1 Bill No. 23 of 2014 THE CODE OF CRIMINAL PROCEDURE (RAJASTHAN AMENDMENT) BILL, 2014 (To be introduced in the Rajasthan Legislative Assembly) A Bill further to amend the Code of Criminal Procedure, 1973 in its application to the State of Rajasthan. Be it enacted by the Rajasthan State Legislature in the Sixty-fifth Year of the Republic of India, as follows:- 1. Short title, extent and commencement.- (1) This Act may be called the Code of Criminal Procedure (Rajasthan Amendment) Act, (2) It extends to the whole of the State of Rajasthan. (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint. 2. Amendment of section 29, Central Act No. 2 of In the Code of Criminal Procedure, 1973 (Central Act No. 2 of 1974), in sub-section (2) of section 29, in its application to the State of Rajasthan, for the existing expression ten thousand rupees, the expression fifty thousand rupees shall be substituted.

2 2 STATEMENT OF OBJECTS AND REASONS The Rajasthan Excise Act, 1950 was amended by the amending Act of In section 54 of the Act the provision of sentence for three years imprisonment and fine of twenty thousand rupees has been provided. Aggravated form of the offence is punishable by imprisonment for a term which shall not be less than three years but which may extend to five years and with fine of twenty thousand rupees or ten times of the loss of excise duty, whichever is higher. In view of same it is necessary to enhance the power of Judicial Magistrate of the first class of imposing fine from ten thousand rupees to fifty thousand rupees, so that he can try such cases. Under the existing provision of sub-section (2) of section 29 of the Code of Criminal Procedure, 1973, a Magistrate may pass a sentence of imprisonment for a term not exceeding three years, or of fine not exceeding ten thousand rupees or of both. The Registrar General, Rajasthan High Court, Jodhpur has proposed for the State to enhance the power of Judicial Magistrate of the first class to sentence a convict with fine upto rupees fifty thousand. Therefore, the State Government has proposed to amend sub-section (2) of section 29 of the Code of Criminal Procedure, 1973 by way of enhancing the amount of fine of rupees ten thousand to rupees fifty thousand so that Judicial Magistrate of the first class can try such cases in the State.
