The Province grees with the jurisdictionl bsis referred to by the Secretry of Stte in his letter of August 26th but submits tht such bsis is brod enough to encompss ll questions rised by the Province. The Province ccordingly submits tht the exmple referred to on pge 2 of the Secretry of Stte's letter is illustrtive only nd is not exhustive of the ommission's. jurisdiction. 8

4 The Deprtment of Stte of the United Sttes of Americ 1. The Province does not understnd the brief submitted by the Deprtment of Stte to rise ny jurisdictionl objection to the Province's Request. 2.- The Province grees with the Deprtment's ssertion tht "... the bsis of much of the ommission's jurisdiction 'is the Boundry Wters Trety..." nd tht Person sserting dverse effects of n Order mde by the ommission ought not to be left without remedy. 3. The procedurl suggestion contined in the lst prgrph of the brief submitted by the Deprtment of Stte is one which my require creful considertion in other circumstnces. However, the Province does not understnd the Deprtment to suggest tht such Rule of Procedure should be given retrospective effect so s to pply to the Request of the Province nd ccordingly offers no further comment.on it. The ity of Settle The brief of the ity of Settle will be delt with by reference to the following excerpts from tht brief. 1. "Nowhere in the Trety is the lnguge which expressly or impliedly gives the ommission jurisdiction to review n Order of Approvl mde by it... to declre such Order to be nullity or to rescind the pprovl contined therein much less to enjoin prty seeking to implement ommission Order." Reply - pge 2, Settle Brief. The Trety confers upon the ommission jurisdiction commensurte with its responsibilities. The ommission is

6 2. "Whtever further jurisdiction the ommission my hve with respect to its Order of Approvl of Jnury 27, 1942, would pper to lie in the purported reservtion..." - pge 2, Settle Brief. Reply From the bove, nd the tenor of the footnote on pge 3 of its brief, it would pper tht Settle considers the 'source of jurisdiction of the ommission to depend on its 'Rules of Procedure nd the scope of tht jurisdiction to fluctute ccording to the lnguge of n Order. f there is no bsis for continuing jurisdiction in the Trety, s. Settle contends, the ommission hd no power to include the reservtion contined in prgrph numbered 2 in its 1942 Order. Since its purported pprovl in 1942 of Settle's ppliction ws expressly conditioned upon this reservtion, the logicl result of this contention on the prt of Settle is the invlidity of the entire Order becuse the ommission exceeded its jurisdictionl The Province hs mde cler tht its Request is mde under the continuing jurisdiction provided for in the Trety.nd lterntively in the prticulr ssertion' of tht jurisdiction found in the reservtion contined in prgrph numbered 2 of the 1942 Order. 3. "The ommission's ttention is drwn to its Decision in Docket No. 31 in the mtter of the ppliction of the Mdwsk ompny... - pge 4, Settle Brief. Reply ' The Decision of the ~ommi'ssion in Docket No. 31 is of no ssistnce in the present circumstnces.
