West Branch, Iowa City Council Meeting September 21, 2015 Council Chambers 7:00 p.m. Mayor Roger Laughlin called the West Branch City Council meeting to order at 7:00 p.m. Mayor Laughlin then asked the Council, staff and members of the audience to stand and led the group in the Pledge of Allegiance. 5 COMMUNICATIONS/OPEN FORUM John Tigrett, 628 E. Main, addressed the Council and asked that they make improvements to the alley behind his home. John Gillenwater, 616 E. Main, told the Council that he had discussed the matter with Public Works Director Matt Goodale and made his preferences known on western and southern portions of the alley adjacent to his property. PUBLIC HEARING/NON-CONSENT AGENDA West Branch High School Student Government Adviser Abby Noelck and Student Representatives Jenna Bower and Katie Hovancik Homecoming Parade. Abby Noelck and Jenna Bower spoke to the City Council about the West Branch High School Homecoming Parade scheduled for September 30, 2015 at 6:00 p.m. Approve street closures along parade route for the West Branch High School Homecoming Parade on Wednesday September 30, 2015 from 5:45 p.m. 6:45 p.m./move to action. Motion by Pierce, second by Ellyson to approve street closures along the parade route for the West Branch High School Homecoming Parade on Wednesday September 30, 2015 from 5:45 p.m.-6:45 p.m. AYES: Pierce, Ellyson, Miller, Stevenson. Motion carried. West Branch Preservation Commission Member John Fuller Update from the Commission on Designs to Improve Heritage Square. John Fuller presented the latest design that is being proposed by the Preservation Commission for the Heritage Square area, which included new pavers on the north side of the Square and did not reduce the grass area on the southern portion. The sign on the wall would read Heritage Square and the urns would be placed on the side of the walls. The gazebo footings still need to be assessed. Mayor Laughlin agreed to check the footings. Fuller stated that the Commission was unanimous in suggesting that the grass area not be reduced in the Square. The project is ready to be engineered. Stevenson asked about the concrete pad and bench in the northwest portion of the square. Fuller replied that both the pad and bench were temporary and would be removed. Benches and trash cans would be added later. Third Reading of Ordinance 734, amending Chapter 165 Zoning Regulations. /Move to action. Ordinance 734 is an ordinance amending Chapter 165 Zoning Regulations. Many of the changes contained within the ordinance are intended to provide consistency and clarity to the language within the Chapter. Section (4) was revised to add language that would lessen the restrictions for fences located at the rear of a corner property to make them more consistent with the requirements of neighboring properties. This description is a summary of the ordinance which will become effective on October 1, The entire ordinance is available for inspection at the West Branch City Office located at 110 North Poplar Street in West Branch, IA between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday. Motion by Ellyson, second by Stevenson to approve the third reading of Ordinance 734. AYES: Ellyson, Stevenson, Miller, Pierce. Motion carried. Accept the resignation of Police Officer Alex Koch./Move to action. Officer Koch thanked the City Council for the opportunity to work for the citizens of West Branch under the direction of Chief Horihan and Sergeant Hanna. Ellyson and Stevenson thanked Koch for his service. Motion by Ellyson, second by Stevenson to accept the resignation of Alex Koch. AYES: Ellyson, Stevenson, Miller, Pierce. Motion carried. Mayoral Appointment: Resolution 1384, hiring Alex Koch as a part-time police officer for the City of West Branch, Iowa, and setting the salary for the position for fiscal year /Move to action. Motion by Pierce, second by Stevenson to approve Resolution AYES: Pierce, Stevenson, Ellyson, Miller. Motion carried. Resolution 1385, adopting the Cedar County Outdoor Warning System Activation Protocol./Move to action. Chief Stoolman stated that this resolution confirms that West Branch has adopted the county-wide protocol for activating the sirens, but does not make any changes to the current protocol. Stoolman recommended approval of the resolution. 5

