1 L~(IV7 1 3 TOWN COUNCIL OF MAMMOTH LAKES MINUTES OF REGULAR MEETING APRIL 3, 2013 CLOSED SESSION At 5:00 p.m. the Mayor announced that the Council would be entering into closed session for the purposes as stated in the agenda. ANNOUNCEMENT OF ACTION TAKEN IN CLOSED SESSION The Council reconvened from closed session at 4:55 p.m. and announced that there was no reportable action taken. POLICY MATTER 1. Discussion and Recommendations Regarding Mid-Year Review of Revenues and Expenditures for Fiscal Year The meeting began at 5:03 p.m Agenda bill from Town Manager Marianna Marysheva-Martinez appending the year end projected revenues and expenditures. Ms. Marysheva-Martinez gave a Power Point presentation outlining the information in the staff report. There was discussion among members of Council and staff. SPEAKING FROM THE FLOOR: Sandy Hogan thanked Town Staff for a clear budget that was easy for her to read. There was discussion among members of Council and Ms. Hogan. CONSENSUS: Approve direction that staff proposed as follows: 1. Approve the recommended changes to staffing in Administration and Community & Economic Development, as described on pages 4 and 5 of this report and in Attachments 3A and 3B. 2. Approve the use of $65,000 from the $96,000 one-time Airport repayment to fund an unbudgeted gap for the Permit Technician cost (approximately $50,000), the approved reclassification of the Senior Building Inspector to the Assistant Building Official, and a planning intern (at $16,000). 3. Approve the recommendation to keep an estimated $307,261 in year-end savings in the Public Safety budget. Staff recommends that these savings be used in FY , and possibly in FY , to fund a full-time, entry-level police officer position. 4. Approve the recommendation to utilize the $72,000 in available funds within Public Safety to pay for: (a) $60,000 for Police Station improvements (for which the Council approved $75,000 in FY ); and (b) $12,000 to help pay for Tasers.

2 Town Council Minutes Page 2 of 8 5. Approve the recommendation to accrue over $700,000 in estimated General Fund savings to the REU. If an alternative source of funding is not identified for the Whitmore Pool and Park facilities in FY , these savings could be used to fund the Towns share of the cost. 6. Approve the proposed schedule of budget meetings for FY ROLL CALL At 6:01 p.m. the Mayor called the meeting to order in the Council Chamber, Old Mammoth Road, Mammoth Lakes, California. The Council was present in its entirety with Councilmembers J0 Bacon, John Eastman, Michael Raimondo, Mayor Pro Tern Rick Wood, and Mayor Matthew Lehman in attendance. PLEDGE OF ALLEGIANCE Executive Director of Mammoth Lakes Housing Pam Hennarty, Deputy Director of Mammoth Lakes Housing Jennifer Halferty, and daughter of Community Service Officer Kari Orr, Teagan, led the flag salute. PUBLIC COMMENTS Associate Transportation Planner Jessica Morriss gave an update regarding the Main Street Project. There was discussion among members of Council and Ms. Morriss. John Urdi, Mammoth Lakes Tourism, gave an update regarding current marketing activities. There was discussion among members of Council and Mr. Urdi. Leigh Gaasch said that the pedestrian beacon lights in front of the post office did not work. Martin Kleinbard said that he had brought up several issues in the past that had not been resolved. He said that TOT could not be enforced on an illegally zoned transient rental. He said that he attended a Main Street workshop where the consultants were unprepared to help resolve key issues, and the public was asked to comment on unrealistic goals. There was discussion among members of Council and Mr. Kleinbard. Ten Stehlik asked if there was a workplan item regarding installing yellow flashing lights on Canyon Boulevard by the Westin stairs across from the bus stop. There was discussion among members of Council, Ms. Stehlik, and staff. COUNCILMEMBER REPORTS/ADDITIONS TO THE AGENDA Councilmember Raimondo attended the opening of the Underground Lounge and Nightclub. Councilmember Eastman attended the Eastern Sierra Council of Governments and the Eastern Sierra Transit Authority board meetings.

