1 November 21, 2016 A City Council workshop and regular meeting was held on the above date in the City Council Chamber, 100 South Houston Avenue with all officers and members present except City Manager JRhett Parker. Mayor Anderle called the workshop to order at 5:30 p.m. Mayor Anderle briefly reviewed the agenda items. Steve Morris requested the Council approve the ordinance abandoning a portion of Vogelsang. The street was never developed. By abandoning the street, the adjoining property owners could then put fencing up to keep people off the property. The following departmental reports were reviewed by each Department Supervisor: Street Supervisor Craig Arnold stated that patching, striping and handicap parking are underway. Trees are being removed for CEDC property. Trees have been trimmed at Hike and Bike trail, Ledbetter, Orchard Park and Downtown mall. Flowerbeds have also been cleaned out. Council Member Schiller thanked the crew for clearing out the dead tree at the Williams Civic Center. Council Member Williams asked when the street behind Rattlers will be paved. According the Craig, it will be done when paving resumes next year. Fire Chief Henry Horelica stated that the Fire Department has been slow. They have been planning for the upcoming Christmas parade. Police Chief Randy Dixon reviewed his typed report. The Police Department has received a $7,500 grant. The building is almost complete and thanked all who attended the grand opening. Fencing has begun and should hopefully be complete soon. Officer Domel was given an award from Cameron ISD for the traffic control he provides at Fannin Avenue and 22 nd Street. Council Member Goza asked about parking concerns at the new police building. Chief Dixon acknowledged possible parking issues and will continue to work on a solution. Court Clerk Wende White reviewed her typed report. Librarian Marie Christopher stated that the Library had received Bots and Books grant. The program will begin in January Twelve libraries in Texas received 8 kits and 8 I pads from the grant. The library has begun a Books on Wheels program for patrons that cannot get out. The Halloween party for the community was a success. City Secretary Amy Harris reported that a new electric provider contract was negotiated and will save the City $15,000 over the 3 year contract. Preparing for the auditors currently. Utilities Director Jerald Brunson stated that all testing went well this month at the water and sewer plant. Experiencing more breaks at the sewer plant; however, the employees have been doing the repairs in-house to try to save money. Mayor Anderle called the regular meeting to order at 6:05 p.m. Council Member Davis offered the invocation. Council Member Williams led the pledge of allegiance. 1

2 Mayor Anderle requested citizen comments. There were no citizen s comments at this time. Council Member Schiller moved to approve minutes of the regular meeting of November 7, Council Member Mondrik seconded the motion and it carried with Council Member Hardeman abstaining. Wilfred Stubbs, representing the Killeen Rough Riders, presented the following: Appreciation Plaque to the Street/Park Department Gift Certificates for the two officers that assisted Appreciation Plaque to the City of Cameron along with a $500 donation and eight $25 Brookshire Brother gift cards for needy families in the community. Mr. Stubbs thanked the City for use of Ledbetter Park for the annual trail ride and asked for use of the park again on October 19-22, Council Member Davis moved to approve the request. Council Member Schiller seconded the motion and it carried unanimously. Mayor Anderle read the first reading of the following ordinance: AN ORDINANCE OF THE CITY OF CAMERON, TEXAS CLOSING, VACATING AND ABANDONING A STREET LOCATED BETWEEN BLOCK 6, LOT M, LOT 4 AND LOT 3 IN THE RENDOR ADDITION IN THE CITY; PROVIDING FINDINGS OF FACT; AUTHORIZING A CONVEYANCE OF SUCH ABANDONED ROADWAY; PROVIDING A SEVERABILITY CLAUSE AND AN OPEN MEETING CLAUSE. WHEREAS, after review, Council has determined that the designated street situated between block 6 of the Rendor Addition (R15529), Lot 4 of the Rendor Addition (R25520) and Lot 3 of the Rendor Addition (R28353) should be abandoned and relinquished to the abutting property owners equally as determined by the City; and WHEREAS, the City Council finds that the best interest of the City will be served by abandoning this designated street described within this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CAMERON: Section 1. Findings. The foregoing recitals are hereby found to be true and correct and are incorporated into this Ordinance as findings of fact by the City Council. Section 2. Alleys/Streets Abandoned. The designated street or alley located between Block 6, Lot M of the Rendor Addition (R15529), Lot 4 of the Rendor Addition (R25520) and Lot 3 of the Rendor Addition (R28353), as more particularly shown in Exhibit A attached hereto and incorporated herein as though fully transcribed, is hereby permanently closed, vacated and abandoned by the City and the general public and relinquished to the abutting property owners equally. Section 3. Authorization to Close. The Mayor and the City Secretary are authorized, empowered, instructed and directed to execute such release of easement or quitclaim deed(s) as may be requested by the property owners, conveying the rights and interests of the City in the above described abandoned and vacated portion of the easement to the adjacent property owners. The determination as to which property owners are conveyed any property interested herein are solely at the discretion of the Mayor and the City Secretary. Upon the filing of this ordinance among the 2

