1 NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF SIOUX CITY, IOWA City Council agendas are also available on the Internet at You are hereby notified a meeting of the City Council of the City of Sioux City, Iowa, will be held February 12, 2018, 4:00 p.m., local time, in the City Council Chambers, 5th Floor, City Hall, 405 6th Street, Sioux City, Iowa, for the purpose of taking official action on the agenda items shown hereinafter and for such other business that may properly come before the Council. This is a formal meeting during which the Council may take official action on various items of business. If you wish to speak on an item, please follow the seven participation guidelines adopted by the Council for speakers: 1. Anyone may address the Council on any agenda item. 2. Speakers should approach the microphone one at a time and be recognized by the Mayor. 3. Speakers should give their name, spell their name, give their address, and then their statement. 4. 10 City of Sioux City EFFECTIVE FISCAL and PUBLIC POLICY COMMITTEE (Advisory Board) MISSION STATEMENT The Effective Fiscal and Public Policy Committee will review and make recommendations to the City Council on matters pertaining to budgets, capital expenditures, and revenues and operating expenditures as well as make other recommendation on fiscal matters as it may be advisable while considering what is in the best interest of the taxpayers and the City. The committee also serves as an advisory and resource body to the City Council by analyzing, developing and recommending policies and procedures concerning issues not addressed by other boards, commissions and committees. MEMBER ROLE The Effective Fiscal and Public Policy Committee concerns itself with matters relating to taxation and other revenue measures; the bonded debt of the City of Sioux City; deposit of public moneys; the expenditure of public funds; and all aspects of financial policies. The Effective Fiscal and Public Policy Committee provides an opportunity for detailed discussion and consideration of financial matters. The advisory committee shall prepare recommendations and submit them to the City Council based on requests from the City Council relating to current community concerns. Examples of those requests are: review and assistance with strategic planning and special project review and formulation on City projects or initiatives with broad impact. Civic engagement is a foundational element of a productive society and I plan on being as involved as my schedule allows. 3. Yes, I currently serve on the Estimator/Collections Advisory Group. The group is tasked with a new concept for hospitals, which is starting the collections process while the patient is in house. With any change, resistance and other challenges face the organization and it is the focus of the advisory group to make the transition as seamless as possible while also allowing for an efficient and effective process for collection. 4. 13 Grow Sioux City Growing Sioux City is a top priority for all Sioux City residents. That means developing partnerships to expand job creation, encourging entrepreneurs, improving our city s public safety services and infrastructure, revitalizing neighborhoods and increasing housing opportunities. Record Numbers to Celebrate Residential Growth The City of Sioux City saw record breaking residential housing construction in A total of 274 housing units were built, the highest number in the past decade. The previous high was 241 units in Much of the rise in housing units can be attributed to privatepublic partnerships and renewed interest in in-fill development. The continued use of city-wide urban revite has encouraged new development around the city. City staff expect this upward trend to continue with construction in the Whispering Creek and Eagle Ridge developments, and the announced renovation projects for the former Everett School, Hatch building, Commerce building and former St. Luke s Methodist Hospital. Active Urban Renewal Grant Celebration Work continues within the two active urban renewal areas of Jones Street and Rose Hill. Both areas are seeing housing rehabilitation, public improvement projects, such as alley recontruction, and public service projects. A very successful public outreach event was held at the Rose Hill Park in September of Over 100 people from the neighborhood attended to provide input on what additional amenities should be added to the park. A splash pad was the overwheming winner; construction will start in the summer of In September of 2017 a celebration was held by the Sioux City Community Development Department to celebrate the investment of over five million dollars in U.S. Department of Housing and Urban Development Lead Hazard Control Grant funding in Sioux City! The grant, which provides funds to address lead paint hazards in homes, has assisted a total of 220 homes in Sioux City since Partnerships for Growth Industrial Expansions The Bridgeport Industrial Park continues to see growth. Expansions are currently underway on a number of businesses, including Cloverleaf Cold Storage ($18M), Westrock ($48M), Consumers Supply ($4.8M), and Braunger Foods ($4M). A new $7 million facility for Keizer Refrigeration is currently underway as well. Makerspace A new space encouraging collaboration and creativity opened on TriView Avenue in late Makerspace Sioux City allows the tools and space needed for productive collaboration in the skilled trades with woodworking, cooking, painting, sewing, technology and more. It is a great addition to Sioux City. Renewable Fuels Project Private Management With the support of the Orpheum Theatre s board, City Council voted to move management duties of the Tyson Events Center and Orpheum Theatre to Spectra, a private management company based out of Philadelphia. The change will offer more resources to local staff on everything from booking, to facility maintenance, to security, to a new menu and food experience at our venues. Management of the Sioux City Convention Center was also moved to Kinseth Hospitality, a hotel developer committed to building a new Courtyard by Marriott property in the current east lot of the Convention Center, joining the two via a newly-built pre-function space. Both changes took effect on January 1, Seaboard Triumph Foods began operations of its new $300 million plant in September The City s Economic Development team assisted STF to obtain the IEDA s approval for phase II, which is currently underway. The Seaboard Triumph Foods plant will eventually employ 2,400 people. Local Startup Success The Sioux City Economic Development Department works with a number of local businesses to help connect them with the resources they need for success. One such success story is local tech startup, Lienwaivers.io. The startup was recently approved for a $100,000 loan through the Iowa Economic Development Authority s Demonstration Fund and took 2nd place in the John Pappajohn Iowa Entrepreneurial Venture competition. Sioux City Utilities Director Mark Simms partnered with Bartlett & West on the company s first ever webinar where they shared information about biogas and the Sioux City Renewable Fuels Project. Sioux City is one of the first in the country to take action in this direction. Nearly 200 professionals from accross the country attended the webinar with excellent reviews.

