The tender notice shall form a part of the contractor agreement. The tenders are invited on the Departmental design only. The tender if firm or company, shall in their forwarding letter mention the names of all the partners of the firm or company ( as the case may be ) and the name of the partner who holds the power of attorney if any, authorizing him to conduct transaction on behalf of the firm or company. Right reserved to revise or amend the contractor documents fully or partly there of prior to the date notified or amended for the receipt of tender. Such deviations / amendments if shall be communicated in the form of corrigendum or by a letter as may be considered suitable. 2) Issue of Blank tender forms. Blank tender forms will be available on M.M.C. website address mmc.maharashtra.etenders.in, on date & time prescribed above.form Fee D.D. to be deposited along with the tender, should be in the shape of D.D. of Nationalised or Scheduled Bank. The Tender Form Money in the form cheque or any other form, other than prescribed above will not be accepted.tender forms shall not be sent by post or courier in any case. 2.1 Earnest Money. Earnest Money to be deposited along with the tender, should be in the shape of D.D. of Nationalised or Scheduled Bank. The Earnest Money in the form cheque or any other form, other than prescribed above will not be accepted. 2.2 Tender of those who do not deposit earnest money in the above acceptable forms shall be summerilly rejected. 3) Security Deposit & Retention Money:

6 5 % Security Deposit will be deducted from the R.A.Bill, If the bill of the work will be 1 st & final the Security Deposit 10% will be deducted. Retention money will be deducted 5 % from the each R.A. bill. 4) Right Reserved Right is reserved to reject any or all tenders without assigning any reason thereof. 5) Place and date of submission of tender Tender shall be accepted on website address of M.M.C. mmc.maharashtra.etenders.in, at above prescribed date & time. 6) Manner of Submmision & Its accompaniments. Offer to be submitted in two separate sealed envelopes of Commercial and Technical bid. B) FOR Commercial Bid : The second envelope clearly marked as Envelope No. 2 and name of work shall contain only the main, tender documents including the common sets of conditions / stipulations issued by the Corporation. A tender submitted without this would be considered as invalid. The tenderer should quote his offer on B-1 form as percentage rates at the appropriate place of tender documents, to be submitted only in Envelope No.2. The Contactor shall quote for the work as per details given in the main tender and also based on the details of condition issued / additional stipulations made by the corporation. The tender shall be unconditional doubts if any shall be got clarified by the tenders from the Corporation. In case the Corporation finds such design or assumptions unacceptable offer for such design in the Envelope No. 2 shall not be considered by the Corporation. The contactor should note this procedure carefully,. He should quote his offer in words & figures on the given place for the offer. He should not quote this basic cost offer anywhere directly or indirectly on Envelope No. 1 or 3, if any such mention is made, the tender will become invalid and will not be considered. C) Submission of the Tender The two sealed envelope No. 1 & 2 shall be again put together in one common cover, shall be marked the name of work and full name with address of the tenderer. The tenderer should ensure that their tender is submitted to the right place of website address of M.M.C. mmc.maharashtra.etenders.in, ( as mentioned earlier ) before the expiry date and time. No delay on account of any cause, will be entertained for the late receipt of the tender. Tender offer is received after the date & time is over, will either not be accepted or if inadvertently accepted will not be opened and shall be returned to the tenderer unopened. The tender should not be submitted through post. D) Opening of the Tender Following procedure will be adopted for opening of the tender. First of all Envelope No.1 of the tenderer will be opened to verify its contents as per as per requirements.lf the various documents contained in this envelope do not meet the requirements of the Corporation a note will be recorded accordingly by the tender opening authority and the said tendering Envelope No. 2 will not be considered for further action but the same will be recorde

7 Envelope No.2 This Envelope shall be opened after opening envelope No. 1 only, if the contents of envelope No.1 are found to be acceptable to the department, and there are not assumption, presumption or any conditions from any of the contractor. The tendered rates in schedule B as percentage above / below the estimated rates put to tender shall then be read out. Right to reject any or all tenders without assigning any reason thereof is reserved by the competent authority Commissioner, Malegaon Municipal Corporation. 7) Rejection of Offer The offer which does not fulfill any of the condition of the notified requirement of the direction & Guidelines laid down by the MMC or are incomplete tender document in any respect are likely to be rejected without assigning any reason thereof. 8) Acceptance of Tender : Right to reject any or all tenders without assigning any reason thereof is reserved by the competent authority, whose decision will be final and legally binding on the tenderers. 