3 County records the vacation and abandonment of the Crossing shall be and become a valid and binding act and deed of the City of Cameron, Texas. Section 4. Severability. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portion or portions thereof; but as to such remaining portion or portions, the same shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to be severable. Section 5. Open Meetings. It is hereby officially found and determined that the meeting at which this ordinance is passed was open to the public as required and that public notice of the time, place, and purpose of said meeting was given as required by the Open Meetings Act, Chapt. 551, Tex. Gov't. Code. Council Member Mondrik moved to approve the following ordinance on its second and final reading. Council Member Goza seconded the motion and it carried unanimously. ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMERON, TEXAS, RATIFYING, CONFIRMING, APPROVING, VALIDATING, AUTHORIZING AND DIRECTING THE INSTALLATION, PLACEMENT AND ERECTION OF NO PARKING WITHIN THE CITY OF CAMERON AT 306 SOUTH NOLAN AVENUE; AMENDING SECTION OF THE CITY S CODE OF ORDINANCES TO ADD A PROVISION PROHIBITING THE PARKING OF MOTOR VEHICLES AT SAID LOCATION; PROVIDING FOR A VIOLATON OF THIS ORDINANCE IN AN AMOUNT NOT TO EXCEED $500.00; AND PROVIDING FOR SEVERABILITY. Whereas, prohibiting parking at all times in front of St. Monica s Catholic Church (the Church ) located at 306 South Nolan Avenue, between Tyson and Gillis streets, has been requested by the Church in order to protect public health, safety, and welfare; and, Whereas, at a public meeting the City Council considered the request and public comments of citizens and determined that the Church such a request should be granted in order to protect the public health, safety, and welfare. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAMERON, TEXAS: Section 1. NO PARKING Signs. The City Council hereby authorizes the City Manager, or his designee, to place, locate, install and erect NO PARKING signs, which were requested by the Church, on the west side of South Nolan Avenue between Tyson and Gillis Streets in front of the Church and as shown on the map attached as Exhibit A. The NO PARKING signs shall be in the shape, number, color, and lettering as approved by the City Manager. The NO PARKING signs shall be purchased, erected, installed, and maintained at the sole cost and expense of the Church using City personnel or contractors. Any dilapidated and unsightly sign may be removed by the City. Section 2. Code of Ordinance. Section of the City s Code of Ordinances is hereby amended to include subsection (c) to read as follows: (c)(1) Prohibited area. It shall be unlawful for any person to park or cause to be parked at any time any motor vehicle on the West side of South Nolan Avenue between Tyson and Gillis Streets in the city. (2) Penalty. Any person who shall park or cause to be parked a motor vehicle in violation of subsection (c)(1) hereof, at any time, shall be guilty of a misdemeanor, and upon conviction thereof shall be assessed a fine of not less than fifty dollars ($50.00) or more than five hundred dollars ($500). (3) It shall be a defense to prosecution of this subsection (c) that No Parking signs are not posted at the location. 3

4 Section 3. Effective Date. This Ordinance shall be published in the official newspaper of the City, as required by law and shall become effective after publication as provided by law. Section 4. Severability. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and, if any phrase, sentence, paragraph, or section of this ordinance should be declared invalid by the final judgment or decree of any court of competent jurisdiction, such invalidity shall not effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such invalid phrase, clause, sentence, paragraph or section. If any provision of this Ordinance shall be adjudged by a court of competent jurisdiction to be invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision, and to this end the provisions of this Ordinance are declared to be severable. Section 5. Open Meetings. It is hereby officially found and determined that the meeting at which this ordinance is passed was open to the public as required and that the public notice of the time, place and purpose of said meeting was given as required by the Open Meetings Act, Chapter 551, Tex. Gov t Code. Council Member Mondrik moved to approve the expenditures of November 5, 2017 to November 18, Council Member Hardeman seconded the motion and it carried unanimously. The following expenditures exceeded $25,000.00: Progressive Waste Solutions $33, CEDC $28, Citizens National Bank $ 27, Council Member Williams moved to approve the October 2016 Financial Report. Council Member Goza seconded the motion and it carried unanimously.
