1 Europen Trety Series - No. 112 Convention on the Trnsfer of Sentene Persons Strsourg, 21.III.1983 The memer Sttes of the Counil of Europe n the other Sttes, signtory hereto, Consiering tht the im of the Counil of Europe is to hieve greter unity etween its memers; Desirous of further eveloping interntionl o-opertion in the fiel of riminl lw; Consiering tht suh o-opertion shoul further the ens of justie n the soil rehilittion of sentene persons; Consiering tht these ojetives require tht foreigners who re eprive of their lierty s result of their ommission of riminl offene shoul e given the opportunity to serve their sentenes within their own soiety; n Consiering tht this im n est e hieve y hving them trnsferre to their own ountries, Hve gree s follows: Artile 1 Definitions For the purposes of this Convention: "sentene" mens ny punishment or mesure involving eprivtion of lierty orere y ourt for limite or unlimite perio of time on ount of riminl offene; "jugment" mens eision or orer of ourt imposing sentene; "sentening Stte" mens the Stte in whih the sentene ws impose on the person who my e, or hs een, trnsferre; "ministering Stte" mens the Stte to whih the sentene person my e, or hs een, trnsferre in orer to serve his sentene. Artile 2 Generl priniples 1 The Prties unertke to ffor eh other the wiest mesure of o-opertion in respet of the trnsfer of sentene persons in orne with the provisions of this Convention.

Artile 3 Conitions for trnsfer 1 A sentene person my e trnsferre uner this Convention only on the following onitions: e f if tht person is ntionl of the ministering Stte; if the jugment is finl; if, t the time of reeipt of the request for trnsfer, the sentene person still hs t lest six months of the sentene to serve or if the sentene is ineterminte; if the trnsfer is onsente to y the sentene person or, where in view of his ge or his physil or mentl onition one of the two Sttes onsiers it neessry, y the sentene person's legl representtive; if the ts or omissions on ount of whih the sentene hs een impose onstitute riminl offene oring to the lw of the ministering Stte or woul onstitute riminl offene if ommitte on its territory; n if the sentening n ministering Sttes gree to the trnsfer. 2 In exeptionl ses, Prties my gree to trnsfer even if the time to e serve y the sentene person is less thn tht speifie in prgrph Any Stte my, t the time of signture or when epositing its instrument of rtifition, eptne, pprovl or ession, y elrtion resse to the Seretry Generl of the Counil of Europe, inite tht it intens to exlue the pplition of one of the proeures provie in Artile 9.1. n in its reltions with other Prties. 4 Any Stte my, t ny time, y elrtion resse to the Seretry Generl of the Counil of Europe, efine, s fr s it is onerne, the term "ntionl" for the purposes of this Convention. Artile 4 Oligtion to furnish informtion 1 Any sentene person to whom this Convention my pply shll e informe y the sentening Stte of the sustne of this Convention. 2 If the sentene person hs expresse n interest to the sentening Stte in eing trnsferre uner this Convention, tht Stte shll so inform the ministering Stte s soon s prtile fter the jugment eomes finl. 3 The informtion shll inlue: the nme, te n ple of irth of the sentene person; his ress, if ny, in the ministering Stte; 2

Artile 5 Requests n replies 1 Requests for trnsfer n replies shll e me in writing. 2 Requests shll e resse y the Ministry of Justie of the requesting Stte to the Ministry of Justie of the requeste Stte. Replies shll e ommunite through the sme hnnels. 3 Any Prty my, y elrtion resse to the Seretry Generl of the Counil of Europe, inite tht it will use other hnnels of ommunition. 4 The requeste Stte shll promptly inform the requesting Stte of its eision whether or not to gree to the requeste trnsfer. Artile 6 Supporting ouments 1 The ministering Stte, if requeste y the sentening Stte, shll furnish it with: oument or sttement initing tht the sentene person is ntionl of tht Stte; opy of the relevnt lw of the ministering Stte whih provies tht the ts or omissions on ount of whih the sentene hs een impose in the sentening Stte onstitute riminl offene oring to the lw of the ministering Stte, or woul onstitute riminl offene if ommitte on its territory; sttement ontining the informtion mentione in Artile If trnsfer is requeste, the sentening Stte shll provie the following ouments to the ministering Stte, unless either Stte hs lrey inite tht it will not gree to the trnsfer: ertifie opy of the jugment n the lw on whih it is se; sttement initing how muh of the sentene hs lrey een serve, inluing informtion on ny pre-tril etention, remission, n ny other ftor relevnt to the enforement of the sentene; elrtion ontining the onsent to the trnsfer s referre to in Artile 3.1.; n whenever pproprite, ny meil or soil reports on the sentene person, informtion out his tretment in the sentening Stte, n ny reommention for his further tretment in the ministering Stte. 3

