L. 103, No. 69). known as "The Second Class Township Code," further providing for formation of county associations of township officers. Will the House agree to the bill on third consideration? Bill was agreed to. The SPEAKER. This bill has been considered on three different days and agreed to and is now on final passage. The question is, shall the bill pass finally? The SPEAKER. The Chair recognizes Mr. Ryan. Mr. RYAN. Will the gentleman, Mr., consent to a brief period of interrogation? The SPEAKER. The gentleman indicates that he will. The gentleman may proceed. Mr. RYAN. This may, Mr., also be a point of parliamentary inquiry of you and the Parliamentarian. I am not sure just what this is. But as I read the bill-and I am asking the gentleman a question now-as I read HB 717 with its various amendments, it does not change the law. It serves no useful function, because the only thing it does is in section 601 of the code, it adds the word "managers," yet in section 602 of the code the word "managers" appears already, so that there is really nothing being done, and it seems stupid to run bills that do nothing. The SPEAKER. It is hard for the Chair to construe that as any kind of an inquiry, but- Mr. RYAN. Do you agree? The SPEAKER. In that case, that is an inquiry for Mr.. Mr. STUBAN. This is a bill that came from the Local Government Commission, and the only thing is, I guess the managers are concerned that they were not included in this and the townships were not interpreting as allowing them to go. Mr. RYAN. Mr., I am going to invite the gentleman to read the next paragraph. Now, granted, it has all been stricken, but it is existing law, section 602, where the word "managers" appears. It is my understanding, Mr., from our legal staff that this bill, the way it started out, was going to add "managers" and do away with "assessors," in which case there would be a change in the law. However, another amendment was offered which put the assessors back in, and the managers were already in, so that there is no practical change in the law represented by this bill. I do not understand why we need it if that is the case. Mr. STUBAN. Well, Mr., if there seems to be a misunderstanding or some misconception as to what the bill is doing- Mr., since there seems to be some problem with this piece of legislation, I do not think it is that important of a piece of legislation, and let us just go over the bill and we will check with the Local Government Commission as to what the intent is of this legislation. Mr., I would like to take this opportunity to remind the House that the Appropriations Committee will accept amendments to the capital budget up until 5 o'clock today. Any amendments to any of the capital budget programs, up until 5 o'clock today, I want to remind the House members. I will repeat it again. You do not have to be a member of the Appropriations Committee. Any member of the House that has any amendments to any of the capital project programs, those amendments must be in by 5 o'clock today. Mr. WOZNIAK offered the following amendments No. A2 129: Amend Title, page 1, line 2, by striking out "the definition of conviction." and inserting revocation or suspension of operating privilege. Amend Bill, page 1, lines 5 through 16, by striking out all of said lines and inserting Section 1. Section 1532(a) and (b)(l) and (3) of Title 75 of the Pennsylvania Consolidated Statutes, amended May 30, 1990 (P.L. 173, No.42), are amended to read: Revocation or suspension of operating privilege. (a) Revocation.-The department shall revoke the operating privilege of any driver for one year upon receiving a certified record of the driver's conviction of[,] or an adjudication of delinquency [or consent decree] based on any of the following offenses: (1) Any felony in the commission of which a court determines that a vehicle was essentially involved. (2) Any violation of section 3735 (relating to homicide by vehicle while driving under influence). (3) Any violation of the following provisions: Section 3732 (relating to homicide by vehicle). Section 3742 (relating to accidents involving death or personal injury). Section 7102(b) (relating to removal or falsification of identificatioh number). Section 7103(b) (relating to dealing in vehicles with removed or falsified numbers). Section (relating to dealing in titles and plates for stolen vehicles). Section 7121 (relating to false application for certificate of title or registration). Section 7122 (relating to altered, forged or counterfeit documents and plates). (b) Suspension.- (I) The department shall suspend the operating privilege of any driver for six months upon receiving a certified record of the driver's conviction of[,] or an adjudication of delinquency [or consent decree] based on any offense under the following provisions: Section 3367 (relating to racing on highways). Section 3733 (relating to fleeing or attempting to elude police officer). Section 3734 (relating to driving without lights to avoid identification or arrest). Section 3736 (relating to reckless driving). Section 3743 (relating to accidents involving damage to attended vehicle or property).