9) Other Conditions : I) The offer should remain valid for 150 days from the opening of tenders. ii) The notes and conditions stipulated in this notice will form a part of the agreement. iii) The tenderer whose tender is accepted will have to an undertaking in writing to the effect that he/they will pay the labours engaged on the work the wages as per minimum wages Act 1948 applied to the zone in which the work lies and act accordingly. iv) The tenderers shall be presumed to have carefully examined the drawings, conditions and specifications of work and to have fully acquainted themselves with all details of site locations communications materials and labour conditions, water supply position and any other general information data etc. pertaining to and needed for the work. v) All pages of the tender documents conditions, specifications of Schedule A, Schedule B an drawing etc. shall be initiated at the lower and where space provided for, by the tender before submission of the tender. vi Contractor shall give a tentative program of work along with his offer within specified time schedule. Vii Agency should specifically note the following. a) His offer should be inclusive of all duties and taxes, (C.S.T. M.S.T. Excise) payable by him as on the date of submitting tenders. b) He will have to make his own arrangement to obtain and make payments and deposits if anyfor water and electricity etc. required for construction purpose from the authorities concerned including required by him for testing purpose. Corporation does not undertake to pay any of such charges against water & electricity etc. Viii The contractor shall either himself supervise the execution of the works or shall appoint qualified engineer to act on behalf. If in the opinion of the Engineer in charge the contractor has himself no sufficient knowledge and experience of receiving technical instructions or can not give his full attention to the work, the Contractor shall at his own expense employ a full time qualified Engineer specifically for the work.if any necessary part, item or type of work required to be executed or to be deleted in this Tender document by human mistake, the contractor / tenderer shall be strictly bound for execution for such type of work/job, which is the part and parcel of the tender. Ix Agency to inform himself fully. The agency shall be deemed to have fully acquainted himself with the work & site condition and carefully examined the special conditions, the specification mentioned by Govt. from time to time for the said work, and shall be deemed to have fully informed himself regarding the local conditions, and various prevailing laws at the time beings. 11) Earnest Money & Security Deposit. There shall be no liability on the Department to pay any interest on the Earnest Money Security Deposited by or recovered from the contractor.the amount of deposit will be refunded after completion of the defect liability prescribed for this contract. NOTICE TO CONTRACTOR Sr No Detail 1 The tenderer must obtain from himself, on his own responsibility and at his own expenses, all the information which may be necessary for the purpose of filling this render and for entering into a contract for the execution of the same and must examine the drawings and inspect the site of the work and acquaint himself with all local conditions and matters prevailing thereto. 2 Each of the tender documents is required to be signed by the person or the persons submitting the tender in token of his / their having acquainted himself/ themselves with the special conditions, conditions of contract etc. as laid down. Any tender with any of the documents not so signed will be rejected. 3 The form must be filled in English and all the entries must be hand written in ink. If any of the documents are missing or not signed, the tender shall be considered invalid. 4 Neither erasures not over writings shall be made in the price schedule or anywhere in the tender documents. Every correction shall be made by crossing the pen across the incorrect or un required position and writing the correct or required portion above. Any correction shall bear the dated initials of the tenderer. 5 The intending tenderer shall deposit the Earnest Money, as a guarantee of a good faith which event of any waive, refusal or delay in signing the contract. The deposit of the unsuccessful tenderer will be returned after a decision is taken regarding the award of the contract. (after issuing the work order to the successful tenderer.) 6 The Security Deposit 5 % of the estimated cost will be deducted through the bill, in addition to this 5 % retention money will be deducted through each R.A. bill. If the bill will be recorded in 15` & final mode the security Deposit will be deducted 10 % through bill. 7 Within seven days of the receipt of intimation from the Employer of the acceptance of his / their tender the successful tenderer shall be bound to enter the contract by signing an agreement and conditions of the contract attached herewith, in the written acceptance by the employer the tender will constitute a binding agreement between Employer and the person so tendering whether such formal contract is or not subsequently entered into. 8 All compensation or other sum of money payable by the contractor to Malegaon Municipal Corporation, Malegaon under the terms of contract may be deducted from the deposit or from any sum or sums that may be or may become due the contractor on any account whatever and in the event of the deposit, being reduced by the reason of any such deductions the contactor shall, within fifteen days of being asked to do so, may deposit in cash any sum or sums which may have been deducted from his deposit. 9 Malegaon Municipal Corporation is not concerned with any rise or fall in prices of any materials. The rate quoted shall include all cost, allowances, tax or any other charges including any enhanced labour rates etc. which may be enacted from time to time by the State or Central Government under no circumstances. 10 The rate quoted by contractor shall include all eventualities such as heavy rain, sudden floodsetc. which cause damage to the executed work or which may totally wash out the work. Until the completion certificate is issued to the contractor. Malegaon Municipal Corporation will not be responsible for such damage or wash out of the construction work. 11 This essence of the contract. The work should be completed within prescribed time period.if the work is not completed within prescribed time period a fine under follwing rates would be imposedthe contractor will have to give a time schedule of various items of work to be done so thatthe works gets completed within stipulated time.

