1 Europen Trety Series - No. 73 Europen Convention on the Trnsfer of Proeedings in Criminl Mtters Strsourg, 15.V.1972 The memer Sttes of the Counil of Europe, signtory hereto, Considering tht the im of the Counil of Europe is the hievement of greter unity etween its memers; Desiring to supplement the work whih they hve lredy omplished in the field of riminl lw with view to rriving t more just nd effiient sntions; Considering it useful to this end to ensure, in spirit of mutul onfidene, the orgnistion of riminl proeedings on the interntionl level, in prtiulr, y voiding the disdvntges resulting from onflits of ompetene, Hve greed s follows: Prt I Definitions Artile 1 For the purposes of this Convention: "offene" omprises ts delt with under the riminl lw nd those delt with under the legl provisions listed in Appendix III to this Convention on ondition tht where n dministrtive uthority is ompetent to del with the offene it must e possile for the person onerned to hve the se tried y ourt; "sntion" mens ny punishment or other mesure inurred or pronouned in respet of n offene or in respet of violtion of the legl provisions listed in Appendix III. Prt II Competene Artile 2 1 For the purposes of pplying this Convention, ny Contrting Stte shll hve ompetene to proseute under its own riminl lw ny offene to whih the lw of nother Contrting Stte is pplile. 2 The ompetene onferred on Contrting Stte exlusively y virtue of prgrph 1 of this rtile my e exerised only pursunt to request for proeedings presented y nother Contrting Stte.

2 Artile 3 Any Contrting Stte hving ompetene under its own lw to proseute n offene my, for the purposes of pplying this Convention, wive or desist from proeedings ginst suspeted person who is eing or will e proseuted for the sme offene y nother Contrting Stte. Hving regrd to Artile 21, prgrph 2, ny suh deision to wive or to desist from proeedings shll e provisionl pending finl deision in the other Contrting Stte. Artile 4 The requested Stte shll disontinue proeedings exlusively grounded on Artile 2 when to its knowledge the right of punishment is extinguished under the lw of the requesting Stte for reson other thn time-limittion, to whih Artiles 10., 11.f nd g, 22, 23 nd 26 in prtiulr pply. Artile 5 The provisions of Prt III of this Convention do not limit the ompetene given to requested Stte y its muniipl lw in regrd to proseutions. Prt III Trnsfer of proeedings Setion 1 Request for proeedings Artile 6 1 When person is suspeted of hving ommitted n offene under the lw of Contrting Stte, tht Stte my request nother Contrting Stte to tke proeedings in the ses nd under the onditions provided for in this Convention. 2 If under the provisions of this Convention Contrting Stte my request nother Contrting Stte to tke proeedings, the ompetent uthorities of the first Stte shll tke tht possiility into onsidertion. Artile 7 1 Proeedings my not e tken in the requested Stte unless the offene in respet of whih the proeedings re requested would e n offene if ommitted in its territory nd when, under these irumstnes, the offender would e lile to sntion under its own lw lso. 2 If the offene ws ommitted y person of puli sttus or ginst person, n institution or ny thing of puli sttus in the requesting Stte, it shll e onsidered in the requested Stte s hving een ommitted y person of puli sttus or ginst suh person, n institution or ny thing orresponding, in the ltter Stte, to tht ginst whih it ws tully ommitted. Artile 8 1 A Contrting Stte my request nother Contrting Stte to tke proeedings in ny one or more of the following ses: if the suspeted person is ordinrily resident in the requested Stte; if the suspeted person is ntionl of the requested Stte or if tht Stte is his Stte of origin; 2