14 Improved Services Grow Sioux City New Emergency Medical Ambulance Services New Training for Police Officers The Sioux City Police Department continues to work to improve services to the public, and a large part of that is providing the highest level of professional training to officers. With the assistance of a grant from the Missouri River Historical Development Board, the SCPD was able to partner with the Woodbury Country Sheriff s Department to purchase a Virtra 360 training simulator. The simulator will allow area officers and deputies to train on high risk engagements in the safety of a controlled environment. Siouxland Paramedics, the long-time ambulance contractor for Sioux City, notified the City in late July that they would no longer be performing emergency ambulance services after the first of After much consideration, the City Council voted to have Sioux City Fire Rescue take on this service as an all civilian division of the department. Since that time, SCFR has been busy hiring division personnel (27), obtaining the required regulatory licensing, equipment, supplies, software, hardware, obtaining a billing contractor, etc. This is one of the largest changes/projects in SCFR s 150-year history in this community. SCFR is committed to providing a stable, quality emergency ambulance service for all residents and visitors. Transportation Plan Sioux City staff are constantly working to improve transportation options in Sioux City. Public Transit has two new fixed route buses to replace current aging vehicles and to keep up with service demands. Transit staff also completed five bus stop improvement projects to provide better accessibility and new shelters as part of an IDOT grant. American Airlines added a second daily flight to Dallas/Fort Worth for the 2017 holiday season and is scheduled to add another this spring. The Sioux City Rail Study Phase 2 is underway and will be complete by the end of February Conceptual designs needed in order to reduce freight rail congestion will be completed shortly. Construction Update Sioux City s Public Works Division completed several projects this past quarter, including intersection upgrades in the Bridgeport area to help with the construction of Seaboard Triumph Foods. Additional projects helping to improve quality of life for residents include the reconstruction of Country Club Boulevard, Perry Way and 46th Street. Staff have worked closely with businesses during the continued construction on West 7th this past year to keep access open and improve the process for all involved. The third and final phase of the replacement and upgrade of the transmission main along S. Lewis Boulevard was completed last quarter. This project strengthens the City s ability to provide high quality and reliable water service to the Northside, Kelly Park and Greenville areas. Investing In Downtown Reinvestment District This transformational project reached several major milestones in the third quarter of A formal contract with the IEDA for the Sioux City Reinvestment District was approved. It will provide for the use of $13.5 million in state funds for the four planned projects, with an overall $134 million projected capital investment. All four of the major projects, the Convention Center Hotel, Bomgaars Ag Expo Center, Virginia Square, and the Warrior Hotel and Davidson buildings are moving forward. The fundraising for the Bomgaars Ag Expo Center has reached the goal of over $5 million in private funds committed, meeting the state contingency. Additionally, a total of $918,000 in State Brownfield funds were awarded to the Warrior Davidson project. Additional Downtown Developments J Development announced plans to redevelop three historic buildings in Sioux City, including the former Hatch Furniture building, Commerce building, and the former St. Luke s Methodist Hopsital building into mixed-use and market-rate residential facilities. $750,000 of State Brownfield funds were awarded to both the Commerce and St. Luke s building projects. The three projects will add over 24,000 square feet of commercial space, with a total capital investment of $34 million.

15 Promote Sioux City Promoting Sioux City as not only a tourist destination but as a great place for people to settle down, raise a family or start a business is a strategic focus area City staff prioritize. Accomplishing this goal means increased recreational opportunties, continued development of our public spaces, and enhancing local arts and cultural amenities. Recreational Opportunities Grow Cone Park Cone Park, Sioux City s new four seasons park, officially opened on December 21, Cone Park features a tubing hill with automated snow-making equipment, a refrigerated ice skating rink, an outdoor fire pit, and a lodge for warming, rentals and concessions. The lodge will be used as a rental facility during the non-winter months and the skating rink will convert to a free public splash pad in the summer. Friday and Saturday evenings in the winter months from 9:00-11:00pm feature Cosmic Tubing sponsored by the Hard Rock Hotel Sioux City. The event allows visitors to tube down the hill to a laser light show coordinated with music. A special thanks to the Cone Family, Iowa Economic Development-Vision Iowa, Missouri River Historical Developement (MRHD), Woodbury County, Hard Rock Hotel Sioux City, Wells Enterprise, The Grupp Family and the many businesses and individuals that helped this project become reality. The Arena The City is currently working with HCC Enterprises to construct a major new recreation and sports training facility near the Bomgaars Ag Expo Center. This facility will provide year-round athletic opportunities for the region, including youth sports training programs for basketball, volleyball, baseball, football, softball, etc., multi-sport leagues and tournaments, athletic showcase events, multi-court facility rentals, coaching clinics, and more. New Downtown Park The Pearl Street Park grand opening was held in October The park project was made possible by the generous donation of Regina Roth. The new downtown park includes play structures, musical play features, shade structures, stone boulders, bicycle racks, paved walking paths, landscaping and pedestrian lighting. Recreational Programming Pickle Ball Sioux City Parks and Recreation now offers Pickle Ball at the Long Lines Family Rec Center. Pickle Ball memberships will be available through June 30, Rock On! The 4th Annual Rock On! Climbing Competition was held at the Long Lines Family Rec Center in December The competition was held for climbers age five and up. There were 1st, 2nd and 3rd place winners for both men and women in mulitple divisions. Next year staff anticipate doubling the number of participants. Making a Splash The Cook Park Splash Pad project kicked off with the demolition and landfill of the Cook Park pool in November DeWild Grant Reckert and Associates (DGR) was hired for design services for the splash pad construction project. The Cook Park Splash Pad is anticipated to open in summer of Breakfast With Santa A Breakfast with Santa event was held in November 2017 at the Long Lines Family Rec Center. Families were able to have a fun, festive breakfast together, decorate cookies, and participate in crafts. Santa was there to visit with the children and take pictures.

16 Promote Sioux City Enhancing Local Arts Attracting Visitors Fall Fest Fun Two dozen attractions hosted events celebrating fall in Sioux City October 13-14, The family-friendly activities were designed for residents and visitors to enjoy the fall season in Sioux City, spend time with friends and family and showcase local attractions. Some of the activities included free or reduced admission to attractions, costume contests, food trucks, crafts, live music, Baconfest, and more. First Hour Free The trial promotion of 1st Hour Free Parking in the City parking ramps downtown was implemented in the fourth quarter of Preliminary data shows that this promotion is encouraging additional usage of the ramps and those users are generating enough additional revenues to offset a significant portion of the predicted revenue loss. Parking is in the process of upgrading the enforcement equipment used by City parking attendants. Parking ramp signs were also recently updated. The new LED lighted signs offer an improved user-friendly visual to attract and educate visitors. Foodie Drives Tourism Sioux City Foodie, a new web series highlighting local restaurants, launched in the summer of 2017 and now has 1,901 followers and 1,828 page likes on Facebook. Four videos have been shared to date, with a total reach of 110,579 and 52,500 views. All businesses spotlighted in the videos saw a large spike in business immediately following the video s release. From Pierce Street Coffee Works to Shahi Palace, many new faces and new customers were noted, which means Sioux City Foodie is not only driving tourism, but educating locals about what is available in their hometown. Gilchrist Learning Center The Sioux City Art Center held a groundbreaking on October 26, 2017 to mark the beginning of construction on the Gilchrist Learning Center. The new standalone Gilchrist Learning Center facility will allow the Art Center to increase public access to its education programs by expanding the number of classes and workshops offered, as well as the hours its programs are available to the public. In addition, the new Learning Center will expand and enhance the Art Center s ongoing collaboration with the Sioux City Community Schools. The projected completion date for the Learning Center is July Broadway Audience Grows The Orpheum Theatre Board initiated a consultancy with TRG Arts out of Colorado over a year ago, and since then staff have worked with TRG on strategies designed to increase attendance, subscriptions, and revenue for the annual Broadway Series. So far, it looks like the strategies are working. For the season, total subscription revenue is up 55% over last season. There is a 93% increase in acquistion packages sold and 71% of renewing subcribers upgraded to a full 6-show series. New LAMB Theatre LAMB Arts Regional Theatre & School announced in October a capital campaign to turn the building at 625 Douglas St. into a performing arts center that will be the new home for the theatre. The restored building, an $11 million project, will include a 250- seat thrust theatre, as well as a 120-seat studio theatre and a smaller cabaret-style theatre, all surrounding a beautiful 2-story atrium with skylight. Additional space will be available for classrooms, rehearsal areas and dressing rooms. Russell Wooley, LAMB Arts Regional Theatre Artistic & Managing Director, said, We re proud to say that this renovation, along with the excellence and innovation of LAMB Theatre, will rival cities much larger than ours.