COMMENTS FROM MAYOR AND COUNCIL MEMBERS Mayor Roger Laughlin Laughlin told the Council that the League of Cities Annual Conference would take place this week. Several members confirmed that they would be in attendance and talked about various training sessions that are available. Laughlin stated that he would also be attending a first-time attendee orientation. ADJOURNMENT Motion to adjourn meeting by Miller, second by Ellyson. Motion carried on a voice vote. West Branch, Iowa City Council Work Session September 21, 2015 Council Chambers 7:25 p.m. Mayor Roger Laughlin opened the West Branch City Council meeting at 7:25 p.m. by welcoming the audience and the following City staff: City Administrator Matt Muckler, Police Chief Mike Horihan, Library Director Nick Shimmin, Parks & Recreation Director Melissa Russell and City Attorney Kevin Olson. City Council Goal Setting Session Muckler reviewed goals that were set in the past year. City Council members held an extensive discussion on potential goals. Council members set the following thirteen goals (with the number of votes in parentheses): 1. Street Upkeep (15), 2. Additional Amenities at Wapsi Creek (14), 2. Splash Pad (14), 4. New Salt Shed (12), 4. Business Incentive Plan (12), 6. N. Downey & East Main Street Sidewalks (11), 6. Complete I & I Phase II Work (11), 8. Continue to work on Emergency Communications System (9), 9. Preserve Golf Course (8), 10. Trail Expansion (7), 10. Creek Clean-Up (7), 12. Adopt a PTO Plan with Disability/Maternity/Adoption Benefits (6), 12. Flood Retention Structure (6). Other goals considered by the City Council included the following: Later City Office hours (4), Police Evidence facility (2), Provide online payment option for Utility billing accounts (1), Police Recruitment Program (1), Paver crosswalks downtown, Pilot Stormwater BMP s, Place cemetery information online, Code Revisions, Acquire Electronic Records System, and Define pay ranges for positions. 10 RESOLUTION NO RESOLUTION ADOPTING THE CEDAR COUNTY MULTI-JURISDICTIONAL LOCAL HAZARD MITIGATION PLAN Whereas, the City of West Branch, Iowa recognizes the threat that natural hazards pose to people and property within our community; and Whereas, undertaking hazard mitigation actions will reduce the potential for harm to people and property from future hazard occurrences; and Whereas, the U.S Congress passed the Disaster Mitigation Act of 2000 ( Disaster Mitigation Act ) emphasizing the need for pre-disaster mitigation of potential hazards; Whereas, the Disaster Mitigation Act made available hazard mitigation grants to state and local governments; and Whereas, an adopted Local Hazard Mitigation Plan is required as a condition of future funding for mitigation projects under multiple FEMA pre- and post-disaster mitigation grant programs; and Whereas, the (City of West Branch, Iowa) fully participated in the hazard mitigation planning process to prepare this Multi-Jurisdictional Local Hazard Mitigation Plan; and Whereas, the Iowa Homeland Security and Emergency Management Division and the Federal Emergency Management Agency Region VII officials have reviewed the Cedar County Multi-Jurisdictional Local Hazard Mitigation Plan, and approved it contingent upon this official adoption of the participating governing body; and Whereas, the City of West Branch, Iowa desires to comply with the requirements of the Disaster Mitigation Act and to augment its emergency planning efforts by formally adopting the Cedar County Multi-Jurisdictional Local Hazard Mitigation Plan; and Whereas, adoption by the governing body for the City of West Branch, Iowa demonstrates the jurisdictions commitment to fulfilling the mitigation goals outlined in this Multi-Jurisdictional Local Hazard Mitigation Plan Whereas, adoption of this legitimizes the plan and authorizes responsible agencies to carry out their responsibilities under the plan; 10

11 Now, therefore, be it resolved, that the (City of West Branch, Iowa) adopts the Cedar County Multi-Jurisdictional Local Hazard Mitigation Plan as an official plan; and Be it further resolved, the (City of West Branch, Iowa) will submit this Adoption Resolution to the Iowa Homeland Security and Emergency Management Division and Federal Emergency Management Agency Region VII officials to enable the plan s final approval. 12 RESOLUTION NO RESOLUTION ORDERING THE CONSTRUCTION OF CERTAIN SIDEWALKS LOCATED AT 620 S. DOWNEY STREET, WEST BRANCH, IOWA. WHEREAS, Section of the Iowa Code and Section of the Code of Ordinances of the City of West Branch, the City Council may order the construction of sidewalks within the City; and WHEREAS, if the property owner does not construct said sidewalk as ordered by the City Council, Section of the Code of Ordinances, the City may perform the sidewalk construction and assess the costs back against the property owner; and WHEREAS, the City Council has heretofore decided that the property generally referred to as Kum & Go, located at 620 S. Downey Street (the Property ), needs to construct a sidewalk to complete a sidewalk section that will be constructed by the City near the Property; and WHEREAS, it is now necessary for the City Council to order the construction of said sidewalk via Resolution of the City Council. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of West Branch, Cedar County, Iowa, that the owners of the Property are required to construct a 10-foot wide sidewalk along its S. Downey Street frontage in accordance with City specifications and at a location and elevation approved by the City of West Branch and the Iowa Department of Transportation in the Public Improvements for S. Downey Street & Tidewater Drive, West Branch Iowa Project plans. BE IT FURTHER RESOLVED, that the sidewalk shall be constructed at the Property no later than April 1, 2016, and if not, the City Administrator is hereby directed to proceed with said construction and assess the costs of the same against the Property. 13 RESOLUTION NO A RESOLUTION APPROVING THE PURCHASE OF A 2016 FORD F-550 SD 4X4 DIESEL UTILITY TRUCK WITH STAINLESS DUMP BOX AND SNOW REMOVAL EQUIPMENT IN THE AMOUNT OF $71, WHEREAS, the West Branch Public Works Department requested and the City Council approved the purchase of a utility truck, stainless dump box and snow removal equipment in the fiscal year annual budget; and WHEREAS, bids were accepted from local dealers and the lowest bid submitted by the deadline was from West Branch Ford in the amount of $42,922.00; and WHEREAS, Future Line LLC has provided a proposal to install a stainless dump box and snow removal equipment in the amount of $28, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of West Branch, Cedar County, Iowa, that the City Council approves the purchase of a 2016 Ford F-550 SD 4X4 Diesel Utility Truck from West Branch Ford and a stainless dump box and snow removal equipment from Future Line LLC in the amount of $71, Passed and approved this 5th day of October, ATTEST: Roger Laughlin, Mayor Matt Muckler, City Administrator/Clerk 13

16 RESOLUTION NO A RESOLUTION APPROVING A CONSULTANT AGREEMENT WITH LISA RICKERTSEN FOR FINANCIAL CONSULTING SERVICES WHEREAS, the City is interested in contracting with Lisa Rickertsen for financial consulting services; and WHEREAS, the City has knowledge of Lisa Rickertsen s previous experience with municipal finance; and WHEREAS, the City has a desire to enter into an agreement to engage Lisa Rickertsen as an independent contractor to perform financial consulting services on an as-needed basis; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of West Branch, Cedar County, Iowa, that the City Council approves a consultant agreement with Lisa Rickertsen for financial consulting services. 17 CONSULTING SERVICES AGREEMENT THIS AGREEMENT entered into by and between the City of West Branch, Iowa (hereafter City ) and Lisa Rickertsen (hereafter Rickertsen ). WHEREAS, Rickertsen has experience providing municipal finance services (the Services ); and WHEREAS, the City desires to engage the services of Rickertsen to provide said Services; and WHEREAS, the parties desire to enter into an agreement to engage Rickertsen as an independent contractor to perform the Services. NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. Independent Contractor. Rickertsen expressly agrees that this Agreement does not create any rights as an employee of City, and that City is engaging Rickertsen as an independent contractor to provide the Services to the City on an as-needed basis. 2. Compensation for Services. The City shall compensate Rickertsen for the Services as follows: a. The City shall pay Rickertsen the sum of $50 per hour for providing municipal finance consulting services, said sum to include all applicable mileage. b. The compensation paid under the agreement will not exceed $10,000 unless approved by future resolution of the City Council. The City shall pay Rickertsen after the second regularly scheduled City Council meeting upon submission of an invoice for the Services to the City Clerk. 3. Use of City building and equipment. Rickertsen, upon request of the City Administrator, shall be allowed to access City Hall and the City equipment during regularly scheduled business hours. 4. Insurance. The City shall provide liability insurance to Rickertsen under the City s policy. 5. Termination. Rickertsen or the City may terminate this Agreement by providing 30 days written notice to the other party. 17

18 6. Indemnification. That in consideration of the mutual covenants of the parties and for value received, Rickertsen agrees to indemnify and save harmless, City and its officers, employees, agents, and their successors, assigns and personal representatives from any claim, action, liability, loss, damage, or suit arising from the Services provided herein. 7. Form As required by law, the City will issue Rickertsen a Form 1099 showing the amount paid to Rickertsen as an independent contractor during each calendar year this Agreement is in place.