Artile 7 Consent n its verifition 1 The sentening Stte shll ensure tht the person require to give onsent to the trnsfer in orne with Artile 3.1. oes so voluntrily n with full knowlege of the legl onsequenes thereof. The proeure for giving suh onsent shll e governe y the lw of the sentening Stte. 2 The sentening Stte shll ffor n opportunity to the ministering Stte to verify through onsul or other offiil gree upon with the ministering Stte, tht the onsent is given in orne with the onitions set out in prgrph 1 ove. Artile 8 Effet of trnsfer for sentening Stte 1 The tking into hrge of the sentene person y the uthorities of the ministering Stte shll hve the effet of suspening the enforement of the sentene in the sentening Stte. 2 The sentening Stte my no longer enfore the sentene if the ministering Stte onsiers enforement of the sentene to hve een omplete. Artile 9 Effet of trnsfer for ministering Stte 1 The ompetent uthorities of the ministering Stte shll: ontinue the enforement of the sentene immeitely or through ourt or ministrtive orer, uner the onitions set out in Artile 10, or onvert the sentene, through juiil or ministrtive proeure, into eision of tht Stte, therey sustituting for the sntion impose in the sentening Stte sntion presrie y the lw of the ministering Stte for the sme offene, uner the onitions set out in Artile The ministering Stte, if requeste, shll inform the sentening Stte efore the trnsfer of the sentene person s to whih of these proeures it will follow. 3 The enforement of the sentene shll e governe y the lw of the ministering Stte n tht Stte lone shll e ompetent to tke ll pproprite eisions. 4 Any Stte whih, oring to its ntionl lw, nnot vil itself of one of the proeures referre to in prgrph 1 to enfore mesures impose in the territory of nother Prty on persons who for resons of mentl onition hve een hel not riminlly responsile for the ommission of the offene, n whih is prepre to reeive suh persons for further tretment my, y wy of elrtion resse to the Seretry Generl of the Counil of Europe, inite the proeures it will follow in suh ses. Artile 10 Continue enforement 1 In the se of ontinue enforement, the ministering Stte shll e oun y the legl nture n urtion of the sentene s etermine y the sentening Stte. 4

As to its nture, the punishment or mesure shll, s fr s possile, orrespon with tht impose y the sentene to e enfore. It shll not ggrvte, y its nture or urtion, the sntion impose in the sentening Stte, nor exee the mximum presrie y the lw of the ministering Stte. Artile 11 Conversion of sentene 1 In the se of onversion of sentene, the proeures provie for y the lw of the ministering Stte pply. When onverting the sentene, the ompetent uthority: shll e oun y the finings s to the fts insofr s they pper expliitly or impliitly from the jugment impose in the sentening Stte; my not onvert sntion involving eprivtion of lierty to peuniry sntion; shll eut the full perio of eprivtion of lierty serve y the sentene person; n shll not ggrvte the penl position of the sentene person, n shll not e oun y ny minimum whih the lw of the ministering Stte my provie for the offene or offenes ommitte. 2 If the onversion proeure tkes ple fter the trnsfer of the sentene person, the ministering Stte shll keep tht person in ustoy or otherwise ensure his presene in the ministering Stte pening the outome of tht proeure. Artile 12 Pron, mnesty, ommuttion Eh Prty my grnt pron, mnesty or ommuttion of the sentene in orne with its Constitution or other lws. Artile 13 Review of jugment The sentening Stte lone shll hve the right to eie on ny pplition for review of the jugment. Artile 14 Termintion of enforement The ministering Stte shll terminte enforement of the sentene s soon s it is informe y the sentening Stte of ny eision or mesure s result of whih the sentene eses to e enforele. Artile 15 Informtion on enforement The ministering Stte shll provie informtion to the sentening Stte onerning the enforement of the sentene: when it onsiers enforement of the sentene to hve een omplete; if the sentene person hs espe from ustoy efore enforement of the sentene hs een omplete; or if the sentening Stte requests speil report. 5

