DISCUSSION/ACTION ITEMS A Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS) Rosa Park reported that the process of updating the RTP/SCS, the long range plan that was updated every four years, and which links transportation planning with land use as well as air quality in the Stanislaus region, had begun. She stated that staff met with all member agencies to review the status of projects listed in the 2014 RTP/SCS. She also Page 1 of 2

5 said that public workshops were held the prior week in Oakdale, Patterson and Modesto and that more workshops would be held in October to receive input from the public. B. Measure L Implementation, Policies and Procedures Monica Streeter said that policies, procedures and a master agreement for distributing Measure L funds to member agencies were in the process of being developed. There was a brief discussion that the agreement would be based on the Measure L Ordinance and Expenditure Plan. Rosa Park indicated that a workshop would be held to review this information in more detail. C. Senate Bill (SB) 1 Update Rosa Park said that the guidance for the programs and funding under SB I was being developed by the state and that staff was participating in all the California Transportation Commission (CTC) workshops regarding this topic. D. Draft August Policy Board Agenda Review It was suggested that Item 8A be moved to Discussion instead oflnformation. 6. INFORMATION ITEMS A. Measure L Funds Received 7. EXECUTIVE DIRECTOR REPORT- NONE Rosa Park repmted that she attended the Self-Help Coalition meeting. She also said that she, Chair Zoslocki and Member Chiesa would be attending the CTC meeting on August 16, which was why the Policy Board meeting was canceled on that date. 8. 6 TO: Executive Committee Staff Report Motion THROUGH: Rosa De León Park, Executive Director FROM: Cindy Malekos, Manager of Administrative Services DATE: September 6, 2017 SUBJECT: Re-Appointment of Member to the Citizens Advisory Committee (CAC) Recommendation By Motion: Re-appoint Elizabeth Claes to the Citizens Advisory Committee (CAC) for a four-year term. Background The CAC is a StanCOG standing committee that meets monthly to provide input to the Policy Board from the public s point of view. The CAC bylaws state that it shall consist of up to 10 members from the Stanislaus region that are appointed by the Executive Committee. Discussion Elizabeth Claes is a resident of Turlock. She has served as an active member of the CAC since her appointment in Ms. Claes has served as the Chair of the CAC and also as a representative on the San Joaquin Valley Rail Committee. She has expressed her willingness to continue to serve on the CAC. 7 TO: Executive Committee Staff Report Motion THROUGH: Rosa De León Park, Executive Director FROM: Cindy Malekos, Manager of Administrative Services DATE: September 6, 2017 SUBJECT: Appointment of Member to Bicycle Pedestrian Advisory Committee (BPAC) Recommendation By Motion: Appoint John Gerling from Modesto to serve on the Bicycle Pedestrian Advisory Committee (BPAC) for a four-year term. Background The BPAC is a StanCOG standing committee that meets every other month to review and provide input to the Policy Board on matters related to bicycle and pedestrian needs or concerns and to advise on the development of the StanCOG Non-Motorized Transportation Plan. The BPAC Bylaws state that it be comprised of 10 residents of Stanislaus County, one representative from each of the jurisdictions, appointed by the Executive Committee. Each appointment is for a term of four years, with no member serving for more than eight consecutive years. Discussion There is currently a vacancy on the BPAC representing Stanislaus County. John Gerling has submitted an application to serve on the BPAC. He has been referred to the BPAC by the prior member whose term expired. His application is attached. 10 TO: Executive Committee Staff Report Discussion THROUGH: Rosa De León Park, Executive Director FROM: Lakshmi Rajagopalan, Associate Planner Isael Ojeda, Associate Planner DATE: August 28, 2017 SUBJECT: 2018 State Transportation Improvement Program (STIP) Funding Background On August 16, 2017, the California Transportation Commission (CTC) adopted the 2018 State Transportation Improvement Program (STIP) Fund Estimate (FE). StanCOG s STIP county share available for programming is $17,224,000. Of this amount, $16,464,000 is available for our Regional Improvement Program (RIP) projects and $760,000 is designated by the State to StanCOG for Planning, Programming, and Monitoring (PPM). PPM funds are designated for STIP administration and STIP project development. These funds are available to our region for the 4th and 5th year of the 2018 STIP cycle (FY 2021/22 and FY 2022/23). On January 21, 2016, the 2016 STIP Fund Estimate was amended by the CTC due to an anticipated reduction in the price-based excise tax in The revised 2016 STIP fund estimate lead to a decrease in total STIP capacity by $800 million. This decrease resulted in approximately $754 million of negative STIP capacity for California and $7.431 million for Stanislaus region. This new fund estimate resulted in removing the already committed $4.1 million for the McHenry Avenue Widening project from FY 2017/18 to FY 2019/20. In addition, STIP funding for State Route 132 West Freeway/Expressway Phase 1 was delayed from FY 2015/16 in the 2014 STIP to FY 2018/19 in the 2016 STIP. The CTC expectations and priorities of programming projects with 2018 STIP funding are as follows. 1. Reprogramming of projects from the 2016 STIP, as amended 2. Project cost increases requested in RTIPs and ITIP that were not programmed in the 2016 STIP