17 Enhance Connectivity with Citizens & Businesses The City of Sioux City encourages resident engagement within their communities by parnterning with local businesses and educational institutions to increase opportunities, nurturing young professionals, streamlining City processes to gain efficiencies for citizens, and promoting volunteerism. Community Engagement Future of Sioux City Several community-wide events, workshops, surveys and meetings were held in October of 2017 to engage residents and business owners with the development of a new Comprehensive Plan for the City of Sioux City. The plan in intended to help effectively guide city leaders as they make throughtful decisions for the community s next 20 years. Riverfront Input Citizens Get Involved City staff and the City Council encourage Sioux City residents to have a voice and engage in their local goverment and community. The Emergency Preparedness Fair held in October of 2017 was a free event open to the public to provide knowledge on how to react in emergency situations. A Coffee with Council event was held in December. The informal event allowed Sioux City residents to voice their concerns and visit with Council Members and City staff. The City s Human Rights Department hosted a free forum at the Sioux City Public Museum in early December focused on the Impact of Women-Only Spaces. On November 30, 2017 a Riverfront Development Public Input meeting was held to discuss Chris Larsen Park. It was an opportunity for the public to participate in the schematic design process of the project. Prior to this meeting, City staff, the Riverfront Steering Committee, and the consulting project team, SmithGroupJJR, Inc., held several meetings with key stakeholders to discuss and gather input for the project design. The City s Economic Development Department hosted a Business for Breakfast event with guest speaker, Srini Rao, in November. The networking event offers local professionals an opportunity to hear insights on current business trends from national acclaimed speakers. Public input meetings with Corbin Design began in December for suggestions on updating the wayfinding system in downtown Sioux City. Doing Good in Sioux City Giving Tree The Sioux City Police Department has partnered with the Friends of the Sioux City Police Department Board and local anonymous donors to create a Giving Tree program. This program allows officers who encounter individuals facing various critical needs to access limited funds to assist individuals in crisis. Officers were already able to use the program to assist with several holiday emergencies. Kiss A Pig City staff created a fun way to raise money for the United Way of Siouxland in The Kiss a Pig contest allowed employees to designate their donation to piggy banks assigned to each of the five City Council members, the City Manager and Sioux City Police Chief. The person who collected the most money in their piggy bank got to pucker up and kiss a pig! Sioux City Police Chief, Rex Mueller, was the big winner! City staff exceeded 2016 s donations and surpassed their 2017 goal. Employee Action Committee The Employee Action Commitee, EAC, is comprised of a group of City employees who volunteer to organize various employee activities. One activity the EAC organizes is the Jeans for Worthy Causes program. The program allows employees to wear jeans on Fridays if they donate to that month s charity. In December the EAC used Jeans for Worthy Causes donations to adopt two deserving families in Sioux City. The funds were used to purchase Christmas gifts for the families, winter outerwear, and househould items. Employees also donated food items to each family. A total of five boxes of food were donated to each family. The EAC also arranged to have an Angel Tree this year. The tree had the names of 50 deserving Sioux City children along with their Christmas Wish List. All 50 names were claimed by City employees who purchased and wrapped gifts for the children. Little Free Library The Sioux City Housing Authority began a Little Free Libary in July of 2017, taking up the challenge to increase reading proficiency and improve the overall academic achievement of children in low-income families in Sioux City. The Housing Authority received a donation of 3,500 books this fall to ensure children receiving rental assistance have continued access to books in their homes.

18 Enhance Connectivity with Citizens & Businesses Community Collaborations Museum Partnerships The Sioux City Public Museum has numerous on-going collaborations in the community, including working partnerships with the Human Rights Commission, The Siouxland Disability Commission, The League of Women Voters, Downtown Partners, and the Boy Scouts/Girl Scouts. Some of these activities include forums, projects and public events. The Museum worked closely with the District s Jr. ROTC in 2017 and produced programming and exhibits for their benefit. In November, the Museum hosted a Veteran s Day event conducted by the Jr. ROTC Cadets. Connecting Through Technology New Library Programs In early December the Sioux City Public Library switched its language learning database from Mango to Transparent Languages. The new database offers Library patrons over 100 languages to learn plus English learners of all levels will find engaging English content. Transparent also offers a mobile app so language learners can keep learning while on the go. Library cardholders can now stream thousands of artists from nearly 40,000 record labels free of charge without ads, anytime, anywhere. The Library now offers Freegal Music to all library cardholders. The music service offers users the ability to stream up to three hours of music a day. After-School Book Club The Sioux City Public Library partnered with Beyond the Bell to start an after-school book club in Sioux City s middle schools. The book club debuted at West Middle in November, meeting once a week for seven weeks. The Library will take the book club to East Middle in January and North Middle in March, offering more students the opportunity to engage in reading and activities. Nurturing Young Professionals Ready to Launch Sioux City s annual Launch Week, which promotes networking opportunities and entrepreneurship, was successfully held November 10-17, The week consisted of the Iowa Startup Games, business planning workshops, pitch competitions, and networking events. Career Academy The sale of the Museum Plaza building to the Sioux City School District was finalized late last year. The sale of the building to the school district will allow for an expansion of the downtown Career Academy, which provides students with the education to become a skilled workforce. Building Trust Valuing City Employees Recognition The Sioux City Police Department continues to advance public safety communication and build trust with citizens using social media. The department initiated a Social Media Unit within the agency in December. The goal of this unit is to provide 24 hour, up to the minute information to citizens with social media. apply online: On October 19, 2017 the Sioux City Police Department held a ceremony to celebrate the promotion of three officers. The ceremony was the first held in many years and allowed families, the public, and officers to celebrate their milestones. In order to better recognize and empower employees, this public promotional ceremony will now become tradition. connect with Online Applications Sioux City s Human Resources Department implemented NeoGov, an online applicant tracking system, in October of The system automates the entire hiring and selection process from requisiton to hire. The program is not only easier for applicants but is also streamlining processes for staff.

