Public Review and Comment Period Schedule for the StanCOG Draft 2018 Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS) and Programmatic Environmental Impact Report (PEIR) Elisabeth Hahn reported that the Draft 2018 RTP/SCS and PEIR had been released on May 11, 2018 for a 55-day public review and comment period that was to end on July 5, She said that two public hearings were scheduled on June 20 th and July 18 th and that the documents would be presented to the Policy Board at their August 15, 2018 meeting. B. Public Review and Comment Period Schedule for the StanCOG Draft 2019 Federal Transportation Improvement Program (FTIP) Debbie Trujillo provided a report on the Draft 2019 FTIP which programs projects in Federal Fiscal Years (FFY) 2018/19 through 2021/22. She stated that the draft document was out for public review from June 5 th to July 5 th, with a public hearing scheduled for June 20 th at the regularly scheduled Policy Board meeting. She also reported that the 2019 FTIP would be presented to the Policy Board for consideration at their August 15th meeting, and submitted to Caltrans by September 3, C. Motion to Recommend Policy Board Adopt by Resolution the FY 2018/19 Transportation Development Act (TDA) Allocations for Transit and Adopt by Resolution the FY 2018/19 Transportation Development Act (TDA) Apportionments for Transit and Other Purposes Karen Kincy reported that the Transit Cost Sharing Committee met in April and recommended approval of claims totaling $20,052,240. She said that there would then be LTF funds remaining of $1,303,920 which were recommended to be held in reserves for future transit use. There was a discussion that the funds should be distributed to the jurisdictions for Other Purposes: Streets and Roads according to the methodology in Step 3 of the Transit Cost Sharing Procedures. The City of Modesto and Stanislaus County were supportive of the staff recommendation. The City of Ceres suggested that a split be considered between Streets and Roads, and Reserves. *By Motion (City of Oakdale/Stanislaus County), and a unanimous roll call vote, the Management and Finance Committee recommended that the Policy Board adopt by Resolution the FY 2018/19 Transportation Development Act (TDA) Allocations for Transit (as shown on Exhibit A of the Staff Report). *By Motion (City of Ceres/City of Patterson), and a 8-2 roll call vote (with the City of Newman and the City of Waterford voting No), the Management and Finance Committee recommended that the Policy Board adopt by Resolution the FY 2018/19 TDA Apportionments for Transit and Other Purposes (as shown in Exhibit B of the Staff Report), with the change of a 50% split for Other Purposes-Streets and Roads, and 50% for reserves. D. Motion to Nominate FY 2018/19 Management and Finance Committee (MFC) Chair and Vice-Chair *By Motion (Stanislaus County/City of Oakdale), and a unanimous vote, the Management and Finance Committee (MFC) elected Sean Scully to serve as the FY 2018/19 Management and Finance Committee Chair. 5

7 TO: Management and Finance Committee Staff Report Motion FROM: Karen Kincy, Manager of Financial Services Stephanie Mora, Financial Services Specialist I DATE: July 6, 2018 SUBJECT: FY 2017/18 Local Transportation Fund Allocations for Other Purposes: City of Waterford Recommendation By Motion: Recommend the Policy Board adopt by resolution the FY 2017/18 Local Transportation Fund (LTF) Allocations for Other Purposes: City of Waterford. Background On June 21, 2017, the StanCOG Policy Board adopted LTF apportionments for FY 2017/18 for Transit and Other purposes. On November 15, 2017 the StanCOG Policy Board adopted an LTF Supplemental Apportionment for FY 2016/17. The City of Waterford has submitted claim for those funds, as follows: City of Waterford: 2017/18 Purpose Source Claim Nonmotorized LTF $ 6,950 $ 6,950 The claims have been reviewed and determined to be complete. The claimants have submitted all required audits and reports. The audits for FY 2016/17 contain no audit findings. The rules governing the LTF require the adopting resolution to contain specific findings prior to any LTF allocations. The findings are as follows: 7