11 3. Projects or project components programmed in the 2014 STIP and deleted without prejudice in the 2016 STIP 4. New Projects What is the STIP? The STIP is the biennial five-year plan adopted by the CTC for future allocations of certain state transportation funds for state highway improvements, intercity rail, and regional highway and transit improvements. State law requires the California Transportation Commission to update the STIP biennially, in even-numbered years, with each new STIP adding two new years to prior programming commitments. The 2018 STIP covers the five year period of Fiscal Year 2018/19 through Fiscal Year 2022/23. The STIP consists of the two following broad programs: The Regional Improvement Program (RIP), which is funded from 75% of new STIP funding, and The Interregional Transportation Improvement Program (ITIP), which is funded from 25% of new STIP funding. The 75% RIP is further subdivided by formula into regional shares among all the Regional Transportation Planning Agencies in California. Regional shares are available solely for projects nominated by regions in their respective RTIPs. Caltrans will nominate projects for the ITIP. What is eligible for STIP funds? Each new STIP includes projects carried forward from the previous STIP plus new projects and reserves from those proposed by regional agencies in their RTIPs and by Caltrans in its ITIP. Projects that will be considered for the RTIP funding shall: be a Regionally Significant Project have a complete Project Study Report (PSR) or equivalent be ready for construction be eligible for federal funds be fully funded include a project level evaluation which includes a benefit/cost estimate and identify the estimated impact the project will have on the annual cost of operating and maintaining the state s transportation system for a 20 year period What is the programming process? The programming cycle begins with the release of a proposed fund estimate in July of odd-numbered years, followed by CTC adoption of the fund estimate in August (odd years). The fund estimate serves to identify the amount of new funds available for the programming of transportation projects. Once the fund estimate is adopted, Caltrans and the regional planning agencies prepare transportation improvement plans for submittal by December 15th (odd years). Public hearings are held in January (even years) in both northern and southern California. The STIP is adopted by the CTC by April (even years). StanCOG Policy Board is responsible for approving the STIP Programming and developing the RTIP which identifies the proposed STIP projects. Regional agencies must adopt and submit their RTIP for the 2018 STIP FE to the CTC and to Caltrans no later than December 15, 2017.

12 The RTIP needs to include programming proposals from StanCOG s regional share consistent with the 2018 STIP FE. These proposals may include new projects and changes to prior STIP projects. In addition, STIP funding for the State Route 132 West Freeway/Expressway Phase 1 was delayed from FY 2015/16 in the 2014 STIP to FY 2018/19 in the 2016 STIP. Because the Policy Board has established the SR 132 West Freeway/Expressway as the agency s top regional priority transportation project, and because the McHenry Avenue Widening Project was removed from the previous STIP cycle, staff recommends that the RTIP include the following projects in the Stanislaus Region for the 2018 STIP funding capacity, as they meet the RTIP criteria for funding: 132 West Freeway/Expressway McHenry Avenue Widening Staff will return with an allocation recommendation of the new STIP capacity to the above mentioned projects upon board approval. 14 TO: Executive Committee Staff Report Discussion THROUGH: Rosa De León Park, Executive Director FROM: Elisabeth Hahn, Principal Planner Stephen Hanamaikai, Associate Planner DATE: August 23, 2017 SUBJECT: Transportation Development Act Amendment Update Background The Transportation Development Act (TDA) provides funds for capital purchases and operating for public transportation services. Funds are generated through local sales tax revenues that are collected by the state and returned to the local agencies through state-identified Regional Transportation Planning Agencies, such as the Stanislaus Council of Governments (StanCOG). TDA law establishes a formula for transit operators to measure how much of their funding comes from ticket sales, referred to as the farebox recovery ratio (FRR). In order to receive the full allocation of TDA funds available to a transit operator, a minimum FRR must be achieved. Operators of fixed route transit serving an urbanized area within an urbanized county (i.e. a county with a population of 500,000 or more, as determined through the decennial census), are required to meet a FRR of no less than 20%. Operators of fixed route transit that serve both urban and rural areas within an urbanized county are allowed to have a blended FRR, as determined by the RTPA, with a minimum FRR of 10%. FRR for services exclusive to senior and disabled persons, such as dial-a-ride (DAR), can be no less than 10%. Penalties which decrease the amount of TDA funds available to a transit operator are applied when the required FRR is not met. In the 2010 decennial census, Stanislaus County became an urbanized county as its population increased above the 500,000 threshold to 515,334. As such, current FRR s for providers of fixed-route transit in Stanislaus County are as follows: - Modesto Area Express (MAX): 20% (urban) - Stanislaus Regional Transit (StaRT): 15% (urban-rural blend) - Turlock Transit (TT): 20% (urban) - Ceres Area Transit (CAT): 20% (urban)

