1 MINUTES OF LIMA CITY COUNCIL LIMA, OHIO December 18, 2017 The Council of the City of Lima met in regular session at 7:00 p.m. Attending were: Tony Geiger, Law Director; John Payne, Deputy Law Director; Randall Bartels, Auditor; Steven Cleaves, Finance Director; Susan Crotty; Dir. Of DCD; Mike Caprella, Dir. of Util.; Howard Elstro, Dir. of Public Works; Chief Martin, Chief Black, and Sally Clemans, Clerk. The invocation was given by Councilor Kreher followed by the Pledge of Allegiance. ROLL CALL showed the following members present: Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Absent, Glenn. McLean moved, seconded by Lowe, that the agenda be amended by adding communication number 21. Motion carried. THE FOLLOWING ITEMS WERE PRESENTED ON THE CONSENT CALENDAR: a. Minutes of the previous meeting not read since each received a copy. b. Traffic Commission minutes of November 6, c. Bd. of Building Appeals minutes of November 16, d. Treasurer s reports for month of August, September and October. Adams moved that item Aa@ of the consent calendar be received, filed, and approved and that items Ab-d@ be received and filed, seconded by Lowe, motion carried. THE FOLLOWING COMMUNICATIONS WERE PRESENTED: 1. From the Auditor requesting legislation to enter into contract with Reineke Lincoln and Best One Tire. Adams moved, seconded by Lowe, that the communication be received, filed, and the Law Dir. authorized to prepare the necessary legislation. Motion carried. 2. From the Auditor requesting legislation to enter into contract with King Bros. Truck Center and Rush Truck Center. Moved by Adams, seconded by Lowe, that the communication be received and filed. From the City Eng. regarding donations for Melrose Storm Water improvements. Moved by Gordon, seconded by Miles, that the communication be received and filed. Motion carried. THE FOLLOWING ORDINANCES WERE PRESENTED: Enacting Section of the Codified Ordinances. Moved by Gordon, seconded by Lowe, that the ordinance be brought off the table and defeated on the first reading. The following vote was recorded on the motion: Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Miles and Nixon. Nay, none. The Chair declared the motion carried and the Ordinance is defeated on the first reading by a 7-0 vote Authorizing the Mayor to enter into contract for Purchasing Manager Services for Calendar Year Gordon moved, seconded by McLean, that the ordinance be passed on the third reading. The following vote was recorded on the motion: Yea, 3; Gordon, Miles and Nixon. Nay, 4; McLean, Lowe, Kreher and Adams. Gordon moved, seconded by McLean, that the ordinance be passed on the third reading. The following vote was recorded on the motion: Yea, 3; Gordon, Miles and Nixon. Nay, 4; McLean, Lowe, Kreher and Adams. The Chair declared the ordinance did not receive the required vote and has been defeated on the third reading Authorizing the Mayor to enter into contract with JP Management for Engineering Technician Services. Gordon moved, seconded by Miles, that the ordinance be passed on the third reading. The following vote was recorded on the motion: Yea, 3; Gordon, Miles and Nixon. Nay, 4; McLean, Lowe, Kreher and Adams. The Chair declared the ordinance did not receive the required vote and has been defeated on the third reading Authorizing the Mayor to enter into a contract for Plans Examiner Services for Calendar Year Gordon moved, seconded by McLean, that the ordinance be passed on the third reading. Councilor Adams said I am wondering why they are asking that this be removed. Mr. Elstro said that they did not use him much last year can we can send them to Wood County. The following vote was recorded on the motion: Yea, 3; Gordon, Miles and Nixon. Nay, 4; McLean, Lowe, Kreher and Adams. The Chair declared the ordinance did not receive the required vote and has been defeated on the third reading Authorizing the Mayor to enter into contract for Certified Building Official for Calendar Year Gordon moved, seconded by McLean, that the ordinance be passed on the third reading. The following vote was recorded on the motion: Yea, 3; Gordon, Miles and Nixon. Nay, 4; McLean, Lowe, Kreher and Adams. The Chair declared the ordinance did not receive the required vote and has been defeated on the third reading Providing for the Issuance and Sale of bonds in the Maximum principal amount of $1,425,000 for the purpose of paying the costs of improving Schoonover Park through the rehabilitation and renovation of the Schoonover Dam, including re-grading of the downstream slope and extending the upstream slope, installation of an emergency spill way, and replacement of the existing principal spillway and existing outlet pipe, the restoration of the Schoonover Park Fountain by refurbishing the concrete perimeter wall and bottom installation of signage, landscaping, and electrical and water lines, the restoration of the Schoonover Lake Island Foundation and structure, including erosion control, tiling, backfilling, installing stairs and otherwise improving the same, and the acquisition construction installation, equipping and furnishing of an ADA compliant fishing pier, together with all necessary appurtenances thereto. Adams moved, seconded by McLean, that the Fiscal Officer s Certificate be received, filed and approved. Motion carried. 5 Levying special assessments for property maintenance code charges on premises in the City of Lima, Ohio. Kreher moved, seconded by McLean, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into contract with Lippincott Plumbing for the purchase of a boiler for the Water Treatment Plant. McLean moved, seconded by Gordon, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into contract to provide salvage rights to the Habitat for Humanity, Ohio as part of the Elm Street Grade Separation Project (PID80441). Gordon moved, seconded by McLean, that the ordinance be passed on the first reading. The following vote was recorded on the motion. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to purchase or accept donations of real property for the Melrose Street Storm Water Improvements (Phase I), Project No Gordon moved, seconded by McLean, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into a contract with Northwest Property Maintenance services, LLC for the property maintenance services for Calendar Year Kreher moved, seconded by Gordon, that the ordinance be passed on the first reading. Councilor Adams asked how this contract compares to the contracts in the past. Ms. Crotty said there is a slight increase but this was the only one that qualified. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into contract for Housing Loan Originator Services. Kreher moved, seconded by Gordon, that the ordinance be passed on the first reading. Councilor Adams said this position is funded out of the HOME funds and Council has already approved those so I will support it. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into contract for Junk Auto and Vehicle Enforcement. Kreher moved, seconded by Lowe, that the ordinance be referred to the Economic and Community Development Committee and placed on a second reading. Councilor Lowe said [5]