19 Instill Sioux City Pride Instilling Sioux City pride in residents will lead to expanded diversity, increased participation from our City s youth in all aspects of the City, and a more beautiful city. Sioux City s Youth Involvement Youth Are The Future The Sioux City Police Department realizes that the future of Sioux City lies in our youth. Because of that, the police department is heavily invested in youth involvement to educate young residents and build community. This fall, the department began several community partnerships with the Head Start and Beyond the Bell program. Officers regularly stop at local schools and program locations to read to kids, play with them, or just sit and talk. The program has been extremely successful at bringing officers closer to children in the community. Mayor s Youth Commission The Mayor s Youth Commission is a collection of Sioux City s youth who are very dedicated to the City, and participate in numerous volunteer activites throughout the year. In December, 41 high school seniors were recognized at a ceremony held at the Cone Park Lodge. The new Mayor and Mayor Pro-Tem were also sworn in that night. In 2017, 4,398 volunteer hours were completed. Christmas also signaled SCPD s continuing committment to the Shop with a Cop program as officers partnered with a local retailer to take underprivileged children on a shopping trip for family gifts had the highest participation of any prior year. We Are Sioux City Houlihan Run Sioux City recognized Shelby Houlihan, a 2016 Olympian and hometown hero, by naming a street in her honor. Houlihan Run spans about two-fifths of a mile between S. Lakeport Street and Sergeant Road. Second grade Nodland Elementary students attended the street naming event and ran down the newly named street with the Olympian. A Show of Support The Sioux City Police Department recently unveiled a new Cancer Victim/Survior Squad Car to show City support of individuals suffering as a result of this disease. The black and white police vehicle is specially marked to pay tribute to all cancer victims and surviors and is signed with the names of people who have been personally impacted by cancer. The vehicle was rolled out during the no-shave November fundraiser of the SCPD and the proceeds of the event were donated to the June E. Nylen Cancer Center. Sioux City Rocks The Sioux City Public Library hosted a Sioux City Rocks event with close to 70 residents attending. The event was an opportunity for people to come together and create painted rocks to brighten people s day. The group hides the rocks around Sioux City for others to find. The overall goal is to create a community of painters and spread positivity. It also gets people outside exploring our city. Celebrate Our Diversity Color Blind Forum Sioux City is home to a diverse population of which we are proud. The Sioux City Police Department makes great efforts to establish liasons in the community to help increase understanding and improve relationships. In a continuing effort to engage minority residents and openly discuss police-community relations, the department partnered with Unity in the Community to host a public forum. The Color Blind forum was held in October to discuss diversity in Sioux City and how to build stronger community by embracing differences. Iowa s First Sioux City is home to Iowa s first public wheelchair charging station. Installed in December, the charging station is located in the Martin Luther King Jr. Ground Transportation Center. The station is equipped with a standard power cord and 24 V 5-amp charger that allows individuals who use wheelchairs or scooters an opportunity to charge their chairs at a location other than their home.

20 Instill Sioux City Pride Protecting Our Environment Award Winning Project Two water quality projects that were partially grant-funded, the Promenade Improvement Project and the Riverside Parking Lot and Biocell Project, were completed in the fall of The Promenade Improvement Project accomplished several goals including improved stormwater drainage, improved water quality through the addition of green infrastructure, and provided increased access to green space in our downtown area. The project was awarded the 2017 Best Development Award in the Renovated Civic category by 1000 Friends of Iowa! The transformation of the Promenade area in downtown not only improves water quality, but is an opportunity to educate people about its importance. Into the Streets Re-Event In October, the City was able to utilize Morningside College students during their annual Into the Streets community service day for removing invasive species in Sertoma Park. Invasive species tend to crowd out any native species. By removing invasive species we can help the existing patches of native prairie to flourish. Sioux City s semi-annual Re-Event took place in October. Held 9 a.m. to 2 p.m. at the Long Lines Family Rec Center parking lot, the event sponsored by the City and the Environmental Advisory Board collected materials that can be recycled, reused and refurbished. Vendors at the event accepted electronics, Styrofoam, batteries, light bulbs and used bicycles. Recycling Success The City s glass recycling program has been in place for one year now. To date, over 100 tons of glass have been recycled through Ripple Glass. Ripple Glass Recycling Containers can be found at the following locations; Hy-Vee Hamilton Blvd. Hy-Vee Sergeant Rd. Hy-Vee Gordon Dr. Fareway War Eagle Dr. Fareway Indian Hills Dr. Prairie Habitat The Parks and Recreation Deparment was awarded a Prairie Partners Cost Share Program Agreement and a Partners for Fish and Wildlife Program Landowner Agreement for funding to support establishing a wildlife habit in the Sioux City Loess Hills Prairie Corridor. The proposed improvements are designed to improve the habitat for native pollinators, including the monarch butterfly. The work will include the establishment or restoration of native prairie habitats that include a diverse mix of native wildflowers and grasses that provide nectaring sources and shelter for pollinators to survive. Staff is looking into utilizing group rides if they can coordinate times and locations, this may result in Paratransit cost savings which will be brought back to wrap up. Public Works Dave Carney, Public Works Director; Ed Pickens, Public Service Field Supervisor; and Darrel Bullock, Code Enforcement Manager; presented the Public Works budget. Council asked for a resource area or link to be placed on the City s website for volunteer and for-hire snow removal by neighborhood. Ed Pickens, Public Service Field Supervisor, stated he has contacted the Sioux City Community School District to see if any student athletes or groups would be interested in volunteering for private snow removal as needed. City Council Donna Forker, Finance Director, presented the City Council budget. Council asked about the contributions to other for agencies for Blue Zones and Siouxland Film Festival, this will be brought back to wrap up. Council mentioned funds will need to be budgeted for the USS Sioux City trip. City Manager Robert Padmore, City Manager, presented the City Manager budget. Motion by Scott, seconded by Capron, to double the amount allocated for the internship program to $31,864; all voting aye. Finance Donna Forker, Finance Director, presented the Finance budget. Revenue will increase $12,500 in e-payables rebate.

