4 1026 Notices Department of Agriculture Division of Conservation Notice of Authorization to Proceed with On-Call Engineering Services The Watershed Institute has been identified as a qualified entity to provide certain on-call engineering services to the Kansas Department of Agriculture, Division of Conservation. Pursuant to its current Agreement for On- Call Engineering Services with The Watershed Institute, the Kansas Department of Agriculture, Division of Conservation issued a notice of authorization to proceed for a Review and Assessment of existing streambank restoration projects in the Cottonwood, Delaware and Neosho rivers. The authorization to proceed was issued on August 25, 2015, on a total bid price of $8,316. South Central Kansas Economic Development District Notice to Contractors and Vendors The South Central Kansas Economic Development District (SCKEDD) in Wichita administers the federally funded Kansas Weatherization Assistance Program in a 13-county region in south central Kansas. SCKEDD is in the process of contracting with the following: A vendor who can supply HVAC equipment, including wall, console and forced-air furnaces. Vendors who can supply cellulose insulation, ASH- RAE 62.2 ventilation systems and various weatherization materials. A contractor that is a licensed electrician capable of service upgrades, wiring repair and replacements, panel replacements, adding dedicated electrical circuits for furnaces and installing mechanical ventilation systems per ASHRAE 62.2 standards. Fan kits will be provided by SCKEDD. A contractor that can provide licensed plumbing work for supply line and waste line repair or replacement and water heater replacement. A roofing contractor that can provide full and partial residential roof repairs and replacement. A general contractor that can perform weatherization work in the following counties with estimated number of units in parenthesis: Barber (2), Chautauqua (1), Cowley (8), Elk (1), Harper (2), Kingman (3), Mc- Pherson (5), Pratt (1), Reno (10), Rice (3), Sedgwick (85), Stafford (1) and Sumner (3). Because SCKEDD employs weatherization crews, only the work that can t be performed in-house will be contracted out. Weatherization work includes performing air sealing, repairing broken windows, adding weather-strips to exterior doors, installing plastic vapor barriers in crawl spaces, insulating foundation walls and floors using fiberglass batting material, installing dense pack-blown cellulose insulation in exterior walls, installing roof vents and insulating attics with blown cellulose. Mobile home weatherization work includes repairing duct work systems and installing blown fiberglass insulation into bellies, walls and roof cavities. Work will be performed on single-family dwellings and mobile homes. All weatherization contractors will be responsible for complying with the EPA s Renovation Repair and Painting (RRP) regulations as enforced by KDHE in Kansas. KDHE and Kansas weatherization requires all licensed firms to employ only certified renovators to perform weatherization work. Contractor requirements include, but are not limited to: Capability to be licensed in all municipalities served by SCKEDD weatherization RRP renovation firms licensed with KDHE All workers licensed as RRP renovators with KDHE All workers have completed LSWP training provided by the Department of Energy Worker s comp and general liability insurance Contracts will be for a one-year period October 31, 2016, with an option to extend the contract for up to three additional one-year periods at the discretion of SCKEDD and the approval of the Kansas Housing Resources Corporation. A mandatory bidder s conference will take place to answer all questions regarding the distributed bid packets. If you are unable to attend in person, teleconference capabilities will be provided. The bid sheets provided will require contractors and vendors to provide line-item prices by county for all items listed. Contractors are required to provide references with their bid package as a high value will be placed on quality of work. SCKEDD may choose any or all of these factors to evaluate contractor bids: price, quality of references, timeliness in completing work, quality of completed work, timeliness in billing, quality of billing, and any other factor as specified in the bid package. Persons wishing to comment on the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment if they wish to have the comments considered in the decision-making process. 