2 Welcome 執行總監的話 This year saw a shifting landscape and heightened challenges in the ongoing global migration crisis: on the one hand, more forced migrants and people seeking protection than ever; on the other hand, countries which had traditionally accepted the most refugees taking a sharp turn towards nationalism and xenophobia. More than 10,000 people are currently seeking protection in Hong Kong, including survivors of torture. Yet fewer than one percent of protection claims in Hong Kong receive a positive decision, compared with 30%-40% globally. We are therefore extremely proud that after hundreds of hours of legal and psychosocial support from our team, ten Justice Centre clients were formally granted protection by the Hong Kong government in 2016, enabling them to take the first steps toward rebuilding their lives. In addition to the successful claims, we provided legal information to over 500 men, women and children to enable them to navigate the procedural maze of seeking protection in the territory. Within this set of clients, 172 refugees, torture survivors and other forced migrants received intensive legal and psychosocial services which made a vital difference to the quality of their lives in Hong Kong. In 2016 we also published our ambitious and ground-breaking research project Coming Clean, which established the prevalence of forced labour and human trafficking for the purpose of forced labour among migrant domestic workers in Hong Kong. In 2017 our advocacy work will continue with original research into the nexus between asylum seekers and human trafficking in Hong Kong, which despite the city s status as a transit hub and destination for traffickers has never passed a comprehensive law to criminalize this abuse of human dignity. Finally, I would like to acknowledge all Justice Centre staff and directors, as well as our supporters, funders and partners who contribute so much to our work; all of our achievements have only been possible because of your dedication, passion and commitment to protecting the rights of the most vulnerable forced migrants in Hong Kong. 3 We regularly host legal information sessions for refugees at our centre and at outreach sessions across the community. These sessions detail how to apply for protection in Hong Kong and what to do at each stage of the process. With substantive support from our pro bono lawyers, our legal team works with each refugee over six to eighteen months, preparing testimony, conducting extensive background research, and compiling other relevant evidence to strengthen their claims. This specialised support in refugee and international human rights law ensures that these individuals have the meaningful access to justice that they deserve. Alongside our intensive legal assistance programme, we provide psychosocial support to enable the most vulnerable refugees to tell their stories and work with our lawyers without experiencing re-traumatisation. These refugees may suffer from post-traumatic stress disorder as well as other mental impairments and physical illnesses as a result of the torture and/ or persecution they have experienced. Without psychosocial support, they would be unable to provide their testimony in a coherent, chronological manner, and they would risk having their case for protection mistakenly rejected. Appeals 上訴申請 In May we launched an extension of our legal services to assist refugees with appealing their rejected claims to the Torture Claims Appeal Board and the High Court. By ensuring that refugees are represented at this crucial stage in the judicial process, we hope to improve the quality of decision-making by Hong Kong courts and to guarantee that refugees receive the protections and rights to which they are entitled. This work could not be possible without the support of our pro bono partner lawyers who directly represent our clients and the duty lawyers with whom we work closely 年五月我們開始了一項法律服務的延伸服務, 協助難民就他們被拒絕的聲援申請向酷刑聲請上訴委員會及高等法院提出上訴申請 藉著保障難民能夠在法制過程關鍵時刻得到代表援助, 我們希望可以提高香港法庭的裁決水平以及保證難民受到他們應有的保護及權益 多謝代表我們客戶的公益律師和當值律師, 沒有他們的幫助的話, 我們不可能提供這項支援 clients represented on appeals cases 8 名客戶獲代表上訴申請 Legal seminars for duty lawyers 提供給當值律師的法律課程 Justice Centre hosted eight bi-monthly legal seminars for duty lawyers and other sector participants in 2016 and the beginning of Offering detailed discussion of recent developments in both domestic and international refugee law, the seminars also provided guidance for lawyers working with victims of trauma or representing refugee children. Considering the many shortcomings in the Unified Screening Mechanism and in the treatment of refugees who are undergoing the traumatic and often disheartening process of being screened, representing refugees and asylum seekers thus involves particular challenges and difficulties, and