The work actually carried out and done will be measured from time to time for which payment will be made subject to the terms and conditions of the contract., 14 M.M.C.Malegaon do not bind themselves to accept the lowest or any tender and reservethemselves the right to accept or reject any or all tenders in whole or in part, withoutassigning any reason for doing so. 15 For Hot mix Hot laid road works the contractor should produce the proof of plant & machinery having MOST certification, & below the work of Rs. 50 lakhs the agreement with the Plant owner of each work separately will be acceptable. GENERAL CONDITION 01 Unless otherwise specifically provided for either in tender items or in specifications or in the schedule of the supply of materials, all items in the tender are inclusive of cost of all materials required for the execution of the items and these, as are provided as per the relevant ISI (Latest revision) or standard specifications. 02 All the materials used in the work shall be best quality and any materials rejected shall be removed from the site within 24 hours. 03 All other rules regarding workmen's compensation, etc. shall be binding on the contractor. 04 All items to be executed in the course of the work have to be executed by the contractor as per specification in the P.W.D.handbooks, the books of standard specifications, published by the Public Works Board of Government of Maharashtra, relevant LS. Specifications, latest editions and practice in vogue, at the rates as per rules of the board and condition of agreement in this respect. The contractor shall be responsible and liable to pay for damage to public property caused by him.he should keep the account of such materials in suitable book which would have available for inspection to the Engineer in charge. The contractor shall be responsible for proper handling and safe custody of all materials delivered by him for use on work. 05 For all accident on the contracted works the contractor shall be responsible to pay the compensation to the suffer or his legal depends as per the legal Compensation Act in force. 06 The contractor shall engage an authorized agent or an experienced qualified supervisor for the work capable of managing guiding the work on his behalf. He shall take such orders as may be given to him by the Engineer in charge from time to time and shall be responsible to carry them out promptly. 07 A work order book shall be maintained at work site. The contractor shall sign the order given by the Engineer in charge and shall carry them promptly. After completion of the work, the work order book shall be surrender to the concerned Engineer in charge. 08 Quantities given in the tender_are approximate and are liable for variation. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. The contractor shall also comply with all requirements of the Health Department in regard to anti malaria. 10 All items occurring in the work and as found necessary in actual execution shall be carried out in workmanship like manner as per the current specifications prevalent in as per orders of the Engineer in charge, as stated above. 11 It is clearly understood that the conditions of the contract and specifications are intended to be rigidly enforce and no relaxation on the ground of conditions prevailing is to be allowed. 12 The contractor will be entirely responsible for breach of the contract of laws of local bodies, Government etc.while using private or public conveyance procuring and stacking materials. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but without any guarantee about it.

