1 President Timothy Tarulli called the meeting to order at 7:30 pm. All stood for the invocation that was given by Reverend Chris Mulpas from First Christian Church followed by the Pledge of Allegiance. Roll Call: Bair, Gunnoe, Mueller, Maurer, Korns Five (5) present. Motion by Mueller to excuse Moss and Parolini. Seconded by Gunnoe. Discussion. Motion carried. Excused. Motion by Maurer to accept November 4, 2013 regular council meeting minutes. Seconded by Gunnoe. COMMITTEE REPORTS: Service Bair One recommendation from meeting tonight at 7:15 pm: that an emergency ordinance be prepared to authorize the City of Dover participation in the Highway Resurfacing Project with the State of Ohio as described in the body of this ordinance. Parks & Recreation Gunnoe No formal report. Safety Moss No report. Human Resources Mueller Two recommendations from meeting tonight at 7:00 pm: (1) that an emergency ordinance be prepared to change the position of auditor s office assistant to auditor s payroll and benefits coordinator and to set the wages at $19.60 an hour for 2013 and $20.20 an hour in 2014, (2) that an ordinance be prepared to establish the salaries and compensation of the Dover City Treasurer Dover Council President and the Dover At-Large Councilpersons for the terms commencing on January 1, Finance Maurer Four recommendations from meeting at 6:30 tonight: (1) that an emergency ordinance be prepared to amend chapter 182 of the Dover Codified Ordinances and to provide additional guidance and a process for the use of these funds, (2) that an emergency ordinance be prepared directing the Treasurer and the Auditor of the City of Dover to re-allocate the Dover City Income Taxes collected for the year Twenty-five percent (25%) of the total income tax receipts shall be placed in the Master Capital Improvement Fund and the remaining balance shall be divided between the Street and Maintenance Repair Fund, the Cemetery Fund, the Police and Fire Pension Fund, and the General Fund, (3) that an emergency ordinance be prepared making supplemental appropriations and authorizing the transfer of funds to meet current obligations of the City of Dover and the departments therein, (4) that an ordinance be prepared to make temporary appropriations for current expenses and other expenditures of the City of Dover, State of Ohio, for the year 2014 only until the enactment of the annual appropriation ordinance and not later than April 1, 2014 declaring an emergency. Maurer scheduled a finance meeting on November 25 th at 6:30 pm. Planning, Zoning and Codes Korns No formal report. Utility Parolini per Korns - Korns asked for passage of ordinance this evening.
2 ADMINISTRATION REPORTS: Dover City Council Minutes of November 18, 2013 Page Two Mayor Homrighausen One request for assignment from Planning Commission meeting on November 12 th : a request for a committee assignment to review the proposed sign variance from Heritage Square Plaza in Dover. The Planning Commission recommends approval. Mayor Homrighausen announced that registration forms for this year s Christmas Parade are available in his office. The Christmas Parade is December 7, 2013 beginning at 5:15 pm. In connection with the Christmas Parade, the annual lighting ceremony will occur for the downtown area. The Mayor thanked Police Chief Joe Ball and his wife Jean for donating this year s Christmas tree that will be displayed adjacent to the Santa House. Mayor Homrighausen invited all residents of Dover to attend. Auditor Fox No formal report. Fox read a letter to Council announcing her retirement effective November 30 th. President Tarulli thanked Fox for her years of service and dedication to the City of Ohio. Law Director O Meara No formal report. O Meara requested that Council enter into Executive Session following legislation to discuss potential litigation and negotiations. Service Director Douglas Douglas reported that the city is finishing projects for the end of the year including the CDBG project. The Parkview Drive curbs will be finished this year. The leaf crews are working and the city has two good leaf pick up machines. Safety Director Vorhees One request for assignment: a request for a committee assignment to review the city s contract with the Tuscarawas County Sheriff s Office regarding jail costs. Vorhees congratulated Fox on her retirement and said he will miss working with her. City Engineer Dummermuth: No formal report. NOTICES & COMMUNICATIONS: Monthly Reports August 2013 bank reconciliation and September 2013 bank reconciliation. Notices and Communications We received notice from the State of Ohio Department of Commerce that all permits to sell alcoholic beverages in the city will expire on February 1, Every permit holder must file a renewal application. PREAMBLES: Emergency Resolution 25-13, Emergency Ordinance 54-13, Emergency Ordinance 55-13, Ordinance 56-13, Emergency Ordinance 57-13, Emergency Ordinance 58-13, Emergency Ordinance 59-13, Emergency Ordinance 60-13, Ordinance 61-13, Ordinance AUDIENCE: Gina Sonnik, 515 Union Avenue Dover on behalf of Phillips Edison Company who manages Heritage Square in Dover. Sonnik stated that they are interested in adding a sign on James Street close to Giant Eagle as they are working to fill the shopping center with a doctor s office and fitness center. Sonnik said the current sign is full and the new sign they are requesting is 12 feet while a current Dover ordinance
3 Page Three won t allow for more than 7 feet. This space would allow for 12 tenants. Sonnik provided a copy of the sign for council to review. O Meara asked how soon. Sonnik said pending approval they would like to send it to the sign vendor yet this year. Mayor Homrighausen said the Planning Commission recommended approval by council. Tarulli asked why it isn t going to be illuminated. Sonnik said there is no reason and in the future they would have the ability to do that. UNFINISHED BUSINESS: Korns scheduled a meeting on December 2 nd for Planning, Zoning and Codes Committee at 6:30 pm. Vorhees scheduled a Safety Committee meeting on December 2 nd at 7:15 pm for Moss. Mueller motioned that Council enter into Executive Session following legislation for the purpose of potential litigation and negotiations. Seconded by Gunnoe. Discussion. Roll call. 5 yeas. Motion carried. Executive Session. LEGISLATION: Emergency Resolution up for Third Reading. A resolution authorizing the fire department to participate in the Assistance to Firefighters Grant Program, applying for and if awarded, act as the lead agency in a regional grant application the purpose of which is the acquisition of a portable training tower and a portable firefighter training trailer or trailers with a cost not to exceed $480,000, being 90% reimbursable with the City of Dover's share not to exceed $12,000. Motion by Korns to pass. Seconded by Mueller. Discussion. Roll call. 5 yeas. Motion carried. Passed. Emergency Ordinance up for Third Reading. An emergency ordinance to approve the execution of an Efficiency Smart Schedule with American Municipal Power, Inc. Motion by Korns to pass. Seconded by Gunnoe. Discussion. Roll call. 5 yeas. An emergency ordinance authorizing the Director of Public Safety to enter into a contract, on file with the Dover Safety Director, with the Joint County Public Defender s Office to provide legal counsel to indigent persons charged with loss of liberty offenses in the New Philadelphia Municipal Court, and arising in the City of Dover, at a cost not to exceed fourteen thousand seven hundred dollars ($14,700.00) per year.