can be very demanding. Justice Centre has in the past few years met those challenges without flinching and continues to focus on key elements including ongoing training and support of lawyers acting pro bono or those assigned by the Duty Lawyer Scheme. The recent series of seminars two of which I co-presented fostered lively discussion on necessary improvements in what is a flawed assessment process, and I was able to use much of the research in my own cases, including several substantive judicial reviews in the High Court (Court of First Instance). This is the kind of NGO support which is far more established in other jurisdictions in the world, where more mature refugee assessment systems are found Australia, Canada, the UK. Justice Centre is now well-recognised by refugees and advocates alike as doing vital work. 5 Celeste s story 賽勒斯特的故事 Education 教育 Celeste* is a single mother of two teenagers from East Africa. The family fled their home country due to political persecution and arrived in Hong Kong in Our team provided assistance to her and her children with their claim for protection under the Unified Screening Mechanism. She was granted asylum status in 2016 by the Hong Kong government. Justice Centre leads a variety of educational programmes targeted toward multiple groups: high school students, local and international law students, and pro bono partners currently working in the field. These programs not only bring awareness of our work to a wider community, but also nurture the next generation of human rights advocates. When I came to Hong Kong, I didn t know that I needed help and support. I didn t talk to anybody, I didn t sleep well and I was so closed off. I thought that I didn t need to talk about my problems, but Justice Centre gave me a psychotherapist. They also helped me to draft my testimony, and to know my legal rights. For most students, this is their first opportunity to use their legal knowledge and skills outside the classroom and to work (under dedicated supervision) with vulnerable clients. Students research innovative legal arguments that they can use to defend their clients. 7 Advocacy 倡議 In addition to directly helping individual refugees, we also seek to protect the rights of forced migrants in Hong Kong by influencing various issues at the policy level. To promote our advocacy efforts, we work closely with local networks such as the Refugee Concern Network, which brings together Hong Kong-based organisations concerned with protection claimants rights; regional networks like the Asia Pacific Refugee Rights Network and Southern Refugee Legal Aid Network; and international human rights treaty bodies. 除直接幫助各難民外, 我們在香港也尋求通過政策層面上影響各種各樣的問題, 保護強迫移民權利 要促進我們的倡議努力, 我們與地區網路例如難民關心網路及其引薦的香港本地保護聲訴人的組織 ; 區域網絡如 Asia Pacific Refugee Rights Network 和 Southern Refugee Legal Aid Network, 以及國際人權公將組織 Coming Clean The findings influenced the US State Department s annual Trafficking in Persons report, which assesses efforts by countries around the world to tackle human trafficking. This innovative study the first of its kind included focus groups and interviews with more than 1,000 migrant domestic workers in Hong Kong. 8 Local and international recognition 本地和國際認可 In April our executive director Piya Muqit was invited to Geneva to speak about redress and rehabilitation for child torture survivors at a workshop organised by the United Nations Voluntary Fund for Victims of Torture (UNVFVT). The workshop culminated in a public event where Piya spoke alongside the UN High Commissioner for Human Rights. 9 Refugee empowerment Voices for Protection 保護之聲的聲音 難民賦權 On International Women s Day 2016, in cooperation with the leadership development consultancy Bridge, Justice Centre hosted the fourth intake of Voices for Protection, an empowerment programme launched in 2014 to equip refugees with the skills and knowledge to be their own advocates and spokespeople for the refugee community in Hong Kong. In May the Hong Kong daily newspaper Ming Pao published a piece written by Voices graduates the first opinion piece by refugees to appear in Chinese-language media. 在 2016 年的國際婦女節,Justice Centre 與發展領導力諮詢機構橋樑合作, 主辦了第四次 保護之聲, 這是 2014 年發起的賦予能力計畫, 給于難民為自己在難民社區裡鼓吹和發言的技能和知識 五月份, 香港 明報 出版了由講畢業生撰寫的作品 成為在中文媒體上第一張難民的作品 Free to Run In 2016 we continued our partnership with Free to Run, a group of volunteers who use running, physical fitness and outdoor adventure as a means of empowering and educating refugees from conflict zones. The weekly Hiking for Healing group that we organised with Free to Run provides refugee women with a chance to break their isolation and experience the beautiful trails in Hong Kong. We also pioneered a weekly mixed-gender track training group, where refugee men and women train alongside volunteers and compete in races.
