On that question, the Chair recognizes Mr.. Mr. RYAN. Thank you, Mr.. Mr., this is loosely described a technical amendment, which I have cleared with the prime sponsor. What I have done is, on page 3, line 18, d have added the wads "or collected" after the word "imposed," the reason for this being that in the case of intangible personal property taxes, these taxes are imposed by the State but collected by local government, and this is to clear up that technical defect. 17 LEGISLATIVE JOURNAL-HOUSE Will the House agree to the amendments? The SPEAKER. On that question, the Chair recognizes Mr. Fargo. Mr. FARGO. Thank you, Mr.. This amendment and the other amendment that I have to offer are really introduced to bring the Pennsylvania law, as it affects the tax liability of veterans in the Persian Gulf, into line with what the Federal Government has allowed for veterans in respect to the Federal income tax. This particular amendment will say that if a veteran is killed in the Persian Gulf or dies as a result of an injury from serving in the Persian Gulf, his income taxes for the year of his death and the previous year will be forgiven. I would ask that we approve this amendment. The SPEAKER. The Chair recognizes Mr.. Mr. BOWLEY. Thank you, Mr.. Mr., will the maker of this amendment please stand for a brief interrogation? The SPEAKER. The gentleman indicates that he is willing to be interrogated. The gentleman may proceed. Mr. BOWLEY. Mr., under your amendment, if a person were to, say, unfortunately be killed in the tax year 1990 and they have already paid their taxes for the tax year 1989, would they in fact be eligible then for a refund of those taxes already paid in 1989? Mr. FARGO. They would as they are attributable to his earnings. That is correct. Mr. BOWLEY. Mr., under your amendment, do you feel you have adequately covered that they would be eligible for that refund? I question whether under that amendment they would be eligible for a refund and how they would go about getting that refund. Mr. FARGO. The SPEAKER. On that question, the Chair recognizes Mr. Fargo. Mr. FARGO. Thank you, Mr.. As I stated before, this is in order to track the Federal laws that have been passed as respects the Federal income tax, but what this is stating is that if, because of this bill or under the

18 LEGISLATIVE JOURNAL-HOUSE FEBRUARY 12, provisions of this bill, the tax return is not filed on time, that the refund comes to the taxpayer or the veteran, in this case, within the 6 months of the filing date of April 15, then from that point on-and this is tracking Pennsylvania law as a payment of interest on refunds-from that point on, interest wlll~be paid t~~tha~veteran for tb&w.& Azd eme ember that this is just a refund of taxes that have been overwithheld or overpaid for that particular year, and because of the fact that the individual was in the Persian Gulf and he was not able to file his return on time, that money is residing with the State of Pennsylvania, and as of October 15-which gives the statutory 6 months-as of that date, interest will start running on that refund. 21 LEGISLATIVE JOURNAL-HOUSE A RESOLUTION Proclaiming the month of March 1991, as "Nutrition Month." WHEREAS, Nutrition is the substance of which life is made and by which life is sustained; and WHEREAS, The quality of food individuals consume each day plays a vital role in their health throughout the life cycle; and WHEREAS, Many individuals do not always know which foods are good for them; and WHEREAS, There is a need for continuing nutrition education and a massive effort to enhance good nutrition practices due to misleading labels and confusing nutritional information; and WHEREAS, In conjunction with the Pennsylvania Dietetic Association, the Commonwealth works with hospitals, nursing homes, schools, colleges and universities to provide educational information on good nutrition; and WHEREAS, A variety of Pennsylvania organizations provide valuable information about the nutritional value of foods and the benefits of good health; and WHEREAS, The Pennsylvania Dietetic Association joins with the Department of Health, the Department of Aging and the Department of Education to promote the slogan "Bite into a Healthy Lifestyle"; therefore be it RESOLVED, That the House of Representatives, in recognition of the important role nutrition plays in the lives of Pennsylvanians, proclaim March 1991, as "Nutrition Month" and urge all citizens to "Bite into a Healthy Lifestyle." 22 LEGISLATIVE JOURNAL-HOUSE FEBRUARY 12, Corriaan I called up for active duty during this crisis, Pennsylvanians coweil Josephs Pitts Kaiser Preston Kasunic Raymond Kenney Reber Kosinski Richardson O'Donnell, Dermody Kruszewski Ritter Donatucci Kukovich Robinson NAYS-1 NOT VOTING-1 The question was determined in the affirmative, and the resolution was adopted. The SPEAKER. The gentleman, Mr., calls up HR 30, which will be read by the clerk. The following resolution was read: House Resolution No. 30 A RESOLUTION Recognizing the Honorable Paul McHale and the Honorable M. upon the occasion of their return to active duty with the United States Marine Corps. WHEREAS, The Honorable Paul McHale and the Honorable M., members of the House of Representatives, have been recalled to active duty with the United States Marine Corps; and WHEREAS, This call comes at a time of national military need in relation to the liberation of Kuwait; and WHEREAS, Representatives McHale and join hundreds of other Pennsylvanians currently on active duty with the United States Armed Forces in the Persian Gulf; therefore be it - RESOLVED, Tiat the ~ouse of Representatives hereby recognizes the loyalty and patriotism