1 CITY COUNCIL MINUTE RECORD Page 1 The City of Buda, Texas Volume 135 Tuesday, April 19, 2016 CALL TO ORDER Mayor Ruge called the meeting to order at 6:32 p.m. ROLL CALL City Secretary Alicia Ramirez certified a quorum with the following Council Members present: Mayor Todd Ruge Mayor Pro Tem Wiley Hopkins Council Member Angela Kennedy Council Member David Nuckels Council Member Eileen Altmiller Council Member Bobby Lane Kenneth Williams, City Manager Council Member George Haehn was absent and excused from the meeting. City Staff in attendance: Assistant City Manager Brian La Borde, City Secretary Alicia Ramirez, Planning Director Chance Sparks, Chief of Police Bo Kidd, Library Director Melinda Hodges, Parks & Recreation Director Drew Wells, Public Works Director Mike Beggs, Water Specialist Brian Lillibridge, Public Information Officer David Marino, Economic Development Director Ann Miller, and Executive Assistant Isabel Fernandez PUBLIC COMMENTS None. Mayor Ruge announced the Proposition Four Item H.8. is pulled from tonight s agenda. He noted staff and consultants would be working with stakeholders directly affected by the drainage projects identified under the 2014 Bond Program. CONSENT AGENDA APPROVAL OF THE APRIL 4, 2016, APRIL 5, 2016, AND APRIL 9, 2016 CITY COUNCIL MEETING MINUTES ADOPTION OF A RESOLUTION EXPRESSING OFFICIAL INTENT TO REIMBURSE CERTAIN EXPENDITURES WITH REGARDS TO THE FACILITATION AND IMPLEMENTATION OF THE 2014 GENERAL OBLIGATION BOND (#2016-R-08) APPROVAL OF AMENDMENT NO. 1 TO THE CITY OF BUDA CELL TOWER LICENSE AGREEMENT WITH CLEAR WIRELESS, LLC., AND A MEMORANDUM OF SITE AGREEMENT, AND AUTHORIZATION FOR THE CITY MANAGER TO EXECUTE SAID AGREEMENTS Motion, to approve the Consent Agenda, as presented, was made by Council Member Lane and seconded Council Member Haehn. Motion carried unanimously.
2 Page 2 Minutes Volume 135 April 19, 2016 PRESENTATIONS PRESENTATION BY MR. JOHN HEWA, CEO, REGARDING AN UPDATE ON PEDERNALES ELECTRIC COOPERATIVE (PEC) REGARDING OPERATIONS, SERVICES, AND RELATED MATTERS Mr. Hewa presented background information. A copy of the presentation is part of the permanent supplemental record. General discussion was held on the company s services, solar initiatives, new facilities planning, collaboration on sites and future land purchase, and review franchise fees. Mr. Hewa informed PEC directors recently approved a community and member solar deployment project up to 15 megawatts, which will be divided into smaller projects and distributed within the territory. He noted staff is researching potential land sites, and if there is a facility or proposed site near a future project site, PEC may consider partnering with their neighbor. Mr. Hewa further informed on the company s mobile billing platform, service alerts, and kiosks. PRESENTATION AND DISCUSSION ON THE POTENTIAL FOR A CITY OF BUDA AQUIFER STORAGE AND RECOVERY (ASR) PROJECT Water Specialist Brian Lillibridge presented background information. A copy of the presentation is part of the permanent supplemental record. General discussion was held on interested in pursuing the feasibility study, cutting edge technology, what are the restrictions, viable source. Mayor Ruge informed the City budgeted funds for the EP project in FY , which never happened. City Manager Kenneth Williams added those funds might be transferred to the ASR study. REGULAR AGENDA APPROVAL OF THE FINAL SCHEMATIC DESIGN AND ANY COSTS ASSOCIATED THEREWITH FOR THE MUNICIPAL AND PUBLIC SAFETY FACILITIES IN ACCORDANCE WITH PROPOSITIONS ONE & TWO OF THE 2014 BOND PROGRAM Assistant City Manager Brian LaBorde presented background information. Mr. LaBorde introduced Talmidge Smith and Ginny Chilton of Page Architects and Brenda Jenkins of ECM. General discussion was held on the roof material, library total footprint, library long range plan consultant, Emergency Operations or Preparedness Center and related amenities, and the project budget. City Manager Kenneth Williams commented on the emergency operations center, the generator, and identifying critical departments. He noted the proposition stated EOC, noting this was an essential part of the building. Mr. Williams further noted the importance of planning for these essentials. He noted staff has questions and needs answers to those questions.
