9 6052 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 (Authoritative English text of this Department Notification Number SMS-1/ RDD- Shimla-9, dated the 21 st December, 2009 as required under clause (3) of article 348 of the Constitution of India) NO.SMS-1/ RDD- Dated: Shimla , the 21 st December, Notification Whereas the Draft National Rural Employment Guarantee Scheme, Himachal Pradesh (Transparency, Grievance Redressal and Social Audit) Rules, 2009 were published in Rajpatra, Himachal Pradesh on 24 th August, 2009 vide notification NO.SMS-1/ RDD- dated 22 nd August, 2009 for inviting objections and suggestions from the persons likely to be affected thereby as required under sub-section (1) of section 32 of the National Rural Employment Guarantee Act, 2005; And whereas no objection/suggestion has been received in this behalf during the stipulated period; Now, therefore, in exercise of the powers conferred under sub-sections (3), (5) and (6) of section 23 read with section 32 of the National Rural Employment Guarantee Act, 2005 (Act No. 42 of 2005), the Governor of Himachal Pradesh is pleased to make the following rules for carrying out the purposes of the aforesaid Act, namely:- 1. Short title extent:- (1) These rules may be called the National Rural Employment Guarantee Scheme, Himachal Pradesh (Transparency, Grievance Redressal and Social Audit) Rules, (2) They shall extend to the whole of the State of Himachal Pradesh, except the areas administered by a municipality. 2. Definitions:- In these rules, unless there is anything repugnant in the subject or context:- (a) Act means the National Rural Employment Guarantee Act, 2005 (42 of 2005); (b) Block Programme Officer means the Block Development Officer; (c) Department means the Rural Development Department of the Government of Himachal Pradesh;

10 6053 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 (d) District Programme Coordinator means the Deputy Commissioner of the concerned district; (e) Gram Sabhas means a body consisting of persons registered in the electoral rolls relating to a village or villages comprised within the area of a Gram Panchayat; (f) Nodal Officer means an Officer appointed by the concerned departments of the State Government, which is the implementing agency of any scheme framed under the Act; (g) Record means and includes- (i) any document, manuscript and file; (ii) any microfilm, microfiche and facsimile copy of a document; (iii) any reproduction of image or images embodied in such microfilm (whether enlarge or not); and (iv) any other material produced by a computer or any other device; (h) section means a section of the Act; (i) Secretary means a person, by whatever name called, appointed under section 133 and sub-section (1) of section 134 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994) to discharge the functions of the Secretary of the Panchayat Samiti and the Zila Parishad concerned; (j) Social Audit Committee means the persons who conduct/facilitate the Social Audit at Gram Panchayat level; and (k) State Commissioner means the Director, Rural Development Department, Himachal Pradesh. (2) The words and expressions used in these rules but not defined in these rules shall have the same meanings respectively as assigned to them in the Act. Chapter-1 Transparency 3. General transparency of National Rural Employment Guarantee Act:-

11 6054 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 Complete transparency shall be ensured in the process of administration and decision making, by giving people full access to all relevant information for fulfillment of the objectives of the National Rural Employment Scheme by way of the pro-active discloser of information relating to the following documents as per sub-rule(2) of rule 4 of these rules:- (1) Pro-active disclosure at the Gram Panchayat Level shall include the following,- (i) summary of the Registration Applications; (ii) (iii) (iv) (v) summary of the Job Card Register; abstracts of the muster rolls due for payment; unemployment allowance lists; list of assets; (vi) list of members of the Vigilance and Monitoring Committee; (vii) measurement book summaries; (viii) any other document or information relating to implementation of provisions of the Act. (2) Pro-active disclosure at other levels shall include the following,- (i) abstract of the labour budget prepared by the (ii) (iii) (iv) (v) (vi) District Programme Co-ordinator; abstracts of the Shelf of Projects with technical and administrative estimates; abstract of Annual Plan; employment Guarantee Fund account statement; abstract of the Annual Work Plan and Budget Proposal (AWPB); abstract of Financial Audit Reports (and Action Taken Reports); (vii) abstract of the Social Audit Report (and Action Taken Reports); (viii) utilization Certificate; (ix) (x) (xi) completion Certificate; list of Technical Estimates; summary of the Grievance Redressal Register; (xii) list of Enquiries Conducted; (xiii) summary of the Evaluation reports;

(xvi). 4. Pro-active disclosure:- (1) It shall be the duty of the Gram Rozgar Sewak in the case of Gram Panchayat, Secretary in the case of the Panchayat Samiti or Zila Parishad, Nodal Officer in the case of department of the Central Government or the State Government to make public the updated data on registration, number of job cards issued, demand for work received, list of people who have demanded work and the number of days of employment provided, list of eligible persons who could not be provided employment under the Act and were paid unemployment allowance, details of funds received and spent, details of payments made, accounts, list of works sanctioned and their order of priority within the Gram Panchayat, works started, cost of works and details of expenditure on it, duration of work, person-days generated, reports of local vigilance committees, and consolidation of muster rolls and bills of each work completed. (2) The Pro-active disclosure of documents and information mentioned in in sub-rule (1) shall be made,- (i) through displaying on notice board; (ii) through publication; (iii) through displaying or presenting at the Social Audit forums of the Gram Sabha; and (iv) posting on the internet. 5. Accounts and record open to inspection:- All accounts and records relating to NREGS shall be made available for public scrutiny free of cost. Chapter-2 Grievance Redressal 6. Appointment of Grievance Redressal Officer:- The Block Programme Officer at the Block level and the District Programme Coordinator at the district level, as the case may be, shall be the Grievance Redressal Officer for complaints received in respect of the implementation of NREGS.