11 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but

25 without any guarantee about it. 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. NOTICE TO CONTRACTOR Sr No Detail 1 The tenderer must obtain from himself, on his own responsibility and at his own expenses, all the information which may be necessary for the purpose of filling this render and for entering into a contract for the execution of the same and must examine the drawings and inspect the site of the work and acquaint himself with all local conditions and matters prevailing thereto. 2 Each of the tender documents is required to be signed by the person or the persons submitting the tender in token of his / their having acquainted himself/ themselves with the special conditions, conditions of contract etc. as laid down. GENERAL CONDITION 01 Unless otherwise specifically provided for either in tender items or in specifications or in the schedule of the supply of materials, all items in the tender are inclusive of cost of all materials required for the execution of the items and these, as are provided as per the relevant ISI (Latest revision) or standard specifications. 02 All the materials used in the work shall be best quality and any materials rejected shall be removed from the site within 24 hours. 03 All other rules regarding workmen's compensation, etc. shall be binding on the contractor. 04 All items to be executed in the course of the work have to be executed by the contractor as per specification in the P.W.D.handbooks, the books of standard specifications, published by the Public Works Board of Government of Maharashtra, relevant LS. Specifications, latest editions and practice in vogue, at the rates as per rules of the board and condition of agreement in this respect. The contractor shall be responsible and liable to pay for damage to public property caused by him.he should keep the account of such materials in suitable book which would have available for inspection to the Engineer in charge. The contractor shall be responsible for proper handling and safe custody of all materials delivered by him for use on work. 05 For all accident on the contracted works the contractor shall be responsible to pay the compensation to the suffer or his legal depends as per the legal Compensation Act in force. 06 The contractor shall engage an authorized agent or an experienced qualified supervisor for the work capable of managing guiding the work on his behalf. He shall take such orders as may be given to him by the Engineer in charge from time to time and shall be responsible to carry them out promptly. 07 A work order book shall be maintained at work site. The contractor shall sign the order given by the Engineer in charge and shall carry them promptly. After completion of the work, the work order book shall be surrender to the concerned Engineer in charge. 08 Quantities given in the tender_are approximate and are liable for variation. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. The contractor shall also comply with all requirements of the Health Department in regard to anti malaria. 10 All items occurring in the work and as found necessary in actual execution shall be carried out in workmanship like manner as per the current specifications prevalent in as per orders of the Engineer in charge, as stated above. 11 It is clearly understood that the conditions of the contract and specifications are intended to be rigidly enforce and no relaxation on the ground of conditions prevailing is to be allowed. 12 The contractor will be entirely responsible for breach of the contract of laws of local bodies, Government etc.while using private or public conveyance procuring and stacking materials. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but without any guarantee about it.

40 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. Once a tender is submitted, the matter will be decided according to.the tender conditions in the absence of such authentic pre-clarification. 18 The contractor shall indemnity the Government against all actions, suits, claims and demands brought or made against him in respect of any thing done or committed to be done by the contractor in execution of or in connection with the work of his contact and against any loss or damage to the Government in consequence of any action or suit being brought against the contractor for any done or committed to be done in the execution of work of this contract. 19 Escalations of Price variation shall not be paid under this contract. 20 Arbitration clause is not included in the tender. GENERAL CONDITION 01 Unless otherwise specifically provided for either in tender items or in specifications or in the schedule of the supply of materials, all items in the tender are inclusive of cost of all materials required for the execution of the items and these, as are provided as per the relevant ISI (Latest revision) or standard specifications. 02 All the materials used in the work shall be best quality and any materials rejected shall be removed from the site within 24 hours. 03 All other rules regarding workmen's compensation, etc. shall be binding on the contractor. 04 All items to be executed in the course of the work have to be executed by the contractor as per specification in the P.W.D.handbooks, the books of standard specifications, published by the Public Works Board of Government of Maharashtra, relevant LS. Specifications, latest editions and practice in vogue, at the rates as per rules of the board and condition of agreement in this respect. The contractor shall be responsible and liable to pay for damage to public property caused by him.he should keep the account of such materials in suitable book which would have available for inspection to the Engineer in charge. The contractor shall be responsible for proper handling and safe custody of all materials delivered by him for use on

