1 U 9tlPp R 27 MINUTES OF THE REGULAR MEETING OF THE SOLYANG CITY COUNCIL Council Chambers 1644 Oak Street Solvang, Ca January 26, 2015 Monday 6: 30 pm CALL TO ORDER Mayor Richardson called the meeting to order at 6:30pm. ROLL CALL PRESENT: Mayor Richardson, Council Members Duus, Jamieson, Skytt and Zimmerman STAFF: Brad Vidro, City Manager, Roy Hanley, City Attorney, Matt van der Linden, Public Works Director/City Engineer, Fred Lageman, Parks Recreation Director, Lt. Shawn O' Grady, Mary Ellen Rio, City Clerk PLEDGE OF ALLEGIANCE Led by Council Member Jamieson. CITY MANAGERS REPORT No report. 1. PUBLIC COMMUNICATIONS - WRITTEN OR VERBAL Tracy Farhad and Brenda Ball Presented the FY Mid-Year Report for the Solvang Conference and Visitors Association Carey McKinnon Provided the Solvang Library update for October December 2014 Fred Kovol Since 1985 the City has spent 60 plus million dollars on water Now I understand we are re-upping our state water project for another 30 years The Can and Will Serve letter appears to have disappeared from the radar The previous Councils have just not done their jobs We need to turn our water system and facilities over to professionals; turn it over to ID# 1, they do it so well Think also about turning the sewer system and facilities over to professionals Solvang needs to focus only on tourism
2 Page 2 CJ Jackson Over the past 5 years in this drought situation the Alisal has lost over 40 pine trees When the pine trees are dead or dying, they are susceptible to disease and the pine beetle and can pose a threat Perhaps as a City you could spread the word, possibly working with the Fire Department in informing the public that the dead trees need to be taken care of Also, might want to educate the public on Poison Oak which seems to be thriving with the current weather situation. It can be equally as contagious when it sheds its' foliage 2. COUNCIL REQUESTS Council Member Jamieson requested that Council Protocols, shown on the future calendar, be heard sooner than later. 3. APPROVAL OF AGENDA AS PRESENTED Mayor Richardson requested that item 7 be heard prior to item CITY COUNCIL MINUTES OF JANUARY 12, 2015 Motion was made by Council Member Jamieson, seconded by Council Member Skytt to approve the minutes as presented. Motion carried with a verbal response of 5 ayes. 5. CONSENT AGENDA Consent Agenda read by City Clerk. a. Approval of pre- issues and warrant registers dated January 26, 2015 b. Recognize and accept the generous monetary donations and construction of Sunny Beach sand volleyball courts at Sunny Fields Park from the Santa Ynez Valley Youth Recreation. c. Approve the Alisal Bridge Private Irrigation Pipeline Agreement between the City of Solvang & Alisal Ranch, and authorize the Mayor to execute Agreement. d. Accept the FY Pavement & Drainage Improvement Project, PW 050 and direct the City Manager to execute and record the Notice of Completion. e. Award of Construction Agreement, Santa Ynez Valley Transit security lighting& bus stop improvement project: 1. Award a Construction Agreement with J & T Engineering and Construction, in the amount of$ 189, 965 and authorize execution of the Agreement by the Mayor 2. Approve Budget Appropriation Revision 3. Authorize the City Manager to execute any change orders if within contingency amount of$20,000
3 Page 3 f. Approve an Amendment to the Professional Services Agreement with Bengal Engineering in the amount of$28, 000 for Alisal Bridge Seismic Retrofit Project g. Receive and file Santa Barbara County Fire Department report for fourth quarter of 2014 Motion was made by Council Member Skytt, seconded by Council Member Duus to approve the Consent Agenda as presented. Motion carried with a roll call vote of 5 ayes. REGULAR AGENDA 7. WATER SUPPLY UPDATE Staff report by Public Works Director Water supply outlook for 2015 has significantly improved As a result of maximizing well operations, the cutbacks by Solvang water customers and the state water carryover of 2014 we have exceeded prior projections Based on these figures it will only be necessary to purchase water from ID# 1 in November 2015 when the state water system is down for annual maintenance This will reduce our water purchase costs significantly As a participant in the Supplemental Water Purchase Program with CCWA, the need would be decreased and any water received from this program could provide a valuable carryover to 2016 Provided an update on well production Public Comment: None. Council acknowledged receipt of the January 2015 water supply update. 6. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOLVANG DECLARING ITS INTENTION TO ESTABLISH THE SANTA YNEZ VALLEY TOURISM BUSINESS IMPROVEMENT DISTRICT ( SYVTBID) AND FIXING THE TIME AND PLACE OF A PUBLIC MEETING AND A PUBLIC HEARING THEREON AND GIVING NOTICE THEREOF Council Member Skytt reported a conflict of interest and left Council Chambers. Staff report by City Manager In 2010 a Tourism Business Improvement District was established for a 5 year term for the purpose of promoting tourism The TBID, known as the Santa Ynez Valley Hotel Association dba as Visit the Santa Ynez Valley, allows lodging and tourism related businesses to organize their efforts to increase tourism The group is requesting to renew the TBID for a period of 10 years with a gradual increase in the assessment over the 10 year period A change in the renewal process will have the jurisdictions each collecting and forwarding the assessments directly to the SYVHA however Solvang would still serve as the lead agency
