2 2 ETS 53 Prevention of Pirte Sttions, 22.I.1965 The memer Sttes of the Council of Europe signtory hereto, Considering tht the im of the Council of Europe is to chieve greter unity etween its memers; Considering tht the Rdio Regultions nnexed to the Interntionl Telecommuniction Convention prohiit the estlishment nd use of rodcsting sttions on ord ships, ircrft or ny other floting or irorne ojects outside ntionl territories; Considering lso the desirility of providing for the possiility of preventing the estlishment nd use of rodcsting sttions on ojects ffixed to or supported y the ed of the se outside ntionl territories; Considering the desirility of Europen collortion in this mtter, Hve greed s follows: Article 1 This Agreement is concerned with rodcsting sttions which re instlled or mintined on ord ships, ircrft, or ny other floting or irorne ojects nd which, outside ntionl territories, trnsmit rodcsts intended for reception or cple of eing received, wholly or in prt, within the territory of ny Contrcting Prty, or which cuse hrmful interference to ny rdio-communiction service operting under the uthority of Contrcting Prty in ccordnce with the Rdio Regultions. Article 2 1 Ech Contrcting Prty undertkes to tke pproprite steps to mke punishle s offences, in ccordnce with its domestic lw, the estlishment or opertion of rodcsting sttions referred to in Article 1, s well s cts of collortion knowingly performed. 2 The following shll, in reltion to rodcsting sttions referred to in Article 1, e cts of collortion: c d e the provision, mintennce or repiring of equipment; the provision of supplies; the provision of trnsport for, or the trnsporting of, persons, equipment or supplies; the ordering or production of mteril of ny kind, including dvertisements, to e rodcst; the provision of services concerning dvertising for the enefit of the sttions.

3 3 ETS 53 Prevention of Pirte Sttions, 22.I.1965 Article 3 Ech Contrcting Prty shll, in ccordnce with its domestic lw, pply the provisions of this Agreement in regrd to: its ntionls who hve committed ny ct referred to in Article 2 on its territory, ships, or ircrft, or outside ntionl territories on ny ships, ircrft or ny other floting or irorne oject; non-ntionls who, on its territory, ships or ircrft, or on ord ny floting or irorne oject under its jurisdiction hve committed ny ct referred to in Article 2. Article 4 Nothing in this Agreement shll e deemed to prevent Contrcting Prty: from lso treting s punishle offences cts other thn those referred to in Article 2 nd lso pplying the provisions concerned to persons other thn those referred to in Article 3; from lso pplying the provisions of this Agreement to rodcsting sttions instlled or mintined on ojects ffixed to or supported y the ed of the se. Article 5 The Contrcting Prties my elect not to pply the provisions of this Agreement in respect of the services of performers which hve een provided elsewhere thn on the sttions referred to in Article 1. Article 6 The provisions of Article 2 shll not pply to ny cts performed for the purpose of giving ssistnce to ship or ircrft or ny other floting or irorne oject in distress or of protecting humn life. Article 7 No reservtion my e mde to the provisions of this Agreement. Article 8 1 This Agreement shll e open to signture y the memer Sttes of the Council of Europe, which my ecome Prties to it either y: signture without reservtion in respect of rtifiction or cceptnce, or signture with reservtion in respect of rtifiction or cceptnce followed y rtifiction or cceptnce. 2 Instruments of rtifiction or cceptnce shll e deposited with the Secretry Generl of the Council of Europe.

4 4 ETS 53 Prevention of Pirte Sttions, 22.I.1965 Article 9 1 This Agreement shll enter into force one month fter the dte on which three memer Sttes of the Council shll, in ccordnce with the provisions of Article 8, hve signed the Agreement without reservtion in respect of rtifiction or cceptnce, or shll hve deposited their instrument of rtifiction or cceptnce. 2 As regrds ny memer Stte which shll susequently sign the Agreement without reservtion in respect of rtifiction or cceptnce or which shll rtify or ccept it, the Agreement shll enter into force one month fter the dte of such signture or the dte of deposit of the instrument of rtifiction or cceptnce. Article 10 1 After this Agreement hs entered into force, ny memer or Associte memer of the Interntionl Telecommuniction Union which is not memer of the Council of Europe my ccede to it suject to the prior greement of the Committee of Ministers. 2 Such ccession shll e effected y depositing with the Secretry Generl of the Council of Europe n instrument of ccession which shll tke effect one month fter the dte of its deposit. Article 11 1 Any Contrcting Prty my, t the time of signture or when depositing its instrument of rtifiction, cceptnce or ccession, specify the territory or territories to which this Agreement shll pply. 2 Any Contrcting Prty my, when depositing its instrument of rtifiction, cceptnce or ccession or t ny lter dte, y declrtion ddressed to the Secretry Generl of the Council of Europe, extend this Agreement to ny other territory or territories specified in the declrtion nd for whose interntionl reltions it is responsile or on whose ehlf it is uthorised to give undertkings. 3 Any declrtion mde in pursunce of the preceding prgrph my, in respect of ny territory mentioned in such declrtion, e withdrwn ccording to the procedure lid down in Article 12 of this Agreement. Article 12 1 This Agreement shll remin in force indefinitely. 2 Any Contrcting Prty my, in so fr s it is concerned, denounce this Agreement y mens of notifiction ddressed to the Secretry Generl of the Council of Europe. 3 Such denuncition shll tke effect six months fter the dte of receipt y the Secretry Generl of such notifiction. Article 13 The Secretry Generl of the Council of Europe shll notify the memer Sttes of the Council nd the government of ny Stte which hs cceded to this Agreement, of: ny signture without reservtion in respect of rtifiction or cceptnce;

5 5 ETS 53 Prevention of Pirte Sttions, 22.I.1965 c d ny signture with reservtion in respect of rtifiction or cceptnce; ny deposit of n instrument of rtifiction, cceptnce or ccession; ny dte of entry into force of this Agreement in ccordnce with Articles 9 nd 10 thereof; e ny declrtion received in pursunce of prgrphs 2 nd 3 of Article 11; f ny notifiction received in pursunce of the provisions of Article 12 nd the dte on which denuncition tkes effect. In witness whereof the undersigned, eing duly uthorised thereto, hve signed this Agreement. Done t Strsourg, this 22nd dy of Jnury 1965, in English nd French, oth texts eing eqully uthorittive, in single copy which shll remin deposited in the rchives of the Council of Europe. The Secretry Generl of the Council of Europe shll trnsmit certified copies to ech of the signtory nd cceding Sttes.
