4 City of Llano Regular Called City Council Minutes May 18, :30 p.m. A. CALL TO ORDER Mayor Virdell called the meeting to order at 5:30 p.m. with the following present: Mayor Pro-Tem Miiller, Alderman Keller, Alderwoman Lang, Alderman Ferguson and Alderman Hopson. B. PLEDGE OF ALLEGIANCE Led by Mayor Pro-Tem Miiller C. INVOCATION Led by Ervin Light D. PUBLIC COMMENTS CONCERNING MATTERS NOT ON THE AGENDA (Visitors shall be limited to no more than (3) three minutes to address the Council or at the discretion of the Mayor In accordance with Section of the Texas Government Code, an inquiry made at a meeting shall be conducted as follows: (a.) If at a meeting of a governmental body, a member of the public or the governmental body inquires about a subject for which notice has not been given as required by this subchapter, the notice provisions of this subchapter do not apply to: 1. A statement of a specific factual information given in response to the inquiry; 2. A recitation of existing policy in a response to the inquiry. (b.) Any deliberation of or a decision about the subject of the inquiry shall be limited to a proposal to place the subject on the agenda for a subsequent meeting. E. CONSENT AGENDA ITEMS All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Council member so requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the Agenda. 1. Approval of the regular called City Council meeting minutes as written, dated May 4, Mayor Mike Virdell/Toni Milam, City Secretary 2. Approval of Resolution , recognizing the City of Llano as the official home of the World Rock Stacking Championship Competition, as a part of the Llano Earth Art Festival. Mayor Mike Virdell Motion by Alderman Keller, with a second by Alderwoman Lang to approve of the consent agenda items as presented. Motion approved. F. REGULAR AGENDA ITEMS 1. Discuss and consider action on the approval of Ordinance 1298 canvassing the returns and declaring the results of the General Election held on May 9, Mayor Mike Virdell/Toni Milam City Secretary, Toni Milam read the official canvassed returns as provided by the Llano County Election Administrator, Cindy Ware. Motion by Alderwoman Lang, with a second by Mayor Pro-Tem Miiller to approve Ordinance 1298, canvassing the returns and declaring the results of the General Election held on May 9, Motion approved.

Mayor Virdell to formally recognize outgoing Alderman Todd Keller and Mayor Pro-Tem Bryan Miiller for their outstanding service and commitment while serving the citizens of Llano. Discuss and consider the appointment of the Mayor Pro-Tem to serve for one year. At this time, requested nominations from Council on the appointment of a Mayor Pro-Tem, serving for one year. A motion Alderwoman Lang was made to appoint John Ferguson as Mayor Pro-Tem; a second motion by Alderman Hull was made to appoint Allen Hopson as Mayor Pro-Tem, serving for one year. Mayor Reagor called a vote by a showing of hands nominating John Ferguson as Mayor Pro-Tem. The vote was 3-2, with Alderwoman Lang, Alderman Conner, and Alderman Ferguson voting yes. Mayor Reagor called a vote by a showing of hands nominating Allen Hopson as Mayor Pro-Tem. The vote was a 2-3, with Alderman Hopson and Alderman Hull voting yes. Alderman Ferguson was appointed Mayor Pro-Tem to serve for one year. 2. Discuss and consider action on amending the City Council Policies and Procedures. Discussions regarding the City Council Policies and Procedures was held. A motion to allow any Councilmember to place an item on the agenda was made by Alderwoman Lang, with a second by Mayor Pro-Tem Ferguson. Motion approved.

6 As per the City Council Policies and Procedures, Exhibit A, Section 3, City Councilmember Assignments/Requests of Staff, a motion by Mayor Pro-Tem Ferguson, with a second by Alderman Conner was made to add Mayor in addition to the City Manager and the City Secretary. Motion approved. There was brief discussion regarding extending the amount of time spent on Staff s time and adding more detail to an agenda item. Motion by Alderwoman Lang, with a second by Alderman Conner to amend Article I, item 1 to change when items are due to the City Secretary s office by noon on Wednesday prior to a Monday Council meeting. Motion approved. Mayor Pro-Tem Ferguson made a motion to eliminate item 1 under Exhibit A as it relates to City Council Meeting Agenda Packet-Supplementary Documents. Motion died for lack of a second. Motion by Alderwoman Lang, with a second by Alderman Conner to direct Staff in issuing an Ordinance for codification which would require two readings of Ordinances, unless under Roberts Rules of Order, the rules were suspended, then Ordinance could be adopted immediately. Motion approved, with Alderman Hopson voting no. 3. Discussion only on the Drought Contingency Plan, rescinding Stage 3 to voluntary. Mayor Reagor discussed the Mayor and/or the City Manager having the authority to change from one Stage to another without Council approval. No formal action taken. 4. Discuss and consider action on the approval of a Letter of Agreement between the City of Llano and Llano County Tax Assessor-Collector regarding Tax Assessment-Collection services for the City of Llano authorizing the Mayor to execute the Letter of Agreement. Motion by Mayor Pro-Tem Ferguson, with a second by Alderwoman Lang approving a Letter of Agreement between the City of Llano and the Llano County tax Assessor-Collector regarding Tax Assessment-Collection services for the City of Llano and authorizing the Mayor to execute the Letter of Agreement. 5. Discuss and consider action on the approval of an Interlocal Agreement between Llano County and the City of Llano for Radio Services, authorizing the Mayor to execute the Interlocal Agreement. Motion by unanimous consent without objection made by Mayor Pro-Tem Ferguson to approve of the Interlocal Agreement between Llano County and the City of Llano for Radio Services, and authorizing the Mayor to execute the agreement. Motion approved. 6. Discuss and consider action on the approval of the April, 2015 Financials. Motion by Alderman Hopson, with a second by Mayor Pro-Tem Ferguson to approve of the April, 2015 Financials. Motion approved. 7. Discuss and consider action on the appointment of a committee to meet with the representatives of the Llano Economic Development Corporation regarding the J. L. Kuykendall Arena and Event Center. Motion by unanimous consent without objection to appoint Alderman Hull and Alderman Conner to meet with the representatives of the Llano Economic Development Corporation regarding the J.L. Kuykendall Arena and Event Center. Motion approved.