The new and improved Comprehensive Plan will feature a chapter devoted to historic preservation and will initiate a subsequent Preservation Plan based on the goals identified in the Comprehensive Plan update. The Historic Preservation Commission has representation on the Steering Committee and two Commissioners are part of a one-on-one stakeholder group directly with the Plan s consultants, Houseal-Lavigne. The commission approved a 2018 work plan to include work on the Woodbury County Courthouse 100 th Anniversary celebration, the involvement of college students in preservation projects, and developing a robust historic property inventory. (See Attachment A) HPC has identified a downtown study area to build an all-inclusive database of historic information, inventories, photos, architectural features, etc, and will use the information, for instance, to build a mapping and app component to tie to the HPC website found here: b. 44 2017, there were several requests from individuals wanting technical assistance, including serious inquiries on the purchase of deteriorated historic structures. Many of these requests have come through the updated Sioux City HPC website ( Members of the Commission have guided the Heights Neighborhood through the survey and site inventory process to prepare for an application to the National Register of Historic Places. The Heights Neighborhood is in the process of applying for local grant funds to prepare the NRHP application materials. c. Sponsored public educational programming in historic preservation. Examples include training sessions offered to the public, walking tours, open houses, lectures, Preservation Month activities, etc. (use additional pages if needed) Sioux City HPC continued its educational programming in 2017 through the 13 th Annual Historic Preservation Week (see Attachment B). Planning for the week begins in October for the events held the first week of May. The Commission partners with several organizations in Sioux City to make the week a success. Partnerships include the Sioux City Public Museum, Downtown Partners, the Northwest Iowa Architects Council, SiouxLandmark, and Rivercade. Activities in 2017 included presentations on the Virginia Square development, which is located in the city s old warehouse district, a walking tour of the Virginia and Court Street area, which bridges the old warehouse district with Historic Fourth Street District, National Train Day events at the Railroad Museum, and the presentation of the Treasure of Sioux City Award (s) to Grace Lindon, a local preservationist, and the John Peirce Mansion Committee. In addition, the Sioux City Historic Preservation Commission website contains several self-guided walking tours for people to access. Dovetailing with the 13 th Annual Historic Preservation Week, the Commission undertook the INAUGURAL Omaha Exchange Bus Trip April 29 th and May 13 th. In partnership with Restoration Exchange Omaha, Historic Preservation Commission organized a day-long bus trip to Omaha on April 29th, where we were treated to a tour of some of their most preserved treasures: Joslyn Castle, Storz Mansion, St. Cecilia s Cathedral, and Farnam-Blackstone Historic District. Fifty Sioux City Citizens and Commissioners attended this event. Two weeks later, the Historic Preservation Commission hosted a large group from Omaha on their visit to Sioux City. They were treated to tours of the Orpheum Theatre, State Steel Building, Woodbury County Courthouse, Summit Street, and Williges Building. The inaugural tour exchange was a huge undertaking, and a huge success. The Commission looks forward to future exchanges with other cities in the area! Commission members have started work compiling property inventories and research for a new walking tour book highlighting the historic Summit Street area and the rich history therein. 6. No new or revised design standards and/or guidelines were adopted in Are there any particular issues, challenges, and/or successes your preservation commission has encountered or accomplished this year? (use additional pages if needed) Great successes were achieved by the Sioux City Historic Preservation Commission in The inaugural Omaha Exchange bus trip in spring in conjunction with Restoration Omaha was a highlight, and the Commission hopes to make this an annual or bi-annual event with other neighboring cities in the future. The Downtown Iowa Conference, August 1 st -3 rd, was hosted in Sioux City with HPC involvement. The Commission allocated financial support of the event, as well as volunteering and attending sessions. The Commission successfully lobbied to allocate Public Works funding specifically devoted to improving brick sidewalks in Historic Fourth Street District. Two crosswalks have been installed using historic bricks with more funding allocated to the streetscape in Book sales at the Sioux City Public Museum and Sioux City Gifts greatly contribute to the funding of training opportunities and donations to local conferences and celebrations that are pertinent to furthering the mission of HPC. Over the years the Commission has written or greatly contributed to books ranging from biographical walking tours to indepth spotlights of terra cotta on Sioux City buildings. Each March a joint meeting of the City Council and Historic Preservation Commission is held. In 2017 the meeting focused on the creation of a wider downtown historic district and the development of a city-wide preservation plan. Staff and the Commission met with the state archeologist office and regional Native American tribes on the repatriation of human remains at the War Eagle Monument site, which was nearly destroyed by a mudslide in the late 1980 s. Work is being done by regional tribes to claim the remains for reburial. Two murals were reviewed by HPC, one in the Historic Fourth Street District. The Historic Fourth Street mural was approved by HPC as being a positive contribution to the district, if the original brick stays intact. The Commission worked diligently to advocate for the retention of Federal Historic Tax Credits during the tax plan negotiations in fall Letters, s, and phone calls were sent to all of Iowa s Senators and House Representatives stressing the direct benefits the credits continue to give downtown Sioux City. The Historic Preservation Commission continues to be proactive rather than reactive in potentially concerning preservation issues. With contacts throughout the city, members of the Commission can work with property owners behind the scenes rather than in a public hearing setting to defend preservation. The Commission appreciates notice from the SHPO of projects they are working on in Sioux City, whether that is National Register nominations, alteration projects, etc. The Commission continues to see challenges in rehabbing historic homes versus demolition. Commission members continue to work to find developers willing to undertake this type of work. While infill development is a welcome addition to the core area of Sioux City, it often results in demolition of historic resources. A number of residential and commercial properties are in danger of further deterioration and demolition. The Commission has continued to play a large role in raising awareness of the number of red-tagged homes in the historic districts in Sioux

46 City. This increased awareness of the problem has resulted in a new city matching fund program to rehabilitate homes that have been placed on the red-tagged list for demolition. 9. Section III Historic Preservation Program Administration The CLG will organize and maintain a historic preservation commission, which must meet at least three (3) times per year. The commission will be composed of community members with a demonstrated positive interest in historic preservation, or closely related fields, to the extent available in the community. Commission members will participate in state-sponsored or state-approved historic preservation training activities. 10. DISCUSSION: The City Engineering Division is in charge of the sidewalk program that addresses defective sidewalks throughout the City that are in need of repair or replacement. During the 2017 construction season 75 complaints regarding defective sidewalks were received by the Engineering Division. Of those 75 sidewalk complaints, 65 properties completed the necessary repairs themselves and 10 were completed by the City hired contractor, Strawn Construction Services, Inc. A total of 5 property owners have not reimbursed the City for the cost of the sidewalk repairs at their property, which totals $11,262.10, this total includes the additional 25% fee to compensate for the cost of supervision and administration per Sioux City Municipal Code Section Staff recommends assessing that amount against the 5 property owners, plus an additional $50.00 assessment fee as provided by Sioux City Municipal Code Section , for a grand total of $11, to be assessed. FINANCIAL IMPACT: These costs have been paid using General Obligation Bonds under CIP Annual Sidewalk Program. It is appropriate that the property owners reimburse the City of these expenditures. WHEREAS, following notice and failure of the property owner(s) to act within a reasonable time to repair or replace defective sidewalk abutting their property constituting a safety hazard, (hereinafter called "the work"), the City thereafter performed the required work necessary to repair or replace the defective sidewalk; and WHEREAS, the City Manager has reported to the City Council the total cost of performing the work in a written report attached hereto and by this reference made a part hereof; and WHEREAS, the work has been fully completed and should be accepted by the City and the costs assessed; and WHEREAS, the City Council must now fix the amount to be assessed against the benefited property. The total cost to be assessed against the benefited property is $11, The work was fully completed on November 1, 2017, and is hereby accepted. 3. After full consideration of the schedule of assessments prepared by the City Manager showing the assessments proposed to be made for the work, which schedule was filed in the office of the Clerk on February 12, 2018; the said schedule of assessments, be and the same are hereby approved and adopted; and that there be, and is hereby assessed and levied, as a special tax against and upon each of the lots, parts of lots and parcels of land, and the owner or owners thereof liable to assessment for the cost of said work, the respective sums expressed in figures set opposite to each of the same on account of the cost of performing the work. 4. The assessment shall be payable in one installment and shall bear interest at the rate of eight percent per annum, the maximum rate permitted by law, from the date of the acceptance of the work on February 12, 2018; the installment, with interest on the assessment from date of acceptance of the work by the Council, shall become due and payable on July 1, 2018; and shall be paid at the same time and in the same manner as the September semi-annual payment of ordinary taxes. Said assessments shall be payable at the office of the City Treasurer, in full or in part and without interest within thirty days after the date of the first publication of the notice of filing of the schedule of assessments with the County Treasurer of Woodbury County, Iowa.

