5 Notices 813 Department of Health and Environment Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications In accordance with Kansas Administrative Regulations through 63, through 17, 28-18a-1 through 33, through 154, , and the authority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been prepared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below. The proposed actions concerning the draft documents are based on staff review, applying the appropriate standards, regulations, and effluent limitations of the state of Kansas and the Environmental Protection Agency. The final action will result in a Federal National Pollutant Discharge Elimination System Authorization and/or a Kansas Water Pollution Control permit being issued, subject to certain conditions, revocation, and reissuance of the designated permit or termination of the designated permit. Controls consist of two concrete pits and two grass buffers. Proposed construction includes Concrete Pit 3, freestall barn, and 0.53 acres of open lots to be controlled by proposed grass buffer. There has been no change in animal numbers from the previous permit. Name and Address of Applicant CB Feeders NE 100th Ave. Preston, KS Kansas Permit No. A-ARPR-C004 Federal Permit No. KS Legal Description SW/4 of Section 10 T27S, R11W Pratt County Receiving Water Lower Arkansas River Basin An update to the Nutrient Management Plan (NMP) was received for this existing facility currently permitted for 1,500 head (1,500 animal units) of cattle weighing greater than 700 pounds. The facility s NMP was updated to include the addition of a new land application field. There are no changes to the permit or in the permitted number of animal units. Only the updated portions of the Nutrient Management Plan are subject to comment. This facility is engaged in a limestone quarrying and crushing operation with no washing. Outfall 001, 002, 003 and 004 consists of stormwater runoff. The permit contains generic language to protect waters of the state. Persons wishing to comment on the draft documents and/or permit applications must submit their comments in writing to the Kansas Department of Health and Environment if they wish to have the comments considered in the decision-making process. No Jeff Andersen Department of Labor Division of Workers Compensation Notice of Hearing Cancellation Pursuant to HB 2280, a public hearing was scheduled to be conducted at 3:00 p.m. Friday, August 10, 2018, in Hearing Room 3 of the Department of Labor Building, 401 SW Topeka Blvd., Topeka, Kansas. The purpose of the hearing was to consult and solicit information from individuals and entities that may be affected by the proposed changes to the Workers Compensation 2019 Schedule of Medical Fees (hereafter Medical Fee Schedule). At this time, the meeting for August 10, 2018 is being canceled and will be rescheduled at a later date. Doc. No Department of Transportation Request for Letters of Interest Description Interchange Design Project KA Request for Proposal (Technical) Larry Karns Director Background and Purpose/Scope of Project The Kansas Department of Transportation (KDOT) is seeking a consultant to provide design services for the I-35 and Gardner Road DDI Interchange. The work includes public information type, access management, grading, surfacing, concrete pavement, bridges, fencing, seeding, lighting, signals, ancillary items, bi-annual cost estimates, signing, and pavement marking. Potentially some work will be needed on 191st Street approaches. Additional deliverables in the final plan stage will include information for environmental permitting, plans to KDOT s landscaping section, final electronic plans, electronic files for the contractor, 3D files, and Control CADD indexed DGN files. KDOT will perform the survey and geotechnical work. Schedule and Deadlines Technical proposals are due on or before 12:00 p.m. (CST) August 16, 2018, to be delivered via to David. Nagy@ks.gov. Anticipated Schedule for Subsequent Events Evaluation and ranking of technical proposals on or about August 23, 2018 after which time all firms that submitted will be notified of the ranking. Negotiations with the most highly ranked firm to commence on or about August 30, Standard 4-Phase agreement to be place and in effect September 6, Evaluation Factors Technical proposals will be evaluated based on the factors listed below, evenly weighted, to rank the most qualified firm in order of preference as first, second, third, etc. Evaluation factors: 1) the quality and completeness of the response to this request; 2) qualifications and experience of consultant personnel/manager proposed for services; 3) proposed approach for design; and 4) past performance history for similar projects/services for KDOT. The highest ranked firm will be asked to enter into negotiations with KDOT for an agreement. In the event KDOT cannot reach agreement with the ranked firm, it will terminate negotiations with such firm and commence negotiations with the next highest ranked firm, and so on, until either agreement is reached for a satisfactory scope of services for a fair and reasonable price, or KDOT decides to pursue other alternatives. Contract Terms and Conditions A standard four (4) phase agreement will be utilized with special attachments for the Kansas Tax Clearance Certificate, the Certification of Final Indirect Costs, and the Policy Regarding Sexual Harassment. Instructions for Technical Proposal Note: No costs shall be contained in the technical proposal. Technical proposals will consist of the technical proposals and a completed and signed Special Attachment No. 7 ( Certificate of Final Indirect Costs ), a completed and signed Special Attachment No. 8 ( Tax Clearance Certificate ), and a completed and signed Special Attachment No. 10 ( Policy Regarding Sexual Harassment ). All these forms are attached to the original announcement. The main