13 6056 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] Procedure for filing complaints:- (1) There shall be maintained a complaint register in the office of the Block Programme Officer and District Programme Coordinator. In addition, a complaint box shall also be installed to facilitate submission of Complaints relating to NREGS. (2) Any person may make complaint either in writing or orally to the concerned Grievance Redressal Officer who shall get the complaint, whether written or oral, entered in the complaint register and all the complaints shall be acknowledged. 8. Procedure for disposal of complaints:- Any complaint received under sub-rule (1) of rule 7 shall be disposed of within seven working days from the date of receipt by inquiry through spot verification and inspection by the concerned Grievance Redressal Officer who shall also inform the complainant regarding the action taken in writing. 9. Appeal:- (1) In case the complainant is not satisfied with the action taken under rule 8, he may file an appeal against the orders and proceedings of the Grievance Redressal Officer concerned to the following authorities within forty five days from the date of order of proceedings of the Grievance Redressal Officer:- (i) Against the orders and proceedings District Programme of the Block Programme Officer Coordinator (ii) Against the orders and proceedings State Commissioner of the District Programme (NREGA) Coordinator (2) The Appellate Authority shall dispose of the appeal within one month from the date of filing of appeal. 10. Procedure for monitoring of complaints:- (1) It shall be the duty of the Grievance Redressal Officer to prepare monthly report in respect of complaints received and disposed of by him during the preceding month. (2) The Block Programme Officer shall send a copy of monthly report to the concerned District Programme Coordinator by 10 th

14 6057 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 day of subsequent month and the District Programme Coordinator shall compile the monthly statement in respect of whole of the district and send a consolidated monthly report to the State Commissioner (NREGA). (3) The District Programme Coordinator shall send a copy of monthly report prepared under sub rule (1) to the State Commissioner (NREGA). (4) The State Commissioner (NREGA) shall be the State Level Officer to monitor the disposal of complaints in the State. Chapter: 3 Social Audit. 11. Social Audit Committee:- (1) The Gram Sabha, from the date of publication of these rules, and thereafter every general election of the Panchayat in its first general meeting, shall form by consensus one social audit committee consisting of not less than nine persons, who are not office bearers of the Gram Panchayat, to conduct and facilitate the social audit of NREGS: Provided that all the members of vigilance committee formed under sub section (4) of section 7 of the Himachal Pradesh Panchayati Raj Act, 1994 shall be included in the social audit committee: Provided further that the social audit committee shall consist of at least two workers who have worked in current/previous works under NREGS of the same Gram Panchayat: Provided further that not less than one third members of Social Audit Committee shall be women. (2) The Panchayat Secretary or Panchayat Sahayak, as the case may be, shall be the member secretary of the social audit committee. (3) The social audit committee in its first meeting, after its constitution, shall elect amongst its members a Chairperson. (4) The social audit committee shall hold at least four meetings in each year.

15 6058 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 (5) There shall be paid a sitting fee at such rate as notified by the State Government from time to time in respect of member of Gram Panchayat meeting subject to maximum two meetings in each quarter of the year. 12. Time period of social audit:- The social audit committee shall conduct social audit of NREGS in four Gram Sabha meetings required to be held in each year under the provisions of sub section (1) of section 5 of the Himachal Pradesh Panchayati Raj Act, Training to the members of the Social Audit Committee:- Necessary training shall be imparted to the members of Social Audit Committee as per the orders, memos and executive instructions issued by the State Government from time to time. 14. Steps for conduct of the social audit:- (1) It shall be the duty of the Gram Rozgar Sewak to provide the following documents/information to the social audit committee at least fifteen days before the date of meeting of the social audit committee :- (a) work-wise/place-wise details of works completed in the Gram Panchayat alongwith work-wise technical estimation and sanction; (b) details of muster-rolls issued against these works; (c) details of material purchased for execution of works, material consumed alongwith the related bills/vouchers; (d) work-wise/place-wise details of on-going works in the Gram Panchayat alongwith work-wise technical estimation and sanction; (e) quarter-wise details of households demanded employment, provided employment number of days of employment provided to each household and details of wage payments made to each worker; or (f) any other document/information sought by the social audit committee.

16 6059 jkti=] fgekpy izns k 24 fnlecj] 2009@3 iks k] 1931 (2) The social audit committee in its meeting shall verify all documents and information provided to it by the Gram Rozgar Sewak. (3) The social audit committee, after verifying and scrutinizing the documents/information received by it, shall prepare a report indicating therein its finding and observations, which shall be read out publicly in subsequent Gram Sabha meeting for the information of the Gram Sabha members and to invite their views, suggestions or objections. (4) The social audit committee shall also put up action taken report relating to the previous Social Audit before the Gram Sabha by reading out its contents. Any dissent/objections shall be addressed and recorded in the minutes of the Gram Sabha meeting. (5) The Social Audit shall be open to public participation. Any outside individual person/group/ngo apart from the Gram Sabha and Social Audit Committee shall be allowed to attend the Social Audit as observers without intervening the proceedings of the Social Audit. 15. Accountability of Block Programme Officer / District Programme Coordinator in conducting social audit and action on the Social Audit findings:- (1) The Block Programme Officer shall be responsible for timely social audits and follow up action at Block level. (2) The District Programme coordinator shall ensure that the social audits are convened and prompt action taken accordingly. (3) The Block Programme Officer shall notify, in writing, to all concerned, including Social Audit Committee, labourers as well as village community, in advance to ensure that they are present in the Gram Sabha meeting. (4) The Block Programme Officer concerned shall initiate action on the findings of the social audit within a month of convening of the social audit. (5) All findings related to contravention of the Act shall be treated as complaints and enquiry shall be conducted for any dispute in