53 work. 05 For all accident on the contracted works the contractor shall be responsible to pay the compensation to the suffer or his legal depends as per the legal Compensation Act in force. 06 The contractor shall engage an authorized agent or an experienced qualified supervisor for the work capable of managing guiding the work on his behalf. He shall take such orders as may be given to him by the Engineer in charge from time to time and shall be responsible to carry them out promptly. 07 A work order book shall be maintained at work site. The contractor shall sign the order given by the Engineer in charge and shall carry them promptly. After completion of the work, the work order book shall be surrender to the concerned Engineer in charge. 08 Quantities given in the tender_are approximate and are liable for variation. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. The contractor shall also comply with all requirements of the Health Department in regard to anti malaria. 10 All items occurring in the work and as found necessary in actual execution shall be carried out in workmanship like manner as per the current specifications prevalent in as per orders of the Engineer in charge, as stated above. 11 It is clearly understood that the conditions of the contract and specifications are intended to be rigidly enforce and no relaxation on the ground of conditions prevailing is to be allowed. 12 The contractor will be entirely responsible for breach of the contract of laws of local bodies, Government etc.while using private or public conveyance procuring and stacking materials. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but without any guarantee about it. 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. Once a tender is submitted, the matter will be decided according to.the tender conditions in the absence of such authentic pre-clarification. 18 The contractor shall indemnity the Government against all actions, suits, claims and demands brought or made against him in respect of any thing done or committed to be done by the contractor in execution of or in connection with the work of his contact and against any loss or damage to the Government in consequence of any action or suit being brought against the contractor for any done or committed to be done in the execution of work of this contract. 19 Escalations of Price variation shall not be paid under this contract. 20 Arbitration clause is not included in the tender. Disputes (if any) arisen out of contract is subject to jurisdiction of Civil Court of Malegoan only. NOTICE TO CONTRACTOR Sr No Detail 1 The tenderer must obtain from himself, on his own responsibility and at his own expenses, all the information which may be necessary for the purpose of filling this render and for entering into a contract for the execution of the same and must examine the drawings and inspect the site of the work and acquaint himself with all local conditions and matters prevailing thereto. 2 Each of the tender documents is required to be signed by the person or the persons submitting the tender in token of his / their having acquainted himself/ themselves with the special conditions, conditions of contract etc. as laid down. GENERAL CONDITION 01 Unless otherwise specifically provided for either in tender items or in specifications or in the schedule of the supply of materials, all items in the tender are inclusive of cost of all materials required for the execution of the items and these, as are provided as per the relevant ISI (Latest revision) or standard specifications. 02 All the materials used in the work shall be best quality and any materials rejected shall be removed from the site within 24 hours. 03 All other rules regarding workmen's compensation, etc. shall be binding on the contractor. 04 All items to be executed in the course of the work have to be executed by the contractor as per specification in the P.W.D.handbooks, the books of standard specifications, published by the Public Works Board of Government of Maharashtra, relevant LS. Specifications, latest editions and practice in vogue, at the rates as per rules of the board and condition of agreement in this respect. The contractor shall be responsible and liable to pay for damage to public property caused by him.he should keep the account of such materials in suitable book which would have available for inspection to the Engineer in charge. The contractor shall be responsible for proper handling and safe custody of all materials delivered by him for use on work. 05 For all accident on the contracted works the contractor shall be responsible to pay the compensation to the suffer or his legal depends as per the legal Compensation Act in force. 06 The contractor shall engage an authorized agent or an experienced qualified supervisor for the work capable of managing guiding the work on his behalf. He shall take such orders as may be given to him by the Engineer in charge from time to time and shall be responsible to carry them out promptly.