text of consultant s technical proposal must not exceed six (6) pages (including cover sheets, indexes, etc.) to address the topics listed. Describe processes and procedures proposed by consultant to meet the project completion deadline listed above. Describe processes and procedures, including best practices, that will be used to perform the tasks and produce the deliverables described above under Scope of Services to be Performed. Include in the technical proposal items such as: Project manager/engineer in charge. History of projects with similar tasks. Availability of staff to meet schedule without overtime. No Ron Seitz, P.E., Director Division of Engineering and Design Department of Transportation Request for Comments In accordance with Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) requirements, the Kansas Department of Transportation (KDOT) requests comments on the draft Federal Fiscal Year (FFY) Statewide Transportation Improvement Program (STIP) for Kansas. The STIP is a project specific publication that lists KDOT administered projects, regardless of funding source, including projects for counties and cities as well as projects on the state highway system for a four-year period (October 1, 2018 to September 30, 2022). In addition, a list of projects being advance constructed, summarizing the conversion year(s) and conversion amount by phase for each project listed, is provided. Projects that are developed or revised after the preparation of this STIP document will use the STIP amendment process. Supplementing the project information is a narrative that briefly describes KDOT s public involvement process, project selection process, program financing and fiscal constraint anticipated for the STIP, and an overview of KDOT s public transportation program. Also, included within the STIP narrative are brief descriptions of the programs administered by entities other than KDOT. These programs which are required by federal law to be included in the STIP are: the Federal Lands and Tribal Transportation programs administered by the Office of Federal Lands Highway and the Bureau of Indian Affairs; Recreational Trails, administered by Kansas Wildlife, Parks and Tourism; and by reference the Transportation Improvement Programs (TIPs) administered by each of the Metropolitan Planning Organizations (MPOs) for the six urbanized areas of Kansas. The six state MPOs are: the Mid-America Regional Council (MARC) for the Kansas City area; the Lawrence-Douglas County Metropolitan Planning Office; the Wichita Area Metropolitan Planning Organization (WAMPO) that serves Sedgwick County and the Cities of Andover and Mulvane; the Metropolitan Topeka Planning Organization, the Flint Hills Metropolitan Planning Organization that serves the cities of Manhattan, Ogden, Junction City, and Wamego, and the St. Joseph Area Transportation Study Organization that serves Doniphan County-in the cities of Wathena and Ellwood. A summary of the proposed regulation and estimated economic impact follows: Summary of Regulation: K.A.R Fee for fingerprint-based background checks. This regulation creates a fee fund for fingerprint-based background checks for required individuals in child care facilities and complies with KSA , as amended by 2018 HB 2639, and the background check requirements of the federal Child Care and Development Block Grant Act of Economic Impact: Cost to the agency: The provisions of 2018 HB 2639 establish a child care criminal background and fingerprinting fund administered by KDHE. Fees submitted by applicants and licensees and KDHE s payments for the background checks will be processed through that fund. The KDHE Child Care Licensing and Registration Information System (CLARIS) will interface with the Kansas Department of Aging and Disability Services (KDADS) KanCheck system to enable KDHE to receive the results of the required background checks. Costs to KDHE include establishing the fee fund and the policies and procedures. Costs will be absorbed in the ongoing KDHE budget. Cost to licensees: The proposed regulation requires applicants and licensees to submit a non-refundable fee to KDHE for each individual who is required to complete a fingerprint-based background check. The fingerprint check will be completed for each individual initially and once every five years thereafter. Currently, the cost for each individual will be $48 based on the fees charged by the Kansas Bureau of Investigation (KBI), the Federal Bureau of Investigation (FBI), and the KDADS KanCheck system maintenance fee. In the final rules of the federal block grant, 45 CFR 98.43(f) states that Fees that a State, Territory, or Tribe may charge for the costs of processing applications and administering a criminal background check as required by this section shall not exceed the actual costs for the processing and administration. Costs to other governmental agencies or units: The KBI and FBI will have ongoing costs for processing fingerprint-based background checks. KDADS will have ongoing costs for maintenance of KanCheck, an integrated system for requesting and receiving results of fingerprint-based background checks. This amended regulation specifies the cancer screening data for collection and the requirements for reporting when and by what method cancer screening data is to be reported to the Kansas Cancer Registry. The proposed amendments add two types of cancer screening data to be collected and clarify the method of electronic data transfer to the Kansas Cancer Registry. The proposed amendments comply with the national standards from the Centers for Disease Control and Prevention and the National Cancer Institute in regard to routine cancer screenings that provide the opportunity to identify cancers in early stages or before cancers become malignant. The long-term impact of having cancer screening data is to reduce screenable cancers and prolong survivorship.