8 Required Findings (1) The claimant's proposed expenditures are in conformity with the Regional Transportation Plan. (2) The sum of the claimant's allocations from the Local Transportation Fund does not exceed the amount the claimant is eligible to receive during the fiscal year. (3) There are no unmet transit needs which are reasonable to meet within the jurisdiction. 9 STANISLAUS COUNCIL OF GOVERNMENTS RESOLUTION APPROVING FY 2017/18 LOCAL TRANSPORTATION FUND ALLOCATIONS FOR OTHER PURPOSES: CITY OF WATERFORD WHEREAS, the Stanislaus Council of Governments (StanCOG) is a Regional Transportation Planning Agency and a Metropolitan Planning Organization, pursuant to State and Federal designation; and WHEREAS, StanCOG has been designated as the Transportation Planning Agency with the responsibility to administer the Transportation Development Act; and WHEREAS, the City of Waterford has submitted a transportation claim in conformance with all applicable rules and regulations; and WHEREAS, StanCOG has adopted a Regional Transportation Plan which identifies transit needs which are reasonable to be met, with consideration to the size and location of identifiable groups likely to be dependent upon transit, the adequacy of both private and public services and potential alternatives; and WHEREAS, StanCOG upon proper review has determined that there are no unmet transit needs that are reasonable to meet within the jurisdiction of the City of Waterford. NOW, THEREFORE, BE IT RESOLVED, that based on the staff report and the evidence presented, the Policy Board finds: (1) The claimant's proposed expenditures are in conformity with the Regional Transportation Plan. (2) The sum of the claimant's allocations from the Local Transportation Fund does not exceed the amount the claimant is eligible to receive during the fiscal year. 12 TO: Management and Finance Committee Staff Report Motion FROM: Elisabeth Hahn, Principal Planner Debbie Trujillo, Assistant Planner DATE: July 23, 2018 SUBJECT: Recommendation By Motion: 2019 Federal Transportation Improvement Program (FTIP) and Corresponding Air Quality Conformity Analysis (AQCA) Recommend that the Policy Board adopt by Resolution the 2019 Federal Transportation Improvement Program (FTIP) and Corresponding Air Quality Conformity Analysis (AQCA). Background The Federal Transportation Improvement Program (FTIP) is a federally mandated four year program of all transportation projects that will receive federal funding or are subject to a federally required action. It includes all federally funding projects and regionally significant projects for which approval from federal agencies is required, regardless of funding source. Through collaboration with the California Department of Transportation (Caltrans), the California Transportation Commission (CTC), StanCOG's member agencies, and the four public transit operators, the FTIP is updated every two years. The FTIP implements the long-range Regional Transportation Plan (RTP) to accomplish improvements in mobility and air quality. Per federal legislation, no project may receive federal funding unless it is contained in an approved FTIP. The Clean Air Act Section 176(c) (42 U.S.C. 7506(c)) and U.S. Environmental Protection Agency (EPA) transportation conformity regulations (40 CFR 93 Subpart A) require that each new FTIP demonstrate conformity to the State Implementation Plan (SIP) before the MPO considers it for adoption. The analysis demonstrates that the criteria specified in the transportation conformity regulations for a conformity determination, are satisfied by the 2019 FTIP. The FTIP is a financially constrained program of transportation projects that identifies the current and pending uses of federal and state transportation funds. The FTIP demonstrates fiscal 12

13 constraint by including sufficient financial information to confirm that the projects can be implemented using committed or available resources. Projects contained in the FTIP are derived from the following sources: The 2018 RTP; The adopted State Transportation Improvement Program (STIP) and the State Highway Operation and Protection Plan (SHOPP) Program approved by the CTC; Surface Transportation Block Grant Program (STBGP), formerly RSTP and Congestion Mitigation Air Quality Improvement (CMAQ) Program projects approved by the MPO, and Federal Demonstration (DEMO) projects; Federal transit projects and programs funded by the Federal Transit Administration (FTA); Highway Bridge Program (HBP), Highway Safety Improvement Program (HSIP), and other maintenance, seismic retrofit, and safety programs; Active Transportation Program (ATP), and; Locally funded projects on state highways, and other "regionally significant", nonfederally funded projects that have committed funding sources. Discussion On June 5, 2018 StanCOG staff released the Draft 2019 FTIP and the corresponding Draft Conformity Analysis for a 30-day public review and comment period. A public hearing was held on June 20, 2018 at the regularly scheduled Policy Board meeting to provide the public and other interested stakeholders with an opportunity to comment on the Draft 2019 Federal Transportation Improvement Program (FTIP) and the corresponding Draft Conformity Analysis. Following the 30-day public review and comment period, StanCOG received one comment letter on the Draft FTIP document. Staff has reviewed and addressed the public comment received and provided a response to comment in Appendix V of the final Draft 2019 FTIP document. 