3 Fown Council Minutes Page.3 ni 8 Mayor Pro Tern Wood attended the Mammoth Lakes Housing board meeting. regarding current results and activities for Mammoth s elite distance runners. He gave an update There was discussion among members of the Council regarding high altitude training at the Whitmore Track. Mayor Lehman attended a Mammoth Bike Games meeting. Mayor Lehman requested that Agenda Items 14 and 15 be switched in order since he would be recusing himself from Item 14. REPORTS FROM COMMISSIONS AND/OR DEPARTMENTS Assistant Building Official Johnny Goetz announced that Town Clean Up Day would be held on May 18th. He thanked the Town s partners in this event, Mono County and Mammoth Disposal. Recreation Manager Stuart Brown gave an update regarding current recreation events. There was discussion among members of Council and Mr. Brown. Finance Manager Cyndi Myrold gave an update regarding the Town s financial software transition. There was discussion among members of Council and Ms. Myrold. COUNCIL PRESENTATIONS Certificate of appreciation to Elizabeth Tenney for her efforts regarding the Mammoth Lakes Gateway Community Project. Town Manager Marianna Marysheva-Martinez introduced Ms. Tenney. Tenney with her certificate of appreciation. Mayor Lehman presented Ms Certificate of appreciation to Executive Director of Mammoth Lakes Housing Pam Hennarty. Town Manager Marianna Marysheva-Martinez introduced Ms. Hennarty. presented Ms. Hennarty with her certificate of appreciation. Mayor Pro Tern Wood Five year anniversary award to Associate Transportation Planner Jessica MolTiss. Town Manager Marianna Marysheva-Martinez thanked and introduced the three Town staff members receiving awards tonight. Senior Planner Sandra Moberly and Mayor Lehman presented Ms. Morriss with her certificate of presentation Ten year anniversary award to Community Service Officer Kari Orr. Police Chief Dan Watson and Mayor Lehman presented Ms. Orr with her certificate of appreciation.

Police Chief Dan Watson and Mayor Lehman presented Sergeant Moscowitz with his certificate of appreciation. CONSENT AGENDA It was moved by Councilmember Michael Raimondo, seconded by Councilmember John Eastman, and carried by a 5-0 roll call vote to approve with Mayor Pro Tern Wood abstaining on Items 7 and 8, the consent agenda. 7. Approve the minutes of the special meeting of March 18, Approve the minutes of the regular meeting of March 20,2013. Ri Approve by resolution the 2013 Recreation Department proposed Fee Schedule amendments (395 20) 10. Receive and file the Community and Economic Development Director Job Description Accept the Register of Demands No in the amount of $766, Accept the Register of Demands No in the amount of $524, POLICY MATTERS 12. Removal of Town of Mammoth Lakes Representatives from the Mammoth Lakes Housing Board of Directors to eliminate conflict of interest issues raised by the State Agenda bill from Senior Planner Sandra Moberly, Associate Planner Jen Daugherty, and Executive (420 30) Director of Mammoth Lakes Housing Pam Hennarty appending a letter dated January 22, 2013 from the State regarding conformance with conflict of interest regulation. Ms. Moberly requested that the item be continued to the meeting of May 1st. Ms. Hennarty outlined the information in the staff report. Town Manager Marianna Marysheva-Martinez said that she saw a conflict for the Town Manager to sit on the Mammoth Lakes Housing board and to oversee the contract. She requested that the Town Manager be removed from the Mammoth Lakes Housing Board. CONSENSUS: Ri (420 30) Postpone this issue to the meeting of May 1st.

Community and Economic Development (CED) Work Program Update/Single Family Transient Rental Work Program Schedule Options Discussion Agenda bill from Senior Planner Sandra Moberly appending the current Community and Economic Development Work Program. Ms. Moberly outlined the information in the staff report. SPEAKING FROM THE FLOOR: John Morris, Mammoth Lakes Lodging Association, asked to keep this discussion separate from the current TOT enforcement efforts. He said that he was in favor of the study to discover the factual evidence. He outlined the many questions that needed to be addressed in the study. He said that the study should be conducted by an impartial, third party consultant firm. Mr. Morris said that the study needed to be supported by a very strong local presence in the form of an 8-9 person steering committee representing various interests. He said that he would like to be a part of the steering committee. He said that he hoped the study could be grant funded, and to not use funds that would be diverted from essential services. There was discussion among members of Council and Mr. Morris. There was discussion among members of Council and staff regarding funding for the study. Cheryl Witherill said that she agreed with Mr. Morris. She urged the Council to approve Option 2 or 3. She said that the current program would answer some questions. She said that it should be funded with grant money. John Vereuck said that he was opposed to allowing transient rental of single family homes. He said that we should try to rent homes that were already allowable to get information before money was spent on consultants. Lizzy Lipman said that she lived in a neighborhood that did not allow nightly rentals but that the neighborhood behind her allowed nightly rentals. She outlined the negative impacts of transient rentals. Tom Gaunt said he was not in favor of nightly home rentals since there was no accountability for those homes and guests. He said that nightly home rentals would destroy the integrity and quality of life in our neighborhoods. Steve Lavender, vacation homeowner, asked what the Town wanted to accomplish with the study. Ten Stehlik said that issues were brought forward at the December meeting, and that two issues that were missing were the guest experience and the impact on the availability of workforce housing. Leigh Gaasch said that she was concerned about where the nightly home rentals would be. the guests should not visit the Sierra Valley Sites. She said that