8 1030 Request for Comments Department of Health and Environment Request for Comments The Kansas Department of Health and Environment received Resource Conservation and Recovery Act (RCRA) hazardous waste Part A and Part B permit renewal applications from Day & Zimmermann Kansas LLC (owner/operator). The facility is located at Scott Road, Parsons, Kansas, and has EPA Identification Number KSR KDHE is providing notice of its intent to renew the RCRA hazardous waste management permit for the facility. The proposed renewal permit will require Day & Zimmermann Kansas LLC to continue hazardous waste operations and corrective action at the facility. In October 1985, the state of Kansas received final authorization from the U.S. Environmental Protection Agency to implement a hazardous waste management program in lieu of the federal program, except for those portions covered by the 1984 Hazardous and Solid Waste Amendments (HSWA). In September 2013, authority for the corrective action portion of the RCRA program was delegated to the state of Kansas. The draft permit sets forth in a concise document all of the applicable requirements that KDHE will require the permittee to comply with during the 10-year duration of the permit. The draft hazardous waste permit includes standard permit conditions, general facility conditions, container storage requirements, thermal treatment requirements, air emission requirements for containers, corrective action requirements for groundwater and soil, and corrective action requirements for solid waste management units (SWMUs) and areas of concern (AOCs). Section 6 addresses corrective action for all releases or future releases of hazardous waste or hazardous constituents from any SWMU or AOC at this facility. Section 6 also includes general conditions, process steps, and a facility submission summary for corrective action activities. The draft permit is being considered for issuance under authority of K.S.A et seq. and K.A.R a, and Subtitle C of RCRA, as amended by HSWA. Documents that support the permit conditions specified in the draft permit are part of the administrative record. Applicable regulations are found in 40 CFR Parts 124, , 266, 268 and 270, as specified in this permit. All citations found in the draft permit to federal regulations are for the sake of convenience. Some modifications to federal regulations by applicable state regulations are noted in this permit, but all modifications to federal regulations by state regulations are incorporated. To the extent that state regulations exclude any sections of applicable federal regulations, those sections are not in effect. In the instance of inconsistent language or discrepancies between conditions found in the permit, state regulations or federal regulations, the language of the more stringent provision will govern; otherwise, state law governs. State hazardous waste laws require that the public be given at least 45 days to review the administrative record for the draft permit prior to KDHE taking a final action. The purpose of having a public comment period is to ensure that interested parties have the opportunity to evaluate the conditions specified in the draft permit and to provide their input into the permit decision-making process. In accordance with 40 CFR , during a public hearing any person may submit oral or written statements and data concerning the draft permit or Part B application. The secretary of health and environment will make the decision regarding the issuance of the permit after the close of the public comment period. The secretary will consider all comments received during the public hearing and comment period. When the final decision to issue or deny the permit is made, notice will be given to the applicant, to all persons who submitted written comments, and to those who requested notice of the final permit decision. If none of the comments received during the public comment period result in revisions to the draft permit, the permit will become effective immediately upon issuance of the final permit decision. If comments received during the public comment period result in revisions, the permit will become effective 30 days after service of notice of the final decision to allow for public review of the revisions in accordance with 40 CFR and K.A.R (c)(8). (a) In assessing documents submitted as evidence of United States citizenship, each election officer shall consider the following factors: first name, middle name or initial, surname, date of birth, place of birth, and sex. (1) The first name and the middle name or initial, if provided, shall be consistent with the information provided on the person s application for voter registration. Hyphenated names shall be permitted if not inconsistent with the information provided on the person s application for voter registration. (2) If the name on the document is inconsistent with the applicant s name as it appears on the application for voter registration, the election officer shall perform the following: (A) Ask the applicant for a second, government-issued document confirming the voter s current name; (B) if the applicant is unable or unwilling to provide a second, government-issued document, allow the applicant to sign an affidavit pursuant to K.S.A and amendments thereto, stating the inconsistency related to the applicant s name and swearing under oath that, despite the inconsistency, the applicant is the individual reflected in the document provided as evidence of citizenship; and (C) if the applicant is either unable or unwilling to provide a second, government-issued document and refuses to sign an affidavit, inform the applicant of the applicant s right to appeal to the state election board, pursuant to K.S.A and amendments thereto. (3) The date of birth indicated on the document submitted as evidence of United States citizenship shall match the date of birth provided on the application