81 07 A work order book shall be maintained at work site. The contractor shall sign the order given by the Engineer in charge and shall carry them promptly. After completion of the work, the work order book shall be surrender to the concerned Engineer in charge. 08 Quantities given in the tender_are approximate and are liable for variation. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. The contractor shall also comply with all requirements of the Health Department in regard to anti malaria. 10 All items occurring in the work and as found necessary in actual execution shall be carried out in workmanship like manner as per the current specifications prevalent in as per orders of the Engineer in charge, as stated above. 11 It is clearly understood that the conditions of the contract and specifications are intended to be rigidly enforce and no relaxation on the ground of conditions prevailing is to be allowed. 12 The contractor will be entirely responsible for breach of the contract of laws of local bodies, Government etc.while using private or public conveyance procuring and stacking materials. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but without any guarantee about it. 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. Once a tender is submitted, the matter will be decided according to.the tender conditions in the absence of such authentic pre-clarification. 18 The contractor shall indemnity the Government against all actions, suits, claims and demands brought or made against him in respect of any thing done or committed to be done by the contractor in execution of or in connection with the work of his contact and against any loss or damage to the Government in consequence of any action or suit being brought against the contractor for any done or committed to be done in the execution of work of this contract. 19 Escalations of Price variation shall not be paid under this contract. 20 Arbitration clause is not included in the tender. Disputes (if any) arisen out of contract is subject to jurisdiction of Civil Court of Malegoan only. The Contactor shall quote for the work as per details given in the main tender and also based on the details of condition issued / additional stipulations made by the corporation. The tender shall be unconditional doubts if any shall be got clarified by the tenders from the Corporation. In case the Corporation finds such design or assumptions unacceptable offer for such design in the Envelope No. 2 shall not be considered by the Corporation. The contactor should note this procedure carefully,. He should quote his offer in words & figures on the given place for the offer. He should not quote this basic cost offer anywhere directly or indirectly on Envelope No. 1 or 3, if any such mention is made, the tender will become invalid and will not be considered. If the bill will be recorded in 15` & final mode the security Deposit will be deducted 10 % through bill. 7 Within seven days of the receipt of intimation from the Employer of the acceptance of his / their tender the successful tenderer shall be bound to enter the contract by signing an agreement and conditions of the contract attached herewith, in the written acceptance by the employer the tender will constitute a binding agreement between Employer and the person so tendering whether such formal contract is or not subsequently entered into. 8 All compensation or other sum of money payable by the contractor to Malegaon Municipal Corporation, Malegaon under the terms of contract may be deducted from the deposit or from any sum or sums that may be or may become due the contractor on any account whatever and in the event of the deposit, being reduced by the reason of any such deductions the contactor shall, within fifteen days of being asked to do so, may deposit in cash any sum or sums which may have been deducted from his deposit. 9 Malegaon Municipal Corporation is not concerned with any rise or fall in prices of any materials. The rate quoted shall include all cost, allowances, tax or any other charges including any enhanced labour rates etc. which may be enacted from time to time by the State or Central Government under no circumstances. 10 The rate quoted by contractor shall include all eventualities such as heavy rain, sudden floodsetc. which cause damage to the executed work or which may totally wash out the work. Until the completion certificate is issued to the contractor. Malegaon Municipal Corporation will not be responsible for such damage or wash out of the construction work. 11 This essence of the contract. The work should be completed within prescribed time period.if the work is not completed within prescribed time period a fine under follwing rates would be imposed

The work actually carried out and done will be measured from time to time for which payment will be made subject to the terms and conditions of the contract., 14 M.M.C.Malegaon do not bind themselves to accept the lowest or any tender and reservethemselves the right to accept or reject any or all tenders in whole or in part, withoutassigning any reason for doing so. 15 For Hot mix Hot laid road works the contractor should produce the proof of plant & machinery having MOST certification, & below the work of Rs. 50 lakhs the agreement with the Plant owner of each work separately will be acceptable. And the plant distance from the work is as per the Govt. norm. 16 1% cess against the estimate value will be deducted from I st R.A. and final bill. Contractor Dy. Engineer City Engineer MALEGAON MUNICIPAL CORPORATION, MALEGAON Public Works Branch. GENERAL CONDITION 01 Unless otherwise specifically provided for either in tender items or in specifications or in the schedule of the supply of materials, all items in the tender are inclusive of cost of all materials required for the execution of the items and these, as are provided as per the relevant ISI (Latest revision) or standard specifications. 02 All the materials used in the work shall be best quality and any materials rejected shall be removed from the site within 24 hours. 03 All other rules regarding workmen's compensation, etc. shall be binding on the contractor. 04 All items to be executed in the course of the work have to be executed by the contractor as per specification in the P.W.D.handbooks, the books of standard specifications, published by the Public Works Board of Government of Maharashtra, relevant LS. Specifications, latest editions and practice in vogue, at the rates as per rules of the board and condition of agreement in this respect. The contractor shall be responsible and liable to pay for damage to public property caused by him.he should keep the account of such materials in suitable book which would have available for inspection to the Engineer in charge. The contractor shall be responsible for proper handling and safe custody of all materials delivered by him for use on work. 05 For all accident on the contracted works the contractor shall be responsible to pay the compensation to the suffer or his legal depends as per the legal Compensation Act in force. 06 The contractor shall engage an authorized agent or an experienced qualified supervisor for the work capable of managing guiding the work on his behalf. He shall take such orders as may be given to him by the Engineer in charge from time to time and shall be responsible to carry them out promptly.

