1 FEA February 7, 2018 rescheduled to February 14, 2018 Call to Order: Pledge of Allegiance Secretary s Report: nothing to report Custodial Unit Report: School building maintenance hired a new manager, Josue Gonzalez. We are waiting for word on two new custodians that were hired a month ago. A negotiation team was tentatively put together-ray Bedard, Wayne Shaw, Chris Stevens, Brian Green, Luis Alvarado, Chris Xenakis, and (possibly) Chip Tourigny. ESP Para Unit: Negotiations update Denise Quirion s last day is Friday. Rebecca Perrin will be helping out with para contract negotiations and will probably fill Kari s maternity leave. Kari is working on a custodial person to help out for their negotiations from MTA. We are waiting on the para chair vote to take place in each school. Para chair voting will be posted soon, and the election will be held on Monday, March 5 before and after school. Andrea Fortin, Irene Marro are running for this position. Registrations for the ESP conference is April 6 and 7th at the Sea Crest Hotel in Falmouth. Katie will need a list of people who intend to register so that we can cover the costs of everyone who would like to attend (within our funding capabilities). Please contact Lein Gibbs if you would like to attend. Treasurer s Report: Forms were distributed to us to give to new members. The annual meeting is coming up soon. If you would like to be one of the 12 delegates to attend, please let Katie know by Friday, March 1. The dates of the annual meeting are May 4 and 5. MTA has decided to pay for regional Ethnic Minority seats so Carlos Garcia will be attending at no cost to us. He will not count as one of our 12, along with Katie who is on the board. If you would like to endorse Katie for the board, she will be seeking endorsements. P. R. & R.: Update on duty grievances-grievance was pushed to Level 3 and then denied by school committee. The next level is arbitration. We have three options-do nothing, put the grievance into abeyance and try to deal with it through negotiations, or move to arbitration. Motion made by Sean, seconded by Kim to move the grievance into arbitration. According to Kari, the schools did not bargain this, but the work day extension has still happened. There hasn t been a precedent that Kari can refer to. What does equitable mean-within building or across the schools? Kari thinks a little of both. Are we looking for the district to compensate the time that people have worked? Yes, we are. If we move to arbitration, will it go public? An arbitration could go public. Voting for whether the grievance should go to arbitration was as follows-19 in favor, 0 opposed, 1 abstained.

2 President s Report: Health and safety update-adam, Mike Scares, and Sarah Gibson met with Longsjo. They then met with the Crocker teachers to discuss their building issues. Sarah put together a list of questions for Andre Ravenelle, Bob Jokela, and Tom Peterson. Joseph Knapik is a senior project manager who is working at Longsjo and Crocker. Health and Safety Concerns: Longsjo School The decision was made to go with an asphalt roof which has a 30 year life span. Damage was isolated to the edges and around the eves. They have a vendor, access to money, and the City Council would like this fixed asap. The goal is for the roof to be completed over the summer. They are interviewing project managers because it is over a million dollars for the project. Appropriation for 2 million for roof replacement at Longsjo. 3 options Replacement of slate, synthetic slate, asphalt An exterminator was called as there is a rodent problem. The rodents are gaining entry through the tunnel. Sarah requested the IPM plan. Mike asked if they are going to seal the tunnel. The tunnel is in a corner and has asbestos. Andre asked if we can seal it off and will ask to put it on the list of issues to address. Additionally, the guidance office had issues of not being vacuumed. FPS has authorized the purchase of a new vacuum. They also asked for an update on library area remediation after the pipe burst. The library is being fixed. The secretaries, principal s office and office behind that room were stripped of carpet. They will update the carpet and paint. Things on schedule as of February 8 th. Additionally, two classrooms were totally gutted. FEA put out thermometers in some classrooms. Bob said they are doing a steam trap survey. This is to see if the steam is moving through the radiators correctly. Andre said the thermometers are good for real data not anecdotal. Results/report from testing for asbestos and mold-testing on plaster came back negative for asbestos. Asbestos was only around the radiators. Joe and ATC have all those reports. Crocker Elementary School Steam pipe burst 12/25/17 On Christmas Day, the steam pipe burst for 24 hours pouring hot steam into the building. Custodians went in on December 26 th and shut off water. Tom said they started cleaning it, and then called