for voter registration. If the dates of birth are inconsistent, the election officer shall inform the applicant of the applicant s right to appeal to the state election board, pursuant to K.S.A and amendments thereto. (4) If the place of birth is indicated on the document submitted as proof of United States citizenship, the place of birth may be used to assess the applicant s status as a United States citizen. If the document does not contain a place of birth, this fact shall not result in an unsatisfactory assessment. (5) If the sex indicated on the document does not match the sex indicated on the application for the voter registration, the election officer shall perform the following: (A) Ask the applicant for a second, government-issued document confirming the voter s sex; (B) if the applicant is unable or unwilling to provide a second, government-issued document, allow the applicant to sign an affidavit pursuant to K.S.A and amendments thereto, stating the inconsistency related to the applicant s sex and swearing under oath that, despite the inconsistency, the applicant is the individual reflected in the document provided as evidence of citizenship; and Kansas Secretary of State 2015 Vol. 34, No. 38, September 17, 2015

11 Regulations/Hearing 1033 (C) if the applicant is unable or unwilling to provide a second, government-issued document and refuses to sign an affidavit, inform the applicant of the applicant s right to appeal to the state election board, pursuant to K.S.A and amendments thereto. (6) If a document submitted as evidence of United States citizenship contains an expiration date and this date has passed when the document is submitted for purposes of voter registration, the document shall nonetheless be considered in assessing qualifications to register to vote. (b) If an applicant for voter registration fails to submit evidence of United States citizenship before the deadline to register to vote before an election, the applicant may submit a valid citizenship document by mail or personal delivery to the county election office by the close of business on the day before the election or a valid citizenship document by electronic means before midnight on the day before the election. Electronic means shall include facsimile, electronic mail, and any other electronic means approved by the secretary of state. For each document received in accordance with this subsection, the county election officer shall perform the following: (1) Accept and assess the citizenship document; (2) add the applicant s name to the voter registration list as a registered voter; and (3) if practicable, include the registrant s name in the poll book for the upcoming election. If poll books have already been printed, the county election officer shall, if practicable, communicate the registrant s name to the appropriate polling place with instructions to allow the registrant to vote a regular ballot. If the registrant s name is not communicated to the election board at the appropriate polling place by the county election officer before the opening of the polls on election day, the registrant shall be allowed to cast a provisional ballot. If any applicant to whom this subsection applies fails to submit satisfactory evidence of United States citizenship in accordance with this subsection and the applicant casts a provisional ballot, the ballot shall not be counted. (c) A registered voter who has previously provided sufficient evidence of United States citizenship with a voter registration application in this state shall not be required to resubmit evidence of United States citizenship with any subsequent voter registration application. (Authorized by and implementing K.S.A Supp ; effective Jan. 1, 2013; amended Oct. 2, 2015.) Incomplete applications for voter registration. (a) If the county election officer assessing an application for voter registration determines that the application does not contain the information required by law, including satisfactory evidence of United States citizenship, the county election officer shall designate the application as incomplete. Each county election office shall maintain a list of incomplete applications for voter registration. (b) Any voter registration applicant whose voter registration application has been designated as incomplete under subsection (a) may complete the voter registration application, without submitting a new voter registration application, by providing the required information that was not provided with the original voter registration application within 90 days after the voter registration application was received by the county election office. (c) If a voter registration application was designated as incomplete under subsection (a) and the application is not completed by the applicant under subsection (b), the voter registration application shall be deemed insufficient by the county election officer and the county election officer shall designate the voter registration application as canceled. Each voter registration applicant whose voter registration application was deemed insufficient under this subsection shall be required to submit a new voter registration application in order to become registered to vote.