4 Page 4 Shelby Sim, Director of Visit Santa Ynez Valley explained the new terms as well as increased assessments and provided a PowerPoint presentation with how funding was expended for the prior year. Cheryl Cuming of Civitas, the consultants working with VisitSYV on the TBID, explained the process and benefits. Public Comment: Jim Colvin For many years we struggled to promote Solvang on a very minimal amount of money A group of locals had a vision for a need to increase funding for tourism and hearing about other jurisdictions who had established a TBID moved forward to establish the first one As you have seen the numbers of what has been raised and what has been accomplished I can only hope that you will approve the renewal Kathy Vreeland, Director of the Buellton Visitor' s Bureau We are in support of the TBID, tourism is a huge part of our valley It provides jobs, provides income for local businesses and communities The Valley as a whole is a complete destination, each community has something to offer Look forward to your continued support Linda Johansen I take great pride in this City and would not do anything to harm it Solvang is branded and our area is now known for its wine. We should be proud of that fact as we are now producing world class wine Santa Barbara is not wine country, the vineyards are in the Santa Ynez Valley and we should embrace this fact and be proud In order to compete with other areas, we need the additional TBID money This 10 year plan is effective and efficient with controls in place We have strong local alliances now in the valley and are all working together There has never been a question Solvang is the main focal point of the area Sue Moualim, representing the Chamber of Commerce Hoping you will support this, it does help all the businesses There are several groups in the valley that do overlap however we all share the one main focus for increasing tourism to support our hotel, restaurants and businesses We urge you to support the TBID Bob Field Solvang is a jurisdiction that is attempting to place an assessment on others that are not under their control
5 Page 5 I feel government is getting into places they should not go you can call this an assessment however it really is a tax As it is, we are overtaxed Government has no business forcing private business to join a business association They call themselves a business improvement district however they only assess hotels that is false advertising I think you should all vote no just on the principle of the plan CJ Jackson I work in an entityy that has been in the lodgingg g business since 1946 We have a different product and I am not so sure it fits however I have an open mind We' ve been asked to endorse something before a public meeting is held The information you received today was based solely on Solvang, what would the other jurisdictions think I have not heard enough about the TBID, more information is needed Think carefully, hear from others, ask probing questions, look at expenditures other than Solvang' s Mike Hendrick After listening to some of the comments, wonder if people know this has been in existence for 5 years Most of the hoteliers like what has been done and are appreciative of it In Buellton we have an approval of 98. 6%, that is almost unheard of but they are more than willing to charge this assessment We welcome the public hearings, we welcome future discussions, as was pointed out, you are not approving this tonight, you are just approving holding public hearings Notices were sent to each and every person involved giving them an explanation of the TBID renewal and providing the dates and times of the public meetings to give them an opportunity to have their voices heard Mayor Richardson, in reporting full disclosure, announced he has had conversations with Mike Hendrick, Shelby Sim, Tracy Farhad and Linda Johansen on this subject. Council Member Duus reported conversations with Shelby Sim, Tracy Farhad and Linda Johansen; Council Member Jamieson reported a conversation with Linda Johansen, and Council Member Zimmerman reporting conversations with Shelby Sim and Tracy Farhad. Motion was made by Council Member Duus, seconded by Council Member Jamieson to: 1. Adopt Resolution of Intention 2. Adopt Resolution Requesting Consent of the City of Buellton and County of Santa Barbara to Create the Santa Ynez Valley Tourism Business Improvement District 3. Set Public Meeting for March 9, Set Public Hearing for March 23, 2015 Motion carried with a roll call vote of 3 ayes, 1 no with Council Member Zimmerman voting no and 1 absent with Council Member Skytt absent.

In addition, each member may report on items that will be included on the agenda for such committee or agency and seek guidance from the Council as a whole on such items, including on what position to take on behalf of the City) Santa Barbara County Association of Governments Mayor Richardson reported that the summary of this meeting had been distributed Air Pollution Control Board Mayor Richardson reported adoption of Memorandum of Understanding with the Department of the Conversion Division of Oil, Gas and Geothermic resources which monitors the handling of air pollution, and received a presentation on a revised guide book dealing with health risk assessments Joint Wastewater Committee Finance Committee Water Committee Indian Gaming Benefit Committee California Joint Powers Insurance Authority 9.