94 07 A work order book shall be maintained at work site. The contractor shall sign the order given by the Engineer in charge and shall carry them promptly. After completion of the work, the work order book shall be surrender to the concerned Engineer in charge. 08 Quantities given in the tender_are approximate and are liable for variation. Excavation of the trenches will be according to actual strata met with. The contractor shall have no claim for compensation on account any variation in the quantities and also for any variation in the depth for trenches shown in the drawings. 09 The contactor shall at his own expenses make all necessary arrangement for water supply and sanitary & light arrangements for his employees and shall pay direct to the authorities concerned all taxes and other charges. The contractor shall also comply with all requirements of the Health Department in regard to anti malaria. 10 All items occurring in the work and as found necessary in actual execution shall be carried out in workmanship like manner as per the current specifications prevalent in as per orders of the Engineer in charge, as stated above. 11 It is clearly understood that the conditions of the contract and specifications are intended to be rigidly enforce and no relaxation on the ground of conditions prevailing is to be allowed. 12 The contractor will be entirely responsible for breach of the contract of laws of local bodies, Government etc.while using private or public conveyance procuring and stacking materials. Employment of labour etc.and he will meet out all expense in this contact without any claim whatsoever on the MMC and the MMC shall not take any responsibility on this account. 13 Before entering any property, plot, land, premises or area etc. the contractor shall make his own independent investigation through the Collector or Inspector Land records etc. on his own, and will be liable for action for act of encroachment, trespass etc. committed by him or his labour or for the steps taken by the party concerned. 14 The contractor shall have to clear the site of work before the commencement of work and till the completion of the work without any extra cost the contractor shall arrange a temporary shed at his cost. The MMC shall not pay any rent charges for the shed and no Departments materials will be issued by the MMC for this shed. 15 The (Emd +SD)Deposited amount for the work lodged by the contractor shall be refunded after expiry of guarantee period. And will not bear interest 16 The contractor shall deemed to have carefully examined the work and site conditions including labour, conditions, specifications, schedules and drawings and shall be deemed to have visited the site of the work and have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. In this regard, he will be given necessary information to the best of knowledge of Department but without any guarantee about it. 17 If he shall have any doubt as to the meaning of any portion of conditions, scope of work, specifications, and drawings or any other matter concerning the contact, he shall in good time, before submitting his tender, set forth the particulars thereof and submit them to the City Engineer in writing in order that such doubts may be clarified authoritatively before tendering. Once a tender is submitted, the matter will be decided according to.the tender conditions in the absence of such authentic pre-clarification. 18 The contractor shall indemnity the Government against all actions, suits, claims and demands brought or made against him in respect of any thing done or committed to be done by the contractor in execution of or in connection with the work of his contact and against any loss or damage to the Government in consequence of any action or suit being brought against the contractor for any done or committed to be done in the execution of work of this contract. 19 Escalations of Price variation shall not be paid under this contract. 20 Arbitration clause is not included in the tender. Disputes (if any) arisen out of contract is subject to jurisdiction of Civil Court of Malegoan only. In any case the Commissioner decision is final & binding. 21 The quoted rates shall be total rate for completed item of works as per the specifications, andshall be inclusive of all incidental charges such as lifts, leads for materials, water for construction etc. 22 The sign board of work inclusive of all details should be installed on the site by the Contractor. 23 The photographs should be taken before and after the work & will be kept in record. 24 The testing report of the materials used, should be taken from Govt. polytechnic Vegilance Branch or as directed by the Engineer. 25 The defect liability period will be 12 months from the Virtual completion of work or as per the requirements of any specified item. 26 He works should be completed in stipulated period.