3 Minutes Page 3 April 19, 2016 Volume 135 Mayor Ruge suggested tabling the item until the next meeting to provide more communication with staff and consultants. He expressed concerns with being presented with partial information. Motion, to table the consideration on the final schematic design, as presented, was made by Mayor Ruge and seconded by Council Member Kennedy. Motion carried unanimously. APPROVAL OF GUARANTEED MAXIMUM PRICE (GMP) FOR CONSTRUCTION OF THE PARKS MAINTENANCE BUILDING Parks and Recreation Director Drew Wells introduced Troy Kittel with Page Architects. Mr. Kittel presented background information. A copy of the presentation is part of the permanent supplemental record. He informed the budget cost increase is due to the changes made by the City. Motion, to approve the GMP in the amount of $647,122.00, as presented, was made by Mayor Ruge and seconded by Council Member Altmiller. Motion carried unanimously. DIRECTION TO STAFF REGARDING AN ORDINANCE OUTLINING PROVISIONS FOR DISEASED TREES Parks and Recreation Director Drew Wells and Planning Director Chance Sparks presented background information. A copy of the presentation is part of the permanent supplemental record. General discussion was held on whether staff has contacted the county to possibly partner in a solution; potential negative impacts to affected areas, specifically to property values; educating the public versus imposing ordinance regulations; cost involved to implement such an ordinance; and the proposed ordinance regulations and enforcement of such. In conclusion, Mayor Ruge suggested staff present a budget before considering adopting such an ordinance. Mr. Wells noted cost are based on the diseased center location. Mr. Ruge also suggested staff contact the county and other surrounding cities for potential solutions or funding mechanisms. At this time, Mr. Ruge suggested staff concentrate on the education component. AWARD OF BID FOR DIRECTIONAL DRILLING/LINE BORING WORK RELATED TO THE INTERIM WATER IMPROVEMENTS PROJECT TO DAKOTA UTILITY CONTRACTORS, INC. IN THE AMOUNT OF $129, AND AUTHORIZATION FOR THE CITY MANAGER TO EXECUTE THE CONTRACT Water Specialist Brian Lillibridge presented background information. Motion, to award bid to Dakota Utility Contractors, Inc. in the amount of $129,270.00, as presented, was made by Council Member Lane and seconded by Council Member Hopkins. Motion carried unanimously. DELIBERATION AND POSSIBLE ACTION TO AWARD THE BID FOR PUMP STATION IMPROVEMENTS RELATED TO THE INTERIM WATER IMPROVEMENTS PROJECT AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT Water Specialist Brian Lillibridge presented background information.
4 Page 4 Minutes Volume 135 April 19, 2016 Council Member Hopkins and Nuckels left the meeting at 8:36 p.m. Motion, to award bid to Austin Engineering Company, Inc., in the amount of $434,000.00, as presented, was made by Council Member Altmiller and seconded by Council Member Kennedy. Motion carried unanimously. Record reflects Council Members Hopkins and Nuckels were not present for the vote. RECESS At 8:40 P.M., Mayor Ruge called a recess. RECONVENE At 8:47 P.M., Council reconvened, and the following business was transacted: DIRECTION TO STAFF REGARDING SOLID WASTE SERVICES CONTRACTING AND PROCUREMENT Planning Director Chance Sparks presented background information. A copy of the presentation is part of the permanent supplemental record. General discussion was held on the current trash service, specifically customer service and issues related to initial point of contact; curbside pickup service; bulk trash and tree limb pickup; recycling service; option to increase or decrease the number of bins and appropriate cost adjustments; contract length; and special event partnership and possibly using Hotel Occupancy Tax (HOT) funds. Mayor Ruge suggested eliminating the bi-annual clean up at City Park noting the service is for city residents and not extraterritorial jurisdiction (ETJ) residents. In conclusion, Mayor Ruge suggested staff consider the following during the negotiations: basic trash service; quarterly curbside bulk pickup; cost analysis on bins, bundling, and paper bags; customer service; contract length; and electronic and hazardous waste options. Mr. Ruge commented on the need to test the market and compare prices. He noted the City of Buda is the closest city and should have lower rates. Mayor Ruge also commented on the collection aspect and informed TDS receives payment whether the City gets paid or not. He noted there are substantial amounts of owed monies to the city. Finance Manager Sidonna Foust added another city has negotiated payments are sent on collected amounts. ADOPTION OF A RESOLUTION DIRECTING THE PUBLICATION OF NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND LIMITED REVENUE CERTIFICATES OF OBLIGATION, SERIES 2016 AND OTHER MATTERS RELATED THERETO (#2016-R-09) Finance Manager Sidonna Foust presented background information noting the issuance was for the GBRA pipeline. Motion, to adopt the Resolution in the amount not to exceed $1.3M, as presented, was made by Council Member Lane and seconded by Council Member Altmiller. Motion carried unanimously.