It is sujet to rtifition, eptne or pprovl. Instruments of rtifition, eptne or pprovl shll e eposite with the Seretry Generl of the Counil of Europe. 2 This Convention shll enter into fore on the first y of the month following the expirtion of perio of three months fter the te on whih three memer Sttes of the Counil of Europe hve expresse their onsent to e oun y the Convention in orne with the provisions of prgrph 1. 3 In respet of ny signtory Stte whih susequently expresses its onsent to e oun y it, the Convention shll enter into fore on the first y of the month following the expirtion of perio of three months fter the te of the eposit of the instrument of rtifition, eptne or pprovl. Artile 19 Aession y non-memer Sttes 1 After the entry into fore of this Convention, the Committee of Ministers of the Counil of Europe, fter onsulting the Contrting Sttes, my invite ny Stte not memer of the Counil n not mentione in Artile 18.1 to ee to this Convention, y eision tken y the mjority provie for in Artile 20. of the Sttute of the Counil of Europe n y the unnimous vote of the representtives of the Contrting Sttes entitle to sit on the Committee. 2 In respet of ny eing Stte, the Convention shll enter into fore on the first y of the month following the expirtion of perio of three months fter the te of eposit of the instrument of ession with the Seretry Generl of the Counil of Europe. Artile 20 Territoril pplition 1 Any Stte my t the time of signture or when epositing its instrument of rtifition, eptne, pprovl or ession, speify the territory or territories to whih this Convention shll pply. 2 Any Stte my t ny lter te, y elrtion resse to the Seretry Generl of the Counil of Europe, exten the pplition of this Convention to ny other territory speifie in the elrtion. In respet of suh territory the Convention shll enter into fore on the first y of the month following the expirtion of perio of three months fter the te of reeipt of suh elrtion y the Seretry Generl. 3 Any elrtion me uner the two preeing prgrphs my, in respet of ny territory speifie in suh elrtion, e withrwn y notifition resse to the Seretry Generl. The withrwl shll eome effetive on the first y of the month following the expirtion of perio of three months fter the te of reeipt of suh notifition y the Seretry Generl. Artile 21 Temporl pplition This Convention shll e pplile to the enforement of sentenes impose either efore or fter its entry into fore. 7

8 ETS 112 Trnsfer of Sentene Persons, 21.III.1983 Artile 22 Reltionship to other Conventions n Agreements 1 This Convention oes not ffet the rights n unertkings erive from extrition treties n other treties on interntionl o-opertion in riminl mtters proviing for the trnsfer of etine persons for purposes of onfronttion or testimony. 2 If two or more Prties hve lrey onlue n greement or trety on the trnsfer of sentene persons or otherwise hve estlishe their reltions in this mtter, or shoul they in future o so, they shll e entitle to pply tht greement or trety or to regulte those reltions oringly, in lieu of the present Convention. 3 The present Convention oes not ffet the right of Sttes prty to the Europen Convention on the Interntionl Vliity of Criminl Jugments to onlue ilterl or multilterl greements with one nother on mtters elt with in tht Convention in orer to supplement its provisions or filitte the pplition of the priniples emoie in it. 4 If request for trnsfer flls within the sope of oth the present Convention n the Europen Convention on the Interntionl Vliity of Criminl Jugments or nother greement or trety on the trnsfer of sentene persons, the requesting Stte shll, when mking the request, inite on the sis of whih instrument it is me. Artile 23 Frienly settlement The Europen Committee on Crime Prolems of the Counil of Europe shll e kept informe regring the pplition of this Convention n shll o whtever is neessry to filitte frienly settlement of ny iffiulty whih my rise out of its pplition. Artile 24 Denunition 1 Any Prty my t ny time enoune this Convention y mens of notifition resse to the Seretry Generl of the Counil of Europe. 2 Suh enunition shll eome effetive on the first y of the month following the expirtion of perio of three months fter the te of reeipt of the notifition y the Seretry Generl. 3 The present Convention shll, however, ontinue to pply to the enforement of sentenes of persons who hve een trnsferre in onformity with the provisions of the Convention efore the te on whih suh enunition tkes effet. Artile 25 Notifitions The Seretry Generl of the Counil of Europe shll notify the memer Sttes of the Counil of Europe, the non-memer Sttes whih hve prtiipte in the elortion of this Convention n ny Stte whih hs ee to this Convention of: ny signture; the eposit of ny instrument of rtifition, eptne, pprovl or ession; ny te of entry into fore of this Convention in orne with Artiles 18.2 n 3, 19.2 n 20.2 n 3; ny other t, elrtion, notifition or ommunition relting to this Convention. 8
