DATE: SUBJECT: Consideration of Appointment of City Council Representatives to Outside Agencies; Resolution Designating Representative to the Orange County Fire Authority's Board of Directors; and Update and Posting of the Fair Political Practices Commission (FPPC) Form 806 on the City's Website RECOMMENDATION : By motion, 1. Appoint members and alternates to serve as representatives to various outside agencies through December 2016 (or specific term where noted); and, 2. Adopt a Resolution designating and appointing a representative to the Orange County Fire Authority's Board of Directors; and, 3. Direct the City Clerk to update and post the Fair Political Practices Commission (FPPC) Form 806 (Agency Report of Public Official Appointments) on the City's website. EXECUTIVE SUMMARY: It is recommended that the City Council appoint members and alternates to serve as representatives to various outside agencies through December The City Council adopted the Fair Political Practices Commission (FPPC) Form 806, at its January 15, 2013, meeting. Form 806 allows a City Council to be able to vote on his or her appointment to a public agency, special district or joint power authority that pays a stipend for attendance at governing board meetings. It is recommended that the City Council appoint members and alternates to serve as representatives to various outside agencies through December 2016; adopt a Resolution designating and appointing a representative to the Orange County Fire Authority's Board of Directors; and direct the City Clerk to update the new appointments and post the Fair Political Practices Commission (FPPC) Form 806 (Agency Report of Public Official Appointments) (Attachment 1) on the City's website.

2 Page 2 of 7 DISCUSSION/ANALYSIS: The City is a member of various regional public agencies that provide public service or support City services or interests such as regional transportation, public agency insurance, and water/wastewater processing. These agencies are either joint powers, a decision-making public agency made up of the public agencies within its jurisdiction, or advisory in nature. Advisory bodies develop recommendations which are considered by decision-making agencies. The term of service for most of these agencies follows the calendar year. Therefore, appointments are made on an annual basis (except where noted). The City Clerk will communicate the Council's appointments to the various outside agencies. Below is information about each of these agencies: Orange County League of California Cities: Description: An Association of member Orange County cities that work to further common interests among its members, as well as in the larger California environment. This organization is the local chapter of the California League of Cities. Appointees are the City's designated voting members at the California League of Cities conference (September). ship Requirement: Elected Officials and/or Appointed Officials (Including City Staff) Regular Meeting: Quarterly {TBD) Current Appointees: Kerry K. Ferguson, ; Pam Patterson, Esq., Alternate Recommended Action:_ By motion, appoint (1) representative and (1) alternate representative Association of California Cities -Orange County (AOCC-OC): Description: The Association advocates the preservation and enhancement of local control. It holds periodic meetings of City officials to foster and disseminate knowledge relating to municipal government and to generate interest and more active civic consciousness among the members; discuss municipal issues for the purpose of promoting governmental efficiency and reducing the cost of government; and to formulate policy and advocate the common policies of its members on local, regional, state and national issues of interest to its members. Regular Meeting: 2nd Thursday, monthly, 5:30p.m. Voting : Each member city shall have one vote. The vote shall be cast by the Mayor of each member city, or his/her Council designee, confirmed in writing and delivered to the Association prior to the vote. Recommended Action: No action required