3 d e f g h if the suspeted person is undergoing or is to undergo sentene involving deprivtion of lierty in the requested Stte; if proeedings for the sme or other offenes re eing tken ginst the suspeted person in the requested Stte; if it onsiders tht trnsfer of the proeedings is wrrnted in the interests of rriving t the truth nd in prtiulr tht the most importnt items of evidene re loted in the requested Stte; if it onsiders tht the enforement in the requested Stte of sentene if one were pssed is likely to improve the prospets for the soil rehilittion of the person sentened; if it onsiders tht the presene of the suspeted person nnot e ensured t the hering of proeedings in the requesting Stte nd tht his presene in person t the hering of proeedings in the requested Stte n e ensured; if it onsiders tht it ould not itself enfore sentene if one were pssed, even y hving reourse to extrdition, nd tht the requested Stte ould do so; 2 Where the suspeted person hs een finlly sentened in Contrting Stte, tht Stte my request the trnsfer of proeedings in one or more of the ses referred to in prgrph 1 of this rtile only if it nnot itself enfore the sentene, even y hving reourse to extrdition, nd if the other Contrting Stte does not ept enforement of foreign judgment s mtter of priniple or refuses to enfore suh sentene. Artile 9 1 The ompetent uthorities in the requested Stte shll exmine the request for proeedings mde in pursune of the preeding rtiles. They shll deide, in ordne with their own lw, wht tion to tke thereon. 2 Where the lw of the requested Stte provides for the punishment of the offene y n dministrtive uthority, tht Stte shll, s soon s possile, so inform the requesting Stte unless the requested Stte hs mde delrtion under prgrph 3 of this rtile. 3 Any Contrting Stte my t the time of signture, or when depositing its instrument of rtifition, eptne or ession, or t ny lter dte indite, y delrtion ddressed to the Seretry Generl of the Counil of Europe, the onditions under whih its domesti lw permits the punishment of ertin offenes y n dministrtive uthority. Suh delrtion shll reple the notifition envisged in prgrph 2 of this rtile. Artile 10 The requested Stte shll not tke tion on the request: if the request does not omply with the provisions of Artiles 6, prgrph 1, nd 7, prgrph 1; if the institution of proeedings is ontrry to the provisions of Artile 35; if, t the dte on the request, the time-limit for riminl proeedings hs lredy expired in the requesting Stte under the legisltion of tht Stte. 3

4 Artile 11 Sve s provided for in Artile 10 the requested Stte my not refuse eptne of the request in whole or in prt, exept in ny one or more of the following ses: d e f g h i j k if it onsiders tht the grounds on whih the request is sed under Artile 8 re not justified; if the suspeted person is not ordinrily resident in the requested Stte; if the suspeted person is not ntionl of the requested Stte nd ws not ordinrily resident in the territory of tht Stte t the time of the offene; if it onsiders tht the offene for whih proeedings re requested is n offene of politil nture or purely militry or fisl one; if it onsiders tht there re sustntil grounds for elieving tht the request for proeedings ws motivted y onsidertions of re, religion, ntionlity or politil opinion; if its own lw is lredy pplile to the offene nd if t the time of the reeipt of the request proeedings were preluded y lpse of time ording to tht lw; Artile 26, prgrph 2, shll not pply in suh se; if its ompetene is exlusively grounded on Artile 2 nd if t the time of the reeipt of the request proeedings would e preluded y lpse of time ording to its lw, the prolongtion of the time-limit y six months under the terms of Artile 23 eing tken into onsidertion; if the offene ws ommitted outside the territory of the requesting Stte; if proeedings would e ontrry to the interntionl undertkings of the requested Stte; if proeedings would e ontrry to the fundmentl priniples of the legl system of the requested Stte; if the requesting Stte hs violted rule of proedure lid down in this Convention. Artile 12 1 The requested Stte shll withdrw its eptne of the request if, susequent to this eptne, ground mentioned in Artile 10 of this Convention for not tking tion on the request eomes pprent. 2 The requested Stte my withdrw its eptne of the request: if it eomes pprent tht the presene in person of the suspeted person nnot e ensured t the hering of the proeedings in tht Stte or tht ny sentene, whih might e pssed, ould not e enfored in tht Stte; if one of the grounds for refusl mentioned in Artile 11 eomes pprent efore the se is rought efore ourt; or in other ses, if the requesting Stte grees. 4