Both items include add ons for rear door handle operable locks, dark car feature, automatic headlamps, marker lights, remappable switches on steering wheel, driver side spot lamp, cargo wiring up fit package, front headlamp lighting solution, rear lighting solution, tail lamp lighting solution, push bumpers, side protection plates, and delivery charges. DISCUSSION: The Iowa Department of Agriculture and Land Stewardship (IDALS) is requesting grant applications for projects located in urban areas that are focused on improving water quality. Successful projects will utilize conservation measures that capture and infiltrate storm water and reduce a property's contribution to water quality degradation, runoff and flooding by incorporating practices such as bioretention cells, infiltration trenches, native landscaping, and permeable surfaces. Projects should also include strong outreach/education components to promote increased awareness and serve as an example of practices aimed at reducing nutrient loads to surface waters. The Bomgaars Expo Center has been chosen as an ideal project to include green infrastructure in its storm water design. The buildings and parking lot, all impervious area, will generate a large volume of storm water runoff during rain events. Including green infrastructure in this project will slow down, cool, and filter storm water runoff from the site, which will result in cleaner water entering our waterways and less stress on City infrastructure. The grant requires an educational component to these projects; this will be accomplished by educational signs installed at each practice to explain the benefits of these features. The Bomgaars Expo Center is expected to attract many visitors from throughout the region for a variety of events which presents an ideal opportunity to educate the public on the impact storm water runoff has on water quality and to affirm the City s commitment to environmental initiatives including cleaner storm water runoff. Additionally, it is required by the City s MS4 permit issued by the Iowa Department of Natural Resources for the discharge of storm water that the City enforce water quantity and water quality requirements for all projects, including City projects.

69 If approved, this grant will fund 50% of the construction costs of green infrastructure improvements including a combination of soil quality restoration, infiltration trenches, and native landscaping that will improve water quality. FINANCIAL IMPACT: This project will be funded through a Department of Agriculture and Land Stewardship Water Quality Initiative Grant in the amount of $100,000 with a City match of $100,000 from CIP , Reinvestment District Ag Expo and Learning Center. We have received payment for said damages and are ready to begin repairs. The scope of work includes the design services necessary to prepare plans and specifications for work associated with repairs and replacement of many roofs consisting of asphalt shingles, TPO, EPDM, metal and Kalwall panels. FINANCIAL IMPACT: The funding for the design contract is covered under the CIP for storm recovery. GR Equipment Leasing, Inc. is the real estate holding company for Hirschbach Motorlines which purchased property at 306 Virginia Street. The property adjacent to the north of Hirschbach s property is currently under contract to be sold. The title opinion prepared for the buyer indicates that the legal description used for the Hirschbach Motorlines minimum assessment agreement mistakenly included this adjacent parcel located at 310 Virginia Street. The proposed amendment corrects this issue and allows the sale of 310 Virginia Street to move forward. FINANCIAL IMPACT: None. The proposed amendments will not affect the amount of the minimum assessment. DISCUSSION: In November 2007, as part of a plan to secure New Market Tax Credit ( NMTC ) funds through Iowa Business Growth and Iowa Community Development of Des Moines, the City transferred the ownership of the property located at th Street to an Iowa nonprofit corporation, Museum Building Property, Inc. The NMTC funds were obtained and the project was successful in that the building was developed for commercial use. Museum Building Property Inc. no longer needs to own the property to comply with the NMTC funds requirement and on January 30, 2018, Museum Building Property, Inc. sold most of the property located at th Street to The Sioux City Community School District in the Counties of Woodbury and Plymouth. A portion of that property, commonly referred to as the green space located in the southwest corner of the property, was retained by Museum Building Property, Inc. Museum Building Property, Inc. wishes to transfer that portion of the property back to the City and has executed a warranty deed to do so. FINANCIAL IMPACT: The amount of $1.00 plus costs. The City of Sioux City Urban Revitalization Area was created by Council action on October 1, 2007 and will expire on December 31, 2020.

109 DISCUSSION: The City Council is required by Iowa's Urban Revitalization Law to accept applications for tax exemption prior to February 1, Per Iowa State Code Chapter 404, property owners are allowed to file for tax exemption up to two years late and still be eligible for full tax exemption. Property owners that fail to apply for tax exemption up to two years late may apply for tax exemption at any time during the ten-year tax exemption schedule and be eligible to receive tax exemption for the years remaining in said schedule. A total of thirty-five (35) late applications have been received thirty-one (31) applications are one year late, two (2) applications are two (2) years late, one (1) application is three (3) years late, and one (1) application is five (5) years late. The applications are requesting Schedules 1, 2 and 3 tax exemptions on the value added by improvements made to their properties in 2016, 2015, 2014 and The applications represent $6,526,260 in investment by the property owners. Once approved, the applications will be submitted to the City Assessor who will certify that the improvements made by these property owners meet the minimum percentages allowable for tax exemption based on the State law and assessment records. Residential structures must have increased in value by 5% and multi-family structures by 10%. FINANCIAL IMPACT: Property tax exemptions are for the increased tax valuation on new construction or improvements only. Land taxes and existing property taxes are not exempt. Schedule 1 is for minor residential improvements and provides a ten year 115% property tax exemption. Reviewed By: x Department Director x Finance Department x City Attorney x City Manager RECOMMENDATION: Staff respectfully requests Council approve the above resolutions accepting applications for property tax exemption for improvements made in an urban revitalization area. The City of Sioux City Urban Revitalization Area was created by Council action on October 1, 2007 and will expire on December 31, DISCUSSION: The City Council is required by Iowa's Urban Revitalization Law to accept applications for tax exemption prior to February 1, A total of 200 applications have been received from property owners in the City of Sioux City Urban Revitalization Area requesting Schedules 1, 2 and 3 tax exemption on the value added by improvements made to their properties in 2017 (in applications were received). The applications represent $32,003,687 in investment by the property owners (in 2016 it was $21,891,743). Once approved, the applications will be submitted to the City Assessor who will certify that the improvements made by these property owners meet the minimum percentages allowable for tax exemption based on the State law and assessment records. Residential structures must have increased in value by 5% and commercial structures by 10%. FINANCIAL IMPACT: Property tax exemptions are for the increased tax valuation on new construction or improvements only. Land taxes and existing property taxes are not exempt. Schedule 1 is for minor residential improvements and provides a ten year 115% property tax exemption.