of Representatives Paul McHale and M. upon their reentry into the Armed Forces of the United States. Peter J. I1 Will the House adopt the resolution? The SPEAKER. The Chair recognizes the gentleman, Mr.. Mr. DALEY. Thank you, Mr.. Two hundred and fifteen years ago the Pennsylvania Assembly, standing in session in Philadelphia, passed a number of resolutions honoring what they called then the soldier-statesmen of the Revolution. Today we have before us HR 30 that again does basically the same thing, but 215 years since the original resolutions adopted by the Pennsylvania Assembly. Representative Tom this Friday will be leaving Pennsylvania and has been called up for active duty by the United States Marine Corps. Thousands of Pennsylvanians have been which all of us represent in every one of our legislative districts. If I could have your attention for 1 minute, one particular Pennsylvanian I think should be noted at this point in our deliberation is one Maj. Jeff Scott Tice from Representative Paul 's district. He is an Air Force major and has been shot down over Iraq. He is from East Rockhill Township, and I think we need to pause and think and pray and offer our condolences and prayers to the family that Major Tice will be returned to all of us safely. However, Representative will be part of the soldierstatesmen in the rolls of the House, as the Pennsylvania legislature has seen soldier-statesmen leave through the Revolution, the Civil War, the Spanish-American War, World War I, World War 11, and the Vietnam and Korean wars. I think it is only fitting that we pause in our Assembly today to reflect, offer our prayers, and extend our hope and concern to all Pennsylvanians and all Americans serving in this time of great conflict in our world. I am asking, Mr., that HR 30 be held at the desk and, without objection, that all members of the Pennsylvania House be added to the resolution. I also ask, Mr., without asking for unanimous consent, that we have Representative address the Pennsylvania House of Representatives. The SPEAKER. The Chair recognizes Mr. under unanimous consent. Mr. TIGUE. Thank you, Mr.. That is a heck of a send-off. I would hate to see what would happen if I actually did anything. Pete, thank you for your introduction, and probably it is something I could listen to all day, and in all honesty, I thought I was going to have to. I had not counted on this, but Gaynor abandoned me when I need him. l wsu!d like to szy a few~words,~thot.&, now thinti havethe opportunity. It will be very few. First of all, on behalf of our colleague, Paul McHale, and all the men and women who are serving in the Armed Forces, whether they are in Saudi Arabia or elsewhere, we appreciate the support. When you talk to people who have been over in Saudi Arabia who have come back, like I have, the one thing they keep reiterating is, we really appreciate the support from back home. It is important for morale. Any of you who have served in the military, especially in combat zones, know the importance of morale, so it is important. I understand this is not a tribute to me but a tribute to our men and women in uniform, and on their behalf, thank you very, very much. Hopefully, I will be back in time, right after the tax vote. The SPEAKER. Let the record reflect that there is courage and there is courage. Mr. TIGUE. See, they were counting on my vote. Now they do not know what to do.

23 LEGISLATIVE JOURNAL-HOUSE But, again, please keep everyone, generally speaking, in your thoughts and in your prayers, and we appreciate it. Thanks again. The SPEAKER. The Chair recognizes Mr.. Mr. RYAN. Mr., I think it would be disloyal to me, as a former marine, to not offer to accept a power of attorney given to Mr., another former marine, to cast a tax vote on behalf of Mr.. The following resolution was read: House Resolution No. 33 A RESOLUTION Designating February 1991 as "National Association of American Business Clubs Month" in Pennsylvania. ANNOUNCEMENT BY MR. REINARD The SPEAKER. The Chair recognizes the gentleman, Mr., for an announcement. Mr. REINARD. Thank you, Mr.. Mr., I have the unfortunate pleasure to announce some devastating results of last night's ski night. Before I announce the results, I would like to preface a few of the remarks. First off, Captain and Ace had a legal obligation which prevented them from being there last night. Captain had a medical problem, a nonskiing injury, believe it or not, that kept him away from the ski activities, and the results are very poor from a Republican standpoint, and I would like to announce some of the standings. The Democrats overall beat the Republicans. The firstplace member was Greg Fajt, Freshman Fajt, and second place was a very surprising result for any of us who ski: Bob "Boom-Boom" came in for second place. In the Senate race, the House can have a little bit of consideration since the fact that freshman Mike Bortner, one of our own, won first place in the Senate ski-off against the sly Craig Lewis, who took second. The only victory for the Republicans at all was in the firstplace female staff person member, and that was Melissa Belmont of Senator Greenwood's office, a Republican victory there, and to all of us who know him, the sly Tony Barbush happened to take first place for male staff person. The trophy is being protected right now in the Republican confines of the minority leader, but we are going to try to find it, and we will leave the updating to you guys. Thank you very much, Mr.. The SPEAKER. For the information of the members, no more votes will be cast today. The House will not adjourn quickly but will stay in recess to permit receipt of messages from the Senate.