6 December 18, 2017 he has a gentleman at 750 N. Main St. that has a boat that should be towed. Ms. Crotty said they are looking into the towing contract because the person they are with now will not tow boats. Councilor McLean said we have 3 new Council members coming on. We should wait until our new Council people are informed and then vote on this. They should have a part in this. Mr. Nixon said I understand your point but in the realm of things, this is city business. We have always had contracts that extend multiple years. I don t have a problem with new Council people being informed but when it interrupts city business, I do have a problem. He said I hope it does not send a message about our positon on Economic Development. The message we are sending is we are not taking things seriously enough. I am going to vote against this motion. He requested a roll call vote. The following vote was recorded on the motion: Yea, 4; McLean, Lowe, Kreher and Adams. Yea; Gordon, Miles, and Nixon. The Chair declared the motion carried with a simple majority vote of Authorizing the Mayor to enter into a three (3) year contract with King Bros. Truck Center, Inc. Adams moved, seconded by Lowe, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the Mayor to enter into a three (3) year contract with Rush Truck Center, Inc. Councilor Adams moved to amend the Ordinance in Section 1 to reflect a 3 year contract, seconded by McLean, motion carried. Adams moved, seconded by Miles, that the ordinance be passed on the first reading, as amended. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading, as amended, by a 7-0 vote Amending the 2017 Annual Budget. Adams moved, seconded by Gordon, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing the transfer of cash between certain funds as herein described. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Authorizing Cash advances from the General Fund to certain other funds, and for reimbursement back to the General Fund. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote Making preliminary appropriations for current and ordinary expenses of the City of Lima, Ohio for the period beginning January 1, 2018, until the Annual Appropriation Ordinance of the City of Lima, Ohio, is in force. Adams moved, seconded by Gordon, that the ordinance be passed on the first reading. The following vote was recorded on the motion. Yea, 7; Gordon, McLean, Lowe, Kreher, Adams, Glenn, Miles and Nixon. Nay, none. The Chair declared the motion carried and the ordinance passes on the first reading by a 7-0 vote. MISCELLANEOUS BUSINESS Councilor Kreher wished everyone a Merry Christmas. She said I have been lucky as a Jr. Council member with the help from the experienced council members. She thanked Randi Kohli and said goodbye. Councilor Adams said she has asked for an update on an issue that came through the Traffic Commission. The 4-way stop at Roosevelt and Prospect. They had to remove some trees for sight so they hope it will be done next month. She said I want to thank all the residents in the Fifth Ward. Some of you became friends. Thanks to the Council members. Thanks to the Administration and Mr. Nixon for being able to reach out to you. Councilor Miles said I want to express my delight in serving the Seventy Ward. I am very grateful and look forward to staying active in the Community. To the Mayor and Administration, thank you for taking the time to teach me and it has been a pleasure to work with you. Council members never forget why you were elected. Remember you are here for the people. Remember to represent the City of Lima. Thank you to the members in the audience for always coming out. Remember the reason for the season. Love rules all the time. Merry Christmas. Councilor Gordon said Councilor Lowe I appreciate our conversations. We don t always see eye to eye but you stand by your convictions. Councilor Adams you were always so helpful to me. It means more than I can every say. Councilor Miles, my sister in Christ, I hope we can continue with the prayer service. I wish everyone a Merry Christmas. Be good to each other. Councilor McLean moved, seconded by Lowe, to refer the issue of employment on a part-time status for the City of Lima, be referred to the Administration, the Law Director, and the Civil Service Board. He said working thru temp services is done. We need to have the ability to hire part-time. Motion carried. He congratulated Randi Kohli on his retirement. Also congratulations to Lt. Green who just graduated the FBI Academy. McLean moved, seconded by Lowe, to approve the absence and salary for Councilor Glenn. Motion carried. McLean said knowledge in Council is King. Councilor Lowe said I am personally going to call you. I told people sometime back, I am not a politician. I have always tried to be truthful. Some people in my ward knew I was a hard worker. Things didn t go the way I wanted them to go but I am not upset. Thank you to the City of Lima. To the new Council, read and read again. Ask questions. He said there was an incident that happened about a month ago with the Council Clerk and I apologize to her. President Nixon thanked Councilors Lowe, Adams and Miles for their service. He said Councilor Miles I appreciate your hard work and service to the City. Councilor Adams I have served with a lot of people on Council over the years. You have become a real friend. We would be pressed to find a Council person that was so hard working and dedicated to the citizens in her ward. You were the person who got Cook Park done. He said Councilor Lowe whether we agree on an issue or not, I respect a person that can disagree with me and then have a cup of coffee afterward. He asked that they all stay involved in the community. Merry Christmas and he shared the lyrics to a song by the Goo Goo Gals. Councilor McLean moved that Council adjourn into Executive Session for the appointment and compensation of a Public Official. The following vote was recorded on the motion: Yea, 5; Gordon, McLean, Adams, Miles and Nixon. Nay, 2; Lowe and Kreher. The Chair declared the motion carried with a vote of 5-2.
