1 STATE OF TEXAS COUNTY OF DENTON TOWN OF DOUBLE OAK The met in regular session at 7:00 p.m. at the Double Oak Town Hall, located at 320 Waketon Road with the following members present to-wit: Mike Donnelly Anita Nelson John Dondrea Steve Durbin Ted Gruenloh Ara Minassian Mayor Mayor Pro-Tem Deputy Mayor Pro-Tem Council Member Council Member Council Member Also in attendance were Town Attorney David Berman, Police Chief Derrick Watson, Director of Public Works Charlie Wright, Town Secretary Charlotte Allen and Assistant Town Secretary Eileen Kennedy Mayor Donnelly called the meeting to order at 7:03 p.m. Council Member Durbin gave the invocation. Council Member Minassian led the pledge of allegiance to the American and Texas flag. Mayor Donnelly announced the following employee anniversaries with the Town: Detective Clint Murphy will observe his 1 year anniversary with the Town of Double Oak PD on November 25th Officer Brian Shults will observe his 8 year anniversary with the Town of Double Oak PD on November 12th Director of Public Works Charlie Wright will observe his 12 year anniversary with the Town of Double Oak on November 4th PROCLAMATION NOVEMBER 2-6 MUNICIPAL COURT WEEK Mayor Donnelly acknowledged a Proclamation declaring November 2 6 as Municipal Court Week

CITIZENS COMMENTS Mr. Kevin Falconer, 1003 Cambridge Court, Carrollton, Texas, stated: He was soliciting the support of the Council for election to the Denton County Appraisal District Board of Directors Ms. Candace Simon-Burch, 165 Creekside Drive, Double Oak, stated: She was present to invite all to attend the Annual Constable Tim Burch Christmas Party and Fund-raising Auction IV. MAYOR, COUNCIL MEMBERS AND STAFF REPORTS 4. Mayor and Council No report was given 1. Administration Town Secretary Charlotte Allen reported: Administrative Town Clerk Lynn Jones was enrolled in a seminar to be held in March in Addison and was registered to sit for the Level 2 Certification exam

Public Works/Code Enforcement Director of Public Works Charlie Wright reported: For Public Works, the trees between Bridlewood and Kings would be trimmed beginning this week The 2015 general road repair program (all potholes) was completed no invoice had been received The seal-coating on Highview was still being completed The annual crack-sealing from last fiscal year was still to be finished 2. Public Safety Police Chief Derrick Watson reported: Approximately 200 residents had turned out for National Night Out Due to the efforts of Detective Clint Murphy dozens of identity theft and fraud warrants had been issued in Kansas IV. NEW BUSINESS AGENDA (CONSIDERATION AND ACTION): MAYOR DONNELLY MOVED AGENDA ITEM 9 FORWARD IN THE AGENDA ORDER 9. DISCUSSION, CONSIDERATION AND ACTION TO RENEW AND EXTEND A SPECIFIC USE PERMIT FOR PART OF LOT 5, BLOCK A, CROSSROADS BIBLE CHURCH ADDITION, BEING LOCATED AT 8301 JUSTIN ROAD, LOCATED WITHIN THE CORPORATE LIMITS OF THE TOWN OF DOUBLE OAK, TEXAS AND BEING PARTICULARLY DESCRIBED IN EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF; ALLOWING THE USE OF THE PROPERTY FOR SEASONAL RETAIL SALES; PROVIDING CONDITIONS OF USE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND ($2,000.00) DOLLARS FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE Director of Public Works Charlie Wright reported: The SUP had been re-examined every year since approved in 2011 The applicant s requests and needs had changed and now wanted to add some covered areas One was already in place on the property A new site plan was distributed with this request

