More Court of Special Appeals Opinions Now Available Online Maryland Court of Appeals Chief Judge Mary Ellen Barbera announced plans to increase online access to Court of Special Appeals opinions by making previously unreported opinions available on the Maryland Courts website, effective Friday, May 1, Our goal is to modernize the Maryland court system and to increase electronic access to information, both of which help advance the Judiciary s mission to provide timely, effective and fair access to justice for all, said Chief Judge Barbera. Maryland Rule draws a distinction between reported and unreported opinions, requiring the court to report, as precedents, only those opinions determined to be of substantial interest. Of the approximately 1,400 opinions the Court of Special Appeals issues each year, some 90 percent are unreported; unreported opinions may not be cited in legal argument. While such opinions have always been public documents, they were available only at the Court of Special Appeals Clerk s Office and the State Law Library, upon request. Now, the Court of Special Appeals unreported opinions will be as readily accessible online as reported opinions. We recognize and honor our commitment to provide information in a timely and efficient manner to the public and the legal community, said Court of Special Appeals Chief Judge Peter B. Krauser. As a result, we are joining a growing number of states that now place their unreported opinions online. Page 6
7 Frederick County Circuit Court Seeks Standing Examiner The Frederick County Circuit Court is seeking applicants for the position of Standing Examiner due to the retirement of Charles B. Frey, effective September 30, Applicants must be members in good standing of the Maryland State Bar and have a minimum of five (5) years experience in Family Law. The fee for an Examiner is a minimum of One Hundred Twenty Five Dollars ($125.00) for the Examiner and fifty Dollars ($50.00) for the Clerk of the Examiner, for a total fee of one Hundred Seventy Five Dollars ($175.00). Interested applicants should submit their resume with cover letter to Barbara D. Domer, Circuit Court Administrator, 100 West Patrick Street, Frederick, MD, no later than July 1, Page 7

9 Plaintiff s Tip Future Lost Income in a Personal Injury Case, When There Has Been no Death, Needs Not Be Reduced To Present Value By Steve Campen Don t forget that in a strictly personal injury case, as opposed to a wrongful death case, the Plaintiff s future lost income claim does not have to be reduced to present value. Accordingly, in such cases, there may be less need for an economic expert. Thus, if the age of your client is in evidence, he or she simply needs to testify, for example: "I was making $25,000 per year." And then the jury just needs to multiply $25K times however many years they think he or she would have worked in the future. The main case for this proposition is Lumber Terminals, Inc. v. Nowakowski, 36 Md. App. 82, 373 A.2d 282 (1977). The case says that the Plaintiff or his economist needn't reduce the lost income claim by reducing it to present value. However, the case also says: "We hasten to add, however, that evidence of the present value of future lost earnings is not improper per se, and when offered, may be a valid consideration by the jury. It may come in directly through a defendant's expert or upon cross-examination of a plaintiff's expert; and indeed may even be introduced by a plaintiff bending every effort at fair play." Lumber Terminals, Inc. v. Nowakowski, 36 Md. App. 82, 92, 373 A.2d 282, 289 (1977) In other words, evidence of reduction to present value is admissible; but it isn't necessary. Page 9