6 lown Council Minutes April Page 6 ol% It was moved by Mayor Pro Tern Rick Wood, seconded by Councilmember John Eastman, and carried by a 5-0 roll call vote to approve Option 2: Begin work on the single family transient rental work program during the budget process. The Mayor called a recess at 7:40 p.m. and the Council reconvened at 7:49 p.m. 15. Consider changing the name of Minaret Road to honor Dave and Roma McCoy and the McCoy Family. This item was taken out of order Agenda bill from Senior Associate Civil Engineer Peter Bernasconi outlining options for naming a street in Town after the McCoy Family. Mr. Bernasconi outlined the information in the staff report. Councilmember Raimondo said that he had been asked by community members to rename a street in Town in honor of Dave McCoy. There was discussion among members of Council and staff. SPEAKING FROM THE FLOOR: John Vereuck said that he liked the idea of a Dave McCoy Boulevard. Evan Russell said that naming a street for Dave McCoy would be a great honor. He said that young people did not know about Dave McCoy or the history of the Town. He said that Dave did not go out in public that much. Mr. Russell said that they could help with the efforts to get the McCoy Family to the naming event. There was discussion among members of Council and Mr. Russell. Sandy Hogan said that it was long overdue. John Vereuck said that time was of the essence and that donations would happen quickly. Ten Stehlik asked when Dave McCoy s birthday was. She said that it was a good idea, and that she would donate to it. It was moved by Councilmember Michael Raimondo and seconded by John Eastman to approve Option I and go out in the community to raise money to support this great effort. There was discussion among members of Council and staff.

7 Town Council Minutes Page 7 of 8 Quart Keyes, Mammoth Lakes Chamber of Commerce, asked what Street the Town Council was thinking about naming after Dave. She said that the Chamber had not yet decided on a theme or a grand marshall for the Fourth of July Parade. Town Manager Marianna Marysheva-Martinez reported that staff would bring back this item by May 1st with further clarifications regarding possible streets and possible names for the Street. Councilmember Michael Raimondo and Councilmember John Eastman withdrew their first and second motion. It was moved by Councilmember Michael Raimondo, seconded by Councilmember John Eastman, and carried by a 5-0 roll call vote to approve bringing back this item on May 1st with additional possibilities for funding mechanisms, which road should be re-named, and the new name for the street. 14. Approve the Measure U Application Committee s 2013 Measure U Spring funding recommendations in the amount of $455,635, adopt the resolution appropriating $186,000 of Measure U funds for fiscal year , and direct staff to include the balance of funds in the fiscal year Town budget. This item was taken out of order. Mayor Lehman recused himself and left the meeting at 8:12 p.m Agenda bill from Recreation Manager Stuart Brown appending the 2013 Measure U Spring Award ( )Application Grid, Applicant Executive Summaries and Concept Plan, Applicant Project Filter and Checklists, and Funding Recommendations. Mr. Brown outlined the information in the staff report. There was discussion among members of Council and staff. Mr. Brown read comments from Elaine Smith, Mammoth Track Club. There was discussion among members of Council and Sandy Hogan, Measure U Application Committee. SPEAKING FROM THE FLOOR: Ten Stehlik said that if the Council made changes to the recommendation, then the whole packet needed to go back to the Committee. There was discussion among members of Council and staff regarding profits from Measure U recipients. Lloyd Cearley, High Sierra Events, said that he wanted to appeal the amount for the Mammoth to Bishop Bike Ride that the Committee recommended. He said that Mammoth would benefit from the event. There was discussion among members of Council and Mr. Cearley. There was discussion among members of Council and Ms. Hogan.

It was moved by Councilmember Jo Bacon, seconded by Councilmember Michael Raimondo, and carried Ri 3 18 by a 4-0 roll call vote to approve, with Mayor Lehman absent, the Measure U Application Committees Measure U Spring funding recommendations with the resolution appropriating Measure U funds for ( )FY as amended to add the following phrase: subject to the requirements of any future policy adopted by the Town Council which may require repayment and/or profit-sharing by funding recipients, and to remove the corporate sponsorship development funding from the Mammoth Track Club award but give the Mammoth Track Club the option to return for that portion of the funding. Councilmember Bacon requested that a discussion regarding changing the Measure U Application Committee from a 3-member committee to a 5-member committee be agendized.
