( A GOVERNMENT OF INDIA UNDERTAKING MINIRATNA COMPANY) REGIONAL OFFICE : PUNE No. No.Prodn.(Storage)/NSC-PNA/ Dated : TENDER FOR HIRING GODOWN AT JALGAON FOR STORAGE OF SEEDS NSC desires to hire the godown for storage of seeds at Jalgaon from the reputed godown owners herein after called as Tendere in two bid system. Offer may be quoted in enclosed proforma for storage of seeds as per the following terms and conditions: Two Bid Systems: Two independent sealed envelopes should be prepared as per details given below: 1) ENVELOP NO.1 (TECHNICAL BID SEALED) This envelop should be marked as ENVELOP NO.I TECHNICAL BID FOR storage of seeds and should contain the following documents along with covering letter on letter head (Tenderer should invariably mention their name, address etc. on left hand side of envelop for clear identification). The tenderer should submit the following documents along with tender: a) Partnership Deed / Ownership proof b) Copy of the Registration of godowns. c) Copy of GST Registration certificate d) Copy of PAN Card e) Godown insurance details f) Bank Details. g) Copy of the shop Act License h) As a token of acceptance a signed & stamped copy of our terms & conditions 2) ENVELOP NO. 2 (FINANCIAL BID SEALED) THIS ENVELOP SHOULD BE MARKED as ENVELOP NO. 2 FINANCIAL BID FOR storage of Seed. Tenderer should invariably mention their name address etc. on left hand side of envelope for clear identification. 3) Both the envelops should be enclosed in one big sealed envelope super scribing TENDERS for storage of seeds. The sealed tender should reach to the office of Regional Manager, National Seeds Corporation Ltd Pune on or before up to PM. The Technical & Financial Bids will be opened on the same day i.e. on at p.m. Tenderer must affix seal and put address on each envelop.

3 TERMS AND CONDITIONS 1) Godown should be situated near to Jalgaon preferably MIDC area having sufficient storage space for storing 20,000 Qtls. Soyabean / Gram seed for a period of 11 months. Tender should be submitted in the enclosed tender form. 2) Rate shall be quoted in Rs..per month plus GST as applicable. No other taxes will be borne by NSC. 3) The godown owner must specify the size of godown (Length & Breadth) & height of the godown. Godown will be used for storage of seed and other allied material. There should be proper ventilation of the godown leak proof, protection from rodents & installed with fire extinguisher. 4) The tender shall be accompanied with interest free earnest money deposit EMD Rs.50,000/- (Rs. fifty thousand only). EMD shall be remitted in the form of DD in favour of National SeedsCorporation Ltd. Pune or can be transferred to NSC SBI Account No IFSC Code SBIN Branch Market Yard, Pune.. EMD is refundable only after lifting of total quantity of seeds / material stored by NSC as per the terms and conditions and within the time schedule. Tenders without the requisite EMD will be rejected. EMD of unsuccessful tenderers will be returned within 30 days from the date of tender opening without interest. 5) In case, godown owner fails to handover the godown or provide the required storage space with in the stipulated period as required by NSC, then NSC reserves the right to forfeit the EMD. 6) Successful party has to execute an agreement on Non-judicial stamp paper of Rs.500/-in the prescribed NSC proforma. 7) The storage godown will be inspected by NSC officials for ascertaining suitability of scientific storage condition of seed before giving work order. 8) All taxes in any kind should be borne by the tenderer except GST. 9) NSC or Godown owner may vacate accommodation prior to completion of agreement by giving one month notice by either of the party. Further NSC & Godown owner may extend / renew the lease tenure with mutual consent after expiry of 11 months. 10) The income tax and any other tax if any will be deducted from the bill as per rule. 11) Electricity bill will be borne by NSC and separate electrical meter shall be provided in the godown by owner. 12) NSC will bear insurance charges of stock stored from theft, fire or burglary in the Godown. In case insurance is arranged by the owner of Godown on behalf of NSC, then the same will be reimbursed on submission of policy document in the name of NSC. 13. Security of seed stock will be arranged by NSC. OTHER TERMS AND CONDITIONS:- 1. The rate quoted and accepted by us is the final and NSC shall not be responsible for fluctuation of the electrical or any other expenditures. The agreement can be terminated at any time due to nonperformance of any of the terms and conditions of the agreement to the satisfaction of the Corporation. 2. The NSC reserves the right to accept or reject either in full or part of the tender or all the tenders without assigning any reason. NSC further reserves the right to award contract/issue the order to any other party. ARBITRATION All disputes in relation to the tender, the contract or the interpretation of any of their terms or implementation there-of arising out of or concerned directly or indirectly with the contract/tender shall be referred to the Sole arbitrator to be appointed by the Chairman-cum-Managing Director of the Corporation (NSC)/ purchaser and in the absence of CMD, the highest Executive Officer of the Corporation shall make such appointment. The venue of arbitration shall be at New Delhi. The court of law at the New Delhi/Delhi alone will have jurisdiction in the matter of any disputes whatsoever. The arbitrator shall have powers to enlarge time for making & publishing the award with the consent of the parties. The parties shall have no objection to the appointment of the arbitrator on the ground that the arbitrator had dealt with the matter of any earlier stage. 5 AGREEMENT ( for Hiring of Godowns ) AGREEMENT made on this day... between the National Seeds Corporation Ltd. (A Govt. of India Undertaking) incorporated under Companies Act 1956 and having Regd. Office at New Delhi (who and whose successors and assigns are hereinafter called NSC ) of the ONE PART and M/s... Address ( here in after called GODOWN OWNER which expression shall unless executed by or repugnant to the context be deemed to include its successor and assigns) of the other part. WHEREAS, the NSC had invited tender No: for storing of NSC seeds and the rates offered by GODOWN OWNER have been agreed upon by the NSC Ltd. NOW THIS AGREEMENT WITNESSES: That, the following terms & conditions as incorporated in the tender notice No.Prodn.(Storage)/NSC-PNA/ dated are binding on the parties and their relationship shall be governed by the same. 1) All taxes in any form should be borne by the tenderer except GST. 2) The storage charges will be paid every month/season as the case may be. Party has to submit registered GST Invoice Bill with relevant godown details to Area Office, Jalgaon for payments. The loading and unloading Charges will be borne by NSC. 3) All the payments payable or claimable under this Agreement shall be paid by NSC, Pune through AM, NSC, Jalgaon. 4) Not withstanding the place where this agreement is executed, it is mutually understood and agreed upon between the parties hereto that this contract shall be deemed to have been entered into by the parties concerned at New Delhi and Court of Law in New Delhi alone shall have the jurisdiction to adjudicate thereon. 5) That the Agreement will be in force for one year from.. to...
