3 Objectives Introduce the NYS Migrant Education Program Provide an overview of the Level 2 Data Reconciliation process that New York State Migrant Education Program uses in order to promote the accurate identification of migrant students in New York State school districts Learn about the process of flagging students as migrant and ways to review/check accuracy of the information Discuss best practices for collaboration and benefits of coordination between school districts, NYSED, and NYS Migrant Education

4 What is the Migrant Education Program? Authorized by Title I Part C of ESEA Created in 1965 General Purpose is to: o o o Support high-quality education programs for migratory children. Provide appropriate educational and support services that address the unique needs of migrant students. Allow migratory children the opportunity to meet the same challenging state academic content and standards as their peers and to graduate from high school.

5 Definition of a Migrant Student Has moved during the past 36 months AND Moved with a Migratory Agricultural Worker (Farmworker) AND Moved from one school district to another AND Is under 22 years of age AND Has not graduated from High School

6 Why is Migrant Education relevant? In 2012, New York State had 35, 538 farms. New York is ranked 5 th in the nation for area harvested and value of principal fresh market vegetables. The top qualifying industries in New York State include Dairy, Apples, Trees and Onions. According to the National Center for Farmworker Health, in 2012 there were 112,827 farmworkers and their dependents residing in New York State.

9 Family Educational Rights and Privacy Act (FERPA) Protects the disclosure of PII and educational records of students Governs who has access to this data FERPA Exceptions (34 CFR 99.31) School officials with legitimate educational interest Other schools to which a student is transferring Specified officials for audit or evaluation purposes Appropriate parties in connection with financial aid to a student Organizations conducting certain studies for, or on behalf of, the school Accrediting organizations To comply with a judicial order or lawfully issued subpoena Appropriate officials in cases of health and safety emergencies State and local authorities within a juvenile justice system pursuant to specific state law

13 Data Verification Letter (Ira Schwartz s letter) From the Assistant Commissioner of NYS Education Department, Ira Schwartz. Sent to school district superintendents and District Data Coordinators explaining the importance of correctly flagging migrant students. Instructions of how to identify students that have been flagged as migrant for the current school year.

14 SIRS Letters to School Districts Follow up to the Migrant Student Data Verification letter Sent by the METS along with a list of students that are migrant eligible for the current school year Specific instructions on how to flag a student as migrant is provided within the letter Also, METS sends letters to school districts without migrant students

15 Level 2 Data Reports Collected 4 times a year from NYSED Personally distributed to METS along with a list of students that are migrant eligible for the current school year METS use the information to call school districts to match Level 2 Data with report created by NYS Migrant Education Program

17 NYSED Data Collection and Reconciliation Migrant students are reported with a migrant indicator and Program Service code 0330 if the student is receiving Title I, Part C-funded services. This data is entered at the school level through student management systems and pushed up to the state data warehouse (SIRS) via the RIC or other contracted vendor. If a migrant student leaves a school and comes back, they are counted only once. A migrant student can be reported at more than one school in the state but only once for each school. NYSED performs a cross match with NYSSIS IDs.

18 SIRS DATA REPORTING The Migrant indicator is a required data element in the Student_Lite template. Indicate Y or N (defaults to N if left blank).

19 How can District check accuracy of migrant data? L2RPT-SIRS 401 Reasonableness Report. When running this report, please choose All Locations, the Student Demographic category, and All Subtypes from the dropdown menu. Click on the Migrant category for this year to generate a list of students in your district or Charter School identified with the Migrant Indicator. If your district or Charter School does not have any students reported in SIRS as migrant, the Migrant category will not appear. Migrant status must be reviewed and, if necessary, corrected, before the close of the data warehouse.

20 Data Reporting The Office of Information and Reporting Services (IRS) pulls data for the Office of Accountability and for federal reporting purposes under The Every Student Succeeds Act (ESSA), which contains the major statutory provisions that apply to the Migrant Education Program. Migrant data is reported by NYSED to the U.S. Department of Education each year in the Consolidated State Performance Report (CSPR).