5 Minutes Page 5 April 19, 2016 Volume 135 TABLING ON DELIBERATION AND POSSIBLE ACTION REGARDING CONSIDERATION ON DRAINAGE PROJECTS IN ACCORDANCE WITH PROPOSITION FOUR OF THE 2014 BOND PROGRAM Mayor Ruge announced the item has been tabled at the request of staff. UPDATE AND DIRECTION TO STAFF ON REVISING THE CITY OF BUDA S BOARD & COMMISSION APPLICATION, AND RELATED MATTERS City Secretary Alicia Ramirez presented background information. Council concurred with the suggested changes to the proposed application with the following edits: 1) Resident of City add For how long? 2) Register Voter remove or eligible to be 3) Add Member Responsibilities Acknowledgement STAFF REPORT UPDATE ON 2014 BOND PROGRAM Assistant City Manager Brian LaBorde presented background information. Parks & Recreation Director Drew Wells provided an update on the new park property tour. Staff will follow up with Prop 5 and P&R commission with consultants. And present an update report in May 2016 UPDATE ON: 1) TRAFFIC SIGNAL TIMING ON MAIN STREET AND 2) DEDICATED LEFT TURN LANE ON SAN ANTONIO AND MAIN ST. Public Works Director Mike Beggs presented background information noting the upgrades cost $15K, which will be covered in the current Street Budget. Council concurred with the recommendation. Council Member Hopkins commented on the issues with the turn lane at 967. He informed drivers are using the lane as a merging lane, ignoring the white markings, and creating safety risk. The City Attorney suggested considering the item at a future agenda. 6 Page 6 Minutes Volume 135 April 19, 2016 Planning Director Chance Sparks provided an update on the Traffic Calming. He announced a Work Shop will be held on Tuesday, April 26, at 7:00 to review the draft policy and ordinance. Mr. Sparks also announced the Transit Development Plan staff will schedule for May 2016 Council meeting for review and approval. Mr. Williams provided an update on: City Engineer vacancy - He noted staff have received three applications, and will start scheduling interviews. Reorganization Plan presentation within the next two meetings Sewage spill a serious spill into Garlic Creek, contact TCEQ and TxParks and Wildlife; caused by a contractor; basically no cleanup high flow of rain washed out spill; gallons spilled; contractor clipped SKATA system, media notices sent out as well as social media site; follow up report within 5 days; Weather no substantial flooding Beautification of median near Falcon Bank staff will begin working on a design and installation Staff continue to work on a lot of projects CITY COUNCIL S BOARD AND COMMITTEE REPORTS None. ITEMS OF COMMUNITY INTEREST April 23 24: Buda Wiener Dog Races this weekend April 30: Spring Clean-up May 5: Walk with the Mayor on Thursday at 6:00 CITY COUNCIL REQUESTS FOR FUTURE AGENDA ITEMS Council Member Kennedy commented on a radio program regarding police officers, specifically training. She noted the city is in the leading edge in comparison to other cities. Ms. Kennedy suggested a discussion of current training plans and wish list for future trainings. Police Chief Bo Kidd informed such report is included in the monthly Project Status Report as well as in the budget process. Ms. Kenney noted such a presentation is an opportunity to educate the citizens of the caliber of police force here in Buda. Council Member Nuckels Bradfield park and flooded area; possibly use the TxDOT Bridge Program Council Member Altmiller proceed with the Aquifer Storage Feasibility Study Mayor Ruge Proclamation 5/4 International Firefighters Day and invite them to accept ADJOURNMENT Motion, to adjourn the meeting, was made by Mayor Ruge and seconded by Lane. Motion carried unanimously.