3 Servpro to come in on Tuesday. They did not check AHERA report and ceiling tiles were sent to be checked. AHERA said there was asbestos. Servpro was retained to help with one room because the floor tiles were 9 inches. The next day, the insurance adjuster came in and saw ceiling tiles on the second floor and saw moisture. The adjuster said they would have to replace all of tiles. The adjuster said to have Servepro to continue. On Thursday the 28 th, Servepro started. On the 29 th, the abatement firm said that Servpro was not following protocol with ceiling tiles. They were told to stop. Then district called ATC and by Friday evening the DEP and state were contacted between 5-7pm. Andre then realized Crocker would need to be shut down and had to look for new sites. Class 4 cleaning was performed in the other part of Crocker. Univents will be cut out and replaced as the piping to the univents were damaged. They need a class 3 plumber to determine the damaged area. They needed a plan to send to DLS to look at the boiler. Andre met with staff and said he would replace their items, school or personal. Who entered building, when, and nature of response? Custodians started cleaning on December 26. Servepro was then called because of floor tiles. Were first responders from school district or town trained re: asbestos? When was ServPro involved, and what was ServPro s role? When did potential presence of asbestos become an issue? Who raised it as potential issue? Who did initial assessment of asbestos and when? FEA requests: Medical monitoring for employees who were potentially exposed to asbestos (teachers, custodial staff) Reimbursement for medical expenses (co-pays, lab fees, tests) incurred by employees. Regarding these requests- Rick was not sure. Questions would go to the WC carrier. Asked Joe K about long term health risks and protocol. Joe- EPA worker protection rule mirrors OSHA. He said they would not know if it was at or above those levels. Andre said anecdotally yes. Frequency for testing would be within ten days following the exposure. It would be offered annually thereafter if exposure tasks were continuing to occur. Because the school will be habitable it will only be once probably. Chest xray, pulmonary, gastrointestinal, etc. Joe and Rick will talk

4 about how to get it done and report back to me. Rick said they work with Health Alliance, but it may be Urgent Care near Marshalls in Leominster. Reimbursement/replacement of clothing potentially contaminated while employees were in school is being sought. Reimbursement/replacement of personal items is being sought. Teachers did go into the impacted room. They were identified and given forms to fill out. All insurance is covering work, rent at new schools, etc. 2 weeks ago all Unit A and some Unit B completed an asbestos abatement training. We have request information regarding Crocker-All assessments (structural, systems, asbestos and other hazardous materials) done from time of steam pipe break to present (and continuing). Timeline of actions taken immediately after discovery of the burst pipe. Mike- Talk to contractor overseeing work. ATC has the plan for the 2 floor wing. They are applying to the DEP for a non traditional work process. Boiler room and clean up around dumpster. RFP is out, but not NTWP yet. They will forward it over to Mike. Abatement of other tiles? Conversation with city and ATC gave a proposal. $265,000 was the cost for non impacted wing. Not in operating budget. City treasurer mentioned there is other capital coming from school and fire. Andre is hoping to phase in abatement across the district. Feasibility study will take 2 ½ years for MSBA to determine K4 or K8. Future protocol. Annually a notification will sent out regarding asbestos. Bob does not know if it was done this year. We are aware now on protocol and policy is to let contractors know so that they are aware of asbestos. They are trying to figure out how best to get AHERA reports out. Mike suggested putting it online. On the Saturday night before New Years, they got the call of a pipe burst at Longsjo. They knew the second floor library was negative for asbestos, but on

5 caution tested tiles in office. They were negative, too. Andre said they are working with Joe K. to figure out a protocol. Sarah said some districts have AHERA reports online. MTA survey on recess policy-dean Tran contacted a member to ask how the union wanted him to vote on this. School calendar-the was given to us in draft form form the School Committee. We looked it over and thought it looked fine. Old business-student and staff safety update-adam asked at cabinet for an update. There was an ABA tech posting, and they were going to hire two people with the intention they would hire people on Friday. They were looking at calming classrooms, mindfulness, and self-regulation. Memorial has seen more of Adrienne. At Memorial, they have started a program in which students can cash in for good behavior. Adam and Sue are in the PBIS and ExSEL group. New business-nothing from any of the schools at this time. Kari-The bargaining team has had a few discussions with how to discuss negotiations with the members. Please keep attendance on your building meetings and assign contact people for each building. February 26 is the first day of argument for the Supreme Court s hearing of the agency fees. There will be a rally in Worcester at 5:00 on February 26. Adjourned-6:00