5 Setion 2 Trnsfer proedure Artile 13 1 All requests speified in this Convention shll e mde in writing. They, nd ll ommunitions neessry for the pplition of this Convention, shll e sent either y the Ministry of Justie of the requesting Stte to the Ministry of Justie of the requested Stte or, y virtue of speil mutul rrngements, diret y the uthorities of the requesting Stte to those of the requested Stte; they shll e returned y the sme hnnel. 2 In urgent ses, requests nd ommunitions my e sent through the Interntionl Criminl Polie Orgnistion (Interpol). 3 Any Contrting Stte my, y delrtion ddressed to the Seretry Generl of the Counil of Europe, give notie of its intention to dopt in so fr s it itself is onerned rules of trnsmission other thn those lid down in prgrph 1 of this rtile. Artile 14 If Contrting Stte onsiders tht the informtion supplied y nother Contrting Stte is not dequte to enle it to pply this Convention, it shll sk for the neessry dditionl informtion. It my presrie dte for the reeipt of suh informtion. Artile 15 1 A request for proeedings shll e ompnied y the originl, or ertified opy, of the riminl file nd ll other neessry douments. However, if the suspeted person is remnded in ustody in ordne with the provisions of Setion 5 nd if the requesting Stte is unle to trnsmit these douments t the sme time s the request for proeedings, the douments my e sent susequently. 2 The requesting Stte shll lso inform the requested Stte in writing of ny proedurl ts performed or mesures tken in the requesting Stte fter the trnsmission of the request whih hve ering on the proeedings. This ommunition shll e ompnied y ny relevnt douments. Artile 16 1 The requested Stte shll promptly ommunite its deision on the request for proeedings to the requesting Stte. 2 The requested Stte shll lso inform the requesting Stte of wiver of proeedings or of the deision tken s result of proeedings. A ertified opy of ny written deision shll e trnsmitted to the requesting Stte. Artile 17 If the ompetene of the requested Stte is exlusively grounded on Artile 2 tht Stte shll inform the suspeted person of the request for proeedings with view to llowing him to present his views on the mtter efore tht Stte hs tken deision on the request. Artile 18 1 Sujet to prgrph 2 of this rtile, no trnsltion of the douments relting to the pplition of this Convention shll e required. 5

6 2 Any Contrting Stte my, t the time of signture or when depositing its instrument of rtifition, eptne or ession, y delrtion ddressed to the Seretry Generl of the Counil of Europe, reserve the right to require tht, with the exeption of the opy of the written deision referred to in Artile 16, prgrph 2, the sid douments e ompnied y trnsltion. The other Contrting Sttes shll send the trnsltions in either the ntionl lnguge of the reeiving Stte or suh one of the offiil lnguges of the Counil of Europe s the reeiving Stte shll indite. However, suh n indition is not oligtory. The other Contrting Sttes my lim reiproity. 3 This rtile shll e without prejudie to ny provisions onerning trnsltion of requests nd supporting douments tht my e ontined in greements or rrngements now in fore or tht my e onluded etween two or more Contrting Sttes. Artile 19 Douments trnsmitted in pplition of this Convention need not e uthentited. Artile 20 Contrting Prties shll not lim from eh other the refund of ny expenses resulting from the pplition of this Convention. Setion 3 Effets in the requesting Stte of request for proeedings Artile 21 1 When the requesting Stte hs requested proeedings, it n no longer proseute the suspeted person for the offene in respet of whih the proeedings hve een requested or enfore judgment whih hs een pronouned previously in tht Stte ginst him for tht offene. Until the requested Stte's deision on the request for proeedings hs een reeived, the requesting Stte shll, however, retin its right to tke ll steps in respet of proseution, short of ringing the se to tril, or, s the se my e, llowing the ompetent dministrtive uthority to deide on the se. 2 The right of proseution nd of enforement shll revert to the requesting Stte: d e if the requested Stte informs it of deision in ordne with Artile 10 not to tke tion on the request; if the requested Stte informs it of deision in ordne with Artile 11 to refuse eptne of the request; if the requested Stte informs it of deision in ordne with Artile 12 to withdrw eptne of the request; if the requested Stte informs it of deision not to institute proeedings or disontinue them; if it withdrws its request efore the requested Stte hs informed it of deision to tke tion on the request. Artile 22 A request for proeedings, mde in ordne with the provisions of this Prt, shll hve the effet in the requesting Stte of prolonging the time-limit for proeedings y six months. 6