3 Page 3 of 7 Orange County Library Advisory Board: Description: Library services in San Juan Capistrano are provided by the County of Orange. The Board is comprised of a representative from each member city, the Board of Supervisors, and the unincorporated areas. The Board makes policy recommendations to the Board of Supervisors. ship Requirement: Exclusively elected officials Regular Meeting: Quarterly and determined by the Board Current Appointees: Pam Patterson, Esq., ; John M. Perry, Alternate Recommended Action: By motion, appoint (1) representative and (1) alternate representative San Juan Basin Authority: Description: The San Juan Basin Authority coordinates regional groundwater issues and supply; joint powers. ship Requirement: Appointment at the City Council's discretion Regular Meeting: 2na Tuesday, monthly; 1:30 p.m. Current Appointees: John M. Perry, ; Derek Reeve, Alternate Recommended Action: By motion, appoint (1) Board ; (1) Alternate Board Desalination Project Participation Committee: Description: In 2008, the City agreed to participate in exploring the feasibility of an ocean desalination plant with Municipal Water District of Orange County (MWDOC), South Coast Water District (SCWD), Laguna Beach County Water District (LBCWD), and Moulton Niguel Water District (MNWD). ship Requirement: At the City Council's discretion, but preference for the Committee to be an elected official Regular Meeting: Last Friday Monthly (as needed and days may change) Current Appointees: John M. 4 Page 4 of 7 South Orange County Watershed Management Area (SOCWMA) Description: To address water quality impairments; establishing priorities for water resources solutions across traditional disciplinary bounds; and jointly advocating for policies and funding that assist these goals. ship Requirement: Preference for the Board to be an elected official and the Alternate Board member to be either an elected official or an executive level official. Regular Meeting: Twice a year or as needed (TBD) Current Appointees: Ray Miller, ; John M. Perry, Alternate Recommended Action: By motion, appoint (1) Board ; (1) Alternate Board South County Agencies Group: Description: The South County Agencies Group was formed in 2011 to identify common ground and collaborate to provide effective advocacy for the cities and water districts that provide water service in South Orange County. The South County Agencies Group is made up of the following ten (10) agencies: The City of San Juan Capistrano, City of San Clemente, El Toro Water District, Emerald Bay Service District, Irvine Ranch Water District, Laguna Beach County Water District, Moulton Niguel Water District, South Coast Water District, Santa Margarita Water District, and Trabuco Canyon Water District. ship Requirement: Exclusively elected officials Regular Meeting: 3ra Wednesday, monthly; Moulton Niguel Water District Headquarters Current Appointees: John M. Perry, ; Pam Patterson, Esq., Alternate Recommended Action: By motion, appoint (1) Board and (1) Alternate Board California Joint Powers Insurance Authority (CJPIA): Description: A governmental joint powers insurance pool that assists the City with risk management and related training; joint powers. ship Requirement: Exclusively elected officials Regular Meeting: Held at annual conference scheduled on the third Wednesday in July Reimbursement: $1 00 stipend in lieu of travel expenses Current Appointees: Pam Patterson, Esq., ; John M. 5 Page 5 of 7 Southern California Association of Governments (SCAG): Description: An association representing six (6) counties (Imperial, Los Angeles, Orange, Riverside, San Bernardino and Ventura) that works to develop regional plans for transportation, growth management, housing development, air quality and other issues of regional significance. ship Requirement: Exclusively elected officials Regular Meeting: 1st Thursday of every month Reimbursement: $120 per meeting Current Appointees: Kerry K. Ferguson, ; Pam Patterson, Esq., Alternate Recommended Action: By motion, appoint (1) Board ; (1) Alternate Board Orange County Fire Authority (OCFA): Description: The Orange County Fire Authority Board of Directors has twenty-five members and sets policy according to its adopted Rules of Procedures. Twenty-three of the members represent partner cities, and two members represent the county unincorporated area. ship Requirement: Exclusively elected officials Regular Meeting: 4th Thursday, monthly; 6:30 p.m. to 7:30 p.m.; OCFA Headquarters, Irvine Reimbursement: $100 per meeting Current Appointee: John M. Perry, Recommended Action: By motion, appoint (1) Board Orange County Vector Control: Description: The Orange County Vector Control Board is an independent special district dedicated to controlling rats, mosquitoes, and other disease carrying and public health pests. Activities also include surveillance of vectors and vector-borne diseases, public education services and identification of public health pests. Each Trustee is appointed by the city they represent to serve a two or four year term. ship Requirement: Appointment at the City Council's discretion Regular Meeting: 3ra Thursday, Monthly, 3:00 p.m.; Vector Control Headquarters, Garden Grove Reimbursement: $100 per month in lieu of travel expenses Current Appointee: Pam Patterson, Esq. 6 Page 6 of 7 South Orange County Wastewater Authority Joint Powers Authority (SOCWA): Description: SOCWA is concerned with regional sewage and reclamation efforts for the re-use of groundwater or treated water. The City of San Juan Capistrano owns 1/3 of the J.B. Latham Wastewater Plant. ship Requirement: Appointments at the City Council's discretion Regular Meeting: 1st Thursday, monthly; 8:30 a.m.; SOCWA Headquarters, Dana Point Reimbursement: $100 per meeting Current Appointees: Ray Miller, ; John M. Perry, Alternate Recommended Action: By motion, appoint (1) Board ; (1) Alternate Board Transportation Corridor Systems: (Foothill, Eastern & San Joaquin Hills Transportation Corridors): Description: The Transportation Corridor Agencies (TCA) is a Joint Powers Authority formed in 1986 to design, finance, construct and operate the three Orange County toll roads. The Agency is in the process of merging all toll roads under the direction of one board. San Juan Capistrano has traditionally appointed one Council to serve on the two TCA Boards; joint powers. ship Requirement: Exclusively elected officials Regular Meeting: 2na Tuesday, monthly; 9:00a.m.; Irvine Agency Headquarters Reimbursement: $120 per board meeting and mileage Current Appointees: Kerry K. Ferguson, ; Derek Reeve, Alternate Recommended Action: By motion, appoint (1) Board and (1) Alternate Board SONGS Decommissioning Community Engagement Panel: Description: A panel of 14 to 18 members. Four (4) to six (6) members are elected officials from local communities within the SONGS 10-mile Emergency Planning Zone. An additional 10 to 12 members, representatives of the local public and key stakeholders, will be selected by the SONGS Co-owners. The panel is convened by the SONGS Co-owners as a volunteer, non-regulatory body to enhance and foster open communication, public involvement and education on SONGS decommissioning activities. It is intended to serve as a conduit for public information and encourage community involvement and communication with the SONGS Co-owners on matters related to the SONGS decommissioning. ship Requirement: s from represented cities will be determined by its respective City Councils Regular Meeting: Quarterly (TBD) Current Appointee: Pam Patterson, Esq., Recommended Action: By motion, appoint (1) representative to continue the remainder of the current term.

10 RESOLUTION NO XX A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DESIGNATING AND APPOINTING ITS REPRESENTATIVE TO THE ORANGE COUNTY FIRE AUTHORITY'S BOARD OF DIRECTORS WHEREAS, the City, as a "member" of the Orange County Fire Authority Joint Powers Authority (JPA) is entitled to appoint a representative director ("Director") to the Orange County Fire Authority's Board of Directors; and, WHEREAS, each member agency, by resolution of its governing body, shall designate and appoint one representative to act as its Director on the Authority Board of Directors, except the County whose Board of Supervisors shall appoint two representatives to act as its Directors; and, WHEREAS, each Director shall be a current elected member of the governing body; and, WHEREAS, each Director shall hold office until the selection of a successor by the appointing body; and, WHEREAS, each Director is to serve at the pleasure of his or her appointing body and may be removed at any time, with or without cause, at the sole discretion of that appointing body; and, WHEREAS, any vacancy shall be filled in the same manner as the original appointment of a Director. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, California, does hereby designate and appoint as a Director to the Orange County Fire Authority Board of Directors.