DISCUSSION: The Finance Department has on file a list of gross cumulative payments paid to each separate accounts payable vendor on a monthly basis. This listing is available for Council Members perusal. On your agenda for Monday is a total amount of these payments for City Council approval. The day after the Council meeting, the Finance Department files the list with The Sioux City Journal for publication. Detailed information on these listed payments can be found in the Finance Department. This department keeps a weekly claim register, which lists vendor name, vendor number, and account code. Any question from Council members or citizens concerning vendor payments are easily answered using a cross-reference system on the mainframe computer, which searches information on vendor payments. MYC currently maintains 10 Little Free Libraries (LFL) which are located at Bishop Heelan Pre-K, Book People, Bush Cleaners, Jitters, LaunchPAD, Mercy Medical Center, SC Art Center, SC School District, SC Journal, and SC Police Department. Matt and JoAnn explained that many four-year-old children are not prepared to learn, and they would like to build on the Little Free Libraries we have in an effort to promote early literacy initiatives and would like to add LFLs in areas where preschoolers are. Becky Carlson, Siouxland District Health Department, is working on a campaign, Tobacco 21, to change the age to purchase tobacco products to 21. She needs three MYC students to attend advocacy leadership training to help promote this campaign. She also has a grant for Reinvent the Reel, which is designed to raise awareness of smoking in movies and encourages the movie industry to rate R for movies that have smoking. Payton Beaumier, West High Senior and former MYC Executive Council Member, is working with Siouxland Teens Against Human Trafficking through education and awareness. She will make a presentation to the full meeting on February 26. Mary Koster, Youth Services Coordinator for Siouxland CARES, reported on MYC activities including Neighborhood Network Family Fun Night, Humane Society Caramel Apple Fundraiser, Daddy Daughter Date Night, and Safety Up Lock In (formerly DARE Lock In). Election of the Mayor and Mayor Pro-Tem were held in December. Mayor Bob Scott and City Council members Dan Moore, Rhonda Capron, Pete Groetken and Alex Watters will present the seniors with their senior certificates recognizing their service on Mayor s Youth Commission. Mary Koster reported on upcoming volunteer opportunities. Election was held for MYC Mayor and Mayor Pro Tem. Carli Gasaway, West High School, was elected Mayor. Grace Hoak, East High School, was elected Mayor Pro Tem. Mayor Scott will administer the oath of office to them at the December 11, 2017 meeting. Interviews for new MYC Executive Members were conducted. The next Full Meeting will be Monday, December 11, The next Executive Council meeting will be Monday, January 8, 2018 at 7:00 p.m. at the Chamber of Commerce building. 163 SIOUX CITY TRANSIT ADVISORY BOARD REGULAR MEETING January 17, 2018 On this date 3:32 p.m., at 509 Nebraska Street, Sioux City, Iowa, was held a regular meeting of the Sioux City Transit Advisory Board for the purpose of discussing items of interest and concern to the Sioux City Transit System, the City of Sioux City, and the citizens thereof, matters to be brought to the attention of the Advisory Board by the Transit Manager; and such other business that might properly come before the Board at this time. Collett provided some background information about transit and paratransit operations to Errickson. Owens suggested that Errickson meet with Transit staff to gain additional information regarding Transit operations. ITEM NO. 2 APPROVAL OF OCTOBER MINUTES Bruhn made a motion, Errickson seconded the motion, to approve the minutes from the October meeting. All members present voted aye to approve the minutes. ITEM NO. 3 OPERATING AND PARATRANSIT REPORTS Collett stated we are half-way through the fiscal year. Collett explained the report structure as well as the expense and revenue categories. Passenger counts are down, due in part to operating one less school route. Paratransit ridership has experienced a significant increase in the month of December, because of a change in state Medicaid law. Miller stated SRTS has lost a lot of rides because of the change. Miller stated the Iowa Public Transit Association is working with legislators to make revisions to the rule in order for rides to be paid for. Owens asked of the ARC is involved; and stated the agency might be able to help with the issue. Collett stated this change could cost the transit system an additional $200,000. Staff is working with local agencies on ride efficiencies to reduce the impact. Collett stated Transit staff recently attended Triennial Review training, in Des Moines. The next triennial review will be in The annual NTD report has been submitted. The CIP hearing will be held this Saturday and the operating budget hearing is scheduled for February 3 rd. Collett provided information about the items that will be programmed into the CIP. Collett explained the point system used throughout the state for bus replacement.

164 ITEM NO. 4 OTHER BUSINESS A. Grant Updates Harcum stated the passenger shelter improvement project, funded with a PTIG grant has been completed. Harcum stated the local Jr. League also provided funds for a new passenger shelter. Owens asked if concrete was poured, that was not funded with PTIG funds. Harcum replied yes; and he further explained the process involved based on historic preservation and environmental assessment requirements. Collett stated the concrete projects are being funded with local city bond money. A new grant cycle will be coming up in May, and Transit staff plans to apply for funding to make improvements at the garage, such as a new security camera system, and lighting improvements. Transit and city staff are working on a plan for replacing concrete at the garage. Harcum stated there is no current project to apply for, in the next Intercity Bus Grant. B. New Freedom Nights & Weekends Transportation Harcum stated he is looking for more funding for this service, which is transportation service for eligible paratransit passengers during the nights and weekends when transit buses do not operate. Harcum stated the local share balance is $4,142, as of December 31,2017. This amount is probably not enough to get through the year. Owens stated he will follow up with Green Valley- Floyd Golf Course for a donation; and he plans to work on getting additional contributions to help fund the nights and weekends transportation service. Discussion was held about various agencies who might possibly contribute. ITEM NO. 5 OTHER DISCUSSION Only two board members were physically in attendance, in November. One member attended via telephone, which does not constitute an official meeting. Therefore, the minutes from the October meeting had to be approved today. Collett provided information regarding an accident that involved a bus, this week. Reviewed By: x Department Director Finance Department x City Attorney x City Manager RECOMMENDATION: Staff respectfully requests that the City Council approve the subject urban renewal subarea, based on the following findings; Planning Commission: Agenda Item : Requested Planning and Zoning Commission certification that the Mercy Sub-Area of the Combined Central Business Urban Renewal District conforms to the Sioux City Comprehensive Plan, as adopted in August (Petitioner: City of Sioux City) Chris Madsen stated a developer has approached the City to extend an Urban Renewal Area in order to rehab a building located adjacent to the Mercy Sub-Area. Chris Madsen stated the consultation was held last week, and no members of the affected taxing entities attended the consultation. Suzan Stewart asked if Urban Renewal Districts cost the City more money. Chris Madsen responded stating it doesn t cost the City money as it will not be a TIF (Tax Increment Financing) District, it does however give the developer more opportunities for grants, other funding sources, etc. due to being located inside of an Urban Renewal District. Michelle Bostinelos asked if the Mercy Sub-Area is extended, will it still have the same ending date as the current district. Chris Madsen responded stating yes it will have the same ending date as the current district.