7 8. Discussion with an update from the City Manager regarding the Citizen s Academy. Brenton Lewis, City Manager gave an update regarding the Citizen s Academy. To date, there have only been five applications received from citizens. It was suggested the Staff continue to accept applications, and to postpone the start of the Citizen s Academy until September, Discuss and consider action on rescheduling the June 1, 2015 regularly called Council meeting. No formal action taken on this agenda item. 10. Discussion with direction to Staff regarding calendar dates for conducting Budget meetings. Main St., Llano, Texas to receive written and/or oral comments regarding a specific use permit to place a bed and breakfast in a single family (SF-1) District at 1004 Wright Street. The legal description of this is property is South Addition, Block 23, Lot 106C. 1. BACKGROUND/HISTORY 2. FINDINGS/CURRENT ACTIVITY This is a public hearing to receive comments and/or to be heard regarding this request. 3. FINANCIAL IMPACT N/A 4. ACTION OPTIONS/RECOMMENDATION Public Hearing, No formal action required during the public hearing item.

9 City of Llano Public Hearing Notice The City of Llano Planning and Zoning Board will hold a public hearing at 5:30 p.m. on Thursday, May 21, 2015 at Llano City Hall, 301 W. Main St., Llano, Texas to receive written and/or oral comments regarding a special use permit to place a bed and breakfast in a single family 1 (SF-1) District at 1004 Wright Street. The City of Llano City Council will also hold a public hearing at 5:30 p.m. on Monday, June 1, 2015 to receive written and/or oral comments regarding the special use permit to place a bed and breakfast in a single family 1 (SF-1) District at 1004 Wright Street. The legal description of this property is SOUTH ADDTION, BLOCK 23, LOT 106C. At said times and place all such persons shall have the right to appear and be heard. BACKGROUND/HISTORY An application for a specific use permit was submitted by property owner on April 24, Per Ordinance 1152, notifications sent to property owners within 300 feet of the proposed single family dwelling located at 1004 Wright Street. Notices of the public hearing were posted on the property and published in the newspaper according to the Ordinance on May 6, FINDINGS/CURRENT ACTIVITY Twenty-five notification letters were sent to property owners within 300 feet of the proposed single family dwelling. The Planning and Zoning Commission met on May 21, 2015 to hold a public hearing and to review the request. The recommendation from the Planning and Zoning Commission was to approve the request with no specific conditions. 3. FINANCIAL IMPACT N/A 4. ACTION OPTIONS/RECOMMENDATION Motion to approve Ordinance 1299 on first reading, waiving a second reading, and SUP #341 be issued to property owner to place a bed and breakfast at 1004 Wright Street.

18 ORDINANCE NO AN ORDINANCE OF THE CITY OF LLANO, TEXAS AMENDING ZONING ORDINANCE NO. 735, SECTION 8B-1AND ESTABLISHING SPECIFIC USE PERMIT NO. 341 ALLOWING A BED AND BREAKFAST IN A SINGLE FAMILY 1 (SF-1) DISTRICT, PROPERTY AS DESCRIBED HEREIN; WITH STIPULATIONS DESCRIBED HEREIN; AMENDING THE OFFICIAL ZONING MAP; AND PROVIDING FOR A PENALTY, SAVINGS, SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. WHEREAS, at its meeting held on the 21 st day of May, 2015, the Planning/Zoning Commission did consider and make recommendations on a certain request for a Specific Use Permit to place a bed and breakfast in a Single Family 1 (SF-1) District. Physical address is 1004 Wright Street. Legal description is SOUTH ADDN BLK 23, LOT 106C. WHEREAS, the City Council, after determining all legal requirements of notice and hearing have been met, has further determined the following amendment to the zoning laws would provide for and would be in the best interest of the health, safety, morals, and general welfare: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LLANO, TEXAS. SECTION I. That Specific Use Permit No. 341 is hereby established for the premises located at 1004 Wright Street, Llano, Texas, and more specifically described on the attached Exhibit A, providing for the following use: Bed and Breakfast SECTION II. That development shall be in accordance with all special conditions, restrictions, and regulations. None SECTION III. That the official Zoning Map of the City of Llano shall be amended to reflect the provisions of this ordinance and in accordance with Section 20.2 of Ordinance No. 735 of the City of Llano, Texas. SECTION IV. That any person, firm or corporation violating a provision of this ordinance, upon conviction, is guilty of an offense punishable as provided in the City of Llano Ordinance No. 735, as amended, by a fine not to exceed one thousand dollars ($1,000); and each day or portion thereof during which the violation is committed, continued or permitted shall be a separate offense. SECTION V. That if any section, sub-section, paragraph, clause, phrase, or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provisions hereof, other than the part so decided to be invalid or unconstitutional. SECTION VI. That Ordinance No. 735, otherwise known as the Zoning Ordinance of the City of Llano, as amended, shall remain in full force and effect.