7 Setion 4 Effets in the requested Stte of request for proeedings Artile 23 If the ompetene of the requested Stte is exlusively grounded on Artile 2 the time-limit for proeedings in tht Stte shll e prolonged y six months. Artile 24 1 If proeedings re dependent on omplint in oth Sttes the omplint rought in the requesting Stte shll hve equl vlidity with tht rought in the requested Stte. 2 If omplint is neessry only in the requested Stte, tht Stte my tke proeedings even in the sene of omplint if the person who is empowered to ring the omplint hs not ojeted within period of one month from the dte of reeipt y him of notie from the ompetent uthority informing him of his right to ojet. Artile 25 In the requested Stte the sntion pplile to the offene shll e tht presried y its own lw unless tht lw provides otherwise. Where the ompetene of the requested Stte is exlusively grounded on Artile 2, the sntion pronouned in tht Stte shll not e more severe thn tht provided for in the lw of the requesting Stte. Artile 26 1 Any t with view to proeedings, tken in the requesting Stte in ordne with its lw nd regultions, shll hve the sme vlidity in the requested Stte s if it hd een tken y the uthorities of tht Stte, provided tht ssimiltion does not give suh t greter evidentil weight thn it hs in the requesting Stte. 2 Any t whih interrupts time-limittion nd whih hs een vlidly performed in the requesting Stte shll hve the sme effets in the requested Stte nd vie vers. Setion 5 Provisionl mesures in the requested Stte Artile 27 1 When the requesting Stte nnounes its intention to trnsmit request for proeedings, nd if the ompetene of the requested Stte would e exlusively grounded on Artile 2, the requested Stte my, on pplition y the requesting Stte nd y virtue of this Convention, provisionlly rrest the suspeted person: if the lw of the requested Stte uthorises remnd in ustody for the offene, nd if there re resons to fer tht the suspeted person will sond or tht he will use evidene to e suppressed. 2 The pplition for provisionl rrest shll stte tht there exists wrrnt of rrest or other order hving the sme effet, issued in ordne with the proedure lid down in the lw of the requesting Stte; it shll lso stte for wht offene proeedings will e requested nd when nd where suh offene ws ommitted nd it shll ontin s urte desription of the suspeted person s possile. It shll lso ontin rief sttement of the irumstnes of the se. 7

8 3 An pplition for provisionl rrest shll e sent diret y the uthorities in the requesting Stte mentioned in Artile 13 to the orresponding uthorities in the requested Stte, y post or telegrm or y ny other mens ffording evidene in writing or epted y the requested Stte. The requesting Stte shll e informed without dely of the result of its pplition. Artile 28 Upon reeipt of request for proeedings ompnied y the douments referred to in Artile 15, prgrph 1, the requested Stte shll hve jurisdition to pply ll suh provisionl mesures, inluding remnd in ustody of the suspeted person nd seizure of property, s ould e pplied under its own lw if the offene in respet of whih proeedings re requested hd een ommitted in its territory. Artile 29 1 The provisionl mesures provided in Artiles 27 nd 28 shll e governed y the provisions of this Convention nd the lw of the requested Stte. The lw of tht Stte, or the Convention shll lso determine the onditions on whih the mesures my lpse. 2 These mesures shll lpse in the ses referred to in Artile 21, prgrph 2. 3 A person in ustody shll in ny event e relesed if he is rrested in pursune of Artile 27 nd the requested Stte does not reeive the request for proeedings within 18 dys from the dte of the rrest. 4 A person in ustody shll in ny event e relesed if he is rrested in pursune of Artile 27 nd the douments whih should ompny the request for proeedings hve not een reeived y the requested Stte within 15 dys from the reeipt of the request for proeedings. 5 The period of ustody pplied exlusively y virtue of Artile 27 shll not in ny event exeed 40 dys. Prt IV Plurlity of riminl proeedings Artile 30 1 Any Contrting Stte whih, efore the institution or in the ourse of proeedings for n offene whih it onsiders to e neither of politil nture nor purely militry one, is wre of proeedings pending in nother Contrting Stte ginst the sme person in respet of the sme offene shll onsider whether it n either wive or suspend its own proeedings, or trnsfer them to the other Stte. 2 If it deems it dvisle in the irumstnes not to wive or suspend its own proeedings it shll so notify the other Stte in good time nd in ny event efore judgment is given on the merits. Artile 31 1 In the eventulity referred to in Artile 30, prgrph 2, the Sttes onerned shll endevour s fr s possile to determine, fter evlution in eh of the irumstnes mentioned in Artile 8, whih of them lone shll ontinue to ondut proeedings. During this onsulttive proedure the Sttes onerned shll postpone judgment on the merits without however eing oliged to prolong suh postponement eyond period of 30 dys s from the despth of the notifition provided for in Artile 30, prgrph 2. 2 The provisions of prgrph 1 shll not e inding: 8