15 Achieving the 20% FRR required of transit operators in urbanized counties has proven to be challenging. Transit operators in the Stanislaus Region have employed various strategies in an effort to meet the required FRR; however meeting the required FRR remains an issue. In May and July of 2017, StanCOG staff met with the transit operators in the county to discuss the possibility of an amendment to the TDA which would provide StanCOG the flexibility to set a FRR that is more representative of our county population density and historical development patterns, thus allowing transit operators to provide service to the diverse communities in Stanislaus County without being penalized for not meeting the current 20% FRR. The preliminary proposed TDA amendment language, detailed in the discussion section below, has been drafted and circulated amongst the transit mangers for further consideration. In July 2017, staff met with the office of Senator Anthony Cannella s staff to discuss his support for the proposed TDA amendment. His legislative staff requested that StanCOG provide information relating to the history of other successful amendments to the TDA. StanCOG staff reached out to the Sacramento Area Council of Governments (SACOG), to discuss the history of their amendment to the TDA, which allowed for SACOG to set a combined FRR for all operators in Sacramento County. The information gathered from these discussions will be provided to Senator Cannella s staff. Discussion In the 2000 decennial census, the City of Galt in Sacramento County was identified to be within a newly designated urbanized area, requiring it to increase its FRR from 10% to 20%. Similarly, in the 2010 decennial census Stanislaus County was identified as an urbanized county, thus requiring operators serving the urbanized areas in the county to increase FRR from 15% to 20%. The increase in county-wide population is not necessarily indicative of an increase in population density, which is a primary factor of the transit ridership that allows for the achievement of the required 20% FRR. The preliminary proposed amendment to the TDA identifies two approaches to achieving FRR: one for fixed route transit (paragraph 1), and one for DAR (paragraph 2): In determining whether there is compliance with Section , , , , or for each individual operator serving the area within the jurisdiction of the Stanislaus Council of Governments, the Stanislaus Council of Governments shall take into account population density, based on population estimates provided by the California Department of Finance, when that determination is made. Notwithstanding any other provision of this article, the fare recovery ratio for each individual operator within the jurisdiction of the Stanislaus Council of Governments shall be set at a minimum of 15 percent. In determining whether there is compliance with Section , the fare recovery ratio for each individual operator within the jurisdiction of the Stanislaus Council of Governments shall be set at a minimum of 10 percent. 20 TO: Executive Committee Staff Report Information THROUGH: FROM: Rosa De León Park, Executive Director Karen Kincy, Senior Financial Services Specialist DATE: August 16, 2017 SUBJECT: Measure L Funds Received Background The FY 2017/18 Measure L projections are $38,000,000. The attached schedule shows the status of the Measure L receipts as of August, Monthly estimated allocations are made by the Board of Equalization (BOE) using methodologies to estimate sales tax revenues based on past reports for the region. The actual amount for sales tax revenues are calculated in the month following the end of each quarter, at which time the BOE will deduct their administrative fees for the quarter and issue a final quarterly payment for the net amount based on the actual quarterly revenue received. Discussion Measure L funds are received monthly from the State Board of Equalization. The twelve months of the fiscal year are listed across the top of the attached schedule. The first month StanCOG received funds for FY was in June Distributions made to jurisdictions for FY will be based on receipts from June 2017-May There are three Measure L schedules attached. The first table presents the total monthly allocation to date as compared to the total estimated for the Fiscal Year. The second schedule represents the allocation of Measure L funds by category and jurisdiction. The third schedule shows the total breakdown by jurisdiction and/or project.