14 STANISLAUS COUNCIL OF GOVERNMENTS RESOLUTION ADOPTING THE 2019 FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM AND THE CORRESPONDING CONFORMITY ANALYSIS WHEREAS, the Stanislaus Council of Governments (StanCOG) is a Regional Transportation Planning Agency and a Metropolitan Planning Organization, pursuant to State and Federal designation; and WHEREAS, federal planning regulations require that Metropolitan Planning Organizations prepare and adopt a short range Federal Transportation Improvement Program (FTIP) for their region; and WHEREAS, projects submitted in the 2019 FTIP must be financially constrained and the financial plan affirms that funding is available; and WHEREAS, the 2019 FTIP has been prepared to comply with Federal and State requirements for local projects and through a cooperative process between the Federal Highway Administration (FHWA), the Federal Transit Administration (FTA), the State Department of Transportation (Caltrans), principal elected officials of general purpose local governments and their staffs, and public owner operators of mass transportation services acting through the StanCOG forum and general public involvement; and WHEREAS, the 2019 FTIP program listing is consistent with: 1) the 2018 Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS); 2) the 2018 State Transportation Improvement Program; and 3) the Corresponding Conformity Analysis; and WHEREAS, the 2019 FTIP contains the MPO s certification of the transportation planning process assuring that all federal requirements have been fulfilled; and WHEREAS, the 2019 FTIP meets all applicable transportation planning requirements per 23 Code of Federal Regulations (CFR) Part 450; and WHEREAS, the MPO must demonstrate conformity per 40 CFR Part 93 for the RTP and FTIP; and WHEREAS, the Conformity Analysis for the 2019 FTIP supports a finding that the 2019 FTIP and 2018 RTP meet the air quality conformity requirements for carbon monoxide, ozone and particulate matter; and WHEREAS, the 2019 FTIP and 2018 RTP do not interfere with the timely implementation of the Transportation Control Measures; and WHEREAS, the 2019 FTIP and 2018 RTP conform to the applicable State Improvement Programs (SIPs); and 14

15 WHEREAS, the documents have been widely circulated and reviewed by the StanCOG advisory committees representing the technical and management staffs of the member agencies; representatives of other governmental agencies, including State and Federal; representatives of special interest groups; representatives of the private business sector; and residents of Stanislaus County consistent with the public participation process adopted by StanCOG; and WHEREAS, a 30-day public review/comment period was conducted from June 5, 2018 to July 5, 2018, and a public hearing was held on June 20, 2018, to hear and consider comments on the 2018 FTIP, and Corresponding Air Quality Conformity Analysis; and WHEREAS, the StanCOG Executive Director is authorized to execute any administrative changes to either the 2019 FTIP or Corresponding Air Quality Conformity Analysis in order to be responsive to any Caltrans, FHWA, or FTA comments for the purpose of securing State and Federal approval of these documents. NOW, THEREFORE, BE IT RESOLVED, that the Stanislaus Council of Governments adopts the 2019 FTIP, and Corresponding Conformity Analysis. BE IT FURTHER RESOLVED, that the Stanislaus Council of Governments finds that the 2019 FTIP and 2018 RTP/SCS are in conformity with the requirements of the Federal Clean Air Act Amendments and applicable State Implementation Plans for air quality. 