9 on the Stte despthing the notifition provided for in Artile 30, prgrph 2, if the min tril hs een delred open there in the presene of the used efore despth of the notifition; on the Stte to whih the notifition is ddressed, if the min tril hs een delred open there in the presene of the used efore reeipt of the notifition. Artile 32 In the interests of rriving t the truth nd with view to the pplition of n pproprite sntion, the Sttes onerned shll exmine whether it is expedient tht one of them lone shll ondut proeedings nd, if so, endevour to determine whih one, when: severl offenes whih re mterilly distint nd whih fll under the riminl lw of eh of those Sttes re sried either to single person or to severl persons hving ted in unison; single offene whih flls under the riminl lw of eh of those Sttes is sried to severl persons hving ted in unison. Artile 33 All deisions rehed in ordne with Artiles 31, prgrph 1, nd 32 shll entil, s etween the Sttes onerned, ll the onsequenes of trnsfer of proeedings s provided for in this Convention. The Stte whih wives its own proeedings shll e deemed to hve trnsferred them to the other Stte. Artile 34 The trnsfer proedure provided for in Setion 2 of Prt III shll pply in so fr s its provisions re omptile with those ontined in the present Prt. Prt V Ne is in idem Artile 35 1 A person in respet of whom finl nd enforele riminl judgment hs een rendered my for the sme t neither e proseuted nor sentened nor sujeted to enforement of sntion in nother Contrting Stte: if he ws quitted; if the sntion imposed: i ii iii hs een ompletely enfored or is eing enfored, or hs een wholly, or with respet to the prt not enfored, the sujet of prdon or n mnesty, or n no longer e enfored euse of lpse of time; if the ourt onvited the offender without imposing sntion. 9

10 2 Nevertheless, Contrting Stte shll not, unless it hs itself requested the proeedings, e oliged to reognise the effet of ne is in idem if the t whih gve rise to the judgment ws direted ginst either person or n institution or ny thing hving puli sttus in tht Stte, or if the sujet of the judgment hd himself puli sttus in tht Stte. 3 Furthermore, Contrting Stte where the t ws ommitted or onsidered s suh ording to the lw of tht Stte shll not e oliged to reognise the effet of ne is in idem unless tht Stte hs itself requested the proeedings. Artile 36 If new proeedings re instituted ginst person who in nother Contrting Stte hs een sentened for the sme t, then ny period of deprivtion of lierty rising from the sentene enfored shll e deduted from the sntion whih my e imposed. Artile 37 This Prt shll not prevent the pplition of wider domesti provisions relting to the effet of ne is in idem tthed to foreign riminl judgments. Prt VI Finl luses Artile 38 1 This Convention shll e open to signture y the memer Sttes of the Counil of Europe. It shll e sujet to rtifition or eptne. Instruments of rtifition or eptne shll e deposited with the Seretry Generl of the Counil of Europe. 2 This Convention shll enter into fore three months fter the dte of the deposit of the third instrument of rtifition or eptne. 3 In respet of signtory Stte rtifying or epting susequently, the Convention shll ome into fore three months fter the dte of the deposit of its instrument of rtifition or eptne. Artile 39 1 After the entry into fore of this Convention, the Committee of Ministers of the Counil of Europe my invite ny non-memer Stte to ede thereto provided tht the resolution ontining suh invittion reeived the unnimous greement of the Memers of the Counil who hve rtified the Convention. 2 Suh ession shll e effeted y depositing with the Seretry Generl of the Counil of Europe n instrument of ession whih shll tke effet three months fter the dte of its deposit. Artile 40 1 Any Contrting Stte my, t the time of signture or when depositing its instrument of rtifition, eptne or ession, speify the territory or territories to whih this Convention shll pply. 10