4 Page 4 The question was did she want to renew the site plan while the Town Attorney was present to answer re-zoning questions Lisa Hildinger stated: The business had grown considerably and continued to expand the inventory and product line Due to the Fire Lane, everything had to be moved back When that happened, they had expanded some of the shade cloth covered areas There was uncovered area which they would like to cover at the beginning of the next year and would probably want to cover the remainder later in the next year The parking area would also be expanded which would make the whole business bigger Director of Public Works Charlie Wright reported: The purpose of the 2 buildings that would be going up (metal poles with sheet plastic) was to protect plants in the winter-time The original SUP, Section 2 called out that when the seasonal business was not operating, any building or structures on the property have to come down This request was a change Lisa Hildinger responded: This was a change because the business had grown so much it was difficult to take everything down and put it back up The size of the operation at this point was the cause of the change Director of Public Works Charlie Wright stated: The reason for annual renewals was to assess the true impact of the business - how is it going to look, feedback from the community Mayor Donnelly asked Town Attorney David Berman if the Council could review Section 2 of the original SUP ordinance and make amendments or changes. Town Attorney Berman stated: If fact, that had been done with minor tweaks He would not be comfortable if substantial changes were being considered without a P&Z recommendation and Council public hearing with notice to the public If this was a renewal with only a few tweaks, he was OK with that

5 Page 5 The site plan issue was a different issue it was not a zoning change but more administerial in nature The Council could grant a waiver but the ordinary process was submittal of a site plan to the P&Z The P&Z would review and send a recommendation on to Council for consideration Ms. Hildinger stated they wanted to add 2 more buildings as they were now growing their own plants. Mayor Donnelly asked Ms. Hildinger if she had talked to Crossroads Bible Church about the changes due to their existing restrictions on the property. Ms. Hildinger responded that she had spoken with the church. Durbin motion, Nelson second to extend the existing ordinance for 1-year with a review by P&Z based on what has been submitted for the additional buildings and also when it comes back to Council, reconsider of length Gruenloh, Minassian, Nelson, Dondrea, Durbin THE COUNCIL RETURNED TO THE REGULAR AGENDA ORDER 8. DISCUSSION, CONSIDERATION AND ACTION ON CHANGES TO EMPLOYEE INSURANCE EFFECTIVE 12/01/15 Mr. Rodney Dryden, Wellspring Agency, briefed the Council on the information provided in the agenda packet. Minassian motion, Gruenloh second to approve the G620 plan and apply a bulk reimbursement arrangement for a dollar amount $3001 through $3009 per single employee per year and dollar amount $9001 through $11,700 per employee family per year payable upon demand and also to renew the Met-life Dental Plan, the Met-life Life Insurance Plan and add the Employee Assistance Program and the Fresh Benies 24-hour doctor hotline Durbin, Gruenloh, Minassian, Nelson, Dondrea

6 Page DISCUSSION, CONSIDERATION AND ACTION ON PURCHASE AND INSTALLATION OF MUNICIPAL COURT WALK-THROUGH METAL DETECTOR AND HAND-HELD METAL DETECTOR Police Chief Derrick Watson reported: Court was held 12 times per year with usually large groups appearing at Court Currently all persons initially entering court were wanded for weapons The concern was having someone go through security, leave the court room, go to the parking lot and return after court was in session The total cost of these upgrades would be covered through the Court Security fund Minassian motion, Nelson second to authorize the purchase and installation of a Court walkthrough and hand-held metal detector not to exceed $$4, Nelson, Dondrea, Durbin, Gruenloh, Minassian 11. DISCUSSION, CONSIDERATION AND ACTION ON THE TOWN OF DOUBLE OAK S PARTICIPATION IN THE TxDOT GREEN RIBBON FUND GRANT PROGRAM AND/OR LANDSCAPING AND IRRIGATION ALONG FM-407 AT DOUBLE OAK No report was made. 12. DISCUSSION, CONSIDERATION AND ACTION ON HOUSE BILL 157 LOCAL SALES TAX BILL AND OPTIONS FOR CALLING AN ELECTION IN MAY, 2016 Mayor Donnelly reported consideration was being given for a 1% sales tax election in May CITIZENS COMMENTS No citizens came forward.

7 Page COUNCIL STAFF ANNOUNCEMENTS AND COMMENTS: Council Member Durbin commented there was a severe erosion issue between West Carruth Lane within the easement. Council Member Minassian commented there was a great increase in trash on Tanglewood Lane. Assistant Town Secretary Eileen Kennedy commented that the Board of Adjustment would be meeting on November 18 to consider a variance request. 15.