166 Bostinelos (Geary) moved to recommend to the City Council approval of the item. Motion Carried (Yes: Silverberg, Geary, Bostinelos, Krage, Stewart/ No:0/ Abstain:0). Findings of Fact: 1) The proposal conforms to the Comprehensive Plan. 2) The applicant s proposal conforms to the minimum Municipal Code requirements. Recommended Conditions of Approval: 1) None DISCUSSION: This amendment to the Amended and Restated Combined Central Sioux City -CBD Urban Renewal Plan increases the area of the existing Combined Central Sioux City -CBD Urban Renewal Plan and revises certain sections of the Plan to conform to current City objectives and planning initiatives for the urban renewal area. The separate identities of the Sub-Areas previously established as part of the Plan will be maintained and observed for those purposes which are aided by or in need of the division, but the combined areas of the several Sub- Areas shall be treated together for planning and redevelopment purposes. This Amendment is intended to increase the area of the existing Project Area by adding a tract of land adjacent to the existing Mercy Sub-Area. The existing Mercy Sub-Area and the proposed extension are not a part of the Tax Increment Financing designation. The other existing sub-areas will remain unchanged from the November 13, 2017 designation. This amendment is also intended to continue to promote the development of additional commercial and industrial, as well as residential, sites in the Project Area through the expansion of the infrastructure systems and public facilities in the Project Area. The construction of such facilities is considered to be critical to achieving the objectives of this Plan and is being undertaken as a benefit to the Project Area and the City as a whole. A public hearing is the last step towards approval of this amendment. FINANCIAL IMPACT: Extension of the Combined Central Sioux City-Central Business District Urban Renewal Area will allow for use of economic development tools such as targeted jobs within the proposed subarea. RELATIONSHIP TO STRATEGIC PLAN: Municipal Responsibility: Economic Opportunity. Focus Area: Expand Development Opportunities and Grow Sioux City. #3 Grow a vibrant and balanced economy. This Council further finds: The Amendment No. 2 to the Amended and Restated Combined Central Sioux City -CBD Urban Renewal Plan of the City of Sioux City, Iowa, conforms to the general plan for the development of the City as a whole; and With reference to those portions thereof which are to be developed for non-residential uses, the City Council hereby determines that such non-residential uses are necessary and appropriate to facilitate the proper growth and development of the City in accordance with sound planning standards and local community objectives. Section 3. That Amendment No. 2 to the Amended and Restated Combined Central Sioux City -CBD Urban Renewal Plan for the Combined Central Sioux City -CBD Urban Renewal Area of the City of Sioux City, Iowa be and the same is hereby approved and adopted as "Amendment No. 2 to the Amended and Restated Combined Central Sioux City -CBD Urban Renewal Plan for the Combined Central Sioux City -CBD Urban Renewal Area"; Amendment No. 2 to the Amended and Restated Combined Central Sioux City -CBD Urban Renewal Plan is hereby in all respects approved; and the City Clerk is hereby directed to file a certified copy of the same with the proceedings of this meeting. Section 4. 175 PROPOSED URBAN RENEWAL AMENDMENTS Section D, PROJECT DESCRIPTION, Subsection 1, Boundaries of the Combined Central Sioux City -CBD, is amended to read as follows: 1. Boundaries of the Combined Central Sioux City-CBD. The Combined Central Sioux City -CBD Urban Renewal Project Area encompasses certain areas located generally downtown and extending from the Missouri River in the south to the 8 th Street to the north, and the Floyd River Channel to the east and Hamilton Boulevard to the west. As the Project Area has grown, the new areas being added have been designated as Sub-Areas of the Project Area. Each of the Sub-Areas are described in the following subsections of this Plan, and the legal descriptions of each Sub-Area are included in the Appendices. The boundaries of the Project Area are shown on Map 1, Combined Central Sioux City CBD Boundary. Section D, PROJECT DESCRIPTION, Subsection 2, Sub-Areas of the Urban Renewal Area, Sub-subsection (g), Mercy Urban Renewal Sub-Area Boundary Description, is amended to read as follows: g. Mercy Urban Renewal Sub-Area Boundary Description Pursuant to Resolution No , passed and approved on the 21 st day of November, 2011, the City Council of the City of Sioux City, Iowa, approved and adopted the Mercy Urban Renewal Sub-area, and subsequently amended on the 12 th day of February, 2018, pursuant to Resolution No to include the area bounded by Jennings Street on the west, Sixth Street on the north, Court Street on the east, and Fifth Street on the south. URBAN RENEWAL PLAN AMENDMENTS The Plan may be amended from time to time for a variety of reasons, including but not limited to, adding or deleting land, adding urban renewal projects, or to modify goals or types of renewal activities. The City Council may amend this Plan in accordance with applicable state law. EFFECTIVE DATE This Urban Renewal Plan Amendment No. 2 will become effective upon its adoption by the City Council. Notwithstanding anything to the contrary in the Urban Renewal Plan, any prior amendment, resolution or document, the Urban Renewal Plan shall remain in effect until terminated by the City Council, and the use of incremental property tax revenues, or the "division of revenue," as those words are used in Chapter 403 of the Code of Iowa, will be consistent with Chapter 403 of the Iowa Code. REPEALER Any parts of the previous Plan, as previously amended, in conflict with this Amendment are hereby repealed. SEVERABILITY CLAUSE If any part of the Amendment is determined to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of the previously adopted Plan as a whole or the previous amendments to the Plan, or any part of the Plan not determined to be invalid or unconstitutional.