11 2 Any Contrting Stte my, when depositing its instrument of rtifition, eptne or ession or t ny lter dte, y delrtion ddressed to the Seretry Generl of the Counil of Europe, extend this Convention to ny other territory or territories speified in the delrtion nd for whose interntionl reltions it is responsile or on whose ehlf it is uthorised to give undertkings. 3 Any delrtion mde in pursune of the preeding prgrph my, in respet of ny territory mentioned in suh delrtion, e withdrwn ording to the proedure lid down in Artile 45 of this Convention. Artile 41 1 Any Contrting Stte my, t the time of signture or when depositing its instrument of rtifition, eptne or ession, delre tht it vils itself of one or more of the reservtions provided for in Appendix I or mke delrtion provided for in Appendix II to this Convention. 2 Any Contrting Stte my wholly or prtly withdrw reservtion or delrtion it hs mde in ordne with the foregoing prgrph y mens of delrtion ddressed to the Seretry Generl of the Counil of Europe whih shll eome effetive s from the dte of its reeipt. 3 A Contrting Stte whih hs mde reservtion in respet of ny provision of this Convention my not lim the pplition of tht provision y ny other Contrting Stte; it my, however, if its reservtion is prtil or onditionl, lim the pplition of tht provision in so fr s it hs itself epted it. Artile 42 1 Any Contrting Stte my t ny time, y delrtion ddressed to the Seretry Generl of the Counil of Europe, set out the legl provisions to e inluded in Appendix III to this Convention. 2 Any hnge of the ntionl provisions listed in Appendix III shll e notified to the Seretry Generl of the Counil of Europe if suh hnge renders the informtion in this ppendix inorret. 3 Any hnges mde in Appendix III in pplition of the preeding prgrphs shll tke effet in eh Contrting Stte one month fter the dte of their notifition y the Seretry Generl of the Counil of Europe. Artile 43 1 This Convention ffets neither the rights nd the undertkings derived from extrdition treties nd interntionl multilterl onventions onerning speil mtters, nor provisions onerning mtters whih re delt with in the present Convention nd whih re ontined in other existing onventions etween Contrting Sttes. 2 The Contrting Sttes my not onlude ilterl or multilterl greements with one nother on the mtters delt with in this Convention, exept in order to supplement its provisions or filitte pplition of the priniples emodied in it. 3 Should two or more Contrting Sttes, however, hve lredy estlished their reltions in this mtter on the sis of uniform legisltion, or instituted speil system of their own, or should they in future do so, they shll e entitled to regulte those reltions ordingly, notwithstnding the terms of this Convention. 11

12 4 Contrting Sttes esing to pply the terms of this Convention to their mutul reltions in this mtter in ordne with the provisions of the preeding prgrph shll notify the Seretry Generl of the Counil of Europe to tht effet. Artile 44 The Europen Committee on Crime Prolems of the Counil of Europe shll e kept informed regrding the pplition of this Convention nd shll do whtever is needful to filitte friendly settlement of ny diffiulty whih my rise out of its exeution. Artile 45 1 This Convention shll remin in fore indefinitely. 2 Any Contrting Stte my, in so fr s it is onerned, denoune this Convention y mens of notifition ddressed to the Seretry Generl of the Counil of Europe. Suh denunition shll tke effet six months fter the dte of reeipt y the Seretry Generl of suh notifition. Artile 46 The Seretry Generl of the Counil of Europe shll notify the memer Sttes of the Counil nd ny Stte whih hs eded to this Convention of: ny signture; ny deposit of n instrument of rtifition, eptne or ession; ny dte of entry into fore of this Convention in ordne with Artile 38 thereof; d ny delrtion reeived in pursune of the provisions of Artile 9, prgrph 3; e ny delrtion reeived in pursune of the provisions of Artile 13, prgrph 3; f ny delrtion reeived in pursune of the provisions of Artile 18, prgrph 2; g ny delrtion reeived in pursune of the provisions of Artile 40, prgrphs 2 nd 3; h ny reservtion or delrtion mde in pursune of the provisions of Artile 41, prgrph 1; i j the withdrwl of ny reservtion or delrtion rried out in pursune of the provisions of Artile 41, prgrph 2; ny delrtion reeived in pursune of Artile 42, prgrph 1, nd ny susequent notifition reeived in pursune of prgrph 2 of tht rtile; k ny notifition reeived in pursune of the provisions of Artile 43, prgrph 4; l ny notifition reeived in pursune of the provisions of Artile 45 nd the dte on whih denunition tkes effet. 12

13 Artile 47 This Convention nd the notifitions nd delrtions uthorised thereunder shll pply only to offenes ommitted fter the Convention omes into effet for the Contrting Sttes involved.