16 TO: Management & Finance Committee Staff Report Discussion FROM: Debbie Trujillo, Assistant Planner DATE: August 1, 2018 SUBJECT: Senate Bill 1 (SB 1) FY 2019/20 Local Partnership Program Formulaic Apportionment for Cycle 2 Recommendation: Consider information presented. Background Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017, was signed into law on April 28, This legislative package established the Road Maintenance and Rehabilitation Account (RMRA) and Program (RMRP). SB1 invests a total of $54 billion over the next decade to fix roads, freeways and bridges in communities across California and puts more dollars toward transit and safety. Through SB 1, the Local Partnership Program provides $200 million annually in matching funding to support transportation investments that local communities are already making in their region. These matching funds will support cities and counties that have voter-approved transportation tax measures, such as Measure L. Funds will be distributed by the California Transportation Commission (CTC) on a 50% competitive and 50% formula basis. StanCOG, as the Transportation Authority for the Stanislaus region, is eligible to receive formula shares from the Local Partnership Program, and can nominate a project in cooperation with its member agencies. Cycle 1 of the Formulaic Program covered Fiscal Years (FY) and StanCOG nominated the Route 99 Fulkerth Road Interchange Improvements in Turlock to receive its share of funding, $1.258 million and $1.243 million respectively. The funds were approved by the California Transportation Commission (CTC) in May Cycle 1 of the Competitive Program covered FY through StanCOG submitted the Route 99 Fulkerth Road Interchange Improvements in Turlock as its top priority project. It was awarded $3.009 million in funding in FY by the CTC. The McHenry Avenue Widening Project was submitted as StanCOG s second ranked project. The CTC did not award the McHenry Avenue project competitive program funding. 16

17 Discussion A call for projects for Cycle 2 of the Formulaic Program has been announced, covering FY StanCOG s formulaic share is $1.196 million. The McHenry Avenue Widening project was identified in the Measure L Strategic Plan, adopted by the Policy Board in March, as a priority regional project. The project will be ready to construct in FY Funding sources for this project, however, included $4.1 million of State Transportation Improvement Program (STIP) funds, which were delayed in May by the California Transportation Commission (CTC) to FY In order to better align LPP and STIP funding in the same year, it is recommended that the $1.196 million in FY LPP formulaic funds be left unprogrammed at this time. Staff also recognizes that due to a repeal of SB 1 on the upcoming November 2018 ballot, LPP funding is uncertain. Background Every four years the State of California and the federal government require that regional transportation planning agencies/metropolitan planning organizations update their respective Regional Transportation Plans/Sustainable Communities Strategies (RTP/SCS) and prepare an accompanying Programmatic Environmental Impact Report (EIR). The RTP/SCS is the region s 25-year financially-constrained blueprint for future transportation investments based on specific transportation goals and objectives defined by StanCOG with input from the Valley Vision Stanislaus Steering Committee (VVS), the general public and other stakeholders. The Final 2018 RTP/SCS will guide development of the Regional and Federal Transportation Improvement Programs (RTIP and FTIP, respectively) as well as transportation programming documents and plans throughout the Stanislaus region. The 2018 RTP/SCS is intended to present StanCOG s goals and policies to meet current and future mobility needs through the year If a project is not in StanCOG s adopted RTP, it is not eligible for certain state, local, or federal funding. Pursuant to Senate Bill 375 (SB 375), the Sustainable Communities and Climate Protection Act of 2008, each MPO must prepare an enhanced land use element called a Sustainable Communities Strategy (SCS) as part of the RTP. The SCS sets forth a vision for the region s anticipated growth, taking into account the transportation, housing, environmental, and economic needs of the region. The SCS is a proposed plan by which the region will meet its greenhouse gas (GHG) emission reduction targets established by the California Air Resources Board (CARB). 18

