That is what that means. Mr. LEE. How impaired would it have to be? Mr. WOZNAK. t is just impaired enough that in the act we require having those lights on. Some people with good vision might be able to see things. There are a lot of people out there that having these lights on would prevent a fenderbender or something else. t is a call, once again, but think it is a safety issue that cannot be ignored, that when those lights are on, you can see those cars coming; when they are off, and each and every one of us has been in that situation at least once in our lives, that we had a close call because we did not see somebody coming. This is supposed to prevent that, and that is what that wording means. Mr. LEE. Thank you. The SPEAKER. On final passage, the yeas and nays- Mr. HASAY. Mr. Speaker? The SPEAKER. So then fog lights do not count anymore, Mr. Speaker?

You know, Mr. Speaker, many times when Dempsey you are in a fog, you need the fog lights on. This may be that Dietterick Dinimi situation. am voting against this measure, Mr. Speaker.