19 CARB s current GHG reduction targets for StanCOG s 2018 RTP/SCS are a 5 percent per capita reduction in greenhouse gas (GHG) by 2020, and 10 percent by 2035 relative to 2005 levels. With the application of off model strategies and CARB s CO2 adjustment methodology, the Preferred Scenario (Scenario 2) meets the GHG emission reduction targets established by CARB. The RTP/SCS is subject to the California Environmental Quality Act (CEQA). Per CEQA, StanCOG must prepare an Environmental Impact Report (EIR) for the purpose of providing information to residents and policymakers on any likely impacts to the environment as a result of the construction of the transportation projects or implementation of the programs listed in 2018 RTP/SCS. The EIR is considered programmatic in that it covers the potential effects of the Plan in total; it does not assess the specific impacts of each listed project, individually. Projectspecific environmental analyses are performed by the agency constructing or sponsoring a project prior to its final approval and implementation. The EIR presents the program level analysis of potential environmental impacts related to the implementation of the 2018 RTP/SCS, as required under CEQA. Discussion StanCOG released the Draft 2018 RTP/SCS and Draft Programmatic Environmental Impact Report on May 11, 2018 for a 55-day public review and comment period, which closed on July 5, Two public hearings were conducted as part of regularly scheduled StanCOG Policy Board meetings. The first public hearing was held on Wednesday, June 20, 2018 at the StanCOG boardroom in Modesto. The second public hearing was held on Wednesday, July 18, 2018 at the Ceres Community Center. Spanish translation services were available at the public hearings. A total of 16 public comments were submitted by public agencies, special interest/advocacy groups, and private citizens. In addition, members of the public also made comments during the two public hearings on the RTP/SCS and EIR. Background The Transportation Development Act (TDA) is the law that provides funding through Local Transportation Funds (LTF) for capital purchases and operations of public transportation services. Funds are generated through local sales tax revenues that are collected by the state and returned to the local agencies through state-identified Regional Transportation Planning Agencies, such as the Stanislaus Council of Governments (StanCOG). TDA law establishes a formula for transit operators to measure how much of their funding comes from ticket sales, referred to as the farebox recovery ratio (FRR). In order to receive the full allocation of TDA funds available to a transit operator, a minimum FRR must be achieved. Operators of fixed route transit serving an urbanized area within an urbanized county (i.e. a county with a population of 500,000 or more, as determined through the decennial census), are required to meet a FRR of no less than 20%. Operators of fixed route transit that serve both urban and rural areas within an urbanized county are allowed to have a blended FRR, as determined by the RTPA, with a minimum FRR of 10%. FRR for services exclusive to senior and disabled persons, such as dial-a-ride (DAR), can be no less than 10%. Penalties which decrease the amount of TDA funds available to a transit operator are applied when the required FRR is not met. In the 2010 decennial census, Stanislaus County became an urbanized county as its population increased above the 500,000 threshold to 515,334. As such, current FRR s for providers of fixed-route transit in Stanislaus County are as follows: - Modesto Area Express (MAX): 20% (urban) - Stanislaus Regional Transit (StaRT): 15% (urban-rural blend) - Turlock Transit (TT): 20% (urban) - Ceres Area Transit (CAT): 20% (urban) 20

21 Achieving the 20% FRR required of transit operators in urbanized counties has proven to be challenging. Transit operators in the Stanislaus Region have employed various strategies in an effort to meet the required FRR; however meeting the required FRR remains an issue. In early September, a proposed draft amendment to the TDA was submitted to Senator Cannella s staff for consideration. Senate Bill 903 (SB 903) was sponsored and introduced to the legislature by Senator Cannella. A complete timeline for the bill as it moved through the State Senate and Assembly can be viewed at: Discussion Due to the combined efforts of the StanCOG Policy Board, the Stanislaus region s transit operators and our legislators, Governor Brown signed Senate Bill 903 (Cannella) into law on July 16, Many counties followed the progress of SB 903. The bill has highlighted the necessity for there to be a statewide change. StanCOG staff has received statewide recognition for the efforts put forth on this historic legislative change. The governor signed the bill after additional supportive information regarding the unique needs of the Stanislaus region were provided by staff. Per the passage of SB 903, one of the requirements was that StanCOG conduct a transit assessment of the region. StanCOG is in the process of planning for this assessment to be done. Gus Khouri, StanCOG s State Legislative Advocate presented the following report to the Policy Board at their July 18, 2018 meeting: StanCOG s sponsored bill, SB 903 (Cannella), which was pursued in order to allow the county s transit operators the ability to access state funding to maintain existing service, has been signed by Governor Brown (Chapter 107, Statutes of 2018). The bill received unanimous bipartisan support from legislators without any recorded opposition. The bill was originally drafted to allow for population density to be considered as a metric in determining an operator s qualification for receiving funding through the Transportation Development Act (TDA), while allowing for StanCOG to make adjustments of up to 5% to keep operators compliant. TDA law requires that operators maintain a farebox recovery ratio of 20% in order to access funding, which is difficult for the county s transit operators to meet. The bill was amended however to provide four years of relief from complying with TDA law, in order to keep service on line while a statewide solution can be provided. (1) Existing law authorizes transpmiation planning agencies to administer transit funding made available under the Transportation Development Act. Existing law imposes certain financial requirements on transit operators making claims for transit funds, including requirements that fare revenue collected by the operator cover a specified percentage of operating costs. In certain cases, transit operators are required to meet a higher percentage if they met that standard in the fiscal year. This bill would authorize the Stanislaus Council of Governments, a transportation planning agency, when determining if specified operators have met the requirements for claims for transit funds for the and the fiscal years, to reduce the applicable ratio of fare revenues to operating cost for specified operators by up to 5 percentage points from the ratio that was effective during the fiscal year. If the Stanislaus Council of Govemments acts pursuant to this authorization, the bill would require it, before January 1, 2020, to submit a report to the transportation policy committee of each house of the Legislature and to the Department oftransportation analyzing the options for organizing and suppmiing transit service in the county, as specified. (2) This bill would make legislative findings and declarations as to the necessity of a special statute for the County of Stanislaus. (3) This bill would declare that it is to take effect immediately as an urgency statute. (2) The Stanislaus Council of Governments may use the calculation method described in this section for calculations beginning with the fiscal year. (c) (1) If the Stanislaus Council of Governments reduces an individual operator's ratio pursuant to this section, the Stanislaus Council of Governments, before January 1, 2020, shall submit a report to the transportation policy committee of each house of the Legislature and to the department analyzing the options for organizing and supporting transit service in the county. (2) The report shall include, but not be limited to, all of the following: (A) A description of the transit routes operating within the county. (B) The service levels on those transit routes, including any planned expansions or consolidations. (C) The ridership numbers for those transit routes. (D) The annual budget numbers for the transit services provided by each individual operator in the county, including its ratio of fare revenues to operating cost and any salary increases since the enactment of this section. (3) A report to be submitted pursuant to this subdivision shall be submitted in compliance with Section 9795 of the Government Code. (d) This section shall become inoperative on July 1, 2020, and, as of January 1, 2021, is repealed. SEC. 2. The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique transit circumstances in the County of Stanislaus. SEC. 3. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution and shall go into immediate effect. Failing to meet project delivery dates for any phase of a project may jeopardize federal funding to the region. The 2017 FTIP programmed the region's projects over a period of four federal fiscal years (FFY 16/17, 17/18, 18/19, and 19/20) and is a comprehensive list of transportation projects that receive federal funds, require a federal action, or are regionally significant. StanCOG closely monitors the status of all projects programmed in the FTIP through close communication with the local jurisdictions. Discussion The 2017 FTIP Monthly Project Status Report for FFY 2017/18 demonstrates that as of July 23, 2018, the Stanislaus Region has yet to obligate 31.61% of its FFY 2017/18 federally apportioned funding (see Attachment 1).
